live breaking news. >> that breaking news in san jose, look at this bad crash from sky 7. there is a car stuck under a semi. the driver is dead, and inside that crushed car? a young child. thanks for joining us today. that crash happened at park avenue and mcevoy street in san jose. we are concerned about that child. >> reporter: yes. this is a horrible scene out here. right now, park avenue is still closed as police continue their invest gags. you can see the fire bird is on the truck now, and they are focusing on the semitruck right

now as well as they continue their investigation. a man was killed inside that firebird and a 10-year-old girl alive in the backseat. here's video from the scene, in front of a major construction work site. police say the driver of the big rig turned left at 7:40 this morning and that's when the firebird slammed into the bed of the semi. a witness told us he jumped in to help the 10-year-old girl in the fire bird. >> she was distraught, bloody, flung over the seats saying my daddy's dead. i calmed her down, breathe deep, slow, i'm calling it in. >> we just informed her condition and injuries are nonlife threatening. she will be fine. just a little shaken up. >> reporter: that same witness you heard from, don baker, said flaggers were directing traffic at the site. the sun was facing eastbound

traffic. the truck driver is cooperating with the investigation. this is the 11th traffic fatality here in san jose so far this year. reporting live in san jose, matt keller, abc 7 news. >> our thoughts with that young girl and her family. sky 7 above east welling boulevard after a car and an am track train collided. it happened near the high school. no word yet on whether anyone was hurt there. the crash delayed trains headed to san jose. students from albany high school getting ready for a second afternoon of demonstrations like this we saw yesterday. they are horrified by racist messages targeting specific students. abc 7 news reporter is live for us at albany high with what students are doing today. >> reporter: the school district and the school's not returning calls or making comments, but the students are moving full

speed ahead with today's rally and appear to be very organized. it's going to start at 3:45, everyone's welcome, and they have t-shirts ready to go. some are wearing them today and they say black lives matter. the matter of inclusiveness started first thing this morning. signs of support and unity greeted students at albany high school as they headed into class today. it was a welcomed bit of warmth for those feeling nervous about being here. >> if these people were this racist and horrible, they are antitrans and antilgbt. i'm worried about my safety and the safety of black students and black friends. >> reporter: they discovered a racist created instagram account, it was up for two months. >> there's a picture of me compared to a gorilla. >> reporter: hundreds of students staged a sit-in and rally yesterday. the anchor boiled over when the kids accused of liking the instagram page were surrounded

by furious students as they tried to leave from a meeting. one mom said her son's nose was broken in the confrontation. the superintendent is investigating. another rally is planned today. students hope it helps them start healing. >> i'm aching, terrible, depressed. it was hard to get up, but you have to go on. we're unified as a school. it's great. >> reporter: one mom heart broken, but her daughter walked in with confidence. >> i'm sad. i'm 50 years old, and i thought that by the time i got here, you know, our daughters, we'd have no issues like this. >> reporter: again, we've reached out to the supersben didn't's office to see what plan is in place to protect the kids at today's rally. no comment from the district office. the superintendent e-mailed parents saying they will be discussing all of this at next month's board meeting. reporting live in albany, abc 7 news.

>> so disturbing, amy, thank you. new this morning, three people have to find a new place to live after this fire in san jose. it started inside a 11th street. they called for more help, and they kept the flames from spreading to other nearby homes. nobody got hurt. investigators are still looking into what sparked that fire. the police arrested a suspect for a stabbing inside a walmart store that happened at the walmart on lone tree way. detectives say two people got in an argument near the store and then ran into the men's restroom inside walmart, and that is where the victim got stabbed just before 9:30 last nights. officers captured the suspect at the scene. they also say they recovered the weapon used in the attack. the victim's condition has not been released. san francisco hope you can help identify in man suspected of stealing jewelry. investigators say he smashed the front window of a jewelry store

on waverly street and vanished. he made off with about $100,000 worth of jewelry. and daily city police need hip to identify this man involved in exposure cases. they released the sketch and blurry photos of the man. hard to see what's happening there, but the car is clearer. this happened on monday where investigators say the man exp e exposed himself to a 19-year-old woman in westmoor park, and wednesday, he did the same thing to a 12-year-old girl. the suspect's vehicle similar to a silver or gold 2003 toyota camry. new details on the apartment fire in west oakland. a candle blamed for the cause of the fire, and now the east bay times reports the candle was lit in a room that lacked electricity. a week ago, they documented 11

serious fire violations including problems with fire extinguishers and smoke detectors. monday's fire killed four and displaced dozens more. this afternoon, lawyers for the victims are holding a news ko s conference where they are expected to announce lawsuits. a state capitol so-called over children's bill of rights. the bill says children have the right to have parents who act in their best interest. opponent say that's too vague, and that the state shouldn't have the power to decide the best way to parent. the senator sponsoring the bill says the point is not to tell parents how to raise their kids, but build on existing state standards. >> what we want to do is help families not only meet standards, but exceed those standards because most families actually want their kids to reach their optimum potential. >> reporter: senator richard pan is calling the bill a vision for children in the state. new this midday, u.s. attorney general sessions responding to claims the federal

i'll gra immigration are uses courthouses as bait. they made the claims in a letter to the department of state and homeland security accusing i.c.e. agents of stalking courthouses and arresting undocumented imgrants who are not a risk to public safety. now in a letter just released, sessions slams the claims writing, i.c.e. does not engage in sweepings or other indiscriminate arrest practices. also new this morning, a federal judge approved a $25 million settlement against the now debunked trump university. consumers said they were misled that they would be taught success in real estate. he said he'd never settled, but after being elected, he said he didn't have time to go to trial. the security adviser asks for immunity, and flynn is ready

to testify in the connection to russ russia. >> reporter: flynn wants to testify in the russia hearings, but he wants immunity. flynn's lawyer said he has a story to tell, and he very much wants to tell it. the president said mike flynn should ask for immunity in that this is a witch hunt, excuse for big election loss by media and democrats of historic proportion. so far, they are unwilling to cut a deal. >> i don't think congress should give immunity. if there's an open investigation by the ib, that shouldn't happen. i don't think the president should weigh in on this. >> reporter: flynn appeared to change the tune on immunity in an abc interview for clinton staffers asking for immunity. >> that means you probably committed a crime. >> reporter: meanwhile, putin's press secretary denied russian interference on "gma."

now to the morning money report, good news for oakland international airport seeing a business boost and the biggest jump, international travel. the airport released new numbers this morning showing passenger traffic up 5.6% in february marking 39 months of year over year passenger growth. airport officials credit the boost in part to the fact they added 50 new monthly international departures by southwest and norwegian air. good news if you are paying back student loans, all 26 loan companies that collect for the federal family education loan program will not automatically charge a large penalty fee if you default on payments. that's even though the department of education gave them the green light to do so. a rep says many borrowers are having a difficult time paying back loans and adding extra fees would make things worse. we're helping you raise a toast to the weekend.

good morning to you. i suppose you could say march is going out like a lamb. our temperatures are going up, but, boy, the winds have not calmed down yet. here's a look at live doppler 7 and you notice it's clear. we're not picking up cloud cover due to the gusty north wind, but the water satellite picture, and, yes, clear skies, great visibility, and how about santa

cruz, already 61 degrees. going for a high today of 72. not quite as breezy down there, but it's in the 60s in san francisco, 61 in mountain view, 63 in san jose. the numbers look warmer than they are because of the winds. 55 in half moon bay, and breezy. it's going to take throughout the afternoon for the winds dial back and then a warmer pattern. 61 santa rosa, napa 66, and nevada, mid-60s, 60 in livermore. finally looking at temperatures that will warm up, not only later on today, but through the weekend. look for 80s arriving tomorrow. sticking around through sunday for some of you. let's check out the wind profile throughout the day. you can see along the coast, the color coding hering well over 20 miles per hour, but by 3:00, 4:00, it is remaining breezy, but after that, tonight, the winds pick up again.
