to you, everybody, on this wednesday. we're going to start with an emergency session set for today at the united nations over what's being called a war crime in syria. >> dozens of civilians have been killed after government warplanes dropped suspected toxic gas on their own citizens. we warn you, the images of the suffering can be very difficult to watch. abc's lana zak has the latest. >> reporter: the horrific brutality. the syrian people the victims of a suspected chemical weapons strike by their own government. young children and babies among the victims of one of the worst attacks in the history of this civil war. the death toll continues to rise. the injured struggle to breathe. rescue workers racing to rinse a toxic substance from the skin of victims. the assault unrelenting. even as this local activist reported from one of those hospitals, it was hit with another air strike. the suspected sarin gas attack follows two chlorine gas attacks over the past week. >> the gas attacks are

continuing every day and no one is doing anything to stop these gas attacks. >> reporter: these chemical weapon attacks come just days after the new trump administration signaled a major change in the u.s. approach to syria. >> longer term status of president assad will be decided by the syrian people. >> reporter: but faced with the raw brutality of syrian president bashar al assad, it is unclear if the trump administration will continue to hold that position. today the u.n. security council will hold an emergency meeting on syria. >> we have all seen the reports of the terrible chemical weapons attack in syria. >> reporter: neither the secretary of state or the president directly answered questions on syria following the attack, but president trump delivered this message in a speech on the economy. >> i'm not and i don't want to be the president of the world. i'm the president of the united states. >> reporter: in a statement the white house called the attacks reprehensible and said that the civilized world cannot ignore it but they also laid blame at the foot of the obama administration for their weakness.

meanwhile, the russian government is now disputing that the syrian government had anything to do with it blaming instead insurgents though eyewitnesses say it came from government planes. kendis, diane. >> yeah, the russians saying in fact they bombed a weapons -- a chemical weapons depot there in syria instead. lana, thank you. also breaking overnight, another foreign crisis facing the united states, north korea. >> in a statement secretary of state rex tillerson said, quote, north korea launched yet another intermediate range ballistic missile. the united states has spoken enough about north korea. we have no further comment. overnight the south korean military says today's launch may have been north korea showing off its defiance in order to send a message to president trump and the chinese president who meet this week. here at home the white house is stepping up its latest push to repeal and replace obamacare. looking to breathe new life into the failed republican health care bill. >> the vice president is making daily trips to capitol hill proposing changes aimed at

convincing conservatives and moderates to back the bill. overnight vice president mike pence is trying to revive the health care effort. >> good progress. >> reporter: pence and house republicans emerged from a two-hour meeting just before midnight. >> good progress. >> we're making progress. >> i believe it was a very productive meeting. we're making progress. >> reporter: after a vote on repealing and replacing obamacare was canceled last month amid republican opposition, lawmakers are considering several changes. one would weaken something the president vowed not to touch. >> when you replace it, are you going to make sure that people with preconditions are still covered? >> yes, because it happens to be one of the strongest aspects. >> reporter: now the white house is considering effectively doing away with that provision. also on the chopping block, the requirement that insurance companies cover benefits like wellness visits, mental health treatment, maternity care and ambulances. under the new plan, individual states could opt out. those at last night's meeting didn't reach any official

agreement, but the president and vice president are making their message clear. >> they want to get this done as quickly as possible on behalf of the american people. >> now, the group is planning to meet again today. the president is hoping for a vote on a revised bill by the end of the week, but some republicans say that's unlikely. and speaking of congress, senate majority leader mitch mcconnell has filed a motion to end debate on supreme court nominee neal gorsuch and clear the way for a final vote. democrats are expected to filibuster gorsuch tomorrow. but republicans plan to change the rules to confirm him with a simple majority. oregon's democratic senator jeff merkley has been talking all night staging his own protest over the republicans' decision to block president obama's nominee from last year. and former national security adviser susan rice is denying allegations that she used secret intelligence reports to spy on president trump's associates before he took office. rice acknowledged that she asked for the names of americans who were referenced in the report. but she made it clear that the

policy known as unmasking was a key part of her job and it's not illegal or uncommon. a month after president trump accused president obama of wiretapping him, rice insisted that the new administration was not targeted. >> this is not anything political has been alleged. the allegation is that somehow obama administration officials utilized intelligence for political purposes. that's absolutely false. >> well, rice also denied that she leaked any names. democrats say the allegations are being used to distract from the investigation into russian election meddling and possible ties to the trump campaign. well, ivanka trump is taking on her critics as she speaks out for the first time since taking an official job at the white house. the president's daughter and now assistant to the president tells cbs news when she disagrees with her father, she expresses herself with total candor and she responded to criticism that she's been complicit by not publicly denouncing some of his controversial policies.

exactly at midnight st. petersburg time. and police are now investigating whether the suicide bomber in st. petersburg had accomplices. at least 14 people were killed and dozens others injured when a bomb exploded on a subway train between stations. the 22-year-old suspect was identified from genetic evidence on a bag containing a second bomb that did not explode and was found in a station. the man is also seen on surveillance video at a subway station. in atlanta a murder suspect is scheduled for his first court appearance this morning in the brazen shooting of an attorney at a busy intersection. police say 40-year-old trinh huynh was walking to work when 39-year-old raylon browning snuck up behind her, shot her several times in the back and ran off. later that night he was already in police custody in another county wanted for a stabbing. police still aren't sure if the two even knew each other. two tragic outcomes this morning. a reminder of the dangers of food challenges. a man died at a doughnut shop in

denver while trying to eat a half pound doughnut in under 80 seconds. that challenge has now been suspended at all of the doughnut chains' locations. this comes after a young woman from new jersey died during another food challenge. caitlyn nelson whose father died in the 9/11 attacks passed away after choking during a pancake eating contest at her college. well, if your kid was running up a bill on amazon, you may have a refund coming your way. previously children were able to make purchases on their mobile devices without the permission of their parents but the government sued and as part of the settlement, more than $70 million may be eligible for refunds. details on the refund program will be announced soon and the kids will now need permission from their parents to make those purchases. and amazon has also signed a deal with the nfl to allow its prime customers to stream thursday night football games in the coming season. amazon paid $50 million for those streaming rights. that's five times the amount twitter paid to show thursday

the entire southeast as well with puddles and slick spots extending all the way up to the great lakes. well, the country's busiest airports could be problem spots today. those include chicago and atlanta's airports. detroit and charlotte, as well. and fox news is dealing with yet another scandal this morning, this time involving alleged racial discrimination. >> and all of this comes as the network faces a growing advertiser revolt over its star host bill o'reilly. at least 22 companies have now pulled their commercials from "the o'reilly factor" over alleged sexual harassment settlements with five women and now fresh allegations from inside the network. here's abc's mara schiavocampo. >> reporter: explosive new allegations against fox news. this time the network accused of appalling discrimination. one former and two current employees in the network's payroll department accusing a supervisor of racially charged harassment and saying fox did nothing to stop it.

in this new 36-page lawsuit, tichaona brown, tabrese wright and monica douglas claiming the former head of accounting judith slater who is white harassed the three black women calling their department the urban payroll department questioning whether tabrese wright's three children were all fathered by the same man and expressing an unwillingness to even be near black people. mara schiavocampo, abc news, new york. we have some new information about how the mystery of tom brady's super bowl jersey was finally solved. brady showed off that recovery jersey monday at fenway park. investigators say they got a tip from a 19-year-old pats fan who was shopping for other sports memorabilia when the seller shared a photo of another missing tom brady jersey. the fan rep to police and turns out that seller had both missing jerseys. those jerseys were finally returned to brady this week. i wonder if that fan can lobby for free tickets for life. >> i would hope so. jerseys are very valuable. >> i'm sure brady was very happy to get them back.

we can see one of the worst outbreaks ever of lyme disease this year, and you can blame the oak tree. there was a bumper crop of acorns two years ago. that brings an increase in the number of mice which leads to more ticks, and ticks cause lyme disease. the infection is also likely to be found in new areas where people don't know how to respond. a high-tech danger ended up injuring a 9-year-old boy and forcing the evacuation of an entire elementary school. that third grader from boca raton had a cell phone battery in his pocket and then pulled it out when it started getting hot. well, he dropped it on the floor and the whole thing burst into flames. students and staff were evacuated while the battery burned itself out. the boy suffered some minor burns on his leg. and here's a suspect in san diego who was caught on the fence by the seat of his pants, quite literally. one officer yanked him down causing his jeans to rip all the way to the ankle. the suspect was wanted for throwing a rock at a man and causing a bloody injury.

he then tried to run from the cops and as you can see got stuck. he was finally arrested after they helped him down. >> glad to know he wasn't worse off. and no one can blame cardinals outfielder stephen piscotty if he doesn't play today against the cubs. piscotty was hit in the right elbow in the bottom of the fifth inning last night, so that put him on first base. >> okay, so then he stole second base. as he arrived he was hit again on his left elbow by that throw. look at this. that wasn't the worst of it. >> so, when his teammate then hit an infield single, piscotty, as you might imagine, tried to then score from second. he made it, but he was actually hit in the head by the throw in the process. now, he was diagnosed with a bruise on his head, but he wasn't hospitalized. >> it was that third hit. ow. >> the run he scored was the only one of the night, by the way, for the cards, but they lost 2-1 after all that. >> ouch.

one car was just crashed and this happened just before 10:30 last night before the last night before the toll plaza. the alameda county corner's office arrived here on the scene and no word on the cause of the crash. plenty of questions remain about a deadly officer-involved shooting in napa. police have been at the scene on lnda vista avenue, and it started yesterday afternoon. there were reports of a man firing a weapon possibly after a dispute between neighbors. when officers got there that's when they say the man drove out of his garage and started to open fire on the officers and they fired back, and as you can see, the man crashed into the tree and died at the scene. a few officers expected
