it supports the officer's accounts. >> we cannot be sure beyond a reasonable doubt the justification for their actions, then we cannot charge the case. i cannot and will not either file charges or decline to filee charges removing pressure from anyone. >> five of the six shots hit perez lopez from behind. a use of force expert determined perez lopez would have had -- would have been able to turn 180 degrees by the time the first bullet hit him. abc 7 news reporter vic lee will have a full report on this developing story at 5:00. >> san francisco sheriff's deputy april meyers pleaded not guilty to several charges including giving a firearm to a convicted felon. police arrested meyers in february, a year after she claimed her department issued weapon was stolen during a home burglary. investigators determined the break-in was staged. they found the weapon in a vehicle owned by convicted felon

antoine fowler. investigators say meyers had an affair with fowler while he was in jail. >> rescue crews reached a construction worker who fell into a trench in the east bay this morning. the construction site at omega and purdue roads, fire departments helped with the rescue. they had to sure up the six-foot trench before they could reach the man. he suffered a back injury. >> san jose officer is out of the hospital after a crash in the east bay. look at this. the chp says the off-duty police officer was driving his personal suv when he slammed into the back of a big rig on highway 84 near ruby hill drive in pleasanton. the suv burst into flames with the officer trapped inside. emergency crews put out the fire and then pulled the officer from the wreckage. >> all right. turning now to our weather, the rain is back. umbrellas were out early this morning as light showers came down. >> this is a live look outside now where you can see the clouds are returning and more rain is

expected tonight. spencer christian is here with the forecast. spencer. >> that is a look at live doppler 7. mid afternoon hours had a bit of a break which we're enjoying now in most locations except mount tamme. look terrain to the north, ukaiah, north of clear lake, we even have mixed precipitation, frozen precip in the higher elevations. pushing into the eureka area along the north coast. the trail of clouds and moisture extending from that area of stormy weather, that's what's coming our way. the storm ranks 1 on the storm impact scale. it will produce brief heavy downpours tonight. we'll see isolated showers continuing into tomorrow morning and wind will gust 20 to 30 miles per hour, which may have an impact on the giants game tonight at at&t park. the arizona diamond backs, it will be cloudy, chilly, breezy at that time. rain will likely come before the game ends. notice at 9:00 tonight we'll see a wide area of moderate to heavy rainfall swinging through that

north bay. by 10:00 tonight that area of heavy rain will be moving right through san francisco and other parts of the bay area as well. so, it will be pretty wet probably late in the game tonight at at&t park. then the system, the bulk of it moves out early tomorrow morning giving away scattered showers to the midday tomorrow. will it be dry for easter weekend? i'll have the full forecast coming up shortly, dan and alma. >> thank you, spencer. >> with all the recent rain the drought may be officially over but we are not out of the woods yet. >> a new set of potential issues, news reporter wayne freedman joins us with a by product of all this rain. wayne. >> reporter: we have by-products, ticks, fleas, poison oak. a gentle reminder there is booming life, but with it are some cons. the water keeps coming. first from the sky, then later from the land. the marin county spring this

which require some road work on the streets. and it has caused congestion. >> reporter: here's the proof. look at the number of construction permits issued. they have almost tripped in the last six years. they do place restrictions on those projects. >> what we're doing is trying to minimize disruption during rush hours and enforcing where we can whether it's double parking, getting more signs out there. >> reporter: residents worry all this development just means things are going to get worse. >> so much construction and then, you know, all these new housing and stuff, where are these people going to park, especially if they can't, you know, take public transportation, so. it's a tough situation. >> reporter: the construction isn't the only thing to blame. residents and transit officials also point to ride share companies for adding too many cars to these streets. in san francisco, amy holly field, abc 7 news. >> residents who live near san

francisco's mclaren park proposal to limit the speed limit doesn't go far enough. a new city plan would lower the speed limit on mansell street from 45 miles per hour to 40 miles per hour. residents want it lowered all the way to 25 miles per hour. city is accepting public comment on the speed change until friday. >> st. louis officials and that region's sports authority filed a lawsuit against the nfl over the rams relocation last year to los angeles. the suit claims the rams violated the league's relocation rules when the team left for l.a. and seeks more than a billion dollars in damages. last month, nfl owners voted 31-1 to give the raiders permission to move to las vegas. >> the ceo of united airlines apologized on camera for the first time today since a passenger was dragged off a flight on sunday. >> he also promises policy changes in an exclusive interview on "good morning

america," abc 7 news anchor kristen sze is here with the latest developments. kristen. >> well, dan and alma, today united ceo oscar munoz is striking a much different tone than his earlier statements about the incident. >> the word shame comes to mind and you saw us at a bad moment. and this can never -- will never happen again. >> reporter: this refers to security officers dragging a passenger off a flight from chicago to louisville to make room for united employees needed for a later flight. munoz promises to look at the incentives for passengers to give up their seats and change the use of law enforcement on united flights. >> law enforcement official will never come on one of your planes again? >> to remove a booked, paid seated passenger, we can't do that. >> no, i'm not going. i am not going. >> reporter: also making news, this new video, passenger of david dao before he was dragged,

he'd rather go to jail than be taken offer the flight. they are holding a news conference tomorrow with a dao family member. his attorneys have also petitioned an illinois court to order united to preserve evidence, including surveillance video recording, cockpit voice recording, the complete passenger list, and employee and crew list. and one last major development today, united has promised full refunds for every single passenger on that flight. dan and alma? >> all right, thank you so much, kristen. a southern california man claims united threatened to handcuff him after he refused to give up his seat. last month he was asked to get off of a flight in the flight was full and a higher priority first class passenger was entitled to his seat. they reassigned him to a middle seat in economy class. he wasn't given a decent

apology, but eunited offered to pay the difference between first class. >> travelers haleft $900,000 in loose change last year. passengers left almost $25,000 of change there. jfk came in at number one. the tsa says it does make the effort to reunite people with the items they leave behind, all the extra loose change goes towards providing civil aviation security. >> a battle is brewing in the south bay. it's landlords versus tenants. should no cause evictions be allowed? the group fighting to fight tenants rights and keep people in their homes. >> i'm larry beil live at oracle arena where warriors will wrap up the regular season tonight. the playoffs will begin this weekend. the question is which day precisely? we'll make an educated guess coming up. >> it really matters how it looked. i just wanted to be able to run

there has been a sharp rise in evictions and they accuse landlords of pushing them into an already expensive market. >> abc 7 reporter david louie talks to them. david. >> reporter: it is estimated there have been 2200 no cause evictions in san jose over the past six years and that number might be artificially low because not all of them are reported to the city. now, some might be justified, but the city council is trying to find a way to protect tenants from unjustified ones. a coalition of community faith and labor groups is pushing hard to shape the discussion in next test's city council meeting. they are trying to protect tenants who can legally be evicted for no cause. it happened to rosa when she complained to her landlord about conditions at her apartment. >> it happened a lot and we couldn't even smell it, it was making us sick. and then it had a lot of roaches. and the place was not cleaned proper at all. >> reporter: the city's housing department says tenants fear they might be evicted for making maintenance complaints.

>> tenants have reported to us their fear of asking a landlord to repair that because the landlord can retaliate against them by issuing a no-cause eviction. >> reporter: once evicted renters say it can cost them $8200 to find replacement housing by the time they pay the first month's rent, security deposit and moving expenses. however, landlords believe no cause eviction is a necessary tool to address problem tenants. >> instead of calling names, can you come fix this, you fill out a form, give it to the housing department. now you're protected for six months. can't ask you to move. well, that wouldn't be a problem most of the time, but what if that's the guy that's selling drugs? >> reporter: another concern is eliminating no cause evictions might discourage developers from building rental properties in san jose. they appear to be divided over the issue and a heavy turnout if renters and property owners is expected. abc 7, david louie.

round in practice. the last day in school, you let everybody out early. what steve kerr is looking forward to is the start of the playoffs and the question that everybody has is exact day and time. and here's what we're going to project a little bit. we're thinking that the warriors will play the blazers here at or cal arena saturday afternoon, likely a 12:30 tip time. and the reason we say that is because the warriors and the cavaliers are the marquee teams. they would get the marquee television slots. but in cleveland, quicken loans arena has an arena football league game scheduled for saturday. that would push the cavs' first playoff game to sunday, easter sunday, which leaves the warriors playing on saturday. so, that's what we're anticipating, saturday 12:30 right here, and that's what everybody at oracle is anticipating. we'll have to wait for the official announcement from the league later on tonight. mike shumann is going to join me later in this hour. we'll talk with the one man who has a specific goal tonight against the lakers and that

immediate san francisco bay area, but you can see that there are some little scattered trickles over in the east bay and to our north, lots of rainfall and the storm producing that rain is headed in our direction. right now we're looking at calm conditions in the bay area. current temperatures, 64 in san francisco, 68 down in mountain view, 67 in san jose, hayward and concord cool 58 in santa rosa, north bay is where the rain will arrive first. right now we're looking at partly cloudy skies over the bay from our abc 7 exploratorium pier 15 in san francisco. these are our forecast features. some brief downpours, giving way to scattered showers tomorrow. sunny conditions friday and saturday, more rain arrives easter sunday. storm impact scale, storm of light intensity. there will be some intense moments during the evening hours as we see some brief downpours moving through the bay area. isolated showers tomorrow morning. winds will gust 20 to 30 miles per hour. let's get right into the forecast animation. by 9:00 tonight we'll see an area of moderate to heavy rainfall pushing through the

north bay. it will swing on down to the central part of the bay area by 10:00 tonight. and then continue moving south ward and eastward into the late night hours. overnight we'll just see some widely scattered showers. but that means we'll probably have areas of wet pavement on the roadways tomorrow morning from the morning commute. those showers will start to break up and end by late afternoon, early evening tomorrow. and as we look ahead to rainfall totals, by tomorrow evening we expect a range of anywhere from about just under 2/10 of an inch in the south bay to half an inch in parts of the north bay. we go to the sierra where snow will fall. winter weather advisory is in effect from 8:00 tonight to 8:00 tomorrow night. we expect three to 6 inches of snow above 5,000 feet, low visibility and slick roads and travel delays. moving back to the bay area tonight, during the overnight hours we'll see low temperatures generally in the low 50s and relatively mild overnight. and then tomorrow in the daytime mid afternoon, highs will be reaching just barely above 60 degrees. it's going to be a fairly cool day for this time of the year

students are hoping to create entire villages of these little homes. abc 7 news reporter katie marzullo explains why. >> reporter: if you want to be a big man on campus, just stand next to the tiny house. >> that's pretty much a room and bathroom right there. not much else you really need. i worked with a room and bathroom. so, i think i can prepare myself well for this. >> reporter: it's a novel idea for san jose state students, but this tiny house has a bigger purpose. >> this will be a temporary fix for someone that's waiting for a section 8 housing with a voucher. >> reporter: jerry is an urban and regional planning graduate students. he's writing his masters thesis on tiny houses to help solve the problem of homelessness. his plan, ten villages placed in san jose each with 30 tiny homes. it would give shelter to 300 of san jose's more than 7,000 homeless people. >> i have a team of researchers. policy pro sal for land use for the very first iny home

village. >> reporter: junior thinks it's a great idea. >> we should consider for that and beyond. it could be good student housing. it could be good senior housing. >> reporter: she'd consider it for her stefl but points out she'd have to have somewhere to put it. this student has a different concern. >> if viewers can see i'm a pretty tall person, so a tiny house might be a little bit of an inconvenience for me, though. >> reporter: still the idea of an affordable and portable home makes a tiny house a big winner in the eyes of many. at san jose state university, katie marzullo, abc 7 news. >> netflix is trading tax incentives for infrastructure and as a result is moving its productions back to california. netflix chief content officer ted says he's tired of moving production to whatever state or country offers him the best deals tax wise. louisiana, ga and the u.k. have offered big tax incentives to lure hollywood productions to them. he said all that moving is tough on families and grinds on the talent. the streaming company will instead invest most of its $6 billion production budget in

>> here are the stories making headlines at 4:30. the ceo of united airlines is promising changes. after this widely seen video of security officers violently removing a passenger from a flight, oscar munoz says all customers on that flight will be reimbursed. he also says law enforcement officers won't be allowed on a plane to remove a booked, paid or seated passenger ever again. three of the officers involved in this have been placed on leave. the san francisco district attorney has cleared two police officers involved in a deadly shooting two years ago. he just announced his decision about 90 minutes ago. abc 7 news reporter vic lee will have a live report coming up at 5:00. president trump has reversed course on his view of nato. he he now says it is no longer obsolete. the two met today as top u.s. officials are calling on russia to stop covering for syria's

president. abc news reporter is live in washington following the late effort developments. jen nae. >> reporter: he says he had a productive two-hour meeting with vladimir putin and that included talks of syria, areas of agreement, and areas to improve u.s./russia relations. today the form of tough talks for secretary of state rex tillerson and top russian leaders, amid high tensions between the u.s. and russia, tillerson says there is a low level of trust. >> the world's two foremost nuclear powers cannot have this kind of relationship. >> reporter: during a news conference with russian foreign minister sergey lavrov, tillerson spoke of the meeting with russian president vladimir putin, the areas where the two nations find common ground. >> we agree we want to deny a safe haven for terrorists who want to attack both of our countries. we agreed that north korea has to be denuclearized. >> reporter: he says the two also share desire for unified and stable syria and that there

needs to be more senior level communication between the white house and the kremlin. but as for the areas of disagreement -- lavrov says the u.s. strikes on syria escalated the situation. there needs to be an on honest investigation of the chemical attacks alleged to have come from the assad regime. meanwhile in washington, president trump met with secretary general saying it is time to end the civil war in syria. >> the vicious slaughter of innocent civilians with chemical weapons including the barbaric killing of small and helpless children and babies must be forcefully rejected by any nation that values human life. sflo >> reporter: and while putin is still casting doubt on whether the assad regime used chemical weapons, they are sure the regime directed and executed attack adding it is the latest

of 50 occasions of the regime using chemual weapons. alma? >> the u.n. security council vote today? >> reporter: absolutely. it was after a u.n. ambassador nikki haley called on the russians to join the international community and, quote, push for peace. there was then a vote on a resolution that would have condemned those chemical weapons attacks in syria. russia moved to veto that vote. >> all right, jen nae norman, thank you for that update. >> white house press secretary sean spicer apologizing for saying hitlassad is worse than hitler for gassing the people. he called it an inexcusable mistake. >> i made a mistake. there is no other way to say it. i got into a topic that i shouldn't have, and i screwed up. i mean, you know, and i hope people understand that we all make mistakes. i hope i show that i understand

that i did that. >> minority leader nancy pelosi and other democrats say an apology isn't good enough and spicer must resign. the anne frank center is also calling for spicer to step down. >> housing and urban development secretary ben carson got stuck in a public housing elevator this morning. carson was there to tour the complex and meet with former nba star alonzo mourning. he was rescued about -- after about 20 minutes. carson said in a tweet he had a great meeting with the miami heet legend. the complex is nine years of efforts by morning and his nonprofit. >> a trial date has been set for the widow of orlando night club shooter mateen. she appeared in court in florida after being extradited from the bay area. salman was arrested, as you will recall, from her family's home in row dee owe in january. she pleaded not guilty to charges related to the attack. the trial will begin june 5th. that is one week before the one-year anniversary of the

orlando massacre. and convicted murderer drew peterson was attacked in prison last month. authorities announce peterson was jumped in the cafeteria of a federal pen tensionery in indiana. peterson wasn't seriously hurt and was separated from the general population. the former police officer was convicted of murdering his third wife and is expected of killing his fourth. >> comedian charlie murphy has pad s passed away. 57 year old had a successful stand up comedy career. he was a regular on the dave chap elle show. he died from leukemia this morning in a new york city hospital. >> the sculpture of wall street's famous charging bull statue is cuesing new york city of violating his human rights. the conflict is over this fearless girl statue installed facing the bronze beast without the artist's permission. lawyers call the fearless girl statue an advertising trick created by two corporate giants. the artist says he's not against

we're following breaking news about b.a.r.t. this is a picture from inside a b.a.r.t. train that got stuck inside the transbay tube a little less than 45 minutes ago. it's all dark except for the light from a passenger's phone lighting up his face. it's quite dramatic as you can see. according to b.a.r.t., a brake malfunction on the train stopping it inside the tube. this was sent by abc 7 news assignment manager jim huntington from inside the embarcadero station. you can see crowds of people waiting to get on the trains. an engineer was reportedly able to get the train moving. b.a.r.t. is saying major delays across the system. we are following the story and will bring up updates as they

perhaps there is nothing more painful than paying your taxes and getting swindled in the process. last year the irs managed to stop 1.2 million fraudulent returns. but more than half a million tax payers still had their identities and their refunds stolen. abc news reporter rebecca jarvis has a look at what you can do to prevent being scammed. >> reporter: it doesn't take much for a scammer to take advantage of unsuspecting taxpayers. having your name, date of birth and social security number is about all it takes, and despite aggressive efforts by the irs to stop these thieves, hundreds of

thousands of us will again fall victim. >> the first person to file as you is assumed to be you. and then when the real you files, the system says, wait a minute, i already did that one. >> reporter: and if this happens, you need to contact the irs right away and fill out an identity theft affidavit. >> you should also file a police report to document the crime. now, the good news is you will eventually get your refund, but the bad news is it could take up to an extra 180 days. >> reporter: every year the irs warns taxpayers to be on guard for scams, especially during tax season. at the top of their list, phone scams, criminals posing as irs agents threatening you with financial risk, police arrest, even deportation. next, fishing. sketchy e-mails or web sites to steal your personal information. and then fake tax preparers who set up to perpetrate refund

the operation after the boy was diagnosed with bone cancer. abc 7 news reporter explains. >> reporter: chris is about to show me his modified left leg. it fits snugly around his residual limb. as he takes off his prosthesis, i'm surprised to see his ankle and foot are now where his knee used to be. >> i can run fairly well. still getting better. i can jump. i can walk about as good as i could before the surgery. >> reporter: two years ago chris was diagnosed with bone cancer in his left femur. the procedure that would give him the mot mobility is called rotationplasty surgery. >> remember, that first night looking at it and thinking, why would anybody ever do that to their child, you know? we're definitely not doing that. >> reporter: but chris, who loves sports and is always active, opted for rotationplasty. >> you also have good mechanics.

11:00. the tesla factory in fremont is being described as a nightmare by some who work there. it's so bad one employee has even started an instagram account. abc 7s reporter jeannine de la vega showed us some of the crazy pictures and what the electric car maker is doing to remedy the situation. >> reporter: anything goes seems to be the moat owe when you look at these pictures of cars parked at tesla's factory in fremont. hopping a curb to park, no problem. blocking other cars in to make your own spot, sure. and here's the picture of a prius driver who cheated and parked in an electric vehicle spot. the driver even put the charger in the gas tank to try to fool people. >> it's pretty crazy with a lot of different stouf. >> reporter: an employee who wants to remain anonymous started an instagram account to document the craziness. cars are packed like czar deans. there is a picture of a nasty note on the car threatening to slash tires because of how the driver parked. to help out the 6,000 workers there, tesla added two overflow lots that shuttle employees.
