o'reilly got the news just after he met pope francis at the vatican that ended a more than 20-year run with the begin of fox news in 1996. "the o'reilly factor" has been a cash cow for fox news for 16 years but advertisers abandoned the show after reported settlements were paid to five women accusing him of inappropriate behavior. rebecca jarvis at fox news headquarters with all the latest. good morning. >> reporter: good morning to you, george. executives here at fox you ins spent all day wednesday in back to back meetings deciding the fate of bill o'reilly, the network's top star. after a deep review and consultations with attorneys fox news deciding to terminate their biggest star. >> again, thanks for watching us tonight. >> reporter: overnight the show known for 20 years as "the o'reilly factor" hit the air with a new title, just "the factor." >> it is the end of an era here at the fox news channel. as we mentioned earlier bill o'reilly is leaving this chair

and this network after more than 20 years. >> reporter: just hours earlier 21st century fox announcing nearly three weeks after growing allegations surfaced about the star regarding sexual harassment and mistreatment that it is severing ties with o'reilly saying "after a thorough and careful review of the allegations, the company and bill o'reilly have agreed that bill o'reilly will not be returning to the fox news channel." >> caution, you are about to enter the no spin zone. "the factor" begins right now. >> reporter: the murdoch family which runs fox news adding in an internal memo obtained by abc news, "this decision follows an extensive review done in collaboration with outside counsel." o'reilly who just hours before the announcement was photographed on vacation shaking hands with the pope releasing his own statement saying, "it is tremendously disheartening that we part ways due to completely unfounded claims." civil war in congress, that is

the subject of this evening's talking points memo. >> reporter: for 16 years o'reilly's show was the number one program on cable news. bringing in hundreds of millions of dollars annually. but in the last few weeks at least 83 ad buyers dropped out. network executives reportedly worried that more accusers might come forward if o'reilly stayed on the air, making him a liability. >> they want their audience to know nothing's changing. bill has left the building, but nothing else is going to change. >> reporter: and for now, fox news has revamped its primetime lineup. tucker carson will take over o'rile easily's time slot and until then guest hosts will fill in. what we don't know is what bill o'reil o'reilly's severance might be. some speculating it could be in line with what roger ailes left with last summer in a similar case. that amount was $40 million.

george. >> a lot of payouts from fox. rebecca, thanks very much. we'll talk about it with our chief legal analyst dan abrams. reports that rupert murdoch was resisting this but in the end had no choice. >> remember, this isn't about those "the new york times" reports. this is about what came forward after that. i think they were in a spot where with the number of allegations with paul weiss investigating and with them handing this to 21st century fox and saying, here's what we've amassed, that they may have felt that they had no choice. now, remember, this isn't in a vacuum. >> they were losing business. >> but i don't believe it was about the advertisers. i really don't. do i think that was relevant? yes. do i think that was the ultimate reason this happened? no. i think that they had promised a changed culture in the wake of roger ailes. roger ailes was an even more seismic event in my view than bill o'reilly. he created fox news. he led fox news. he led the culture at fox news.

when roger ailes was ousted, it changed everything there. and i think that that ultimately led to what we've seen here and so you can't view bill o'reilly and just say, what happened to bill o'reilly? you have to view it in the what happened to bill o'reilly after roger ailes? >> getting rid of bill o'reilly doesn't end their legal vulnerability necessarily. >> remember, for sexual harassment claims, you have a three-year statute of limitations. anyone who believes he or she was harassed has to bring a lawsuit within three years. so i think that the vulnerability is going to be what limited there in terms of the time frame. but i think that this is more a pr issue. when i say pr it's also internal. you've got all the employees there. it's not just the people on the outside. it's not just the fans of the show. it's not just the activists. it is also the employees. >> real test for fox to see if they can survive without their star, their prime time lineup entirely changed. >> one thing fox has prided itself on, is not depending on one personality. it's the fox brand.

that we can lose someone. we can lose another person. we still got fox. well, now this is the ultimate test because bill o'reilly was fox news to a lot of people. and when you lose bill o'reilly, now you're going to test it but look, they have a new team in there and i think -- i think people who say fox is done, don't understand fox. >> dan abrams, thanks very much. all right, there are some other important stories we're following this morning. a potential bombshell in the supreme court. there is speculation justice anthony kennedy may be preparing to retire and that would mean another appointee for president trump. the trump administration is announcing they will review the iran nuclear deal. secretary of state rex tillerson talking tough, calling it a failure despite iran's compliance. and president trump is ready to host the italian prime minister all ahead of his first trip overseas as president. much more on that. first, let's get to the new twist in the immigration case making headlines. a 23-year-old d.r.e.a.m.er

deported and now we know the judge set to hear that case is the same one trump attacked on the campaign trail questioning his impartiality. because of his mexican heritage. our senior white house correspondent, cecilia vega, has that story. good morning, cecilia vega. >> reporter: good morning. you remember this was a major controversy from the campaign that found then-candidate trump under fire from even his own allies. the judge that trump said shouldn't preside over one of his cases because of his heritage is now presiding over another case involving the trump administration and immigration. this morning, the judge at the center of one of president trump's most controversial campaign moments is back in the spotlight. by complete coincidence judge gonzalo curiel will now preside over a controversy case involving the trump administration. a federal lawsuit brought by a d.r.e.a.m.er who was deported to mexico. then-candidate trump famously attacked the indiana born judge who presided over a trump

university suit calling him unfit to oversee the case because of his mexican heritage. >> this is a hostility toward me by the judge. tremendous hostility. beyond belief. i believe he happens to be spanish which is fine. he's hispanic which is fine. >> reporter: before curiel now a case involving juan manuel montez, a 23-year-old who illegally immigrated with his parents as a young child, a so-called d.r.e.a.m.er who under president obama received protected status from deportation. and president trump said under his new immigration rules d.r.e.a.m.ers would also be protected. >> they shouldn't be very worried. i do have a big heart. we'll take care of everybody. >> reporter: immigration officials pushing back saying montez had left the country making him eligible for deportation. now it's judge curiel who is in the middle. so, how did this case end up before this judge? well, in this southern california district court judges

are selected based on a rotating schedule. experts tell us this is basically a case, george, of legal roulette, a complete coincidence. >> okay. cecilia vega, thanks very much. we move onto secretary of state rex tillerson and his tough talk on iran. at a press conference he called the iran nuclear deal a failure. >> this deal represents the same failed approach of the past that brought us to the current imminent threat we face from north korea. >> our chief global affairs correspondent martha raddatz is here. this came hours after they certified iran was complying. >> exactly. tough talk, but they are not getting rid of the iran deal clearly, and this was the campaign that wanted to rip it up. wanted to start over, saying it's a terrible, terrible deal, and i think he'll see that in the coming months. they keep saying that, and try to see if iran is complying but i don't think it's going anywhere. >> the sanctions will remain lifted. meanwhile, the secretary of state's former ceo of exxonmobil looking for relief after

sanctions which were imposed after the invasion of ukraine. >> they want to start drilling in the black sea. rex tillerson recused himself from anything involving exxon but on the hill a little outrage. john mccain saying are they crazy? >> meantime, we have russian bombers again off the coast of alaska being intercepted by u.s. fighters. >> yeah, just back and forth and back and forth. first we thought this isn't a big deal. they haven't done it a couple of years but in this identification zone, and air defense identification zone, and they should identify their aircraft, but they didn't. they had to be intercepted by two f-22s on monday and then again awacs aircraft saying you have to identify yourself so a little provocation everywhere in the world. >> why would they do that? >> i think it's just to say, hey, we're here. we're still strong. we can come off the coast of alaska. >> martha raddatz, thanks very much. now to the report of that supreme court justice, anthony kennedy, may step down after 30 years on the bench. 80 years old, appointed by

ronald reagan, considered the court's pivotal swing vote and part of his legacy is the newest justice neil gorsuch one of his clerks and jonathan karl has more. good morning. >> reporter: good morning, amy. predicting a supreme court vacancy is tricky business. justices tend to be extremely secretive about their plans until they announce them but we noticed quite a hint in a small iowa newspaper, "the muscatine journal." interviewed senator chuck grassley of iowa who said, i would expect a resignation by this summer. why is that significant? chuck grassley's committee would hold the hearings on the next nominee. if there is anybody that would know about such things it is chuck grassley and more than that, amy, this is consistent with what i have been hearing in conservative legal circles for weeks. that justice kennedy has been telling friends and colleagues

that he intends to retire this year. possibly after the current term of the supreme court is up on june 30th. >> all right, so let's talk about that potential confirmation process. the president considered gorsuch to be a shoo-in but they ended up with republicans resorting to the nuclear option, changing the rules to get him confirmed. how does that affect how another vacancy could be filled? >> reporter: the nuclear option has been exercised and the rules are changed so the next justice would require only 51 votes. they have 52 republicans. they have the votes to do it but replacing justice scalia with gorsuch didn't alter the balance. of power on the court. there are now four conservative, four liberals and right in the middle as the swing vote in many, many cases is justice kennedy. so that means replacing him with a solid conservative could significantly decisively alter the balance of power on the supreme court. i expect that the next confirmation battle will be a

much bigger more high-profile fight even with that nuclear option exercised. >> all right, jonathan karl, we appreciate it, thank you. michael. now to the investigation into former patriots star, aaron hernandez's death. his family is questioning reports from officials that hernandez killed himself in his cell. abc's eva pilgrim is outside the prison in shirley, mass. good morning, eva. >> reporter: good morning, michael. this was a surprise to those who knew him. hernandez was in general population inside this prison in a cell by himself. authorities say there were no signs he would take his own life telling us, he was not on suicide watch. this morning, questions surround the death of former nfl superstar aaron hernandez. >> hernandez is back. >> something's not right. something doesn't add up. >> reporter: corrections officers finding the 27-year-old in his cell just after 3:00 wednesday morning, hanging from a bed sheet, tied to a window. the bible verse john 3:16 written across his forehead of the door barricaded from the inside.

prison officials calling his death a suicide but this morning some of those close to him aren't convinced including his cousin. >> he was in really good spirits so for this to happen, we were shocked. >> reporter: hernandez's former agent brian murphy releasing a statement saying, absolutely no chance he took his own life. chico was not a saint but my family and i loved him and he would never take his own life. >> the patriots are an incredible organization. >> reporter: his death happening the same day his former team visited the white house to mark their recent super bowl victory. but it was just last week hernandez was acquitted for the 2012 murder of two men. >> not guilty. >> reporter: emotional wiping away tears hearing the verdict blowing kisses to his daughter in court. hernandez, a star tight end who once had a $40 million contract, was serving a life sentence for the 2013 murder of his friend odin lloyd. >> guilty of murder in the first degree. >> reporter: a verdict he was in

the process of appealing. his lawyer calling for an investigation and saying, aaron was looking forward to an opportunity for a second chance to prove his innocence. now, authorities who are now investigating the circumstances of hernandez's death are looking at his recent time here in prison, any fights and any possible gang-related disputes he may have had. michael. >> all right, thank you, eva. just tragic all the way around. >> certainly is. we move on to an airport confrontation all caught on tape. a passenger, look at this, getting physical with an american airlines pilot after they de-planed, and abc's david kerley has more on the story and what exactly happened there. good morning, david. >> reporter: amy, another sign of the tension between some passengers and flight crews. this one as you mentioned after a flight, a physical altercation. walking through the kansas city airport, watch as a passenger shoves a pilot. it happened last week after a flight from dallas. you can see the passenger trying to get past the pilot holding a phone then the shove.

the pilot tripping backwards over his bag then heading outside where his wife was waiting and police intervened. the passenger identified as edward foster told police this started when the pilot apparently traveling in the cabin was, quote, taking up too much room on the aircraft and being disrespectful causing foster to follow him outside the secure area in an attempt to take a photo of the pilot's badge with the cell phone. the police report says foster's phone was knocked out of his hand when this happened. this just days after that video of a united airlines passenger being dragged from an aircraft to make room for a crew member on a flight leaving chicago. in the kansas city incident although the pilot walked away from the altercation police say he, quote, suffered lacerations to both legs and bruising to his forearm. now, the suspect was charged with intentionally inflicting injury and will be in court next month. facing the possibility of a fine

from fox news and what it mean for the network under fire. mr. a dozen women have come forward with allegations against o'reilly, and former fox news chief, roger ailes, who stepped down amid controversy. since then the company has been promising change. abc's linsey davis is here with more on that, good morning, linsey. >> reporter: good morning, amy. while change typically doesn't happen overnight the network which touts itself as being fair and balanced is sending a message that is loud and clear but now many are asking if there is a sexist culture at fox as many of the accusers allege. how deep will the cuts go to eliminate it? one by one they stood up against a media giant. women from in front of the camera like well-known anchors megyn kelly and gretchen carlson to guests on the show to women who work behind the scenes in production and payroll. >> it's time to come out of the shadows and let our voices be heard. >> reporter: together they are shaking up one of the most powerful networks in the world describing it as rife with sexual harassment and racial

discrimination. >> we are calling today for an independent investigation into the culture of sexual harassment at fox news. >> reporter: these accusers say it's a culture that comes from the top down. allegedly from former ceo roger ailes -- >> he tried to kiss me three times. so, i rejected that and when i rejected that he asked me when my contract was up. >> hi, i'm bill o'reilly. >> reporter: to its newly fallen top star, bill o'reilly, to female employees like former head of accounting, judith slater, all forced out under the weight of the allegations against them. despite o'reilly and ailes blanket denials of wrongdoing. the question now will this be enough to change the troubled culture at fox? >> we need a massive investigation, probably by an outside agency. no one believed they could come forward and use this so-called anonymous process to make a claim. so, they've got to start there. >> reporter: parent company 21st century fox has literally paid a

steep price for these allegations paying $20 million to settle carlson's suit against ailes. another $40 million to ailes himself after his ouster and a portion of the $13 million paid to settle five claims against bill o'reilly over the last 15 years. now, the justice department is investigating whether the network failed to inform shareholders about settlements made over sexual harassment allegations against ailes. >> he told me early in the dinner he thought i was a very beautiful woman. >> reporter: as for the woman whose case seemingly became the proverbial straw that broke the back of o'reilly's career at fox, she said, it was never about money, but came forward in the hopes of bringing about systemic change. >> i think it will have a positive effect at fox news. i'm sure we will see many people come forward and i hope that maybe i played a part in that. >> reporter: the lawyer who represented several accusers including gretchen carlson says she will continue to fight. she says that until fox gets rid of the executives who enabled

the harassment, the workplace will not be safe for women and now new reports this morning that more women are coming forward and joining the racial discrimination lawsuit against fox. amy. >> all right, linsey, thank you very much. attorney lisa bloom who represents several women accusing bill o'reilly of misconduct is here with us now. lisa, you're not surprised by what happened yesterday, the removing of bill o'reilly. >> no, i told wendy walsh months ago, if i come forward, i will stand with you. we will have a legal strategy. we will have a media strategy and we will take him down. because it's time. he's driven out too many women, not only out of fox news but out of the television industry entirely. simply because they opposed him on sexual harassment. >> bill o'reilly released a statement in part, saying, it is tremendously disheartening we part ways due to completely unfounded claims and completely deny the accusations and now reports he may be getting as big a payout of roger ailes upwards of $40 million. aren't those conflicting messages to women and men anywhere? >> he says they are unfounded,

but fox news did an investigation, and we participated behind the scenes and had every economic motivation to keep him yet they found the claims were good and well founded. >> all right. and then roger ailes, obviously, let go last year as we mentioned. fox news said they were working to maintain an atmosphere of culture and respect. are they making good on that promise? >> well, this is a very important first step. it's 13 years in the making since the first sexual harassment claim against o'reilly, but at least they are doing it now, and let's give them the credit for that. there's a lot more to be done, there are the enablers. there are the lieutenants of roger ailes and bill o'reilly, the people who covered up and silenced women for years. that all needs to go. they need to clean house and show us that they really do respect women. >> what do you make of these massive payouts? >> well, i think every woman gets to choose for herself what the right path is. i do a lot of sexual harassment cases. doing them for 30 years. some women want to take a confidential settlement and move on with their careers. i respect that. some women want to file a lawsuit, and some women like the

one i came out two days ago wants to file an anonymous internal complaint so it's up to each woman to decide what's best for them. my job is to empower women and help them decide what's best. i don't judge anyone. everybody who speaks out against sexual harassment is helping all the other women. >> do you expect to see more allegations come out in the next days and weeks against bill o'reilly and fox news in general. >> yes, my phone has been ringing off the hook the last couple of weeks. i represented all of the o'reilly accusers for free. none of the ones who i represented asked for a penny. >> do you think that made a big difference. >> yes, we've received a tidal wave of love online. i mean it's really been amazing, the support that we have received. yes. >> all right, lisa bloom, we appreciate your time this morning. thank you so much. lisa will be on "the view" later with one of her clients. bill o'reilly's latest sexual harassment accuser speaking publicly for the very first time again on "the view" later today. michael. all right, amy, coming up in two minutes serena williams, there's some baby news. we'll find out how she won the

and if i hear one more story of people saying, a pregnant woman, she's so fragile. if pregnant women were that fragile the human race would have ceased to exist hundreds of years ago. >> good point. i will say this at eight weeks that's right when i started to feel my pregnancy, and started to get nauseated, and i felt pregnant. that was the line for me. but you mentioned she is an elite athlete. are there any unique concerns when you put your body through so much? >> no question. could she have been more fatigued, absolutely. could she have been a little nauseated, absolutely. we don't have a lot of great literature in obstetrics about elite athletes and their training during pregnancy, but what we do know is they can continue to behave and perform pretty much at their level pre-pregnant during most of their pregnancy, sport-specific of course. we don't want to see people skydiving or do things at high speed and general recommendations during pregnancy for both the elite athlete and

that parenting alert about kids crossing the street. an important new study by researchers at the university of iowa are using virtual reality, whoo, to explain why kids are significantly more vulnerable to accidents while navigating traffic and, t.j., that's why you're here, man. what did this study show about crossing streets. >> if you have a child under the age of 14. not until 14 they start crossing the street like an adult would. let me give you results. 6-year-olds in the simulation were hit by cars 8% of the time. 8-year-olds were struck 6%. 12-year-olds were struck by cars 2% of the time. those seem like small numbers but huge and alarming to researchers. why does this happen? it found that the kids these ages can actually find the gaps, they know that it's time to go but they're delayed -- they'll delay crossing the street. the other thing is a matter of motor skills. play catch with a kid and throw the ball and it hits them in their chest and they close their hands.

the timing is off and puts them at risk. >> every time i cross my daughter does do that hesitation. how does that simulator work? >> this virtual reality technology that's everywhere, they didn't put the kids out in the street. the kid timing it out trying to figure it out and a lot race across the street and so this is what they did to them in this simulation. when we put adults in the simulation and, of course, adults know how to cross the street but kids were hesitant getting across there in we are all parents that fall into the 12 and under kid range. a little scary. what do parents out there need to know to keep them safe. >> find a safe route. walking anywhere to school, if it's longer, fine, there needs to be a safe route. don't have them cross any street anywhere cars don't stop. has to be a stop light or stop sign. don't have them crossing in continuous traffic. you might need to call your local representative. you might need to touch base with folks in your community to

building that 80-year-old justice anthony kennedy is preparing to step down. and the trump administration is taking aim at iran accusing the country of, quote, alarming provocations in the middle east. secretary of state rex tillerson says the administration is now reviewing the iran nuclear deal. he calls the deal a failed approach and says the iranians could pose the same threat as north korea. now, this morning iran's former president mahmoud ahmadinejad who is running for another term lashed out at president trump saying, trump has chosen the path of war in syria. meantime, new concern about chemical weapons in syria. israeli defense officials are claiming that bashar al assad has up to three tons of chemical weapons remaining in his stockpile. and there are new questions this morning about the timing of bill o'reilly's ouster from fox news. some media analysts say the growing o'reilly controversy was threatening to quash efforts by fox to take full ownership of a

european tv company, a deal regulators must approve and industry experts say advertisers who left fox news over the scandal would likely not have returned if new harassment allegations were made. as for o'reilly sources say he could walk away with up to $40 million. and "time" magazine naming the 100 most influential people, several politicians and business leaders making the list but singer john legend is gracing one of the five covers made for the special issue. the list which is not ranked also includes the likes of melinda gates, viola davis, former fox news anchor, gretchen carlson, gymnast simone biles and quarterback tom brady. the tribeca film festival getting under way in fork and jennifer hudson performing at a special concert to pay tribute to music mogul clive davis whose documentary premiered last night. and finally one team mascot going above and beyond at a college baseball game in florida.
