there are two suspects. marcel brooks and adanna ibe. this happened in san leandro. >> abc 7 news reporter is live from the hayward hall of justice where the couple was just arraigned. ann? >> reporter: you know, this is one of those complicated cases. this happened on monday at about 2:30 in the afternoon. police in san leandro say the father of that baby was supposed to meet with the mother inside that mcdonald's. mcdonald's restaurant. he never showed up. instead, police say his former girlfriend did and attempted to shoot the baby. san leandro police are certain this couple intended to kill the 11-month-old baby boy who was inside this mcdonald's seated with his mother. >> during the course of the interview, we are confident that there is a conspiracy placed between these two subjects here to harm that child. >> reporter: police say surveillance video shows

adana ibe in the restaurant getting up from her seat, approaching the baby and allegedly firing once from a short distance. the bullet never hit the child and broke the glass instead. a my opinion it was a miracle missed. >> reporter: this witness remembers sitting next to the shooter wants to hide her identity. she sat down and her hands were dremibling. marcel brooks is the baby's father who according to police was in the area when the shooting occurred. brooks and ibe also have a 5-year-old son. brooks' aunt says the family didn't know about the woman in the restaurant and the baby. currently he is in a relationship with another woman and they, too, have a small child. she came to court today. >> i didn't know about this 11 month old. all i know is marcel is a great dad. he spends time, he's active in all his kids' life.

>> reporter: brooks and ibe were in court this afternoon. they will be charged with conspiracy to commit murder and attempted murder. and when all this was happening, marcel brooks was living at the time with that third woman that we showed you who showed up in court today. now, he was told by the judge to not contact the mother of the 10-month-old baby. i'm live in hayward, lyanne melendez, abc 7 news. >> thank you. a vallejo man faces weapons charges after an online stunt. police say 20-year-old christian brown wielded a pistol on the live streaming service periscope then said he fired a weapon if he reached 100 viewers. officers arrested brown during the traffic stop yesterday allegedly found the firearm inside the car. brown is charged with suspicion of possessing a loaded firearm and violating his probation. after several racist incidents, albany's high school principal has been assigned to another position within the school district. jeff anderson abruptly left his

job this week. it is not clear if anderson stepped down voluntarily or was removed. s.f. gate reports former albany high school principal ron rosenbaum will replace anderson. the leadership change comes after officials learned several students had been involved in racist and cyber bullying incidents on campus and questions over the process for punishment. >> u.c. berkeley is reversing its decision to cancel an appearance by conservative commentator ann coulter. abc 7 news reporter kate larson is live on the campus tonight to explain what is going on here, kate. >> reporter: well, dan, look. yesterday the university canceled next week's event and then today during a press conference announced they do have a safe venue for ms. coulter and the students. the following week on may 2nd. however, from everything ms. coulter has said on tv and twitter she still intends to come here to berkeley next thursday. the problem is nobody has any idea where that will happen.

>> reporter: berkeley college republicans invited coulter to speak. jose dee as is president and said administrators have been difficult in the planning process to bring coulter to cal. >> sometimes it feels like an opposition, if you will. just so we can bring a speaker over. >> reporter: he is a member of bridge usa, a nonpartisan campus organization that co-sponsored the coulter event. he is in favor of coulter speaking on campus on the university's alternative may 2nd date. >> we were actually going to pull out if the event was going to happen outside of that bridge usa because we thought it was no longer a student initiative. >> reporter: now, ann coulter has been tweeting today about the rescheduled event and says, berkeley just imposed an all-new arbitrary and harassing condition on my exercise of a constitutional right. now, university officials tell me that they refuse to respond to an event on april 27 since they simply don't have anywhere

faculty. we're not going to get that level of reality without support from the community. >> officers carried weapons that fired blanks instead of real guns. medical teams took part in the drill. >> a homeowner faces a repair job after a tree fell on a house in sonoma county. that tree caused major damage to a home in guerneville. fire fighters tell us no one was hurt and the home was unoccupied when the tree toppled this morning. the tree also knocked out power lines. crews are working to restore electricity for more than 100 customers nearby. sonoma county crews we were removed part of the tree that blocked the street. recent rains likely played a role in the tree coming down. >> another side effect of the rain, mow skit owes are about to invade the bay area. live in san jose with that, david these mow kit owes are more than just annoying. there is a health issue here. >> that's correct, kristen. that's a big concern because zika virus and west nile virus mostly spread through certain

mosquitos. they keep filling back up. that's where mosquitos can breed. we need lots of help. it's the price we pay when it gets warm and conditions are optimum for a really bad mosquito season. >> i don't love them, which is to say that. >> reporter: are they a big pest? >> actually they are and they love to leave red dots on me all the time which i don't appreciate. >> reporter: the big concern is what will a robust mosquito season mean for the transfer of west nile and especially the zika virus. >> this year we have no idea what that virus is going to do. so, this is why it's important for us to have, you know, very good surveillance systems in place so that we know what's going on out in the field. >> reporter: assistant manager of santa clara county vector control district, his agency finished the latest survey of swimming pools left stagnant over the winter. his team discovered 719 on top of 1400 they already were

the agency hired him 20 years ago. whether you live here or you're just visiting. >> cable cars are part of san francisco. >> it's just iconic, isn't it? >> reporter: now 20-year sfmta employee albert williams who was a cable car conductor 15 years is facing embezzlement charges. >> this agency is outraged. his coworkers are outraged. and disappointment doesn't begin to describe it. >> reporter: sfmta directser of transit say he used various schemes to hide it. >> that was the red flag. >> reporter: on november 2016 audit uncovered the theft. sfmta turned the information over to the controller's office and sfrmt f.p.d. williams is charged with stealing more than $900, but the investigation isn't over. the d.a.'s office says looking back five years, investigators can see williams had exceedingly lower totals on the same route and same shift as other conductors. >> i'm concerned because it

makes us all look bad. >> reporter: the d.a.'s office also says investigators found $32,000 cash in a safe in williams' home, receipts for high-end purchases, multiple cars and packed luggage. >> this was an affront to the entire agency, to the city, and we're glad we have been able to play a role in stopping it. >> reporter: the agency says it is moving in the direction of cashless options for all cable car lines. in san francisco, melanie woodrow, abc 7 news. >> las vegas officials are lining up a sweetheart deal for the raiders. a draft of a lease agreement unveiled today says the raiders won't pay any rent at the proposed $1.9 billion stadium. stadium authority officials say they can't receive revenue because it could cause bonds to lose their tax kpem status. the raiders announced today they received 46,000 deposits of $100 for personal seat licenses for the vegas stadium. >> a landmark oakland business is closing its doors because of

rampant vandalism. the delicatessen and factory is leaving oakland after 90 years in business. owners say the vandalism and graffiti is a daily problem, one city leaders have failed to address despite numerous complaints. the decision comes a year after genova closed its flagship deli on telegraph after vandalism and rising rent. they are working to clear out thousands of participants in today's smoke out. this is a picture from sky 7 over hippy hill in golden gate park. it was just packed as you can see. less than an hour ago, at exact little 4:20 these marijuana enthusiasts took a toek in honor of the bay area tradition. the city of san francisco does not sanction the annual event, but this year did take steps to help with crowd control, trash pickup and city costs by partnering with local merchants. >> one landmark going away, and another unveiled in martinez today.

tesla today announced its biggest ever recall on 53,000 of its model s and model x cars. this is video of the model s provided by tesla, the sedan. the u.s. luxury electric car maker said the parking brakes installed on those vehicles built between february and october of last year macon tan a small gear that could have been manufactured improperly by a third-party supplier. it said 5% of those vehicles may be affected and it would take less than 45 minutes to replace the brakes. more trouble for tesla and its model s and x vehicles. the x is the suv. 47,000 owners who purchased those cars this year and last, yesterday filed a class action suit against the electric car maker in a san jose federal court. they allege tesla's auto pilot

feature is dangerously defective when engaged causing cars to veer off lanes, brake for no reason or slow or stop when approaching other vehicles. >> wall greens will pay nearly $10 million for improperly billing medical for prescription drugs. wall greens dispened drugs for diagnoses that were not approved and then knowingly charged med-i cal as if they were prescriptions. two wall greens pharmacy workers tipped off investigators. the whistle-blowers will share a part of the $9.8 million settlement. a spin-off of google has launched a study to learn what a healthy person looks like. verily provided this video. they will partner with researchers at stanford and duke universities. they want to find markers for health conditions like cancer and heart disease. project baseline is hoping to find 10,000 people in the study so they can track their health. they will analyze the information collected with fitness trackers, medical exams

and genetic testing from paid participants. >> mastercard announced plans to introduce cards featuring fingerprint technology to a wider audience. this comes as mastercard finished successful testing of cards with biometric sensors in south africa. the idea is to reduce costly credit card fraud by making sure the card holder is present when purchases are made. mastercard says customers can save two digital fingerprints when they register a new card with their bank. bay area highways are a lot cleaner today thanks to a partnership between cal trans and the chp. maintenance crews and volunteers have been collecting litter alongside the highways in nine bay area counties as part of cal trans annual litter day. >> when you drive down the highways you want to be able to look and see nice shrubbery without the added litter hanging on the shrubbery. we are a beautiful city and we need to make sure that this city looks beautiful. >> crews are also out educating
