alleged plot to kill an 11-month-old baby, and it happened at a mcdonald's in the east bay. worse, tonight we're learning this may not be the first time they've tried to kill that child. good evening. i'm dan ashley. >> and i'm all ma date. thankfully that shot missed and that baby is okay. adanna ibe and marcel brooks are in jail tonight on attempted murder charges. >> the shooting happened monday afternoon at the mcdonald's on washington avenue in san leandro. both suspects are being held in dublin tonight. katie. >> reporter: dan, ama, they're being held without bail, charged with conspiracy and the attempt itted murder of marcel brooks' 11:00-month-old son. we are learning tonight this may have been the couple's second attempt to kill the baby. >> all i know is marcel is a great dad. >> reporter: nina clark does not believe her nephew had anything to do with the attempted murder of his 11-month-old son. >> he would never, ever, and i'm

saying ever be involved in nothing like this. >> reporter: san leandro investigators say otherwise. they say brooks asked the baby's mother to meet him at this mcdonald's in san leandro monday afternoon so he could see his sn. police say brooks was in the area, but never went inside. they say adanna ibe was there instead. >> the female suspect was inside the restaurant, approached the female and her child, and fired one shot at close range, and then chittexited the restaurant. >> reporter: the bullet missed the mother and child. no one was hurt. >> through the course of our investigation, we learned the intended victim was the 11-month-old document. >> reporter: brooks and ibe tried to kill the baby once before. at the end of march, brooks is accused of luring the mother and baby to a location where ibe tried to run them over with a car. police arrested brooks and ibe in a sacramento hotel. investigators say ibe confessed

but claimed it was all brooks' idea. he denied any involvement. police are not revealing a possible motive. in dublin. developing news out of mendocino county. athena fawcett and katrina johnson disappeared from the boys and girls club in knew kaia around 5:00 this afternoon. athena was wearing a blue hoodie, black leggings and black slip on shoes. katrina was wearing a gray hoodie, dark blue jaenz and a light color blouse. happening now in union city, you may run into delays on 880 after a dadely shall contract. it happened at the whipple road off ramp. several vehicles crashed and a person on the highway was killed. it's unclear whether the person was walking or outside of a broken down car. all lanes reopened about 10 minutes ago. new at 11:00, the two groups that invited conservative commentator ann coulter to speak at uc berkeley are threatening to sue the university if she

cannot speak on the day originally plan. it's claimed uc berkeley infringed on coulter's right to free speech by canceling and rescheduling the event. they are giving the university until 5:00 tomorrow afternoon to honor her original date to speak or they say they will sue. the university says it changed the date because of specific security threats. on fox news tonight, coulter vowed to come to berkeley next week and give her speech no matter what. >> you cannot impose arbitrary and harassing restrictions on the exercise of a constitutional right. i don't happen to be available on may 2nd. >> she intends to come to this campus on april 27th without regard for the fact that we do not have a protectable venue available on that date, is of grave concern. >> may 2nd falls on what is known as dead week, when students are not in class and are studying for finals. coulter is also scheduled to

speak in modesto on april 28th. police are still searching for a man who burglarized at threat three homes in the oeblgland hills and shot a resident. the homes were located on chimney rock court. he was listening to music up stairs at the burglar entered downstairs. >> entered, locked my dead into the backyard by moving a piece of furniture in front of the dog door and then rummaged around. he went in my refrigerator, went through a couple closets, apparently stole nothing and then exited through my front door. >> the burglar did take a soda and a piece of string cheese from his refrigerator and grabbed a sandwich from another home he entered. the man then went through the window of another home and shot a 30-year-old resident standing in the kitchen. police are reviewing surveillance video to try to id that man. 50-year-old tennessee teachered that cummins, accused of kidnapping his student, elizabeth student, has been charged with taking a minor across state lines to have sex. this after authorities found

thomas safe in a remote area of cecilville in siskiyou county after a nearly five-week long nationwide manhunt. abc news reporter ariel ra chef has the latest. >> reporter: an agonizing ordeal coming to a close. >> so many people in this community, so many people outside of this community, outside of this state have been vigilant, have been praying. >> reporter: 15-year-old elizabeth thomas found alive and safe in a residence in a remote area in a northernmost county of california. >> all we know is she's apparently healthy and unharmed. >> reporter: her alleged captor, 50-year-old tad cummins in custody. >> they found elizabeth and arrested tad comings. >> siskiyou deputies locating the car in which they had been traveling. then discovering the pair in a cabin in cecilville. tom has has been the subject of a nationwide amber alert.

she and cummins spotted at a walmart in oakland. cummins now accused of having an inappropriate relationship with the teen, kidnapping her, then leading law enforcement on a cross-country manhunt. in an exclusive interview with abc news, cummins' wife, who has filed for divorce, said cummins had been spending time with the teen in their home prior to their disappearance. >> i think he was mentoring her an maybe just one bad decision started him off on a path he didn't mean to go on. >> reporter: thomas' family now anxiously awaiting her return. thomas is expected to be reunited with her family on friday. as for cummins, he remains in the siskiyou county jail awa awaiting arraignment and extradition to tennessee. the moments after gunfire broke out on paris' fames champs-elysees avenue were chaotic and captured on video by an acting director general of bahrain's state news agency. watch. speaking in arabic, he said

there's shooting in paris. one policeman was killed in the attack and two others hurt. officers shot and killed the 39-year-old attacker they say lived in a suburb of eastern paris. isis has claimed responsibility. san francisco's celebration of all things cannabis is history tonight and many are giving this year's massive 4/20 gathering a thumbs up. you're looking at the scene from sky7 earlier today as thousands got high. there were new rules at the annual pot fest in sharon meadows. cornell barnard is live at golden gate park where the cleanup is already under way. >> reporter: the city workers are pretty fast. the cleanup is almost done. 15,000 pot lovers showed up today. that's several thousand more than last year. there were a few medical calls but no arrests. sky7 was over hippy hill about 4/20 when the pot smoke from 15,000 joints and pipes almost created its own hazy fog bank. >> it was the freedom of being

able to smoke pot everywhere. >> i love a good, positive vibe. >> when the smoke cleared. >> please make your way to the exits. sharon meadows is now closed. >> reporter: the 4/20 party was over and the cleanup was on. dozens of city park and rec workers began the massive garbage cleanup. last year they collected a whopping 11 tons of trash left behind. this year, city workers picked up all day long. most of it will be recycled or com posted. >> our hope is about 50% of what we collect doesn't end up in the landfill. >> reporter: smokers were asked to do their part. this tiny piece of paper was this man's contribution. there were new rules at 4/20 this year. the city issued a permit, so you had to be 21 to get in. no selling marijuana inside. local merchants paid for fencing, port apotties and security. >> we tried a lot of new things this year, and we're pretty pleased with how it went. >> do you want to see more rules

two women who changed the public conversation on workplace bias and harassment spoke out in san francisco tonight. leslie brinkley was there to hear what ellen powell and anita hill had to say. >> you're not going to take excuses like, well, you know, that's just what men do. >> in 1991, anita hill galvanized the country as she accused supreme court nominee clarence thomas of sexual harassment. he got the nomination in the end but she unleashed a wave of women running for office. she told a packed audience in san francisco's haze valley what she thought about fox news taking commentator bill o'reilly off the air because of accusations. >> now they're paying him millions of dollars to exit when, in fact, he should not have been granted the contract

because the evidence was clear. we need to be able to look and use this as a case study where how what not to do. >> these social media companies don't understand harassment. >> ellen powell filed a gender bias lawsuit against a revered capital firm and lost. but she ignited a debate on bias in tech. >> when you look at what is happening in tech, it's somewhat similar. it comes from the top, and there's a lack of will power to put in the change. it is so much easier to push the women out. >> the audience was inspired. >> i'm a survivor of workplace harassment. it does affect your life in many, many ways. >> it never stops until we start treating each other better. >> both hill and powell concluded that social media is helping to hold companies accountable and raise public consciousness about sexual harassment. in san francisco, i'm leslie brinkley, abc7 news. state health officials have fined sequoia hospital in

redwood city $47,000 for mistakenly removing a woman's ovaries. doctors were supposed to remove her uterus, fallopian tubes and appendix during a surgery next year. the report did not include the patient's name or age. artificially sweetened beverages like diet sodas have been associated with stroke and dementia. a new study analyzed the amount of artificially sweetened soft drinks people in two different age groups drank. researchers compared it to how many people 45 and older suffered a stroke and 60 and older suffered dementia. those who drank one a day in both groups were three times as likely to suffer the respective health conditions. tonight we're getting a look at a river rescue in sonoma county. the man was in a kayak without a life jacket when he fell into the russian river between windsor and healds burg this afternoon. he was able to grab onto a branch and pull out a cell phone and called 911. the crew was lowered to the river where they pulled him to safety. he was not hurt.
