we still don't know for certain what sparked that fire. >> and cities in the bay area have been cracking down on warehouses without a real plan to relocate these tennants. >> abc7 news menendez is live. >> reporter: most of these artists will be sleeping on friends couches until they figure out what to do. the locks were changed and sheriff's deputies ordered everyone to leave the warehouse known by artists as the burnell house. >> they changed the locks and we have to come back within 15 days for the rest. >> reporter: nathan cotton and several others living here packed their belongings. those living here, mostly artists say they knew that this

wasn't a living space. >> he's saying that he had no idea that people were living here, people have been living in this building since 2004. >> reporter: but just days after in december, the occupants quickly tried to make structural changes to ensure they would be safe in the event of a fire. but they were told that they could not stay. in late february, they were ordered by the court to leigh the warehouse. >> and how many more landlords are going to take this as a go ahead to evict, how many artists are we going to lose? are we talking hundreds of people being evicted? >> reporter: the owner sent this representative who was upset that they had not moved out completely. erickson never returned our request for an interview, but we confirmed that since 2001, he's been submitting applications to build a three to four-story 49-unit building through the planning department. it has been an ongoing project.

christian bouie says these warehouses serve a purpose. >> you don't have to work so much to pay rent and to have the space to create. >> reporter: housing advocates say the city has to do more to help warehouse tennants find somewhere affordable to live. across the bay now, survivors of an oakland apartment fire that killed four people last month sued their former land lord. they say fwilgd wbuilding was i with rats and lacked safely features that could have saved lye lives. >> there were no smoke detectors, or they were not functioning during the fire.

>> three nonprofits that help run the building were also named in the lawsuit. the owner of the building issued this statement, quote, we are confident that as the facts are brought to light, the true responsibility for the operation and management of the building will become clear. developing news tonight, ann coulter's planned speech tomorrow at cal is off, but uc berkeley police say they're still planning for protests, coulter said she will still show up tomorrow despite the university saying their can't accommodate her. the school denies canceling her speech. in a news release it says it did not cancel the coulter event and has never prohibited ms. coulter from coming on campus. the reason it couldn't accommodate coulter was security threats made a safe event impossible.

face the death penalty. >> the man accused of -- returned to court today. after he said he wanted to receive the death penalty, doctors determined he was suffering from new details in a case of a san francisco man accused of assaulting police officers before they shot him. all but two charges against the man were dismissed by the judges, b. officers say shaun moore attacked officer who is then shot the officer several times. what would it take more moore to walk out a free man?

>> reporter: what would it take for prosecutors to drop this case to resolve the case of shaun moore and the officer involved shooting, and in light of those rulings by the court yesterday, the public defender is asking the district attorney to simply drop the whole case. >> mr. moore was within his rights, and demanding that the police officers get off his steps, and leave him alone. >> reporter: shaun moore the man stand agent the top of the stairs from this body cam video from one of two officers, they were responding to a complaint that moore was acting aggressively to a neighbor. the confrontation with the officers ended when he was shot several times after a scuffle on the top of the stairs. moore was charged with numerous felonies including assault on a police officer, his mother said he had several surgeries before being transported to jail. >> we have not had a lot of

b.a.r.t. police confirm they have surveillance video from inside the train car and they have been able to identify several suspects. no one has yet been arrested, anywhere from 40 to 60 young people ran on to a dublin bound train and robbed people. >> a much smaller group of teenagers was spot it at the lake merit station entering without paying and heading for the platform. trains went through the station without opening their doors. the suspects realized they had been spotted and they took off. police searched but did not find any of them. a san jose man is at the center of a unique immigration case that has him behind bars on the other side of the country. . coming up next, a

diana passed away in 2003, henry died sunday at home in the richmond district at the age of 99. they leave behind eight children and a legacy of giving, having endowed scholarships at several universities. henry chung's funeral is now being planned, it will be a celebration of an extraordinary live and no doubt extrordary food. a new report points out that drugged driving is more -- the most common drug found was marijuana, last november, california became one of nine states to legalize recreational marijuana. the author of the report, the governor's highway safety association recommends more training for officers so they can better identify drivers under the influence of drugs. a giant landslide was caught on camera overnight in mendecino

the weather department, i think a lot of people this weekend are excited to see this forecast. a couple of spots still of some drizzle, i just want to zoom in a little closer, those specs of green you see on your screen, around petaluma, and eastern etna springs and that the dressal and that's about it. this weak storm system is getting out of here. one sign of a change here, finally, our camera atop pier 15, getting some peeks of sunshine. we do have more in the way of cloud cover in the south bay, but that cloud cover is going to be exiting over the next 12 hours, your forecast is going to call for a warming trend, this is going to start tomorrow, but what we do have to deal with not only tomorrow, but starting friday with some very gusty winds, that wind is going to bring in even warmer air to greet us starting saturday into much of next week, out there right now, limited sunshine, a lot of cloud cover, did not warm

too much, got into the low and mid 60s in most spots. we're at 63 in san jose, 64 in napa, a little bit cooler right along the coast. overnight tonight, going to see the cloud cover really disintegrate over the next 12 hours, clouds early on, clearing after midnight and temperatures not all that bad overnight. most spots holding in the 60s, a couple of exceptions like the north bay dropping into the upper 40s. tomorrow could not be more different than what we experienced today. a few clouds right along the coast, but otherwise, it is nothing by midday and the afternoon. very comfortable temperatures in the 60s and 70s, but we will have that wind to deal with. now with the windy weather and the warming temperatures, one of the issues we're going to have is pollen, right now tree pollen and grass pollen at moderate levels, but i do expect that

authorities, he started out as a legitimate call center worker. >> this call is from the internal revenue service. >> reporter: but allegedly used the service for scams, recruiting other youngsters to help. >> they are called freshers, which means they are just out of college typically, this may be their first job. >> the irs is filing a lawsuit against you. >> reporter: she says at first, many of them don't realize their work is a scam. >> a lot of them think they're legitimately working for the u.s. government and getting people to pay their back taxes. >> and now that he is behind bars, she says don't expect the calls to stop. >> i think it's the tip of the iceberg, i think you're going to see a lot more. >> reporter: u.s. authorities agree, the treasury inspector general telling us the arrest does not bring an end to the problem as scammers continue to employ impersonation of the irs as a scare tactic to con people. call centers are part of the

an after school program that's helped thousands of children in an economically vulnerable san francisco neighborhood is celebrating 25 years of service. >> abc7's sheryl jennings has followed the tenderloin after school program from the beginning and has their story. >> reporter: the tender loin after school program the known for his computers and it's yummy food. >> you get to pick whatever you want. >> reporter: andrew loves talking about the tender loin after school program but some of the other students were too shy to talk, so we used a smart

phone to help them tell their story. >> has tas helped you on some projects you have done? >> when i came, i had bad grades and when i came and started doing home work and they started explaining stuff for me and i raised my grades in. >> if not for our program, many of our students would be unsupervised after school, they would be living in a more isolated environment. >> it's a warm and caring place, it's a place of refuge, it's truly home for them, a home away from home. >> don falk is the ceo of the after school program was founded 25 years ago because parents asked tndc for a safe place for their kids after school. former mayor frank jordan helped kick it off. two sisters who were clients back then as children have returned as adult dos work at the center. sondra and catalina ortega are
