face beingli. it appears he had been stabbed by another man when two police officers on foot tried to stop him. it's not clear if the stabbing took place inside or outside the subway >> a white male stabbing an asian or filipino male. the officers intervened. during the course of the intervening, at least one officer discharged a firearm. >> reporter: the man who was stabbed was taken to the hospital. the other did not survive. >> the stabbing was in progress, stabbing was in progress, yes. >> how could we avoid this shooting? >> everything right now is under investigation. it is very preliminary. >> reporter: this fedex driver was across the street when he saw the commotion. >> i don't know what happened. see the people just come out the subway. >> reporter: surveillance video from this muni because was taken by police to help shed some light on the shooting. witnesses are also being interviewed. the incident happened on market near fifth street. >> i just wonder when it's going

officer before being shot to death. happened moments after police answered a call involving an altercation of a 28-year-old man and his father on frazier drive. the son came out of the garage and confrontsed officers just after 11:30. there was a call at this same house. >> they knew there was a potential for violence. again, the officers arrived on scene and did the best they could. the individual charged at the officers and made the confrontation. >> the man died after being rushed to a trauma center. santa clara county prosecutors and san jose police have both launched separate what happened. >> an east bay man [ inaudible ] killing his wife in walnut creek last week entered a not guilty plea today. 38-year-old gregory entered that plea against the advice of his public defender who wanted to delay the arraignment until tomorrow. he is accused of shootingol ros

park last thursday afternoon. police tracked him to martinez and an 18-hour standoff ensued as he sat in a car near a gas station. police took him into custody friday afternoon. >> new developments in a deadly train crash this morning in san lorenzo. we know the high school student killed on his way to school attended kip collegiate academy. >> it happened at grant ask railroad avenues. abc7 news anchor eric thomas has been following. eric? >> reporter: the crash happened along these union pacific railroad tracks west of the academy. by the way, that school will remain open until 8:00 for grief counseling for students who may still be mourning after hearing the details of exactly what happened here. >> he will be incredibly missed. we are all incredibly heartbroken. >> reporter: kelly is the princil at kip king collegiate academy that spoke to reporters just after breaking the news to

students that one of their classmates was killed. >> he had a big heart, and he was able to build close friendships and e tnarhe and loyalty of everyone around him. >> reporter: the 16-year-old junior was riding his bike along the tracks on the way to school at 8:00 this morning. [ inaudible ] mile long union pacific train came through heading southbound. >> we understand that he did not hear the train coming up from behind him and by the time he did realize it, it was too late. >> reporter: he was on railroad bridge when the train hit. it has ridge rails on both sides making escape impossible. the young i victim's name will not be released. he was an honor student 4.0 average taking all a.p. courses. his death has police issuing a warning that riding on the tracks is never a good idea. >> please stay off tracks. there is nothing good that comes of traversing, taking a short cuts through t railroad

oakland tied its existing record, 88 degrees for this data. san jose tied its record as well n see so far have hitcaocations u the low days and we may even have more records before the day ends. this is the view from mount tamme. currently 71 here in san francisco, quite a drop from the high of 82. we have temperature 80s in oakl mountain view, san jose, 90, gilroy, half moon bay. a beautifully clear western sky. 88 in santa rosa. 90 in napa and novato. 92 fairfield, 94 concord and 93 in livermore. tonight 9:00 temperatures -- 10:00 drop to a bit more than they had dropped last night at 10:00 and tomorrow morning at 10:00 where some inland locations yesterday or today i should say were in the 80s tomorrow they will only be in the 70s. so, there is going to be quite a cooling effect from the approaching marine layer. you can see it right there. allasre a cooler

tomorrow, have the complete accuweather seven-day forecast. >> pg&e will assure marina district possible toxins deep beneath their homes don't pose any danger to them. the power company has been testing soil samples at the sites of two gas plants destroyed way back in the 1906 earthquake. the facilities manufactured a fuel similar to natural gas. one plant was located along fill more and alhambra streets. the other was a block away from bay street. houses may have toxins 30 feet below the surface. pg&e says residents are safe. >> we want to let folks know there's no cause for health concerns based on anything that we've found. what we're going to be doing is continually communicating that to them. >> tonight's public meeting will be held at fort mason's building a from 6:00 to 8:00 p.m. we'll be at the meeting with a full report later tonight.

>> today judge sided with san francisco tenants facing eviction and ordered the landlord to pay up. targeting landlord. city attorney dennis herera accused her of harassing tenants and evicting them illegally. $2.4 million in penalties and have no more contact with her tenants. one of the landlords' attorneys released a statement saying, due to a series of court orders before the trial even started, the defendants were unable to tell their side of the story at trial. >> some good news for residents living near milpitas intersection prone to crashes, the intersections at the corner of evans road and kennedy drive now has a four-way stop sign. this image tweeted out by the milpitas police department. less than two months after an abc7 viewer showed the crash right there. right at that intersection. up until now it was only a two-way stop at that intersection. >> a new bill could change the rules of the road for cyclists so republican law maker wants to make it legal for bicyclists to

mosquito fish and frogs and water features at home to act as a natural defense against mosquitos. the first human west nile case of the year in california was reported last week in kings county. >> stanford researchers say mosquito season is getting longer as temperatures rise with climate change. for the spread of als the ideal mosquito bore diseases is 45 degrees fahrenheit. it is critical for predicting future rates of diases. countries could use the information to know when and where to invest in vector control to prevent epidemics. >> a federal judge in san francisco says there is no smoking gun proof uber used files from google's self-driving carwaymo. it is overwhelmingly clear a former waymo executive who works for uber stole 14,000 confidential files before he quit waymo.

record of the past, present and future needs some help. >>d-raiser has been launchedun to repair the damaged artwork. abc7 news anchor kristen sze is here with the details. kristen? >> larry and alma, this is the market street railway mural on ongdi church and 15th owned streets just off market completed in 2003. it is a 180 degree birds eye view of market street. each vertical section showcases a different moment in history dating back to the 1920s. now, one slice shows a 1980s pride parade with sisters of perpetual indulgence and harvey milk signs. another slide shows an imagined future with a swapping center instead of a shopping center. and futuristic vehicles. the mural is the work of san francisco artist mona asking for help to repair the damage time has inflicted. >> so that we can refresh, not just the physical wall, but the

here as you look at santa cruz beach because you wouldn't see people out there on the beach like this if it were not a very warm day. these are our forecast futures.d overnight. that will give us a cooler day tomorrow. and there will be further cooling friday and saturday with strong gusty breezes. right now, though, we're looking at heat. 95 degrees at this hour in vallejo, 94 at concord and san ramon, 92 at flee mont. numerous locations are at or above 90 degrees. we have much milder 71 here in san francisco, 67 at half moon bay. let's move along, take a look at what will happen overnight. coastal fog beginning to spread locally across the bay and to some inland spots. won't have much of a cooling effect tonight. low temperatures will still be relatively mild, mainly in the mid to upper 50s. 60s will be antioch and san jose. we'll feel the cooling effect tomorrow. let's look at the microclimate tomorrow. 69 in half moon bay. downtown 67 degrees, oakland a little milder than san

francisco, but much cooler than today, a high of 73. walnut creek which topped out at hiayod tf wlil 81 tomorrow. and over at antioch which was around 94 so far today, only 85 tomorrow. only 85. now let's look at more closely at the thursday highs. 79 at santa rosa, 80 at napa, the peninsula or bay i should say, 78 at fremont and over to the peninsula san mateo down at san jose which had a record high today, a high of only 79 tomorrow. there will be further cooling friday. temperatures will continue to fall. so, we've got quite a cooling trend taking us into the weekend the we'll see an increase in wind starting friday when gusts will range from 25 to 35 miles per hour. friday evening early, friday evening later, even stronger wind gusts up to 41 miles per hour at point reyes and gusty conditions will continue into saturday. we may see a spotty shower or

before 11:30 on market near fifth street. police say at least one officer fired a weapon. the man who was stabbed was transported to a hospital for treatment. the man who stabbed him died. well, you heard from abc7 news reporter lyanne melendez earlier this hour. she actually tweeted this picture you see here from the scene advising anyone in the area to avoid market street. there it is there. in afghanistan, at least eight civilians died in an attack in kabul. three u.s. service members were also hurt. isis is claiming responsibility for the bomb that went off orngniridung rush hour. back here in the u.s., republicans are trying to drum up support to repeal and replace obamacare. that vote is expected to come tomorrow. two high-profile republicans switched their no votes to yes today, that still may not be enough. janai norman has our story from washington, d.c. >> reporter: republicans rushing to rang l up support for health care report. hoping to cross obamacare off

[ bleep ] [ bleep ] >> reporter: will not face federal charges. >> we simply did not have sufficient evidence to prove beyond a reasonable doubt that either officer violated the federal criminal civil rights laws. >> reporter: the department of justice releasing the results of the federal investigation finding that when police responded to a call that sterling pointed a gun at someone outside the triple s food store outside july, sterling resisted arrest, determining in the struggle captured on multiple videos, it was unclear whether he was reaching for the loaded pistol in his pocket. >> we would have to prove beyond a reasonable doubt that officer did not believe mr. sterling was actually going for a gun, and that he simply decided to shoot him. >> reporter: last summer the case prompted days of protests leading to more than 150 arrests. tuesday night after the d.o.j.'s decision was leaked, there was calm on the streets of baton rouge, something sterling's family hopes will continue,

we're following developing news out of richmond. the chevron refinery is dealing with a level one incident. these are live pictures from the east bay hills camera. it was a big difference a short time ago. take a look at this new video from about 15 minutes ago. you can clearly see flaring from the refinery. they say there is no shelter warning right now. level one incident means hazardous materials were released with the possibility of impact off the side of the plant, but again refinery officials say there is no danger to the public. we're monitoring the situation and will bring you updates as they become available. >> well, you can call this a rush hour miracle. nobody suffered any serious injuries following a dramatic plane crash captured on videos near seattle. not only does the plane zip by but it will burst into flames after clipping lines. he told investigators he was trying to land on a road when

his plane lost power after taking off from a nearby airport. to get another look at the entire video you can go to abc7 news.com. >> there is historic flooding in the midwest. rain continues to fall in missouri after rivers crest forcing evacuations. thousands of people are cut off from work and school with major interstates now sitting waterlogged and empty. here's abc7 news reporter emily rau. >> reporter: the water continued to rise with the rain. major traffic arteries submerged. a short commute to work turned into an hour's long trip. >> i can't stress enough if there is water on that roadway, do not go into it. >> reporter: the deadly weekend storms brought eight least 12 inches of rain damaging hundreds of homes [ inaudible ] national guard both on hand to help. along with a small army of neighborhood residents determined to do whatever possible to protect homes and

businesses in towns along missouri's swelling rivers. >> all the way down the line. >> reporter: in some areas, though, sand bags no match for the record setting water levels. midday wednesday the second major interstate i-55 shut down effectively isolating the entire county just south of st. louis. two of the areas' biggest school districts forced to cancel classes with students, school teachers and buses stranded at home. a levee breached in arkansas along the black river. flood water spilling into the town to people. this as rescuers on the western side of the state continue to search for an 18 month old girl who was swept away in the flood water. her brother's body found monday. the current round of rain falling could bring three to four more inches in the next few days. that means no relief for the saturated levees and the tens of thousands of people affected by this disaster. emily rau, abc news, new york.

today in san jose police officers honored their fallen comrades in a solemn ceremony paying tribute to every life lost in the department's histor history. the most recent officer killed last june in a motorcycle accident, abc7 news reporter chris nguyen has more from san jose. >> reporter: with black bands over their badges. >> i hope and pray we don't lose another. >> reporter: the department pauses to remember the fallen in san jose. the ringing of two bells, honoring each set of offer certificates who paid the ultimate price while protecting the city. >> it never gets easier, but we're here for the families and the families are here for us

because we need each other. >> officer michael j. calfer man. badge 3900. >> reporter: today extra support for the officer killed most recently in the line of duty. >> he loved the people he worked with and he loved his family and he was passionate about all of it. >> reporter: the officer died last june after being accidentally hit by another vehicle trying to make a left turn. as fate would have it, the driver involved in that crash had met the officer at a coffee with the cop event two weeks prior to the tragedy. not lost on his family. >> we told them we understood their pain and we hold no ill will towards him and we forgive him and we extend the grace to him and his family in the exact same way god extends my family grace. >> reporter: a lesson in forgiveness and moving forward. >> we will never forget and we will always honor your sacrifice.
