already in jail. the 36-year-old is charged with the special circumstance murder of angela st. john. >> we believe the suspect went to the resident late in the evening, commit a burglary and steal items out of the garage and confronted by the victim. at that time he killed her and burned the residence and structure to hide the evidence. >> everybody needs their mom. >> reporter: in february, standard john's daughter told us how important it was to find the killer. >> my mom is the last person you would expect this to happen to. >> reporter: a surveillance video showing a man walking near the house and photos of the car and link to the suspect. that car was found in tracy. >> that vehicle was stolen just two days before the homicide and recovered just on may 4th. >> i am relieved. >> reporter: the parm a's owned

began robbing people of purses and cell phones and wallets and beating some into submission. rusty says he was one of them. >> i leaned back way from the crowd and they obviously took exception to that and two individuals jumped on me and started beating me. i leaned back in the seat to cover up. a third individual started kicking me. at that point my wife fell on top of our daughter to cover her up. >> the b.a.r.t. personnel showed a disregard for b.a.r.t. passengers by failing to take any measures to prevent this take from happening, two police officers in the parking lot through which these individuals passed. >> the attorney goes on to say another example was the conductor allowing the teens beating on the train to get onto the train. b.a.r.t. previously said it made two arrests in this incident, also several suspects had been

identified, mostly juveniles. b.a.r.t. did not respond to our request today regarding this lawsuit. live in walnut creek, abc7 news. >> thank you. san jose police are identifying the man they say fired shots at them yesterday. kevin riley shot at them when they arrived for a call of a man with a gun. no one was hurt. he ran off but was captured. police have officially identified 24-year-old campbell resident as the man who shot and killed his ex-girlfriend's parents last week. he was killed by officers after he pointed his gun at them. he had a history of domestic violence and mental issues. he stormed into a house on wednesday night, his former girlfriend was not there, they had broken up last year. he killed her mom and dad and held a 13-year-old boy hostage

before being shot by police. gunshots met a lot of 911 calls in fairfield early this morning. investigators knocked on doors nearby looking for leads. when police arrived, they found three gunshot victims, one pronounced dead at the scene and the other taken to a trauma center. no information on the person who was killed and that shooting is under investigation. an unforestein problem has san jose council moving fast. they plan to vote on two ordinances tomorrow to give tenants more protection if asked to vacate their apartments. david louie has an update in san jose. >> reporter: it has been three weeks now since the city council voted to write an ordinance barring no cause convictions. landlords have issued a flurry

of no cause evictions in order to beat the enactment of the new law. the council added a second emergency amendment to clamp down. >> reporter: they rallied outside city hall hoping to pass both ordinances, one on no cause evictions and the other to make a change immediately. they have been issuing them before the council puts the brakes on them. >> reporter: robert says he used to live in the jungle a homeless place in san jose before finding an apartment and worried he could be homeless again. >> i have found really long waiting lists. i also found very expensive housing to make it almost impossible if not impossible to find place to live. >> reporter: property owners worry the ordinance would make it difficult to get rid of problem tenants especially those that know how to work the system. we had a tenant that moved in

and did everything right to make sure he didn't pay rent for six month and totally trash the unit and caused harm to surrounding neighbors. this is without just cause eviction. >> reporter: they need eight votes to pass it immediately. the council member don rocha is hesitant to predict tomorrow's vote. >> i wish i could know what will happen tomorrow. i know the council and mayor are concerned about this issue and why you're seeing the activity. we wouldn't be discussing it if we didn't think there was a reason. >> reporter: abc7 news. another problem with the sinking millennial tower, 49'ers legend joe montana is suing the developers. he claims the condo has become increasingly slanted. earlier this year, another group said the tower has sunk 2.6

from a jewelry company called pandora. it was a counterfeit site. it sure looked real. online bandits are doing the same with apple and amazon. these are real websites now. but they can trick you. the best way is check the address before you buy anything. bumble bee foods pled guilty tor:con spiring to fix prices for canned tuna. they pleaded guilty to one felony charge and agreed to pay a $25 million criminal fine. the company is accused of being involved in a price fixing conspiracy conducted with other unnamed tuna companies. law enforcement authorities say it began in 2011 and continued until at least late 2013. after the united airline passenger brouhaha and doubtful the airline would lose a single
