>> this white house is erratic, it's bizarre. the way he was fired was outrageous. he heard about it on the news. it's crass, it's wrong. >> reporter: lee admits she and other democrats were vocal critics of comey last october when he announced the fbi was reopening its probe of hillary clinton's e-mails. just 11 days before the election. trump claims comey's handling of the clinton matter was a major reason for his firing. lee points to the probe in the possible intervention of russia in the election. >> it is never a good time to fire an fbi director. >> reporter: the former chairman of the california republican party. >> clearly he had become too political. he was too political last july, and he kept going that way and that's not the position of a law enforcement official to be political. >> i think having lived through watergate, we are at a watergate moment. >> reporter: with comey gone, bay area democrats and congress say it is imperative that a special prosecutor be appointed

to lead the russia investigation. >> the explanations by the white house it was all a coincidence, there is no coincidence. i mean, he skasked for more mon. he was supposed to speak again in front of the senate committee on thursday. between those two things he gets fired. >> reporter: democrats and some republicans are now asking speaker paul ryan to reconvene congress to create a special commission on russia. laura anthony, abc7 news. >> a bay area man is among the candidates being interviewed to take over the fbi as interim director. the candidate is reportedly on the short list are paula bait who leads the department cyber branch, william avana, michael anderson who runs the fbi chicago field office and adam lee who runs the richmond california field office all in the running. it is worth noting that lee began his fbi career as an agent in san diego. he was also a fellow in the california state senate. lee went to college at san

francisco state university and law school at john f. kennedy university in orinda. >> oakland police say someone tried to kidnap a boy from his front yard just before 9:00 on 45th street near broadway near oakland tech high school. investigators say a 10-year-old boy was outside his house when a stranger tried to grab him. the boip managed to pull away. he described his attacker as an adult male with a large build wearing blue jeans and gray hooded sweatshirt. police in antioch are hoping this sketch can help them solve a murder from last month. detectives say this man shot and killed a 23-year-old man near the contra costa county fairgrounds. it happened on april second on k and seventh streets. the victim was shot at least once. he died in the hospital after emergency surgery. the suspect is described as a white man between 20 and 30 years old. >> tonight we're getting our first look at video from a police shooting at a subway

restaurant in san francisco one week ago. >> get back. >> at a meeting today police showed that body camera video and surveillance video from the restaurant. two members of the community. 26-year-old nicolas was shot and killed by officer kenneth cha after he stabbed an employee in a fight behind the counter. he is the same officer who shot and injured a man in january. >> investigations, overarchingly a lot of questions as to one officer involved in two incidents. >> supervisor jane kim and community members praised the chief to his quick response to the first officer involved shooting on the job. >> a popular burger chain chose to temporarily close one of its locations after some customers reported feeling sick. those who dropped by the in-n-out in livermore were instead greeted by traffic cones blocking the entry to the parking lot. as abc7 news reporter chris nguyen explains, health officials suspect noro virus, but they haven't been able to confirm it. >> reporter: for many, a trip

along 580 would be incomplete without a stop at in-n-out in livermore. >> our california relatives told us we should try in-n-out. >> reporter: this afternoon an uncharacteristic scene customers being told to stay way until further notice. >> this is one of my regular stops on the way to l.a. and i can eat it in the car and hurry up and get down so, yeah, i was shocked. >> reporter: as a precaution, company officials made the call to voluntarily close their location on north livermore after after 9 people from a travel group reported feeling sick after recently dining at the restaurant. in a statement, a company spokesman said our investigation did not turn up any indication that there were any issues at our restaurant. nonetheless, we thoroughly cleaned and disinfected the entire facility. the livermore mayor applauded in-n-out for their pro arctive approach calling the company a terrific kmurnt partner. >> they know how popular this is. so, if there is any question in their mind, they want to make

sure that no individual is going to be put at risk. >> reporter: abc7 news checked with the alameda county health department website which shows the company did pass its two most recent inl specs but was cited for a food safety violation during routine check last december. despite all of this, customers say they'll be back. >> yes, my favorite restaurant. double-double. >> reporter: in-n-out says they'll reopen the restaurant after the health department completes an assessment. in livermore, chris nguyen, abc7 news. >> tonight all lanes are open heading into san francisco on the golden gate bridge. an accident briefly shut down all but one lane on southbound 101 just after 3:30. according to the chp, a gray range rover ran into the median blocking traffic. you can see the cars moving by slowly. but like we mentioned, all lanes are back open once again. in vallejo, meantime, a protest over a plan to build a cement factory and deporter ship terminal near mayor island. the city's planning department rejected the proposal saying it

would increase pollution and traffic. but the company is appealing. abc7 news anchor eric thomas is in valeo. >> reporter:? a little less than three weeks in the chambers behind me, they'll have hearings and a possible vote on whether to resurrect the plan for that cement plant near mayor island. i can tell you from attending a news conference this morning there is a lot of opposition to it. dublin, ireland based orson wants to spend $50 million turning this old flour plant into a high tech cement factory. the long shore man's union and neighborhood groups oppose it. >> we want something better than a toxic 24/7 cement factory that will bring in ship loads, bring in ship loads of industrial waste to vallejo's waterfront. >> reporter: vallejo's planning commission voted 6-1 to reject the plan back in march. but ore son is appealing. they are hoping they kill the it once and for all.

>> this is a predominantly black area. we have others who are ill. elderly who are ill. >> reporter: this is a similar plant in france. another company would build the deporter port. recycling metal slag and lime chemicals produces better quality cement producing 90% less energy and 80% less pollution. critics aren't buying it. >> there is no reason to have it here other than the fact that this is a poor neighborhood and they don't think that we're going to arrive. >> reporter: not all are opposed. the solano neighbor said the area would benefit. >> i certainly think so if you have a deep water port, if you have a dilapidated structure that is actually going to turnout an environmentally friendly product. >> reporter: a draft environment impact report said the plant could pump 70 tons of pollutants into the air every year and hundreds of trucks per day would drive through residential streets taking material to and from the plant. they are appealing the planning commission rejection and the city council will debate then

vote on the appeal over two days, may 30th and june 1st. in vallejo, eric thomas, abc7 news. >> some former oakland raiders cheer leaders will finally get paid for working for much less than minimum wage. about 100 former raider ettes will start receiving pay outs from a lawsuit today settled a couple years ago. it has been tied up in court since then. the final step marks the end of the case. the women's class action lawsuit was filed in 2014. it was the first such case against an nfl team. there have been others since. the average settlement amount is $7500. the women who worked for raider ettes for multiple seasons will get about $20,000. there is a lot of talk at this hour about whether homeland security will ban laptops on all international flights. the possible ban reflects fears that terrorists can build bombs into laptops and bring them right onto the plane. laptops and tablets are already banned on u.s. bound planes from ten airports in the middle east

evidence nicolas hodges harmed any children, but one parnt fears his child was close to becoming a victim had hodges not been arrested. abc7 news reporter vic lee is live at the hall of justice with the shocking story. nick? >> reporter: nicolas hodges was arrested last month. he pleaded not guilty to child porn charges. he was back in court today for another hearing. now, the d.a.'s office wants people to call them if they know of any incident where hodges actually harmed a child, was in a relationship with a child. today we found a parent who says his child had a close call. there may be others with the same experience. the judge did not allow our camera in the courtroom, but the swim instructor nicolas hodges, his parents came today. in court their handcuffed son acknowledged them with a smile. john thai was also here. >> this person that we had trusted, trusted greatly, who only a couple of days before he was a est ared had solicited to come baby-sit for our

6-year-old. >> reporter: hodges taught thai's six year old to swim here at the la petite swim school. parents liked and trust him. he had also been with kids at the trampoline school next door to the swim school. he worked here for several years. the charging documents said he had more than 600 files of child porn on his computer and cell phone including explicit videos of children as young as two years old. hodges was arrested at the swim school in april after an investigation by the internet crimes against children's task force. the school issued a statement saying, the s.f.p.d. has not found evidence linking any of our students to the charges against hodges. but john thai and perhaps other parents may have dodged a bullet. thai said this is what hodges told his child. >> i'll come over maybe on a friday night and baby-sit for you and i can do magic tricks.

>> reporter: as thai says, he trusted hodges to teach his son to swim in deep water so why would he not have trusted him to baby-sit? vic lee, abc7 news. >> we are also learning new details about a mob attack on b.a.r.t. a few weeks ago. we reported it at the time by a huge group of teenagers. the chronicle reports the group of 40 to as many as 60 young people was poundeding on the doors and windows on the dublin bound train at the coliseum station, but the operator allowed the automatic doors to open anyway. the paper says the same crowd had apparently swarmed a san francisco-bound trained just moments earlier but didn't rob anyone. the chronicle is also reporting four of the nine cars on the dublin train did not have working surveillance cameras including the car where some customers were beaten and robbed. >> the chp is taking a proactive approach to the new world of legal recreational marijuana. officers are testing a new technology that is designed to enhance the regular field sobriety test. the sobriety test takes into

account eye movement and involuntary bodily indicators, but doesn't say if the drug is in someone's system. now with a hand held device an officer can collect a driver's saliva sample and learn within minutes whether drugs are present in the sample. >> there is a lot invoofld. it's not just one standard measurement. especially when it comes to marijuana. it is a complex drug. we want to make sure we're identifying impairment and not usage. >> the over reaching purpose of the new test, to make sure you are not driving under the influence. >> a new baby monitor about to hit the market has raised concerns about privacy as well as parenting. >> critics say it opens the way for data sharing at the early est stages of life. 7 on your side michael finney is here with more on that. michael, what is too much? >> it's a pretty remarkable device. it can do many different tasks, some say too many of them. the baby monitor by mattel will stream hd video to your tablet

or phone. it also has a light, a speaker and sound machine. the device can act like a parent turning on soft music if the baby starts crying. child advocates worry it will replace bonding with a parent. privacy experts worry it will be used to collect deeply personal family information. mattel says the device has strong encryption features and it complies with laws protecting children's online privacy. recycling centers in california are closing by the hundreds. now lawmakers want to do something about it. nearly 600 recycle centers have closed in the past year and about 300 the year before. lawmakers worry that could lead to more dumping in landfills. they say the centers are struggling because of a sharp decline in prices for scrap materials. the state subsidizes the centers, but not enough to make up for all of these losses. now, lawmakers are looking to update our 30-year-old recycle program. the goal is to recycle 75% of waste by 2020. it's nice to get something

for free, but not if it might cause a problem. a south carolina company is recalling thousands of night lights that were given out for free. am conservation group said the lights could overheat and catch fire. 14 reports of smoke and heat, but no injuries. several companies gave away the lights for promotional gifts starting last november. they also were included in some energy conservation kits. if you have one of these you should unplug it right away. i'm posting a lincoln my facebook page on how to go about getting a new one, which is, by the way, also free. well, may is a long way from march. just ask snapchat. the company's multi billion dollar initial public offering in march was a smash. the largest since facebook's. in fact, today snapchat announced its earnings and wall street, well, was not impressed. revenue was $150 million less than projections, and shares fell fell as much as 25% during trading. the company is feeling the heat from facebook which is taking snapchat's hallmark features and adapting them to its own platforms now. >> charlie brown and snoopy are moving to canada.

today nova scotia based media company dhx announced it is acquiring the entertainment division of iconics the company holds an 80% stake in the brand based on characters from the charles schultz comic strip. the schultz family will continue to own the remaining 20%. schultz lived in santa rosa which is where the museum is dedicated to his work. >> timber, right? an investigation is now underway in italy to figure out why this crane suddenly collapsed. the giant piece of equipment was being used to install a prefabricated section of a railway via duct. the operator of the crane was able to jump clear just as it started to tip over. glad to say no one was hurt. >> they face another round of service disruptions this weekend. no trains will run between the fruitvale and lake merritt
