the possibility of parole. he was convicted of murdering sierra lamar after kidnapping her. they started with the penalty phase this morning telling the jury what to expect to hear from the witnesses, friends, family, her teacher, and others. the prosecutor said the only appropriate verdict is the death penalty. the defense attorney, brian matthe matthews, will hear from torres' family, his rough childhood, and mother of the two kids about what a caring father he is. the defense was disappointed in the jury's verdict, but conceded his life is in their hands. >> if the defense wants to create lingering doubt about what could have happened to sierra lamar, and is that lingering doubt enough to suggest that life without the responsibility of parole is the best option under these circumstances. >> reporter: the prosecution says they will also discuss two incidents from the past where garcia torres had a

confrontation with police and punched a man involved with his sister. the penalty phase could last weeks depending how long the jury deliberates. live in san jose, matt keller, abc 7 news. >> matt, thank you. a bomb threat forced the closure of a san fracisco school for infants and preschoolers. they notified the t this morning they received a bomb threat over the phone. officers cleared the school, searched it, and declared the all clear. a message sent out to parents to pick up their children. the school is still closed for the day, and the investigation is ongoing. new details out of the north bay. good news for the missing 12-year-old girl. police say treasure anderson has been found safe. officers looked for her since yesterday when she vanished on the way home from school. the police department postedage update this morning on its twitter page thanking everyone for getting the word out. new this morning, police are

investigating another car fire in the east bay. this time, in rodeo. you can see a van parked on the side of railroad avenue near 3rd street. the fire gutted it. this follows a string of car fires in the east bay last week. police arrested a suspect over the weekend for those. no word yet on whether this latest fire is connected. today, the families of ten people who died in oakland's ghost ship fire filed a lawsuit against the building's owner and manager. 36 people died in the december 2nd fire. several families filed individual lawsuits claiming the fire was a fire trap and owners and leaseholders ignored safety hazards. the building converted illegally into a living area. records show fire fighters were called to inspect the property, but citations were never issued. developing news, a movement growing to support a man detained by i.c.e. he's a married father of three and a documented immigrant. abc 7 news was in san rafael yesterday apt the rally, pushing

to get him released, and in front of a judge before being deported to mexico. he went to a construction job three weeks ago and never came home. >> translator: i can't explain how i felt that day. it's very terrible. >> i.c.e. provided a statement saying that he, quote, unlawfully entered the u.s. after being previously deported in 2001. he will remain in i.c.e. custody pending court proceedings. new developments from washington. president trump is under fire following reports that he released highly classified information to top russian officials. the president is defending his right to disclose the sensitive intelligence, but as abc reports, that's not stopping the fallout on capitol hill and with our allies overseas. >> it's a great honor. >> reporter: today, the president's defense. president trump not denying the explosive report that he shared

house among other things. they issued a statement to abc 7 news saying "our community safety is always our top priority, and we continue to talk with staff about how we can prepare them for disruptions and any emergencies." heads up, heading for lunch this afternoon? may have a stray shower or two. the golden gate bridge is cloudy and gray there. mike nicco is tracking rain chances where you live. mike? >> it's centered on an area of clear lake, and you can see a little radar return there. i looked at the ground reports, and so far, nothing reaching, so some sprinkles will be possible in the area as it slides south into places like vieljo, crossing the delta into the highway 4 region and discovery bay. the big story is the cold front up to the north. when that comes in this afternoon in the evening hours, we have a better chance of stray showers. this is how it looks from mount tam.

commute, and south of the bridge, a little rain. once this passes, check out the wild swing in temperatures, 50s, 60s, 70s tomorrow, 80s, thursday, and 70s, 80s, 90s saturday and sunday, two hottest days in the forecast. >> several seasons in one week. thank you. >> you bet. >> thank you. new concerns for women who get breast implants. they linked implants to cancer. jessica castro from abc 7 mornings has a woman's alarming story. >> reporter: nearly 400,000 women get breast implants in the u.s. every year, and now widely shared story in the "new york times" raises major health concerns. stacy boone was diagnosed with cancer in 2015, but she never suspected her breast implants ere to blame. >> i thought i had the flu. i was having hot flashes, severe sweating under my armpit, there were not only one, but four

bumps in the lymph nodes. she was diagnosed with alcl. she's not alone. the fda says in six years, there's been 359 reports of possible breast implant associated cancer. including nine deaths. >> there may be something about the texture of the implant inducing some inflammation causing the cancer, but it's currently not well understood why it happens. >> reporter: it's a very rare and potentially deadly form of cancer that affects cells in the immune system found around the breast implant. >> now, this type of cancer has been more associated with this type of textured or gummy bear implant versus the smooth kind. ask, will it be under the muscle, most are, and if you're getting silicon, will you need some kind of imaging follow-up. >> i had my implants done in the early '90s, and i was never told that i needed to go back and have them checked every so many

years. >> reporter: there's good news for stacy. after chemotherapy and stem cell transplant, she's in remission, and next month is two years cancer-free. the fda does not have exact guidelines how much you should check your implants, but talk to the doctor for an individualized monitoring plan. symptoms of alcl include redness, pain, swelling, or asemitry in one breast, but it is generally treatable. jessica castro, abc 7 news. >> texture of the implant, new information. very interesting, jessica, thank you. new this morning, the facebook ceo and his wife are using the billions to do more good. this time for students. the couple announced plans for the charity, the initiative to partner with the college board to help rural and low income students to prepare for college through advanced placement courses and standardized test prep.
