welcome back. we are tracking breaking news in san jose. firefighters fighting a strip mall fire at south white and story road. you can see crews are still out there putting out a lot of water on to this fire. this is an abandoned o'reilly auto parts store. our reporter, matt keller, is on the scene and he first arrived there an hour ago, he said part of the buildinged and luckily nobody was injured in this. we are tracking police activity in an east bay neighborhood

right now, and abc7 news reporter, amy hollyfield, is out there live on the scene to let us know what is happening out there. amy? >> reporter: hi, good morning, jessica. yeah, we can hear the officers making announcements on their loud speaker, telling the man and woman inside this home who are barricaded inside they need to come to the front door with their hands up and they need to surrender, and they made the announcement several times. we have seen no movement here. the sheriff's department has evacuated the homes next to the house here in question. this is on nottingham drive in elsa braun tay. they also told the other residents to shelter in place and pushed us back to the end of the block, so we are a ways back at archery way. they say it started with two neighbors got into an argument and one neighbor started shooting, and he hit a car with some of the bullets but no people, everybody is okay.

a san francisco family wants your help solving this issue. raw tonya kim posted a missing person flyer for her husband who disappeared on mother's day. >> the kids miss him so badly and they call out for his name and call his phone and ask when is daddy coming phone. >> the gps is not working. uber commented saying they don't believe he went missing while on the job and they are working with the police on the investigation and urge anybody with information to call police. cisco is laying off 1,100 more workers as it faces declining revenue. the internet gear maker

supported revenue. cisco says it expect its revenue to climb four to 6% in the next quarter. and then the new smart train schedule has gaps in some of the schedules. and that some say the gaps will discourage people from using the train instead of their car. a launch date will be announced at smarts june 7th rail meeting. we're getting more details about cal train's proposed price increases. they had a public meeting last night. cal train says more money is needed to keep their trains running along the peninsula. proposed changes include increasing parking fees by 50%, and that would be now $80. and monthly pass prices would increase between 13 and 23%, and

each zone fare would go up by 25 cents, and the discounted a ride ticket would no longer exist. another public meeting will be held in july and a final decision expected in august, and changes if approved will take affect in october. can you vote on the new train design. you have until tomorrow to choose one of the four options. they say rider feedback is one of the factors they will consider when choosing a new look. we have a link onning abc7news.com. and then some get paid because of a tech problem, and other to payments to affected drivers will be applied today. >> you know, they say it's 5:00 somewhere, and i don't think they mean 5:15 in the morning, but let's talk about happy hour anyways. somebody decided they needed

clear the next few nights, and maybe open the windows and get some of the cool air in before the hot weekend. here's a pattern. well up to the north, look at the lack of clouds. that's the building warmth over the top of us. in fact it's going to feel great in san francisco today from 63, and then daly city, 69 in the mission, and then south san francisco to 69. in the east bay, still come for pbl with temperatures hanging around 72 to 76 degrees and oakland at 74. head down to the south bay just the beginning today as we get to 80 in los gatos, and gilroy at 81 and everybody else in the upper 70s. concord, 82. pittsburgh, 82. for in fairfield. the pool is looking more inviting, isn't it? look at the spread to pacifica, 62 degrees. the north bay will be soaking in sunshine and temperatures from vallejo, 79 to san rafael,

novato at 80. upper 40s to mid-50s tonight, and then the first 90s arrive tomorrow and hang around until monday. i gave you the all clear just a few minutes ago on east bay 580 and we have a new problem in the same location, and maybe seeing a tiny red filling in east bay 580 before grant line road, and so there's a second crash in the left lane and fire and ambulance on the way to the scene so it sounds more serious, and then the typical delays, westbound into tracy this morning. if you are coming from the east bay, we have one crash blocking one lane. we will keep an eye on that. overall things are good. neck traffic update coming up

just before 6:30. air quality officials say the chevron refinery is to blame for the rotten egg smell. a flaring incident led to the foul order. they charged chevron with four violations. chevron denies it was responsible. given the 11-mile distance and the wide gee august reof the odor complaints we believe it's unlikely the flaring was the source of the odors. and many children and pregnant mothers may have to be retested for lead. the test may have given false low readings. you are looking at company video right here. they are used in most offices. any adult or child who had blood drawn for a lead test since

number one, breaking news in the east bay. a s.w.a.t. standoff happening now, and it started as an argument between two neighbors and one started shooting. he ran inside and is refusing to come out. a fire at a strip mall at south white and story road and we just got word it's knocked down. it's an abandoned o'reilly auto parts store. and robert mueller has been appointed as special counsel to investigate the middling in the russian investigation. number four, all eyes on the stock market when it opens in an hour, and investors are rattled, and the market closing 373 points down, the worst day since the president took office.

the live desk in contra costa county. s.w.a.t. negotiators negotiating this minute after a fight between him and his neighbor led to him opening fire. the man has a woman inside the house, and that person is with him and they are refusing to come out of the house. abc7 news reporter, amy hollyfield, is monitoring the situation and is live and we will have a live report from her in a few minutes. we are also following breaking news in the south bay. there's a strip mall fire in san jose that we have been watching all morning long, and matt keller is live on the scene with us there.

>> reporter: i want to show you something now. you can see firefighters are still spraying water on to the building here, and even though they are in full control and knocked down the fire in the past 20 minutes or so. what they are trying to do with the water is not put out the flames but knock down the awning. they call it a widow maker, and that's when there's a damaged piece of structure that can call on a firefighter down below, they they want to make sure they stay clear of that and knock it down so they don't have issues with it later on today. and this is video from earlier this morning, and you can see the flames that took place here at the o'reilly auto parts store on south white road and story road in san jose. firefighters had a real fight on their hands and two hours they were battling the fire before they were able to knock it down and get control of the flames. they were out here all morning long spraying water from above,

and fighting this defensively. a security guard spotted it at 3:00 this morning and they are the ones that called it in to 911 and got firefighters out here on the scene. the biggest concern is making sure this doesn't collapse down. they want to have it all secure and will put a fence around it as well, and south white road is closed right now, so if you are coming in this area, be aware you will not be able to get through on that part of the south white road here at story road. reporting live in san jose, matt keller, abc7 news. >> thank you for the update. we will get to the weather now with meteorologist, mike nicco. >> i am tracking fog forming along the peninsula coast and ceiling down to 800 feet so watch out if you are traveling through that area. it's going to be hard to see very far in front of you for the next couple hours. for the rest of us, look how quiet is it for us. and this morning, our coolest morning this week.

59 to 74 at noon, and total sunshine at 4:00. and 58 at the coast to inland, and cool to come for this evening. and looks like it's in the clearing stages, so the westbound off-ramp to 580, all of those headed to the bay bridge, it looked like it was clearing from the chp board there so hopefully that means it's an all clear, and we have a backup to telegraph, and so keep an eye on that. and here's a quick check of the richmond side of the richmond san rafael bridge, and everybody else looking good at this point. 5:32 now. lawmakers on both sides of the i will are praising the justice department's decision to appoint mueller to investigate the

russian collusion. mueller will have all the authority of a u.s. attorney, including the ability to take the matter before a grand jury and to issue subpoenas. oversight committee says mueller is a great selection but feels the investigation is premature. >> i don't know a special counsel is warranted at this point, and the career officials at the fbi are true professionals and they have done a great job and they should be allowed to do that job. >> trump is calling the russia investigation a total hoax and taxpayer funded charade. and working as a litigator out of law school and then his career took him to various u.s. attorney offices including the one in san francisco where he became chief of the criminal division. he left the bay area in 1982 and came back in '98 as the district

attorney for northern california, and he resigned as soon as he was appointed special counsel yesterday. he has 60 days to put together the resources he will need to conduct the investigation. and we sent out a push alert about the appointment yesterday. we have new details in the sierra lamar murder trial. there's new information that could spare their client from the death penalty. the "mercury news" learned the lead detective in the case found to have given false information in another murder trial. this new development as lamar's parents are set to testify today in the penalty phase. yesterday we heard from lamar's

sister on what she would say if she could speak to her one more time. >> i would tell her how much i love her and how proud of was, and you know how much affect she made on everybody she met. >> two of her friends and a teacher testified on her ability to make people life and shared herself confidence with others. and then a fund uncovered in a recent audit, and president napolitano's office stashed the money in a fund. all the while pushing for a hike intuition for students. napolitano said yesterday uc was hard at work implementing the recommendations to improve her office's budget practices. parents will rally in an attempt to stop lum elementary

school from closing. other reports dispute the findings. the board is expected to vote on the closure next tuesday. if it decides to move forward with it, lum elementary will close two weeks from today on its last week of school. its last week of school. and then b.a.r.t. total darkness during a massive blackout in april and a passenger took this video. emergency lights were supposed to turn on but they didn't. a similar situation happened at the richmond station the next week when b.a.r.t.s investigated it found out emergency lighting actually doesn't work at 14 of its 46 stations. >> extremely troubling that the lights didn't come on, so we want to be transparent with the public that it's unacceptable. >> b.a.r.t.s already installed new batteries or temporarily systems in those stations until a permanent fix is possible and it's changing how and when it

now your accuweather forecast with mike nicco. >> i thought we could talk about the san mateo bridge, and mass transit, cool this morning and warm this afternoon. glaring sunshine if you are going to be on the roads. and same thing on the water today as it will be pretty smooth due to light breezes. here's a look at the golden gate bridge, and a nice day to walk across the bridge. not too breezy. the air is still relatively clear but it's going to get a little hazier as we get deeper into the heat over the weekend. tree pollen high. and burn time about 10 or 15 minutes. and temperatures up to five degrees cooler on the coolest morning we will have this week. 49 right now in san leandro. look at castro valley, 46. fremont, 48. everybody else in the low to mid-50s along the east bay shore. pleasanton, 45 along with novato and santa rosa. and here's your forecast for today. 60s along the coast in san francisco, and 70s around the

bay and 80s inland, so spring is back but the first signs of heat show up with the 90 in concord tomorrow. look at this, more 90s in the south bay, and in the east bay, saturday, and again on sunday. i hope your ac is working. i will have the accuweather 7 day forecast and when the heat breaks. we are improving in one of the hot spots. westbound 24 we had a crash on the off-ramp to westbound 580, and we did get confirmation that has cleared off to the side. we have a backup on westbound 24 from about college avenue there, so if you are coming through the rock bridge area you will hit that slow down. hopefully that cleared early enough that we will start to recover. a new problem just tr tri valley, and hit a large piece of debris and he will need a tow truck, and just a slight backup that has formed so far.

welcome back. breaking news update on the death of rocker chris cornell. detroit police saying just moments ago they think it might have been a suicide. they won't elaborate on why, they say it's based, though, on basic things observed at the scene. we learned the 52-year-old died inside his hotel room at the mgm grand detroit and his wife called a friend to check on him and the friend found him on the bathroom floor. and he was one of the founding fathers of the '90s grunge movement. plans to ban anything bigger than a cell phone on flights to

europe are grounded for now. they are leaving the door open for future discussions. talks about a possible ban began after intel suggested isis could hide bombs in laptops. developing news in tulsa, oklahoma. a jury has acquitted a white police officer in the fatal shooting of an unarmed black man. the officer was found not guilty of first degree man slighter in the shooting death in september. the trial centered around whether the officer was justified in using deadly force against the man who was unarmed or if she act irrationally out of fear. she said she thought he was reaching inside of his stalled suv for a gun and there was no gun in the vehicle and he did not have one on him. and then everything should be back to normal today after a

computer outage that kept dmv's from registering vehicles driver's license. >> we have been standing in line and a lot of people left angry, about three hours they said they waited. we have been waiting for about 45 minutes. >> normally the line is around the block and you come to dmv and you expect to wait at least a couple hours. >> the computers came back slowly and they are trying to determine what caused the initial outage. and then take a look at these surveillance photos from april 21st. they show the suspect walking into the cvs, and shortly after officials say they pointed a gun at an employee and that employee yelled for help and that is when the suspect took off. call oakland police if you have tips that might help them catch

this guy. air quality officials say the chevron refinery in richmond is to blame for the mysterious rotten egg smell that swept across the bay area. they have charged chevron with four violations, and at first investigations did not know if the smell was coming from the refinery or nearby landfills. the company says given the 11-mile distance and the wide geauography of the complaints, believe the refinery is unlikely of the source. and then impending layoffs for the first time in its 165 year history. there's a projected deficit. it's the only women's college. the president of the college warns mills is not generating enough revenue to support itself. the emergency declaration will

let mills reconstruct it's expenses and move ahead with the layoffs. and water will stop flowing tomorrow, and crews drained the dam to make room for nearby melting snow packs, and a contingency plan is in place to use the spillway if needed. the department of resources will work full time to fill the massive sinkhole that formed in february. and then google opened some eyes and augmented reality was one of the main themes of the event. and ar will enable indoor location like gms inside a store. google ceo unveiled something called google lens. >> you point your phone at it and we can tell you what flower it is, and it's great for somebody like me with allergies. >> also announced google photos will recognize your friends and ask if you want to send them a

we do have breaking news here because we learned this morning that fox news founder and former ceo roger ailes has died. >> we will head out to cecilia for the latest on the passing of roger ailes. he passed away at the age of 77, and this is according to fox news. >> the details are just coming in. in fact we don't have very many of them, and we know roger ailes passed away. a huge figure in media in this country and in american politics, and somebody who has a close working relationship with this president. so far no word or reaction from the white house. this is a white house consumed with problems with the news of special counsel hanging over their head right now. but roger ailes has died and details are just now coming in. right now no word from the white house, amy.

let's go to george stephanopoulos. >> this is really shocking, george. >> yeah, he had been battling various illnesses for sometime. you can't underestimate the imprint he made on public and american politics. his time in politics goes back to the days of richard nixon, and he was responsible for the comeback of richard nixon in 1968 when he was the producer of the "mike douglas show." and remember, nixon had been out of politics and lost the race to kennedy in 1960, and he helped engineer the comeback for these men in the arena town meetings, and he put richard nixon back on the maps. he played a big role in the

mourn his death we celebrate his life. and with all that he has gone through in recent months, how do you believe he will be best remembered? >> a good question. he did make a big stamp on politics and broadcasting, and he left fox news under the crowd of sexual harassment, and he was forced out of fox news and that's a big part of his legacy, and he did not leave fox news the way he wanted to leave. >> speaking to that, george, you mentioned he had many physical health ailments, but one has to wonder what the stress of all of that scandal had on his health. the impact that may have had on his condition. >> no question. this is a tumultuous time at fox news and the entire network has been ruffled by this, and he was at the center and he did so much
