now from abc 7, live breaking news. new york city time square, swarming the aftermath of a horrifying crash this morning. the car that you see there plowed into crowds of people about two hours ago. >> all right. now earlier video. here you see smoke coming from the car after the accident. we have information now, one young woman, 18 years old, killed, 22 others injured including her sister. witnesses say the driver drove the wrong way for three blocks hitting people along the way until finally crashing into the pole there at west 45th street. police arrested the driver, 26-year-old richard rojas from

the bronx saying arrests and ted now for alcohol and drugs. the mayor and police commissioner wrapped up a news conference. >> based on the information we have at this moment, there is no indication that this was an act of terrorism. >> the city is still stepping up its key locations. >> thank you for joining us. turning to the top local news. huge flames in a major fire fight in san jose this morning. an auto parts store damaged by flames for the second time in less than a year. matt keller is now live from the scene on south white road, >> there's a fence around the building, concerned about the roof, not wanting anyone to get close in case it comes down. this is another fire dealing a blow to the o'reilly auto parts store. the smoke from the two-alarm fire could be seen for miles in san jose.

when my photographer, ian, and drove off story road, a part of the building collapsed. >> did you see that? >> what was that? >> it was the building. just, like, exploded. just went down. >> collapsed. >> collapsed. >> reporter: firefighters got the all at 3:02 a.m. when they arrived, the flames were huge. firefighters made sure no one was inside, and backed off, and started spraying water from high atop three ladder trucks. going inside, too dangerous. that overhang always collapses when exposed to fire. see behind you? collapsed on the charlie's side here, the backside of the structure. >> reporter: this is an o'reilly's store, sitting empty since a four-alarm fire last june. no word on what started that fire. this morning, homeless were recorded sleeping near the building, but they are still looking for the cause. >> glad to see there was nothing inside. if it were a functional

business, that's high hazardous risk, chemicals, fire load, would have been much more concerning. >> reporter: i spoke with an o'reilly auto parts representative who told me they were still planning on opening up this store, but with this latest fire, that's now up in the air. reporting live in san jose, matt keller, abc 7 news. >> matt, thank you. new developments in the likely nuero virus in san jose schools, 368 cases of stomach viruses reported at 14 schools since may 4th, up from the 240 cases we knew about yesterday, but the school district says since it's a 24-48 hour bug, many of the kids who have been sick are now healthy and back in school. crews are still sanitizing the affected campus. no teachers or staff reported coming down with the virus. new details in the murder trial of a morgan hill teenager. sierra lamar's parents testify

in the penalty phase of the fan convicted of murdering their daughter. we are live inside the courtroom tweeting. sierra's mom, marlene, is sobbing telling the jury, she misses her daughter's dancing, passion, and love for others. this comes as a new revelation surfaces impacting the fate of torres. the mercury news learned the lead detective in the lamar case gave false testimony in another murder trial. defense attorneys for garcia hope to use this to dpis credit the testimony and prompt the jury to spare their client from the death penalty. developing news where amtrack is investigating how a person was hit and killed by a train. the collision at 6:00 a.m. along the tracks on railroad avenue. the train is an eastbound capital corridor train running from oakland jack london square to sacramento.

investigators have not released the victim's name. 57 people on board the train at the time were not hurt. new this morning in the east bay, a swat standoff in a home has come to a peaceful end, and abc 7 news was there when deputies took the suspect into custody. you'll see in a moment, there's a message for the camera there. this is on noddingham near robin hood drive. investigators have been to the home several times before for disturbances and drug-related issues. this time, an argument between two neighbors saying the suspect pulled out a gun and started shooting. no one got hit. the next door neighbor heard it happen around midnight. >> came out, fired his gun, broke a window of the house, and that was it. sheriffs came, and pretty much they took over from there. >> luis and small children were evacuated. we met with them as they were allowed back into the home. they say it was a very long night. zblmplgtsz new details where the

coroner identified the victims of a suspected murder-suicide. 84-year-old michael deval and 79-year-old discovered by family members inside a home yesterday morning. investigators say the married couple sustained gunshot wounds, and there's no evidence suggesting anyone else was involved in the shooting. new developments, parents are rallying this morning to save their elementary school. the school district says lum elementary has to close because it's not safe in an earthquake, but as abc 7 news reporter amy hollyfield tell us, parents have their own solution. >> reporter: they've got passion. pint-sized protesters and posters. kindergartner treasurer thompson was proud of hers. >> i love lum. i --

[ inaudible ] >> we can rush into the building the way to make as structurally sound, and matter of the compaction. >> reporter: they ran the idea by hired experts and got a different opinion. >> we can ask architects working in the skill for decades and asked structural engineers if it's possible. they said it might be possible, but it would be very, very expensive and would be a two-three year project, and not necessarily an eight-month project. >> reporter: the district says the school needs to be shut down, based on several opinions, including three soil engineers who agree there is is high risk here of liquidfaction. there's another opinion from a structural engineer today.

apointing a special counsel to investigation possible collusion with the trump campaign,ying in part, a special counsel is necessary in order for the american people to have full confidence in the outcome. rosenstein emphasized no determination any crime was committed or prosecution was warranted, but trump lashed out over the decision tweeting the investigation is the single greatest witch hunt of a politician in american history. the move already garnering support across the aisle. >> i now have significantly greater confidence that the investigation will follow the facts, wherever they lead. >> this takes the politics out of it, hopefully. this has gotten too political. >> reporter: the man leading this new investigation, boll mueller, former fbi director, a unique figure in washington. last confirmed by the senate, 100-0, prestigious ten year appointment extended for another two years. >> he has the expertise and experience and the guts and

sun. we were in the 40s this morning. some of us will rebound into the 80s this afternoon. let's look at my accuweather highlights to see that warming from the sunshine. our nights, though, good news, clear and comfortable to open the windows, and the weekend is hot. not even the hottest yet. some people asked when it breaks, and it's wednesday. 60s and 70s other than the coast, 57 there at half moon bay. look at this, light, variable winds everywhere. the wind fastest in fairfield is a land breeze. it's not from the cold ocean. it's over the warmer land, and that's why we're going to warm up significantly today. in fact, feels good downtown san francisco, 69, same thing in the mission, and also in south san francisco, sunset a little bit cooler at 64. still comfortable over on the east bay, 7 had 4 in oakland, and hayward at 75. down to the south bay where it's just the beginning. today, 79 in san jose. get to 80 in los gatos.
