>> it's very complex, it's very disturbing. just in watching the videos, i just tell you it was very disturbing. i have not necessarily seen a case like this in my career. >> reporter: police provided this booking photo of 29-year-old emily stephens as one of the three suspects charged with lewd acts with a child under 14 and other specific acts with a child under 10. investigators won't say how she knew dr. james kohut from santa cruz and michelle brandon from watsonville also charged in the case. >> based on the evidence at this time, we believe that these individuals were working together and we also believe that we have all the suspects associated to this particular case in custody at this time. >> reporter: police tell us the victims ranged in age from 3 to 13 years old. all are now in protective custody. kohut and brandon worked at dominican hospital in santa cruz. on brandon's facebook page she

wrote, i'm a mom and a nurse. love my friends and family. her neighbors are shaken. >> everybody in the neighborhood is just in shock and scared for their own children. and, yeah, we're just horrified. >> reporter: police are still investigating and are working with the fbi because they say the crimes committed did cross state lines. detectives are asking anyone who may be a witness or a victim in this case to please come forward. in watsonville, jeannine de la vega, abc7 news. >> a man is now in custody after a five-hour standoff with contra costa county s.w.a.t. team. they say the incident began as an argument between mckay and a neighbor on knotting ham drive. the suspect pulled out a gun and started shooting. no one was hurt, but others were evacuated and others told to stay in their home. >> illegally cutting down trees in a national forest, ph icap

aal virginia are accused of downing 32 trees during a pledge initiation in april and national forest. 300 miles north of san francisco, the fraternity also faces a charge of possessing a firearm because a witness heard gun fire at the campground. he has denied the charges. >> university of california's office of the president, the state auditor said there was nothing criminal about how janet napolitano handled the seth curry plus. lyanne melendez explains the recommendation. >> reporter: that's what the state auditor said she got while trying to get to the bottom of her investigation into a $175 million surplus which was never disclosed by janet napolitano's office. surprising elaine howell said, because she was later given memos that showed president napolitano was being fiscally responsible. >> we were surprised when we saw

some of the evidence, why were you essentially precluding us for such a long time and getting access to this information. so, i will be quite honest, it was very frustrating. >> reporter: the state auditor said the 175 million consisted of reserves and discretionary funds, nothing was done illegally, but criticized the lack of transparency. >> but certainly there was a failure to disclose to the board and to the public this additional money or this left-over money at the end of the year and how those funds would be used in the future. >> reporter: the auditor also questioned some of the expenses made by napolitano's office which should have shown more prudency. >> if you ended up spending $350 for a hotel, what due diligence did you exercise to try to stay within the federal limit or the state limit? >> reporter: the auditor has given central administrators 33 recommendation reforms. napolitano vows to comply and do better. >> an opportunity for us to streamline, to clarify, to be best in class.

look at the weekend, hot inland with highs in the mid 90s, i'm give you a closer look at your specific communities a little bit later. alma? >> all right, thank you, spencer. the damaged main spillway of oroville dam will soon get some much needed repairs. the state plans to shut down the spillway tomorrow to start on the $275 million rebuilding project. it hopes to finish by the time the next rainy season starts. parts of the spillway began crumbling and washing away back in february. nearly 200,000 people were evacuated when the dam's emergency spillway also began giving way. they were allowed to return two days later. >> huge flames, a major fire fight in san jose. an auto parts store damaged by flames for the second time in less than a year. abc7 news reporter matt keller has the details on a possible cause. >> reporter: the smoke from this 2-alarm fire could be seen from miles in san jose. when my photographer and i drove up to south white road off story road, a part of the building collapsed. >> you see that?

fire that is now up in the air. in san jose, matt keller, abc7 news. >> the pittsburgh man accused of torching several cars in contra costa county made his first appearance before a judge today. james bishop's bail is now set at $1.5 million. investigators say he may have set more than 30 fires. today prosecutors charged bishop with 12 car fires, two involving an inhabited dwelling. bishop was a est ared in benicia late last weelk near a car fire that had just been set e. >> there are now concerns about a potential norovirus outbreak in skrouz county. 28 children and staff got sick at a camp in bolder creek. this comes as more krass are being reported in san jose where cleaning crews continue to sanitize schools, at least 368 students at 14 san jose schools have gotten sick.

information, an opinion from a berkeley engineer that lum elementary school in alameda could be saved. proposal from smith engineering said it could be installed quickly and affordably to protect the school in the event of an earthquake. >> we can retrofit this building the way to make it structurally sound. >> reporter: district officials say they ran this new idea by their hired expert and got a different opinion. >> we did ask architects who have been working in the field for decades and we asked our structural engineer if it would be possible. they said it might be possible, but it would be very, very expensive and that it actually would be a two to three-year project and not necessarily an eight-month project. >> reporter: the district says the school needs to be shut down based on several opinions, including three soil engineers who agree there is a high risk hereof lick which faction. the district is getting a second opinion from a structural engineer today and will post it on its website. all of these reports and opinions will be presented to

the board on tuesday which will take a vote on whether to shut down lum elementary. in alameda amy holly field, abc7 news. >> san francisco officials have reached a deal with developers to build more affordable housing units. supervisor jane kim celebrated the agreement by cutting a symbolic piece of the pyatt a community meeting in the miss district. the pact calls on developers to reserve 18% of rental units for low to middle income families. developers were forced into negotiations after voters approved a higher number, 25% last june. that percentage will remain for neighborhoods impacted by gentrification. >> we are able to keep the mission as well as parts of the tenderloin and south of market at the higher rate of 25% as we pass proposition t. >> the city negotiated the change after a study looked into the feasibility of the higher requirements. >> more reaction today to the death of a former chairman of fox news, roger ailes.

clear skies, it will be seasonally cool up in the north bay with lows in the mid to upper 40s in santa rosa and napa. it is going to be mild just about everywhere else with overnight lows in the low to mid 50s near the bay and in the inland east bay, tomorrow under sunny skies look for mild conditions at the coast with highs there in the mid to upper 60s. we'll see low to mid-'80s around the bay and highs up around 90 degrees in most of our inland valleys. and as we look beyond tomorrow and get even hotter, saturday look for inland highs climbing into the low to mid 90s. it will be just as warm on sunday. a little change, especially inland where we'll see low to mid 90s once again. and on monday the heat holds on in our inland areas, but is it starts to cool down just a little bit near the bay where highs will have been in the 80s over the weekend. we'll see 70s on monday and on the coast it will start to drop back into the 60s. and we have beta breakers on sunday. looks like great running weather early in the morning at least. sunny skies all day long. in the early morning hours on sunday we'll see temperatures here in san francisco in the mid to upper 50s. starts to get a little bit

new york. >> 34-year-old brandon is facing charges including causing a catastrophe and involuntary manslaughter. eight people were killed in may of 2015 when the train accelerated to 106 miles per hour on a 50 mile per hour curve and derailed. philadelphia prosecutors decided not to charge him. but a judge acting on a private criminal complaint from the family of one of the victims ordered charges filed. amtrak is investigating how a person got hit and killed by a train this morning in sunol. the collision happened around 6:00 a.m. along the tracks near tenet and railroad avenues. the train is an eastbound traffic corridor train that runs to sacramento. police haven't released the victim's name. >> at least three tornadoes touched down in oklahoma and texas. fortunately no injuries reported. watches and warnings have been issued for several parts of the states. there is a risk of more storms throughout the night. the midwest is really been dealing with severe weather most of the week.

bloom explains why the billionaire held what he called a press conference on the move. >> reporter: when the british billionaire does jumping jacks in a busy park at lunchtime, it's sure to draw a crowd. though sir richard branson no longer owns an airline based here, he still loves the bay. >> san francisco has been synonymous with the virgin brand. i think people from san francisco love the virgin brand. >> reporter: so when the nike women's half marathon announced it was leaving san francisco, virgin decided to step in. >> and we decided that you americans are quite people so we experimented on the brits first which we did a couple weeks ago in london. >> reporter: the experiment was called virgin sports. now it is coming here the weekend of october 13th. there will be a half marathon, but there will be lots more. >> it's fun and that's our

every year, but we've had an outbreak in northern california. martin galindo is not an isolated case and they all appear to have come from here, the gas station in walnut grove. as of this morning, the salk sa sacramento county health department confirmed five cases three possibles and one suspected, a total of 9 so far, all from tainted nacho cheese sauce served inside from april 22 and may 5. >> i had never seen my sister not have function of her body or be able to communicate. and i've never seen my sister on tubes or anything like that. >> reporter: that's theresa kelly describing her 33-year-old sister lavinia who has spent three weeks in a sacramento intensive care ward. her symptoms began with slurred speech. >> is she saying -- basically she's saying, sister i need you here now. i need you here now.

>> reporter: she is a mother of three. she had been preparing for a wedding. her family told us today while she remains aware, her motor skills are so far gone that she cannot even open her eyes. >> back live outside california pacific medical center, botulism is caused by a toxin found in bacterial spores usually in food. besides the slurred speech, early symptoms include diarrhea and vomiting, dry mouth, double or blurred vision, muscle weakness. as it progresses, victims may not be able to move their arms or legs or even breathe. in the worst cases, they go on a respirator. so, if you had some of that nacho s nacho sauce from the gas station in the sacramento area and experiencing any of those symptoms, see a doctor. live in san francisco, wayne freed nan, abc7 news. >> very scary. wayne, thank you. more fall out from the volkswagen emission scandal a. >> 7 on your side michael finney says there is a new settlement that will actually be a waned fall for the state.

michael. >> the second settlement. when have you heard of anything like that? second settlement between volkswagen and the state has just been announced. latest settlement calls for volkswagen to pay the state $66 million to help reduce pollution. now, that money is on top of $1 billion vw previously agreed to pay california as part of a federal settlement. vw was found guilty of rigging its software to make vehicle emissions look cleaner than they actually were. pier 1 imports is recalling thousands of coffee mugs because if you put coffee in them, they might break. the recall affects 15,000 of these chalk mugs. they get their name because you can draw on them with chalk. however, you actually pour a hot drink into the mug, it might drink and burn. pier 1 has eight reports of cracked mugs. no reports of injuries, thank goodness. you should return the mug to the store for a full refund, or just stick to drawing on it. wal-mart is known for low prices. as soon as grocery prices may

it is tgi tea night on abc7. we started at k89 with a season finale of gray's anatomy. scandal and then stay with us for abc7 news at 11:00. >> tonight on the abc7 news at 11:00, two men with an incredible connection. they jumped off the golden gate bridge and survived. both men say that the moment their fingers left the railing, they felt instant regret. the story of mistakes, survival and second chances. that's tonight at 11:00 on abc7 news. >> now, this weekend will mark the 73rd anniversary of one of the deadly est accidents in the pacific during world war ii. this is an incident that the navy actually covered up for 18 years. >> abc7 news anchor eric thomas talked with a concord man who survived what some historians call the second pearl harbor.

>> it never really occurred to me that i could have got killed. >> reporter: 91-year-old rod was an 18-year-old sailor in may of 1934, three years after the japanese attack. he was moving bullets and bombs among hundreds of ships getting ready for the invasion of saipan. he saw flames on one ship, then a huge explosion launched tons of metal into the air. >> i looked at it thinking, wow, that is really something to see. this is something to remember. and then it occurred to me that what goes up comes down. >> reporter: that's when rod made a run for it, dodging white hot debris. >> finally, stuff started to hit and i went down and curled up. >> reporter: in the fetal position, debris missing him by inches, finally he got up and ran for a bomb shelter just in time to see a fellow sailor killed by white hot metal. but rod made it to safety. others weren't so lucky. the fires burned 24 hours, six ships blew up. at least 163 sailors and marines

died in the blast or fighting the fires. ironically just weeks after rod survived the incident, something similar happened near his hometown of pittsburgh when two ammunition ships blew up here at the port chicago naval station. the navy kept the west lock incident classified until 1962. rod didn't even know how many men died until a few years ago. but he's lived his life to the fullest. married 71 years, a 28 year veteran of the highway patrol. a retiree who loves operating his own home-built train, and, yes, he would do it all again. >> i was just a young kid and it was all exciting. >> reporter: in concord, eric thomas, abc7 news. >> and one final note about rod. after the incident, he became a navy photographic technician, part of the team that developed this iconic photo of marines raising the u.s. flag during the invasion of okinawa. >> remarkable story. >> yeah. >> thanks for joining us for abc7 news at 4:00. i'm larry beil.
