what company made a nacho cheese dip that could be to blame for a botulism outbreak and one man has died. the cheese was purchased at a gas station just south of sacramento, 10 people have been hospitalized and one has died. gehl foods says it's foods remain clear for any c contaminati contamination. the trial involving three san jose prison guards. closing arguments began today. >> reporter: all three jail guards are free on bail right now, but their days may be numbered. today the deputy district attorney reminded the jury of all the evidence that he says points to murder. >> the deputy da told the jury

it doesn't matter what one of these jail guards struck michael tyree. he just has to prove that one of the guards physically assaulted tyree that led to his death. >> this is a very disturbing case that this happened at all. and it makes me wonder how much more it happens in other jails throughout the state. >> reporter: the prosecutor pointed to evidence the morning after tyree's death. rodriguez did google searches can you die if someone punches you in the armpit, can you die if someone punches you in the ribs. there was testimony from inmates in the same jail pod saying they heard screaming and thuds. >> to establish the sort of setting for everything. >> reporter: the prosecution also reminded jurors of text

fatal accident. san rafael police hope you can find a suspect who showed up in a woman's bedroom. she told police a man who looks like this step showed up at the foot of her bed and shined a light in her eyes. this happened on may 10, in san rafael area. meanwhile san leandro police, are looking for a suspect who robbed a sam's superburger and shot an employee overnight. melanie woodruff shows us surveillance video could help investigators. >> san leandro police say that the many cameras around the superburger can help identify the man who robbed

cherry wood avenue. >> this lays is open until like 3:00 in the morning and we hear about it getting robbed occasionally and it's usually at night. >> reporter: employees at a paint shop next door to sam's -- an employee says surveillance cameras captured the suspect headed down this alley. >> the suspect is described as a black man in his 20s, thin build, 5'6", to 5'8" wearing a ski mask, he was wearing a black hoodie, blue jeans and white tennis shoes. >> reporter: police could not say whether this hole at sam's was from the overnight robbery. police say he was one of two employees at the business when the robbery and shooting occurred.

a student has been arrested accused of making a threat at saratoga high school. they told a teacher who contacted the administration immediately. police arrested the student yesterday and haven't stayed whether they'll pursue charges. female students are trying to rewrite the sexual harassment policy at oakland schools based on their own personal experiences. oakland unified could adopt a new sexual harassment policy as a result. >> the things that i was going through is still happening in school. it really resonated with me, when is change actually going to come and what does it take to get that change? >> one yr major change is getting rid of language that indicates the victim will be penalized as a result of the incident. the new policy will go before

this fire on lakeside drive. the building is now con democrated. it housed at least nine businesses, including a hair and nail salon, a computer repair shop. police are looking for the cause, but they don't believe it's suspicious. we have a sad update on a missing santa rosa woman. the santa rosa sheriff said they located the body of catherine hubba hubbardy, the body was found 150 feet down a steep ravine, she may have slipped and fallen. now that the drought is over--in a weird mailing error could end up costing customers even more, abc7 news reporter

laura anthony is in lafayette. >> they want to raise rates so they can pay for projects like this one, but they have to give their customers notice. those notices didn't get mailed out properly the first time, so the district has to do it all over again. a mistake may add insult to injury to east bay mud company already facing the prospect of higher water rates. >> there was a delay in the mailing notice that went out to all of our customers. we think we missed approximately 15,000 to 20,000 customers. >> reporter: that means in addition to this full color mailer, many of mud's 85,000 account holders will also receive this black and white version. >> that's a costly >> irtt's $120,000 we estimate.

about eliminating bus routes. most busses carry 19 riders on average. route 11 runs in daly route 43 connects mills high with b.a.r.t. all these rules only operate on school days, the transit board will vote next month, if approved, the routes will be eliminated in august. volunteers pitched in to help a homeless center in oak land. this is part of national painting week. sherwin williams set up more than 200 projects nationwide, they covered supplies and time. volunteers said it's important that the space is comfortable and lively for the underserved people who use it to study or search for jobs. new numbers show signs of a shift in bay area real estate sales. the u.s. commerce department reports new home sales in the west fell 26% last month.

so it looks like a great day for graduation. here's a look at live doppler 7 greeting you right now, and we have got mostly sunny skies still over our inland areas, but the fog is slowly advancing over the coastline, out over the bay and inland, and that will be the pattern overnight. it is 12 degrees cooler tonight in santa rosa than it was this time yesterday. and 8 degrees cooler in hayward. so all across the area, it has cooled off substantially from just a few hours ago. here's the fog coming out over san francisco. in oakland, it's 62, 67 degrees in mountain view, san jose 63. 68 in gill roy. this is a view from emeryville with the fog rolling in.

and one more view of bluer skies from our rooftop camera here at abc7, and these are our forecast features, we'll see foggy areas overnight. the fog is advancing already as you can tell, cooler days through friday, and milder weather. here's the fog cast, overnight the fog will extend inland, much as it did last night, then in the early morning hours, we'll see the fog pulling back to the coastline, and in the afternoon, it will be much like today, only a little bit cooler. sunny skies over the bay and fog lingering at the coast. lows tonight will be generally in the low to mid 50s, but along the coast and in some north bay valley locations, we'll see lows dropping into the upper 40s, and tomorrow's highs will be in the upper 50s along the coast, to low 60s and upper 60s

so on we go to the accuweather 7-day forecast, cooling has begun already, we'll continue tomorrow, we'll see increasing clouds on thursday, friday will be the coolest day in the forecast period, we'll see temperatures gradually climbing back up the scale on sunday, and on monday, we'll see inland highs in the mid 80s, mid 70s in the bay, 60s along the coast. lovely holiday weekend coming up. as you just mentioned, weather is going to be great for memorial day weekend, but it's the weather that came befo [ inhales, exhales ]

trans just sent us. the collapsed hillside is right here, look at that, incredible, right? and splitting the highway in two sections right there. cal trans expects the repair will take months if not longer. >> it should not be as complicated as if the roadway is missing, which we think might be the case. >> reporter: for now the 50 miles of highway 1 is pretty much off limits, it begins at big sur and ends at ragged point south of this past weekend's slide. i'm going to show you how dramatically this changed the coast line. this is the before picture, now see that skirt there protruding from the coastline, that was not there before and it's all due to this past weekend's slide. the seasonal danger is over.

get some great deals on wine at local grocery and big box stores. to help you decide what to buy, often there will be shelf labels to help you decide what to buy with numbers from 1 to 100. >> if i read the tag and that made he buy the wine, i wouldn't remember what it said to up. >> reporter: the chairman and ceo of the wine school says he checks the labels for different reasons. >> you see them more often and you see more inaccuracy in them in grocery stores and big box wine retailers. >> reporter: a recent lawsuit claims wine labels were used to trick consumers into buying less desirable bottles. we spot checked and found no large shelf labels describing

the wine, we did see price labels that often this tiny print, the vintage indicated may not be available, check the bottle for vintage. both safeway and lucky did have the traditional labels, we also discovered the wine situated right next to the label was not always as described. often at these stories we saw the same winemakers but with a different vintage year, does that matter? our wine expert says not usually with local wines. >> california, yes we have differences, but it is a much more subtle difference from year to year. >> that's because is climate here is more consistent. but he says, that's not the case in other regions. >> yes, a classic example is champagne, it's the coldest, wettest fine wine region of france and the vintages vary greatly, not just the quality, but the style of the wine.

>> reporter: in our spot check of one safeway store, we counted 47 wines with a shelf label that described a different vintage than what was actually on the shelf. that's out of 88 ratings, so more than half were wrong. here we see a shelf label describing a 2009 merlot, it received 87 points from wine enthusiasts. but on the shelf next to the label was a 2014 vintage, that received 84 points from the wine enthusiasts. we also found a 2010 head snapper from argentina, that scored 87 points from wine enthusiasts, but on the shelf there was this 2013 vintage. they rated two different years of this wine,

safeway says they update their shelf tags every 60 days, in this particular case, the supplier indicated that headsnapper malbec 2010 was rated 87 points by wine enthusiasts, new labels are being made for these labels. lucky stated vintage indicated may not be available. after our inquiry, lucky said we are reviewing the program with our vendors to have it corrected or discontinued. >> we made contact with the company and it told us disclaimers on the shelves were in place before the lawsuit was filed and their said we can't comment on any pending litigation, except to note that although the matter has not been fully ajude dated, the court has dismissed portions of the claims. >> you got to match the bottle with the label and make sure they're the same. >> pick up the bottle and make sure it matches. coming up next, a look at

family friends and fans are mourning the loss of legendary james bond actor sir roger moore, moore died in switzerland after a short bout with cancer. he's known as the third 007 from 1973 to 1985. moore played bond in more films than any other actor, including "man with the golden gun", and "live and let die." president trump has arrived in rome for a visit with pope francis. air force one arrived from tel aviv earlier today. the president is slated to meet with the pope tomorrow at the vatican. the pair have a contentious history, the pope was critical of trump's campaign pledge to build a wall on the mexican border. and trump called the pope disgraceful. this is the third stop on the foreign trip, he heads to

we're following some breaking news that a united flight has been evacuated after some sort of energy. this new video just in to our newsroom from the tarmac of newark international airport. there's been unconfirmed reports that the plane had to make an emergencylanding after takeoff. that flight is number 1579 united 1579 scheduled to land at sfo just after midnight tonight, we have no reports of injuries. stay tuned for breaking news and we'll post updates on our abc7 news mobile app. happening now the showdown vote that could shut down a beloved elementary school in

alameda. one study said that the ground under lum elementary could shift and cause the school to collapse. many families are fighting the move, claiming the evidence isn't song enough to justify moving their children to other schools. and right now the dublin unified school district is preparing to vote on a plan to build a new high school two blocks from the santa clarita jail. the district says an elementary school .10 mile from the jail has had no issues. one of the favorites to win the indianapolis 500 grew up in the bay area. with the qualifying rounds behind him, he's back in san francisco. >> reporter: long before he was zippingaround the racetrack, he
