up late and weren't upstairs asleep yet. >> they just said, drop your guns, drop your guns three times. >> reporter: through the overnight fog, she watched from her window as south san francisco police pulled out their guns. >> he opened up his trunk. he pulls out this big rifle. then he ran back on court. and then that's when the gunshots start shooting. >> reporter: shot marks, bullet holes through walls and glass doors of neighborhood homes, all evidence of the mini rounds fired around midnight. however, police won't say if the suspect returned fire. he was holding a shotgun in the street when they arrived and that he was shot and killed after refusing to obey their commands. >> there was a lot of yelling and i heard nine gunshots. >> reporter: at the time the young man speaking who did not want to be identified didn't realize that his jeep was caught in the cross fire. bullet holes through his drunk

and rear window. >> i don't really understand why it happened in this neighborhood. this is a pretty good neighborhood. >> you could see the man, there was a lot of blood. i saw this man's head like his neck blown off. >> reporter: karen shot cell phone video of the aftermath and said she recognized the man as her neighbor, a man she and many other people in the area say was quiet and stuck to himself. in south san francisco, kate larson, abc7 news. >> developing news from pelican bay state prison near the california oregon border where shots have been fired during a fight between inmates and guards, eight prison guards and seven inmates have been hospitalized. the department of corrections says the fight involved two inmates at first then other groups of inmates joined in. the fight got so out of hand prison guards opened fire. those injured were taken to a local hospital for treatment. the injured prison guards are all expected to recover. >> now a new development today we first told you about with a push alert from the abc7 news

oroville dam. construction crews are racing to repair the structure in time for the next rainy season. they have five months to do it. workers have going from the bottom of the damaged spillway up. they expect to be able to pour fresh concrete in weeks as part of the new replacement spillway. crews face the november 1st deadline and they expect winter rain and snow to increase the flow of of water into the lake. >> speaking of the dam, president trump agreed to help fund repairs at the oracle dam. a $650 million contribution for the electrcal train. >> the governor is cautiously optimistic with the trump administration. lyanne melendez has the story. >> reporter: president trump met with the pope known as the defender of the environment. governor brown also a proponent of climate action was watching. >> don't under estimate the power of the holy father. >> reporter: the president had said he would decide if the u.s.

passengers who were evacuated from a united flight that caught fire before taking off at newark, new jersey last night finally arrived at their destination in san francisco this morning. abc7 news reporter matt keller talked to some of the passengers at sfo. >> reporter: relief at sfo baggage claim at about 4:00 this morning, passengers from united flight 1579 arrived in the bay area from newark, new jersey about four hours late. >> it was terrifying, but only for a second. >> reporter: an engine caught fire while taxiing on the tarmac before take off last night. 124 passengers were told to evacuate immediately. >> and then the flight announced everybody take off your seat belts and rush to the exit and the lights were switched off and when we reached the exits the chutes were already deployed. slid down the chute. there were fire engines and everything around. >> reporter: one passenger slid down to the tarmac, they were

taken back to the terminal. some of them shaken. five had minor injuries, including oakland resident porsche. >> i exited the back of the plane and when i was jumping off the tarp, people were piling on behind me. a gentleman landed on my leg. the stewardest said run as fast as you can away from the plane. >> reporter: paramedics asked if porsche wanted to go to the hospital to get her ankle checked out. this 234r50flight was the final stretch of her return trip from her vacation to jamaica. no way she was going to be left behind. >> no way i was going to miss the flight. >> reporter: it has since reopened. at sfo, matt keller, abc7 news. >> flights in and out of sacramento international airport are back on schedule this afternoon after a computer outage caused lengthy delays early this morning. the airport blamed a network outage for bringing down systems used by many airlines. the outage began at 4:00 this morning. agents couldn't check in

customers, issue boarding passes or issue baggage. flights were delayed or canceled as a result. >> the tsa will be testing some new airport security screening procedures later this year that it hopes will help move lines faster. abc7 news has learned they will replace large electronics including separate bins at checkpoints. it will speed things up, but apparently these items will appear similar to explosives and that requires tsa screeners to manually check each bag. these changes are not associated with the laptop ban currently in effect from some flights in the middle east. procedures will be tested at ten airports nationwide including l.a. x. these changes do not apply to passengers enrolled in the tsa's precheck program. >> a new report out today backs up investigations tesla workers were making about conditions at the fremont plant. >> abc7 news anchor kristen sze here with the response.

>> the clean car of the future, tesla workers claim they are laboring under grueling, unsafe, even illegal conditions. today the oektd-based nonprofit work safe posted this report after it was approached by the united autoworkers union. this is based on data tesla reported to the government. now the big headlines, workers there were injured at a much higher rate than the industry average. take a look in 2015, for every 8.8 workers, for every 100 tesla workers, 8.8 were injured. the industry average, only 6.7. >> tesla is about 30% higher than the industry average in terms of overall injuries, and more than double the industry average in terms of more serious injuries. >> tesla sent abc7 news a response. we have had some challenges in the past. with the changes we've made we now have the lowest injury rate

in the industry by far. abc7 news recently received an anonymous letter from someone claiming to work in the plant's stamping department. the person said tesla violated overtime and day of rest rules for months. and after finally being called out is now refusing to pay back wages. expect more attention on tesla's work environment in the coming months as car production and the push to unionize both ramp up. larry and alma? >> thank you, kristen. proposal to build the school right next to a jail in the east bay will not be moving forward. the dublin unified school board voted no on buying the property. here's what we're talking about. the school would have been at the corner of glee son and hacienda drive right next to the santa rita jail. they voted no at midnight. 3-2. didn't come without drama. the board heard from hundreds of people during hours of public comment last night. there are three properties left for the board to choose from to accommodate 2000 students by the year 2023. meanwhile students at lum

a legal strawberry jam is now over. jurors have sided with u.c. davis in a lawsuit over strawberries. today's ruling set professor douglas shah broke the law when he and his partner tried to profit from their work at the university. shaw sued u.c. davis claiming the school unfairly kept his work locked in a freezer, depriving the world of a better strawberry. i know, right? he sought $45 million. university counter-sued saying the professor stole the school's intellectual property by taking some of the fruits of his

a handful of arrests were made. munoz mentioned the april 9 incident at least a half dozen times. he vowed to, quote, redouble our efforts to be more customer focused in everything we do. >> if you commute on b.a.r.t. and things seem more crowded than usual this week, you're not imagining it. abc7 news has learned bart is short dozens of train cars system wide. a spokesperson tells us 35 cars were out of service as of 4:00 this morning and slightly better than yesterday's mark of 43. the problem is traced to the concord maintenance yard which doesn't have enough trains up and running for full service between pittsburgh and sfo during commute hours. the equipment problems are happening as bart's board is set to meet tomorrow to hear about the agency's plummeting ridership. according to bart, total ridership has decreased by 5.5% compared to the same time last year. weekend ridership is decreasing the most, down more than 7% on saturday, and 11% on sundays. bart's figures also show a slump in ridership during commute

stable condition here at children's hospital. while police are trying to find the shooter, or the suspects in this case, the community is reaching out trying to help the boy and his family. he's a little boy, was just walking down the street with his family and his puppy on his birthday. and now he is in children's hospital with gunshot wounds. >> it's always disheartening to see crimes against children and the youth in our community because it impacts the trajectory of their future and ours. >> reporter: it happened sunday night just before 11:00 p.m. in the area of fruitvale in east 27th street in oakland. he was walking with his older brother and parents on the way to a local store. it is unclear what prompted the shooting, or even where the shots came from. but police say the boy was not the intended target. >> you know, we have to all come together because these children are getting involved and, you know, it's just not fair. it's
