trough during the grand opening of this water park. just the day before, cal osha gave the green light and issued a permit for the ride. after they said the water park owned by the city of dublin, corrected a long list of issues noted in an april inspection, including loose bolts at the base. they are zeroing in on now on what they say appear to be pooling or puddling of water in the trough at the bottom. >> because that may have contributed to the accident, so that's one of the things that they will be looking eight very, very closely. >> reporter: does that then apply to slides like the emerald plunge at other parks? >> you know, that's a great question and i have asked if there are other slides like this one at other parks in the state of california, and i'm waiting for a response. >> reporter: it's possible, then, that you'll have to look at water slides at other parks because of the assessment. >> that may be the case. >> reporter: as of this afternoon cal osha said they are actively pulling records for each and every speed slide across the state with similar angles and heights. the manufacturer of this slide

and many others, white water west, issued a statement saying, we are thankful the 10-year-old involved in the incident walked away without any serious injury. they said they are working closedly with officials at dublin's water park where both of the high speed slides are closed down during the investigation. thousands enjoyed the new park over the weekend. it will reopen on saturday. i'm leslie brinkley, abc7 news. >> police have identified two teenagers killed in yesterday's rollover crash in alameda. 17-year-old brianna or ing at the a from hayward and 17-year-old simon from union city died in the crash. take a look at surveillance video. the accident involving a mini van and full-size pickup carrying seven people. at least five people who were in the pickup remain in critical condition. police are still investigate but say speed appears to have been a factor. >> a shelter in place order has been lifted after a bomb scare this morning in san francisco. this all began around noon at the tenderloin police station on

eddy street. >> abc7 news reporter wayne freedman is live at the station. wayne, you said this all began with good intentions? >> reporter: it did start out with good intentions. a caretaker in an apartment is going through a closet, he finds two artillery shells. he says, i wonder if they're live. so, he brings them to the police station and that is how it all began. >> it was about 2 feet long, about maybe 4 inches in diameter. >> reporter: in fact, there were two artillery shells that looked very much like this. what had been a normal day in the tenderloin police station at jones and eddy changed quickly when the man who officers describe as a caretaker for an elderly man brought the shells downtown after finding them in an apartment. >> we left them in his vehicle and came into the station, told us that he had these two rounds in his car seat in front. >> police responded by following protocol. they blocked the street and began evacuating four elderly hotels, including the hotel harold home for some 85 mostly

non-english speaking people. they went door to door, seven floors, with help from the staff. >> always very difficult because a lot of the senior disabled building. a lot of the seniors you see are in walkers or wheelchairs or something like that. so, a challenge. we were able to complee the challenge. >> reporter: one at a time, members of the san francisco police and fire departments helped those residents on jones street to a safety zone behind police tape. by then the bomb skad arrived and took the device away. we still don't know if it was live or not, but police say if you find something similar, leave it alone. they will come to you. in san francisco, wayne freedman, abc7 news. >> napa mother and her boyfriend were convicted today of killing her 3-year-old daughter back in 2014. sara krueger and ryan warner were tried separately for the first degree murder and assault of krueger's daughter kaylee slusher. the prosecutors say the girl's body had been placed in a freezer before it was found. after county d.a.'s office is

not seeking the death penalty. both krueger and warner face 25 years to life in prison. >> well, you may remember this man you see here. he was shot in the head five years ago in san francisco. take a look at him today. but now he says he can't believe a judge has released the man accused of shooting him while he awaits a new trial. abc7 news reporter vic le is live at the county jail with the story. vic. >> reporter: well, let me say first that benjamin's recovery has been miraculous. but it's been a difficult recovery for the young man. there was some consolation, he thought. he thought justice would prevail, but now he's not sure. >> i still have like memory issues, you know, like short-term memory. >> reporter: it has been a miraculous recovery for benjamin tessa who was shot in the head halloween night 2012. his brain wound was so severe, doctors only gave him a 25% chance of living. he was in a medically induced coma for a month.

today he still has problems with his cognitive functions, but otherwise he's doing well. the shooter, a father of a 4-year-old, he and three friends left a halloween party at fort mason when they encountered lee. they say lee groped his girlfriend. the friends say that led to an altercation where lee grabbed a gun from his car and fired it, emptying the magazine. one of the rounds hit pessa. lee's attorney says his client was simply trying to protect himself against the group charging at him, hurling racial insults. >> he was acting in self-defense against a hate crime assault. >> reporter: last april a trial ended with the a jury acquitting lee of most of the attempted murder charges, but they hung on the attempted murder and assault with a firearm charge related to pessa. then two weeks ago the judge released saelee while he awaits a new trial on the deadlock charges. spokesman bastian.

>> it was brain matter on the pavement as a result of the gunshot wound, and we were completely opposed to this release. >> reporter: even though he's on a gps monitoring device and other court order conditions, his release angered pessa and his friends. >> he spent 4 1/2 years locked away while i spent 4 1/2 years in an institution bettering myself and every day trying to like improve myself because of the unfortunate circumstances that have happened to me. >> it's okay to go around shooting people and get a slap on the wrist. >> reporter: a new trial date has been set for july. vic lee, abc7 news. >> police say an oregon and california are investigating a reported kidnapping of a san jose state student just hours before her graduation. the 22-year-old woman was found by county sheriff's deputies friday night near banddon, 95 miles from california. she was forced to drive north until the car ran out of gas.

at that point she escaped. she was found running along an oregon road side. >> and she hid in tall grass next to -- we have a lot of grass next to the ocean. she was able to hide at an old lumber mill site, and he did not locate her. >> the woman says the kidnapper hit her. she was taken to a hospital then treated for facial injuries. the san jose police department tells abc7 news they are actively investigating this incident. >> all right. turning now to our weather, let's take a live look from our mount tam camera. you can see it's been a gray day around the bay area. >> spencer christian, you have some explaining to do. >> i know it's cold outside. what is going on here? still a gray day. live doppler 7, this is not your typical end of may day. lots of clouds around, drizzly out there. gusts over 30 miles per hour at fairfield and s.f.o., and the temperatures are only mainly in the 50s and 60s so it's much cooler than average this time of year.

day. >> bart service is back on track after a rough start to the post-holiday commute. just before 7:00 this morning a richmond bound train broke down outside of transbay two blocking trains from entering or leaving san francisco. after 30 minutes, the disabled train was pushed out of the way. there were also two separate medical emergencies and a malfunctioning track switch at the lake merritt station. a warning for bart riders after a rash of car burglaries at several stations in the bay area. a dozen happened just yesterday at three different bart stations around the bay. there were two at the el cerrito del norte station and one at the na tome a station. >> chipotle says customer data is compromised nearly nationwide. the attacks took place nearly a month, march 24 to april 18. they used malware to attack credit card readers at restaurants giving them access to card holder names, their card numbers, expiration dates, security codes, customers are

we'll start to see partial clearing, though, by mid-morning and afternoon tomorrow look for mainly sunny skies over the bay and inland. but fog and low clouds, maybe a few high clouds, too, will linger near the coast line. the rainfall totals we project will not amount to very much. certainly there will be damp spots and may slow down some of the morning commute. but the totals will range generally from no measurable rain at all to a few 100s of an inch. a high tomorrow afternoon, breezy at the coast once again with high temperatures there near 60 degrees, around the bay look for upper 60s to low 70s. inland if we get the sunshine we're looking for, it will warm up to maybe upper 80s in the warm est spots tomorrow. here's the accuweather seven-day forecast. near 80 tomorrow and wednesday and thursday rather in our inland areas. big warm up begins on friday. we'll see mid-'80s inland and 80 around the bay. sunday, monday, 88 to 90 degrees inland and mid 60s on the coast. so, it's going to be nice and warm out but it will be a gradual one. >> all right, thank you,

emeryville just took the wraps off a brand-new playground this morning, not your typical playground, but a brand-new concept specifically designed for urban environments. abc7 news reporter amy holly field has a look. >> reporter: they're playing in the sky, a high rise play structure. when you can't spread out, think up. >> i think all cities, particularly with urban play grounds, should be looking at a play structure like this. it just makes sense. >> reporter: the emeryville play school district bought this vertical playground from the

it was a busy holiday weekend at yosemite and it is only the beginning as we head into the summer months. this year the fast-melting snow pack is helping yosemite national park max out on tourism and traffic. here is abc7 news reporter corin. >> reporter: the entrance of yosemite national park is the galt way to a series of picturesque sites, the likes of which are hard to find anywhere else in the world. >> this week our dream come true which is really marvelous. >> reporter: he breathed it all in from tunnel view. observing blue skies above a horizon of gray rock, green trees, and white water. but over the holiday weekend, just getting here seemed almost as impossible as the view itself. >> we wait for around one hour and half just to arrive to the

shamoo show is no more. this weekend the san diego park debuting a new educational show called orca encounter which will replace what was one of its biggest attractions. it includes a film about the animal's behavior. while they do breach and splash the audience, sea world says tricks are not the focus. trainers no longer ride or swim with the killer whales. >> it's so important to educate people about these animals. otherwise they're not going to care to want to protects them. >> reporter: but so far sea world's new show is getting mixed reviews. some call it informative and poignant, others calling it boring saying it features little action using the orcas. it's the latest change at sea world. the park announcing last year it would no longer breed orcas following the protest. following years of declining revenue, negative attendance and publicity due in part to the 2013 documentary black fish. it took a critical look at whales in captivity,

specifically involved in three deaths including a trainer in 2010. that film's director believes sea world has made some progress, but not enough. >> they are still swimming around in concrete tanks. my overall hope would be that sea world would just kind of embrace the opportunity to truly evolve and to retire these whales into sea side sanctuaries. >> reporter: this new educational presentation is part of a biggest exhibition launch in sea world history. alex stone, abc news, los angeles. >> sea world maintains it is using the whales in an educational capacity but critics insist the whales are still forced to produce tricks and nothing has changed. >> 7 on your side michael finney is off today. we have a lot of consumer news to get to. warriors getting a lot of excitement but strong warnings about counterfeit ticke cou fake tickets for sale on

craigslist, average number of 40 fans said tickets were fake. they are expecting more fans to arrive with high-priced fake tickets. that has led to heart break in the past. >> there is a really easy fix. there's lots of sites, hundreds of sites probably where people sell tickets online and there's only one site where you can buy tickets and you know 100% your tickets will scan. that's warriors.com. >> team officials are also warning about counterfeit gear often sold at road side stands. they say most of the fakes are made with low-quality materials that won't survive the wash, dyes are going to bleed. may even misspell players' names. authentic items have a hollow gram sticker or name tag and sold at authorized dealers. the real items should last a lot longer. amazon now offering refunds to parents whose kids accidentally rakds up charges on gaming apps. the company agreed to refund up to $70 million in unauthorized charges. those purchases occur when kids download free gifts and they buy

virtual items like gold coins and stars. kids often don't realize those charges are real and will show up on their parents' credit cards. the federal trade commission sued amazon for allowing those unauthorized purchases. parents can claim a refund through their amazon account or through amazon.com. and a milestone today for amazon, its stock topped $1,000 a share for the first time. before retreating a little bit closed 996. it puts amazon market value at $478 billion, that is double that of rival wal-mart and more than 15 times the size of target, only four other u.s. listed companies have shares that trade above 1,000. >> olivia newton john is fighting breast cancer for a second time. today the actress and singer announced she will postpone her world tour which had a stop in southern california. she told fans on facebook that back pain turned out to be breast cancer. she had undergone chemotherapy and partial mass text am i in the early '90s.

name a few. >> it ain't relevant, don't care about it. i'm bored, or i'm a failure. >> reporter: stress in the home in the neighborhood, alcoholism, drugs, even depression, are some of the factors. oakland unified was one of the first in california to start collecting data on students who missed too many days. >> why are kids missing school? because regardless of the reason it impacts their academics. >> reporter: you added the why? >> the why factor. >> reporter: having that information led to outreach programs. each school now has a team with an attendance manager. each student is tracked. and so far oakland seems to be having some success. in 2009, when they began addressing the problem, 16 % of students were chronically absent. today it's just over 11%. page says it's easy to see why students get discouraged. >> and eventually disengage and find someplace else to engage. there are other places in the world to engage.
