a lithium battery erupts into flames in the middle of a cross-country flight. >> let's get right to katie marzullo with the breaking details. katie? >> reporter: the faa tells us it was the lithium battery in a passenger's laptop that caught fire. the laptop was in a backpack in the cabin of the plane. so we're talking about jetblue flight 915, coming to san francisco from new york's jfk and had to make an emergency landing at the airport in grand rapids, michigan. this is video of the plane after it landed there. we understand that at some point passengers smelled smoke and the fire was discovered. and the flight was diverted. a woman on the plane told the abc affiliate in michigan this. >> i was stunned. i knew something was going to happen, because, you know, lithium batteries catching on fire when you're up at 38,000 feet, you can't help but think that we've gotta do something.

so, i was prepared for it. >> reporter: the fire was put out before the plane landed, which was around 8:00 in michigan. no one was hurt and there was no damage to the plane. jetblue released a statement tonight. it reads, jetblue flight 915 from new york's jfk to san francisco, diverted to grand rapids, michigan, following reports of smoke emitting from a carry-on bag, holding an electronic device. the flight landed safely and the aircraft is being inspected by maintenance crews before customers continue on to san francisco. we know they're on their way to san francisco now, finally. you heard from cat honnibol in our story. her daughter is also on the plane and she told us via e-mail, that passengers were patient at first, but they were in michigan for almost three hours. as you might imagine, they started getting pretty frustrated at that point. the flight was supposed to get here around 9:00. now it's not scheduled to arrive until after midnight. live at san francisco

international airport, katie marzullo. >> thank you very much. in developing news, a gunman who caused a scare at the orlando airport is now in custody. and tonight police just announced the gun was a fake. officers swarmed the airport's rental car area. the gunman pointed the weapon at them and shouted, shoot me. crisis negotiators helped bring him in safely. police identified the man as a former member of the military. happening back at home, the oakland city council meeting is going late into the night as council members considered a $1 million settlement to a woman who says she was sexually exploited by several police officers. cornell has the details. >> reporter: dan, it could be midnight before the oakland city council votes on this settlement offer that has been recommended by the city attorney about a sex scandal which rocked the police department. jasmine, the 19-year-old at the heart of a sex scandal, which rocked the oakland police

department, is now being offered nearly $1 million by the city, to settle her claim. she was victimized and exploited by cops when she was under age. >> i'm putting a million dollars up front to settle the case and it's taxpayers' dollars for employees' lack of behavior. >> reporter: she's a former prostitute, and told of her encounters with police. >> 3 out of 30 paid me. >> 3 out of 30? >> reporter: four oakland police officers were fired in the wake of the scandal. council person rebecca kaplan wants more to change. >> we need to focus our time and money on fixing the problem. that means we need to recruit more women police officers, we need to be changing the dynamics between the community and the police, so that you don't get these types of cases of abuse. >> reporter: attorney john burriss is recommending his client accept the settlement. >> this wasn't an amount that

was reached lightly. there was a lot of discussion about this. >> reporter: burriss and his client will hold a news conference on wednesday. abuse lin's lawsuit against other police agencies are pending. in oakland, cornell barnard. police believe the student who said she was abducted at knifepoint and forced to drive to oregon, made up the story. deputies found her running down the road in coos the student said she escaped when her car ran out of gas. the police say, during the interview, the victim recanted the allegations and stated she fabricated the entire incident. the community is not at risk and no suspects are wanted in connection with this investigation. the scene in oakland after gunfire this afternoon left one man dead. police found the man inside a car on 51st avenue.

the bay area news group reports this is the 26th homicide in oakland this year. last year at this time, police had investigated 17 homicides. students at two union city schools are dealing with loss tonight after learning their classmates died in a crash in alameda. briana ortega and simon sotelo were 17 years old. ortega was a senior at the de coto school for independent study. her teachers say she was determined. >> she would have done something wonderful in this world. and i'm sorry that we won't get an opportunity to see what her future would have been. >> the teenagers were among seven people in a pickup truck that crashed. this shows the truck rolling past several times. five other passengers in the truck are still in critical condition. the injury in the sierra

lamar murder trial will decide if her killer deserves the death penalty. closing arguments ended today. garcia-torres was convicted of kidnapping and killing lamar. his defense said he had a rough background and deserves mercy. the d.a. argued that she didn't show mercy to sierra lamar. jurors will also have to consider that he may know where her body is, so that information could die with him. new at 11:00, nine men face charges following a prostitution sting in hayward. police released these photos tonight. investigators say these men responded to an online ad this month and agreed to meet at a motel for sex. when they arrived at the motel, an undercover police detective was waiting for them. both players who threw punches in the giants' brawl at at&t park will appeal their suspensions. giants reliever hunter strickland beamed bryce harper yesterday in the hip. it led to a bench-clearing brawl. the league suspended strickland

they had left a halloween party when they encountered saelee. saelee groped his girlfriend. that led to an altercation, where saelee grabbed his gun and started firing. saelee's attorney was just trying to protect himself against the group charging at him, hurling racial insults. >> he was acting in self-defense against a hate crime assault. >> reporter: last april, i injury acquitted saelee of most of the attempted murder charges, but they hung on one charge related to pesa. then two weeks ago, the judge released him while he awaits a new trial. >> there was brain matter pavement as a result of the gunshot wound and we're oppose said to this release. >> reporter: even though he's on a gps monitoring device, his release shocked and anger pesa and his friends.

>> he spent four and a half years locked away, while i spent four and a half years in an institution bettering myself and every day trying to improve myself because of the unfortunate circumstances that have happened to me. >> they're basically saying it's okay to go around shooting people and you get a slap on the wrist. >> reporter: a new trial date has been set for july. a water park in dublin where a 10-year-old boy was injured, closed today and will remain closed until the weekend. the boy flew off a slide, he had minor injuries. cal osha said today it's looking at water levels and the sharp ac angle of the slide. it's 80 degrees and most slides are 30. regulators plan to look at similar slides across the state. disgusting and vile. those two words among many being used on social media tonight to describe a post by comedian kathy griffin. the photo shows griffin holding
