and its creative director are both arrested. family and friends of those who died are still very emotional. >> it still hurts. it still hurts a lot. >> good evening, i'm dan ashley. >> i'm kristen thanks for joining us. the people who died from the fire all died of smoke inhalation. >> laura is covering it. laura. >> reporter: dan, after conducting six months o investigation and 75 interviews, coming through thousands of documents and 300 pieces of physical evidence, recovered from this warehouse the d.a. came up with two people she says were responsible. >> they allowed large amount of flammable quantities.

>> reporter: and charges against almena and harris, she said the two men created a fire any rebl person would know was deadly. >> it was the defendant's making to get out of that building. almeda and harris' actions were reckless and created a high incidence of death. almena's defense attorney released the following statement we believe these charges represent no less than a miscarriage of justice. we are confident that this attempt to make a scapegoat out of our client will fail. the criminal complaint alleged almena and harris not only packed the warehouse with flammable materials they rewired the electrical system and deliberately blocked one of the exits the night of the fire.

oakland mayor libby schaaf released this statement, i applaud the charges filed today by district attorney nancy o'malley because they send a message you won't get away with making a profit by cramming people into dangerous spaces or failing to maintain safe living conditions. attorney, mary alexander represents 11 of the families who lost loved ones. >> the families are seeking justice and they are very pleased that there have been criminal charges files against two of the people who contributed to the cause of this fire. >> reporter: if convicted of all charges, almnea and harris face up to 39 years in prison. in oakland, laura anthony, abc7 news. >> friends of those who died in the fire say criminal charges are one step towards justice. >> speaking with the victim's friend today, melanie joins us live from the newsroom. >> you might recall, this is somebody we met on the weekend

adopt today's recommendations. commuters are still facing delays because of a fire that broke out in orinda. it raced up a hillside next to highway 24 not far from the caldecott tunnel. crews contained the fire to about 25 acres. the three right lanes remain closed on westbound 24 because of fire engines parked on the roadway. i went through this area today, too, it was really really slow. they suspect a fire in this car is what sparked the hillside blaze. if you ever see an uber or lyft driver doing some things, they want to get to the bottom of it. and insisting they turn over data. live at city hall with more. >> reporter: the city attorney is requesting four years of records including hours and miles logged by these drivers. we all know ride share has become a part of city living.

some feel uber and lyft are now a nuisance. >> when you see a lyft driver idling in a bicycle lane it's no wonder some people are critical of the ride share company. >> it's super dangerous, see it constantly all the time, bikers getting cut off or having to walk around and it's really dangerous. >> reporter: today, the city attorney is demanding both lyft and uber provide data on driver practices an answer questions on discrimination, disability access and public safety. in a statement, that office made clear the city attorney aims to ensure that the two companies estimated 45,000 vehicles in san francisco comply with local and state laws. supervisor jane kim welcomed the investigation. >> are these drivers driving safety? how many miles are they logging in a day? safe working conditions, are they picking up people with

disabilities and are they parking in bike lanes endangering pedestrians. >> reporter: and looking at an additional per ride fee for road construction. lyft was reviewing the subpoena and said we have a track record of working with policymakers who regulate us. the city attorney is concerned about those drivers who commute from sacramento and fresno to provide service here calling them fatigued drivers a threat to themselves and the public. abc7 news. meantime a movement is forming to keep uber out of oakland. the company acquired the former sears building on broadway but yet to move in. they want them to agree to preserve oakland as a diverse city before doing so. the group set a 10 point platform to keep them from overgentrifying providing job

a plan supported by the state's top judges would make most traffic violations civil offenses instead of criminal. according to our media partner mercury news, the idea is to protected people from big fines and possible arrests. dui still would be but running 15 miles above the speed limit will not be. they hope to work with the legislature next year to adopt a final plan. a traffic fix for the 101 peninsula may be in the works. caltrans meets with the public to discuss congestion. one is create a toll lane for solo drivers and the second extend a carpool lane and
