i'm eric thomas. >> i'm kristen sze. an 11-year-old wanted to talk about her dad, and the tragedy that took his life. >> today authorities identified ronny alvarado as he saved his 5-year-old daughter's life. investators say neither was wearing a life jacket. >> leslie brinkley joins us live from the newsroom with the latest. >> kristen and eric, the whole family was having a picnic whe the dad took his 5-year-old daughter on a kayak ride. they were not, as you said, wearing life vests. his other daughter, 11-year-old maria, watched it all happen from the shore. and she wanted to share with me her dad's heroism. >> they were going really fast and they made waves. when the waves hit, the side of

the kayak flipped over and my dad quickly got my sister and held her up. he really tried to get her to safety first. he was like that. his head was in the water. he couldn't breathe. but he made sure she was safe. >> reporter: this is where it happened in the delta near three mile slew. the sacramento county sheriff's department said the dad handed the girl off to a jet skier who safely brought her to shore uninjured. meanwhile the dad submerged and never resurfaced. for hours, helicopters and boats equipped with side scan sonar searched the waterway. at 11:00 p.m. a dive team recovered the body of 40-year-old ronny alvarado, a construction worker from guatemala who leaves behind a wife and two daughters. the skrnlt county sheriff's department said it's the third drowning in the last two months in which the victim was not wearing a life vest. >> it breaks my heart.

i couldn't imagine having a daughter, you know, child out there without a vest. it's just scary. it scares me. >> the family here in san francisco has set up a go-fund me page to raise money to bury the dad here in the bay area. you'll find a link on abc7news.com. live in the newsroom, i'm leslie brinkley, abc 7 news. >> leslie, thank you. 300 people remain under orders to stay out of their homes because of flooding in the san joaquin valley. the king's river breached one levee. the water has surged in the past few days, after the recent heat wave really sped up the melting of the sierra snow pack. we'll have reports on the efforts to deal with the flooding. tioga pass, still plenty of snow in the sierra. will it be heating up again anytime soon. >> now the details. >> they will be seeing warmer

weather later on this week. so let me show you the flood warning in effect for kings river until 2:00 p.m. thursday. obviously the levee breach is a concern and flooding is still a possibility. flood warning going for the central and parts of the southern sierra, which is why tioga pass is closed. highs on tuesday, you can see here, 60s, 70s, sequoia 67 degrees. on wednesday the temperatures vary. but thursday, warmer weather on tap, and that means there's going to be rapid runoff, the snow will be melting quickly. obviously there's still a concern, and that's why they have the flood warnings going for that area. i'll be back to let you know if our temperatures will follow a similar trend where we go warmer later on this week, coming right up. >> sounds good. sandia, thank you. california received a green light to change how water is moved from the delta to southern california. governor brown backed the $15 billion plan called california water fix.

the u.s. fish and woildlife service ruled said it would not jeopardize endangered species like fish. >> they can be pulled into the pumping facilities or they can be killed. by definition, the water fix is helping to re-route that water away from those pumps, and we'll see a decrease in fish entrainment. >> the mega project still faces several more hurdles before any construction can begin. delta farmers oppose the plan because they fear it could hurt their water supply and their crops. investigators in the east bay are working to identify human remains found in a warehouse over the weekend. there's a possibility they could be that of missing san francisco uber driver chai of hayward. melanie woodrow is live at the san francisco hall of justice with more. melanie? >> reporter: well, eric, since those human remains were discovered this weekend, the case has been turned over from the special victims unit to the

homicide division. today people who knew both the missing man and person of interest are being asked to stop by here to speak with investigators. u.s. trading company's owner said he contacted law enforcement saturday. something didn't smell right. san francisco police say they discovered bags of human remains inside the hayward warehouse. >> i just hope and pray that body parts doesn't belong to my husband. but if it is, he had something to do with it. >> reporter: he's been missing since mother's day. they named family friend tang a person of interest. they wanted to talk to him, but he took off, leaving his car at san francisco international airport. >> we believe that he is in cambodia. >> reporter: u.s. trading company's owner said tang worked at the warehouse where the remains were found, for 20 years. neighbors on burrows street say police were out here late last week interested in another

vehicle. >> there's a police car parked behind the car as they were towing it away. it was a range rover. >> reporter: the neighborhood mailman noticed a similar vehicle saturday. >> light colored older model range rover with two occupants. >> reporter: the chais and tangs were good family friends, part of an extended network that liked to hike and dine together. friends within that network are being asked to speak with investigators. they shared this text message from an sfpd homicide detective today asking them to call him. >> sounds more and more suspicious for sure. >> reporter: both neighbors and friends say they can't imagine why tang would want to hurt chai. >> if he's the one, i definitely hope they can get him back. >> reporter: melanie woodrow, abc 7 news. update on a campaign to recall the santa clara county judge criticized for handing a lenient sentence to former swimmer brock turner. they're gathering signatures for next year's ballot.

>> we're tired of seeing sex offenders and domestic abuse perpetrators not being held accountable. >> the group wants county voters to decide whether a judge should keep his job. they held a silent protest this morning as they filed paperwork at the registrar of voters. proponents must collect more than 58,000 signatures for the measure to qualify for the june 2018 ballot. persky was transferred to civil court at his own request last year. efforts to contact the judge for comment were unsuccessful. president trump's ban on refugees from six majority muslim nations got a partial reprieve today from the supreme court. a limited ban was granted until the fall. the news is disturbing to muslims here in the bay area. david louie is live at the airport with reaction. >> reporter: the high court trying to come up with a compromise that was not an outright ban. visitors seeking to come to the u.s., or asylum seekers now from

six countries will have to come up with specific criteria. the president seems happy about this, but others are not. the muslim community has spent the last month reaffirming its faith. they find themselves trying to digest news that the supreme court is for now allowing a limited travel ban to take effect, until a full hearing can be held in october. the travel ban is expected to be effective in 72 hours to prevent the kind of chaos that impacted those already intransit when first implemented earlier this year. visitors from the countries must present claims of bona fide relationship with a person or entity in the u.s. who will review that and how it will be enforced are unclear. however, there is ccern the ban will create a backlash. >> i doeel that this ban is of great concern with regards to people who may have some predisposed prejudices. we may begin to see some ignorance, and i'm hoping that

people will take the time to talk to us. >> reporter: a ban on refugees will be effective for 120 days. >> traditionally the u.s. has been an amazing safety for people persecuted in those countries. now i'm afraid those people won't be able to leave that persecution and get to a safe place. >> reporter: president trump calls the supreme court decision a victory for national security. but there could be consequences. >> we feel this will have some backlash on the muslims. and this should not happen. it's unfortunate that this happened. >> reporter: in milpitas, david louie, abc 7 news. new details on a fight that shut down san francisco's westfield mall. police say they made two arrests, one suspect is a teenager. the man faces charges of assaulting an officer and resisting arrest. an officer suffered minor injuries during last night's brawl. this is cell phone video taken as police tried to break it up. they have not said what started that fight. they used to be the hottest

kate? >> reporter: eric, here they are. the cheapest tickets at the giants ticket office tonight, $9 for standing room. cheapest seats, $15. this comes with pros and cons. we wish our g-men were playing better. but families can afford more tickets. not so great for the businesses nearby. or the season ticket holders trying to sell their tickets. i just spoke to a season ticket holder, face value $120, he couldn't get rid of them. sold them at a discount of $75. clearly these tickets not as hot as they used to be. >> a base hit into right field. >> reporter: the hits keep on coming against the giants. the latest strike being ticket sales. which for some are a grand slam. >> they're dropping. it's going to be a lot easier to bring a family. >> reporter: john brought his family all the way from stockton to see tonight's game against the rockies. >> we'll come to more than one game. >> cheap as 15 when we looked. i wouldn't doubt they will go

really should not be there. voters overwhelmingly back paying higher sales taxes for number of riders cal train can carry. the extra charge would add one-eighth of a cent in san francisco, san mateo county. the tax would have to win by a two-thirds majority. right now cal tran carries 62,000 people per day. a big cleanup effort on interstate 80 is expected to continue late into the night. the davis street on and off ramps are not estimated to reopen until 1:00 in the morning. that's 15 hours after a big rig overturned this morning spilling thousands of gallons of sunflower oil. chp said several drivers stopped and pulled the driver to safety. he was taken to the hospital with minor injuries. the annual debate over the safety and sanity of fireworks sales has begun. there is zero tolerance for

illegal fireworks in dublin, but one of only two in the east bay still allowing the sale of so-called safe and sane fireworks. 13 groups will open stands this wednesday. but in nearby contra costa county and most of the east bay most fireworks are banned. >> where the problem comes in, though, is if somebody purchases fireworks in one of those communities, and then brings them to our community. we have a great number of fires every year that are caused by both the legal and illegal fireworks. >> even in dub lin, they're not allowed every wrer. several dublin parks were designated fireworks zones. for those living in an apartment or condo where they cannot be used. tsa screening, could change tv as we know it. >> and a big development with takata. >> really amazing. the air bag company at the center of history's largest recall is filing for bankruptcy.

today we're getting more information about what it all means. let's start with your car. will it be repaired? takata says it will stay afloat and will manufacture all the parts needed to finish the recall. takata owes somewhere between 10 and $50 billion and the company says that's simply too much for it to survive. americans buy most of their tv programming in bundles. but a new study shows that many don't want to do that anymore. cable and satellite providers have long offered packages of channels. but now according to a new study by tivo, americans say they want to buy their tv a la carte, that is one channel at a time. consumers are buying tv programming for hulu, netflix and other services and want their choices expanded. those with cable and satellite are growing, and cites two reasons. the high cost of pay tv. the preference to binge watch the programs they like.
