to 100-degree mark. we'll see a bit of fog moving out over the bay from the coastline. that will be the pattern for going into tomorrow morning. looks like tomorrow is shaping up to be a hotter day in our inland areas than today. i'll give you a closer look at the forecast in a few minutes. people may have noticed flairing from the valero refinery this afternoon. we noticed smoke but no flames. the refinery said there's no emergency. it had a controlled unit shutdown today and periodic flaring was a possibility. the last time there was major flaring was in may. valero is suing pg&e over that incident. nearly five months after the coyote creek flooding, some of the residents still aren't able to return to their home. >> one group is saying all of this could have been prevented. chris nguyen has the story.

>> reporter: it was the epic flood that a lot of people will never forget. >> they don't speak english. they have very little money. some of them are afraid to speak up. >> reporter: a lot of finger pointing as residents recall that day with the city, county and water district playing the blame game over who should be held responsible. she's living in rock springs for 20 years. she feared for her life as the water quickly rose and was rescued by boat. it was just two weeks ago she was able to return home. however, not everyone in the neighborhood has been as fortunate. medical student spent months living in a shelter. her old apartment still hasn't been repaired. she's among those who have filed claims. >> it's emotionally draining to

not know where you're going to live. not though what's going to happen next. it's hard. >> reporter: the san jose city attorney's office is reviewing the claims and has no comment. local attorney is representing a group of the victims who gathered earlier today. >> we can do this together and press them to make necessary changes. if they don't hear from you, they're going back to business as usual. flood victims have until mid-august to file any claim which is the first step towards a possible lawsuit. chris nguyen, abc 7 news. a suspicion package inside a muni bus created tense moments in san francisco's marina district. shoppers inside were told to shelter this place while police investigating. traffic was also shut down. everything returned to normal about an hour later when officers determined the item was not dangerous. a rescue operation is under

way in downtown oakland. a bird rescue from a tree that was badly damaged two weeks ago and now must come down. laura anthony joins us live from 14th and alice street with more. >> reporter: you can see behind me this tree that was deemed hazard, almost completely gone. the canopy is gone but not before a careful effort to accommodate the tree's winged residents. it seems upset and confused about what to do as crews dismants l tdi dismantle the other side of the ficus he calls home. it's a delicate operation. home to dozens of black crown night herons. >> the tree has to come out. we have coordinated with the city of oakland on a very thoughtful process to get the tree down and try to get the

birds rescued out of tree who cannot self-rescue themselves. >> reporter: this is the same ficus thsplit in half two weeks ago killing birds and injuring others. now before the city cuts down the tree entirely, the remaining birds and their nest are being removed along with any eggs. >> two eggs from the nest up there. two eggs. >> we knew we wanted to get this there and take care of the birds bfore we took the tree down. >> reporter: they are being taken to the international bird rescue in fairfield and will be released back in oakland. laura anthony, abc 7 news. bart police are investigating another robbery at oakland's coliseum station. ten teenagers grabbed a woman's iphone as they got off the train. a good samaritan chased them down and got the phone back. bart police caught the suspects and released the teens when

witnesses couldn't be sure who had taken the phone. this follows a high profile attack in april when teens robbed and beat riders at the same station. look like tourists continue to be targets of theft. two people were robbed at gun point as they walked near delores park. the man and woman were approached by two men with a handgun and knife. they stole passports, phones and tablets. they are calling it the 9:00 p.m. routine. the routine involves people remembering to lock their cars and removalables before going to bed. the campaign kicked off last night with this tweet and this video. >> only takes thieves a few seconds to removalables from your unlocked vehicle. make sure you hide these items or simply don't leave them in the car. always remember to lock your doors and take the keys with you. >> the 9:00 p.m. routine has been a successful antiaft-crime

campaign in other parts of the country. cal train will decide whether to raise fares at the next board meeting in august. they heard tr dfrom dozens of riders. many are against the increase. >> we are paying quite a bit to ride cal train as it is. it's significantly higher than other bay area transit agencies other than bart. >> cal train is looking to raise the cost of monthly parking by almost $30. a spokesperson said they are struggling with a 10 million dollar deficit bauds it ecause on other federal agencies for funding. when they are having trouble, cal train is affected as well. the california state senate has approved a $75 fee on real estate transaction documents.

it's expected to generate 200 to 300 million annually for affordable housing projects. critics say it would hurt middle class people trying to buy homes. a bill that would extend alcohol sales past 2:00 in the morning is a step closer to becoming law. an assembly committee approved the legislation yesterday. the bill would extend drinking hours to 4:00 a.m. this bars, nightclubs and restaurants but not liquor stores. it hads to the assembly appropriations committee. getting serious about politics. >> i basically had to not be fun ny for a long time and show people of minnesota that i was serious. >> comedian turned senator al franken on washington, politics and whether he's running for president. we in kracalifornia and sta all across america believe it's time to act.

may see a bit more of that. right now we'll travel over to the sierra where we had an outbreak of thunderstorms. a bit of moisture has been coming up from the south and the heating action of the sun has destabilized the atmosphere a little bit. thunderstorms there but things are calm in the bay area. you can see in this view. blue skies over the golden gate where we see fog this time of the day. these are our forecast features will see intense inland heat tomorrow. summer spread of temperatures over the weekend and we'll see a cooler pattern developing with the seasonal range of temperatures next week. overnight we'll see a bit of fog near the coast and maybe a trickle of it out over the bay as well. low temperatures will range from mid-50s to about 60 degrees. it's going to be quite mild overnight especially in our inland areas. the beach forecast for tomorrow calls for high temperatures ranging from mid-60s to about mid-70s at santa cruz. ocean starts about 59. the patchy fog will be present. the uv index will be extreme.

don't forget to apply sunscreen. saturday afternoon we'll have the summer spread of temperatures. about a 40-degree range from the highs at half-moon bay to highs up at clear lake and cloverdale. we'll see most locations ree reaching to 90. there will be little change in that pattern on sunday. on monday we'll see cooler conditions in our inland areas and the cooler pattern will spread to the bay side locations as well where we'll see highs in the low to mid-70s. it will remain mild on the coast for the next several days as evidenced by tomorrow's handle of high temperatures. we'll see 66 at half-moon bay. 74 are at oakland. 76 at san mateo. move inland tomorrow, we'll see high highs of 99 at concord. up north 96 at lake po 91 at that napa. over at palo alto, a high of 83.

berkeley police say an extreme case of vandalism is a hate crime. they slashed tires in an affluent neighborhood. there were 35 instances of damage. some of the graffiti is racist and expresses class hatred. detectives say that's a hate crime. >> that many is definitely unusual. not uncommon to see one twor in a week but to see 35 plus

instances in a six to eight hour period, that's a significant amount. >> detectives are asking those in the area who have security camera to check for any images of those vandals. bay area researchers say a troubling number of teenagers are being exposed to smoking. not at home or school but at the movie theater. they help a study by ucsf. reseachers analyze dozens of youth focus movies and found that scenes with smoking have increased substantially in films rated pg 13 even in in in in ini transformers and ringo. >> selling cigarettes to kids. what we think is when parents buy a ticket to a pg-13 movie for their kids, they should be able to send them in the secure and the fact the movie isn't selling them cigarettes too. >> there were some more

when promised to find lenders and when customers fill out the applications they sold their information. they agreed to pay $104 million fine. amid fireworks last weekend a new law took affect aimed at stopping surprise doctor bills. as of july 1st state law says patients do not have to pay huge outsiders outside their insurance networks. they don't know they are getting care from outside providers like lab technicians or specialists. patients are shocked by enormous bills that the insurance won't cover. they must work with providers to cover these unexpected bills without charging the patients. three big cars receive the top safety rating from the insurance institute for highway safety. the big surprise tesla isn't one of them. this video shows crash test on six large cars.

do not try this at home. a beloved retired chp motorcycle officer got a very special escort today. he served with the chp for 28 years. recently the retired officer was hospitalized with health problems. today it was quite a scene as he left the hospital in oakland. he once rode alongside some of these guys. today they honored him. >> we did many things together. i rode with him for many years. we did a lot of activities. a lot of details including the raider escort, basketball escorts and all kinds of other good stuff. >> being a chp officer is family affair. his son nick is now with the force. you can get the latest news any

time. . thanks for us. abc 7 news at 5:00 starts now. they set up over these tanks. >> put a hose down it and pumped diesel. >> stealing fuel under the cover of darkness. a school district is at a loss. imagine seeing this on your hiking trail. several mountain lion sightings have shut down part of a popular park in san jose. a judge visits a murder defendant in the hospital. good evening. police are looking for a couple of diesel full bandits.

>> they used a truck to pump thousands of dollars of fuels from the school district. it happened at the bus yard on olive street yesterday. >> reporter: someone stole more than 1200 gallons of diesel fuel from the bus lot. >> it's hard to believe that one would do that. they took pictures of them. >> reporter: jose, a district kcustodian snapped these crucia shots. you can see the hose was hanging out of truck as they were driving away. the pump they used is professional grade and necessary to reach the large underground fueling tanks. >> it's probably not the first time they've done it. i would imagine just to have the tank in back. we're talking about several to over 1,000 gallons of diesel fuel. >> reporter: they cut the chain and added their own lock so
