president amy lay says prisoners are more defiant after three deputies were convicted earlier this year of murdering an inmate. she says in a recent incident an inmate put a guard in a choke hold as the deputy was trying to handcuff. >> there should be fairness for the inmate, but also for the officers. it has to be balanced, because when the scale is tipped one way or the other it becomes an unsafe environment for both staff and inmates. >> in a statement the sheriff's other says it has not observed a marked increase in inmate versus staff assaults. the protection of all persons is always the highest priority. new tonight, a san jose woman fell about 100 feet sadly to her death from a beach side cliff. it happened in a remote area of davenport in santa cruz county of she was 20 years old. the santa cruz sentinel reports rescuers faced rising tides, high wind and steep terrain. a helicopter had to be brought in in order to reach her.

sheriff's investigators say it appears to be a tragic accident. new at 11:00, angry neighbors turntd out in forts in the east bay. they don't like the proposal to replace a shut down shopping center. car max wants to open a dealership. katie utehs is live in pleasant hill with the story. >> reporter: ama, more than two dozen people spoke out and city council is now deliberating this late night meeting. among the top concerns here, heavy car haulers wreaking havoc on area roads and people potentially test driving through residential neighborhoods. a car max representative made his sales pitch for a used car dealership to the pleasant hill city council. >> we will be redeveloping an under utilized site vacant since 2012. >> he is talking about the desolate lot that used to be a k mart and mcdonald. car max wants to build a new facility at the former shopping center on contra costa boulevard.

a great story this is. an uber driver's last ride of the night turned out to be the first ever ride for a newborn baby. annabel munoz from our sister station in los angeles has the story from mom, dad and the driver. >> reporter: raymond kei decided to pick up his last uber customer of the night when he realized erika davidivich was going into labor. >> your water broke? >> seriously.

>> erika was screaming. she started saying, my water broke. usually for our other three girls, water breaks, it is like still another six, seven, 12 hours. >> reporter: but erika and her husband didn't even make it to the hospital this thiem. >> oh, my water is busting. >> i looked down and the head was coming out. and, you know, i didn't know exactly what to do. i was fairly certain you're not supposed to just let the baby fall. so i -- i caught him. >> i started talking to the operator, giving the location and everything is just going so quickly. within like 30 second or a minute from the water breaking, her -- the baby just comes out. the baby just wanted to come to this earth really quickly. i don't know. >> reporter: emergency responders arrived on the scene shortly afterward. he has been driving for uber since november. >> this kills the list, yes. this always will be number one. >> reporter: davidovich said he
