things like the transfer of paperwork, the filing of motions, court appearances. that sort of thing. on top of the fact that there appears to be heavier than normal case loads. now the public defender told me that yesterday afternoon, there were about 100, 100 arraignments scheduled on the afternoon calendar and that's a lot of arraignments. on top of all of that, he says there appears to be a lack of access among many to this new courthouse. it took lela madison over an hour on the freeway to get here from richmond this morning. her niece had to take mad scisoo her son's arraignment. the oakland courthouse is more convenient. >> a.c. transit bus and tgo int oakland, it would be easier for me to do. >> reporter: starting this week all in custody arraignments in alameda county will be held at this new courthouse in dublin,

it's about 30 miles from the oakland courthouse that's always handled arraignments for crimes occurring in oakland and berkeley. the majority of the county's criminal incidents. the court says it will save time and money. the county's main jail is right next to the new facility. no more busing prisoners to oakland for arraignments but defense attorneys say it's a burden for families of defendants. >> a lot of my clients obviously are indigent and their families are indigent and that's a tremendous hardship. >> reporter: there are also opening day blues. yesterday with a public defender calls total confusion. >> clients just aren't being seen. their case could be in contention next day. they're not being arraigned timely. it is just a massive failure on multiple ends. >> reporter: tyra had to come here again today from hayward. her fiance's arraignment was put over yesterday because his files weren't ready. >> like a lot of miscommunication even with the staff and the d.a.s, they seem

overwhelmed already. >> reporter: the public defender says it's like putting four lanes of traffic into one lane. there's a massive traffic jam. vic lee, abc 7 news. happening now, a state of emergency is in effect near yosemite because of the detwiler fire that is threatening homes right now. evacuations have been ordered in mariposa county as the flames continue to spread. the fire has burned more than 19,000 acres since it broke out sunday afternoon and it's only 5% contained. the evacuation order covers the city of mariposa. officials say firefighters are dealing with unfavorable weather conditions and aggressive fire behavior. >> think we can't emphasize enough how active and erratic this fire activity is especially with this fire. it's done stuff we haven't seen before. >> at least one structure has been destroyed. again, many are threatened. in saratoga, fire crews continue to work to contain a wildfire that's burned ten acres so far near mt. eden and pierce road.

the fire is 50% contained. we're told tonight's concert at the nearby mountain winery is going on as planned. someone could face charges for a drone. it was spotted in the sky near the fire and caused a cal fire helicopter to be grounded. officials say it's illegal to fly over an emergency area and the drone operator could face charges as a result. we have new details on the kidnapping of a baby in san francisco over the weekend. the source familiar with the investigation tells abc 7 news the baby's father also was arrested on child endangerment charges. that baby was are reunited with her mother shortly after police arrested this woman for kidnapping sunday. abc 7 news has learned the woman was in a car with the baby and her father right before the kidnapping. the father had picked up that woman nearby. he then left them in the car and when he got back to the vehicle, they were both gone. police found them on a muni bus. san francisco district attorney's office has not formally charged either the woman or the father. both are still in custody.

b.a.r.t. passengers at the embarcadero station thought they heard and saw an explosion this morning. if you were there, maybe it was you. turned out to be an equipment malfunction, something b.a.r.t. officials say actually happens often. understandably, people were scared nonetheless. abc 7 news reporter melanie woodrow has the story. >> reporter: this is what's left of an insulator that blew this morning at the embarcadero station. ellen was on her way to work. >> we saw big flash of fire and a loud noise and then, like, smoke was, like, everywhere. oh, i thought it was a bomb. >> reporter: b.a.r.t. officials say the insulators keep electricity in the third rail. >> as trains run over those rails they grind off microscopic dust. >> reporter: the dust settles on the insulators making them gray instead of white. >> it will travel through the dust and cause the insulator to fail which creates a small explosion. >> reporter: as often as once every two months according to

b.a.r.t.'s spokesperson. maintenance crews try to keep it from happening regularly by dusting the insulators off with compressed air. >> my heart was racing. people were really scared. i never saw a train empty out so much. >> reporter: she says she was impressed by passengers helping one another including one woman who fell. she said she did not see b.a.r.t. police. >> if they do have b.a.r.t. police at the stations and especially the embarcadero station which is a main station, there should have been police there. >> reporter: officials confirm b.a.r.t. police were not at the embarcadero station when the insulator blew. transportation supervisors informed b.a.r.t. police they were not needed afterwards. in san francisco, melanie woodrow, abc 7 news. late last night a man said he was punched, kicked and robbed while riding b.a.r.t. it happened near the bayfair station. about three or four suspects estimated to be in their late teens probably took his phone and laptop before running off the train into the station. they were not caught.

the victim was taken to the hospital to be treated. and today the victim of another violent robbery on b.a.r.t. wechbt before b.a.r.t.'s board's safety committee. are rusty staff and his family were among several passengers beaten and robbed by a mob of dozens at the coliseum station back in april. we reported this at the time. it's a crime that was captured on video and he told us why he wants it released. >> to better educate the public and to find ways to prevent these incidents from occurring. >> we don't want to jeopardize the prosecution of an individual who did something horrible to a victim or to one of our riders, so it's a balance and we'll be discussing it further here at b.a.r.t. as an organization. >> new report reveals that rapes and sexual assaults on b.a.r.t. properties are up for a fourth year in a row though 82% of b.a.r.t.'s 134 officers are currently on patrol, the system is still nearly 100 officers short of full staffing levels. and we want to hear your experiences with b.a.r.t. share what you love, what you

investigation to look at their history and see where they came from. >> reporter: but they didn't get far. sheriff's deputies found them pulled off to the side of the road in san jose just ten minutes away from the site of the burglary with apple devices all over the back seat. this picture from the santa clara county sheriff's office shows all the items recovered. 4-year-old tan van nguyen of san jose is being held at the county jail. deputies aren't sharing photos of the other suspect, 38-year-old mark tran of american canyon, because he always bailed out. in a statement, a verizon spokesperson said "the safety of our employees and customers is our utmost priority. we appreciate the efforts of local law enforcement in solving this crime." >> the realization, doesn't matter where you live, where you're at, anything can happen. there's crazy people out there that are willing to go into lengths to get what they want. >> reporter: for some, a sense of protection now gone. in cupertino, abc 7 news. a bill that will set new

privacy protection for internet users in california cleared a key senate hearing this morning. the bill will prohibit internet service providers from using any of your personal information for marketing purposes unless they have your consent. more than a dozen major telecommunications companies oppose the bill saying there are already regulations in place to keep consumer data private. the bill has one more hurdle before a vote on the full senate floor. california's nationally recognized cap and trade policy has a new lease on life tonight. it's a system that tries to tackle the challenge of climate change. state lawmakers narrowly approved an extension. >> reporter: dan, there was a lot of hyperbole from governor brown around this initiative. he suggested without passage, california would be devastated by climate change, but the three-bill package was a tough sell, barely squeaking through. >> it's a great day for california, it's a great day for bipartisanship and it's a great

day for the planet. >> reporter: governor jerry brown applauded lawmakers on both sides of the aisle for what he called their courageous action. by the slimmest of margins, they approved an extension of the state's cap and trade system which the governor believes is the best weapon against climate change. the program sets a cap for companies like factories and refineries, on greenhouse gas emissions and requires polluters to purchase permits for every metric ton of carbon dioxide emitted. they pay a penalty if they exceed the limit. if they reduce their emissions, they can sell their credits to companies that pollute more. san francisco assemblyman david chu says he had concerns about what he considered giveaways to the oil industry but says this deal still represents progress. >> the version that we voted on for the first time links our air quality goals to planet program. it increases air pollution penalties that haven't changed since the 1970s.

the past hour, san francisco's board of supervisors unanimously approved creating a new office of cannabis. >> yeah, it will oversee the process through approved permits for the sale of marijuana to adults for recreational use. >> last november, california voterses approved recreational marijuana. starting in january, dispensaries will be permitted to sell it. >> abc 7 news reporter lonnie rivera has more on the story. >> reporter: dispense ary in the south market neighborhood looks like a high-tech coffeehouse. medical marijuana orders placed with touchscreen. the shop is looking into selling recreational pot. san francisco city supervisors approved a new office to handle the anticipated demand. >> the idea that someone else is going to come in in other places and there's going to be this explosion of -- that's not going to happen. >> reporter: those concerns forced supervisors to proprose legislation to cap the number of dispensaries at three in san

francisco's excelsior neighborhood in his district. it will be left up to the office of cannabis to manage the permit process. >> if we don't have regulatory framework in place by january 1st, we won't be able to influence what happens. >> reporter: the supervisor says it makes sense for existing dispensaries to get priority when it comes to recreational permits. >> they have been vetted. they've gone through the process. they've been authorized by the planning department. the operators have had their backgrounds vetted. >> reporter: critics argue the new office may add more red tape with fees and legal hoops. supervisors say some of the fees are intended to fund the office's operating budget. the goal is to have a single point of contact to manage businessowners' questions, regulators' questions and potential public complaints. in san francisco, lonnie rivera, abc 7 news. a hazmat situation shut down an overpass on highway 101 in

novato this morning. atherton avenue. a vehicle spilled hydrochloric acid, commonly used in swimming pools as a cleaner. firefighters and county hazmat crews cleaned it up safely. no problems. the road re-opened by 11:00 a.m. today the only bike share option rolled out in san francisco. 4 go bike opened 24 stations today and plans to double the number of stations by the end of september. san jose trails tweeted these pictures of the new bikes outside city hall. stations are located downtown around san jose state and the . s.a.p. center. bike share users can rent the bike for 30 minutes for as little as $3 and return it to any station. just one week ago, bike share expanded to the east bay for the first time but already sel several bikes have had their tires slashed. abc 7 news reporter jonathan bloom has more on how those running the program responded and why they say it's happening. >> reporter: a week ago oakland

one neighborhood toeld them the shiny new stations would be against them. big plans for 24th street. >> we're trying to make this into a chinatown or japantown. so this particular element, you know, does not fit into the plan of the community. >> reporter: the council president cited studies that show low-income residents are less likely to use bike share and more likely to miss the parking. >> a lot of low income folks who are gardeners and painters use trucks. >> reporter: offering low income riders a $5 one one-year membership and putting more stations in neighborhoods of concern. bike east bay wants to get the word out, bike sharing is not just for the wealthy. >> going to get more people on bikes, get more people to support local businesses and have a happier and healthier way to get around town. >> reporter: in san francisco, jonathan bloom, abc 7 news. some residents in pleasant hill objected, but the city council approved plans anyway for carmax to open a used car dealership at a vacant big box store. other proposals call for building affordable housing on the site of what used to be a kmart. it's been vacant for five years.

there's been a surprise shutdown in san francisco. >> 7 on your side's michael finney is here to explain what happened? yeah, we heard about this first thing this morning. a popular fitness center in san francisco has abruptly shut its doors. 7 on your side bare on gulf and market streets closed down friday. members we talked to today said they received as little as one day warning. they say that warning came from an apologetic instructor, not
