advisory is coming up next. we really are not looking so good through walnut creek. here's southbound 680. we have total gridlock here. we had a full closure overnight for caltrans work. actually watched them pick this closure up, though, so that part of the construction has cleared. but it looks like we still have lanes down. once you make it to 24, so between highway 24 and pleasant hill road, we should have that wrapping up any minute. that was scheduled to be done at 5:00, but boy, if you're about to head out the door, definitely expect delays. we'll look at this on the traffic maps too. you can see where it's spilled over onto 680. looking more dramatic on the traffic camera. next update in less than ten. >> thanks. the search is on for the gunman who shot and killed a man while he was pushing his 3-month-old baby in a stroller. sky 7 was over the scene near hayward yesterday where you can see the stroller among bullet marks. the baby was not hurt and is now in protective custody. that shooting happened on willow at meekland avenue in an area

known as cherryland. investigators say the gunman may have targeted his victim. >> a young man, we believe he is the father of the child. moving forward, we're concerned about threats to that family, so right now, we're going to keep all that confidential. >> investigators are now talking to people in the neighborhood, trying to get surveillance video from neighbors. >> happening today, o.j. simpson will once again have the world's attention when he appears before the nevada parole board, hoping for his freedom. taking a live look at the lovelock correctional center, northeast of reno, where sempson will plead his case via video conference. he was convicted in 2008 of an armed robbery involving two sports memorabilia dealers in a las vegas hotel room. he's served more than eight years of his 9 to 33-year sentence. if he's granted parole, he could be released as early as october 1st. we'll carry o.j. simpson's parole hearing live in a special report at 10:00 a.m. right here on abc7 on the abc7 news app and

also on abc7news.com. >> happening today, local red cross volunteers will head to mariposa county to help victims of the detwiler fire. more than two dozen structures have been destroyed. another 1500 are threatened. thousands of fire personnel are on the front lines. red cross workers have opened shelters and are giving out basic supplies. a team will leave san jose at 9:00 this morning. another team will leze santa cruz at 10:00 a.m. we posted a link to the red cross on our website. go to at abc7news.com. >> a fleet of new train cars is arriving on b.a.r.t., and some of the new ones have just started running. >> they're being tested. matt keller is live at the warm springs station. >> yes, reggie and natasha. this is a test, only a test. these trains are not ready for passengers just yet, but this is a big step for this fleet of the future. in fact, we have video of these trains running last night here

at warm springs station. they were going from hayward. these are the first ones on the main line tracks during business hours. only staff was onboard. they're not certified to carry passengers. it will say out of service on them and the platform destination signs will read test train, do not board. the doors may open, but b.a.r.t. says barriers or staff members will be in place to keep you from getting on. this is exciting. these new trains will mean b.a.r.t. with run longer trains. that means less crowded trains. everything would be new onboard including the cooling system and padded seats with wipable fabric. the goal is to 35 new cars in service by the end of this year. b.a.r.t.'s goal is to get enough funding to increase the fleet over the next couple years to meet growing demand and relieve crowding. >> matt, thanks a lot. happening today, the oakland police department will reach out to the latino community. police chief ann kirkpatrick is hosting a public meeting to discuss the treatment of

undocument eed immigrants and tk about how they work with immigration and customs enforcement. oakland police want to hear your ideas to improve police community relgdzs. tonight's meeting begins at 6:00 at st. anthony's school. >> i want to show you this new video that's just coming in from colorado. overnight, there was a vigil held there for victims of the 2012 aurora theater shooting. today is actually the fifth anniversary of that shooting. and i quickly want to show you this. you can see the victims being remembered there with a moment of silence and a candlelight vig vigil. it was five years ago when james holmes went to the midnight viewing of the dark knight rises and started firing his weapons. 12 people died. dozens were injured. holmes is now serving a prison sentence of 12 life sentences. back to you. >> thank you. >> the santa clara county sheriff's office is investigating over an inmate overdose caused a jail lockdown. a total of four prisoners got

sick yesterday. three have been released from the hospital and are now back in jail. the fourth is expected to make a full recovery. investigators are trying to figure out what they ingested and how the drugs got into the jail. prison reform advocates believe part of the problem is jail understaffing. in its latest budget, the sheriff's office received funding to install body scanners in the jail. >> it will be similar to the body scanners at the airport, so they'll be able to hopefully defect some of these substances. >> the inmates were held in medium security protective custody. the investigation will determine if they will face any additional charges. new this morning, a bay area company claims it's found a way to measure whether drivers are high on marijuana behind the wheel. as california prepares to legalize medical -- legalize recreational marijuana next year, the test could provide law enforcement with a much needed tool. carolyn tyler gives us a closer look.

>> reporter: at sobriety check points, police are looking for drivers who may be impaired. >> marijuana has become just as strong if not stronger of a problem with driving as alcohol. >> identifying them takes a field sobriety test. oakland based town labs wants to make that easier. it's been working on a breathalyzer for pot that measures the amount of thc in a person's breath. the company gave us this video of its first field driving test. they got people stoned and then put them through an obstacle course of common roadside hazards. >> the whole point of this test was to show what happens when you get impaired. >> drivers navigating the course sober and then smoked marijuana 30 minutes before driving the same course again at speeds up to 60 miles per hour. >> when they were stoned, even when the levels of thc were low, meaning they didn't smoke very much, some smokes a lot, some

smoked little, they all made major errors. >> they're currently conducting clinical trials. they expect to make their marijuana breathalyzer available by the end of the year. carolyn tyler, abc 7 news. >> happening today, state attorney general xavier becerra will announce his plan to stop a proposed sale that could raise gas prices in california. he will speak outside the valero gas station in san francisco. valero energy company wants to buy the petroleum terminal in martinez. if that sale goes through, refineries will control all major petroleum terminals in northern california. without competition, gas prices would likely soar. we'll start with opening the weather window on the golden gate bridge. a little hazy here. not quite as foggy as it's going to get over the next hour or so. our beaches today for your activity planner, cool breeze. after being cloudy and foggy, you'll be party cloudy this afternoon. small craft advisory south of the bay bridge today.

and exercising, watch out for the extreme sunshine. let's take a look at temperatures. for the most part in the mid to upper 50s in the inland east bay. especially in the valley. pittsburg, antioch and brentwood, low to upper 60 there. also 60 right now in oakland, mountain view, san jose. 50 in novato. 54 in san francisco. pacifica, a cool 52 degrees. let's take a look around the state today. 93 in sacramento. not too bad. 100 in redding. 108 in palm springs. moers of the thunderstorms will stay in arizona and nevada today. if you're heading to yosemite, poor air quality because of the fire there. a lot of smoke and temperature around 81 in tahoe. to about 91 in yosemite. now, friday, sun and smoke once again in tahoe. it should dissipate to cleaner air saturday and sunday with temperatures in the upper 80s. for highs, and then 50s for lows. here's a look at 280 in san jose. quick look at the numbers for the next couple days. pretty comfortable. until you get to saturday and that's when we flip the switch

and a mini heat wave develops. i'll have all the details coming up next. here's alexis with your morning commute. >> we have our traffic alert in walnut creek. 5:10 in the morning, you do not expect to see this on 680. ouch, not a lot of fun right now. we did have a full overnight closure on southbound 680. i watched them pick that up. they got it done about an hour ahead of schedule, a little before 4:00 this morning. then we still had lanes closed between 680 and pleasant hill road. according to caltrans, that has been picked up. it was scheduled to wrap ought 5:00 a.m., but we have residual delays that will take a while to make up. delay your trip or go to b.a.r.t. or you sit through that. near 11th in oakland, we had a tree on fire. we had the left lane blocked in each direction. looks like that has wrapped up and things are resuming at normal speeds through the area, and our drive times for the bay bridge commute so far looking great. westbound 80, 18 minutes. 9 across the bay bridge, and southbound 101, you look great

that breaking news in berkeley right now. a car just slammed into a building near 6th street and jackson street. happened only a short time ago. look at the scene. you can see a black suv went right into sixth street center. looks like it went through some sort of door or window area. a witness tells us the driver was gone when police got to the scene. we've reached out to police. i will let you know as soon as we get any more details on this. back to you. >> thanks. senate majority leader mitch mcconnell said a draft of the new health care bill will be released today. republican leaders are pushing for a vote by the end ofthex week. details of the bill were finalized behind closed doors. senators have yet to review the new plan to repeal and replace obamacare. the congressional budget office estimates 22 million people would lose coverage under a repeal and replace plan. 32 million would lose coverage

over the next ten years if the senate outright repeals obamacare. the united nations released a report in paris today that stated for the first time the aids epidemic, more than half of all people with hiv are on drugs to treat the virus. aids deaths are also close to half of what they were in 2005, according to estimates. experts applauded the progress but question if the billions spent in the past two decades should have brought more impressive results. 5:15 now. this morning, a clearer picture emerging of a bride-to-be's final moments before she was shot and killed by a minnesota police officer. >> shots fired. one down. >> authorities releasing transcripts of two 911 called made by justine damond. in the first, the 40-year-old tells the dispatcher she can hear a woman screaming, saying she's afraid it might be a rape. she called back confirming her location and asking when police officers would be there. 15 minutes later, she cause

dead. an officer is still refusing to speak with investigators about why he shot her while sitting in the passenger seat of his patrol car. >> we cannot compel him to make a statement. i wish we could. >> the officer's partner said they were startled by a large noise right before the shooting. police say they also want to speak to another possible witness. a young man on a bike who was seen in the area. >> check out this crazy fight in new york city. it start as an argument and really escalated. one of the men who was driving a silver car grabbed a machete and attacked the other who then defended himself with a metal trash can. at one point, the guy with the machete threw it, nearly hitting the guy he was fighting. fists were thrown. heated words exchanged. a woman in the passenger's seat could be seen yelling and threatening to call 911. police eventually got there. the driver was arrested. the other guy was taken to the hospital but is expected to be

okay. he's a spanish guy. >> now, this seems even crazier. and of course, it's happening in where? florida. the man there is shooting an at&t truck just outside his house near miami yesterday. apparently, he was upset because he thought the crew was on his property. >> they were blocking the driveway. >> right, so he comes out and shoots out the tires. >> sure. >> even fired into the radiator. he was eventually arrested. no one was hurt. it turns out the at&t true was not on the man's property after all. >> still blocking the driveway. >> do you think he was like, oops, my bad? >> happening today, the body of salvador dali will be resumed as the result of a maternity case. a woman born in 1956 filed a maternity claim claiming he had an extramarital affair with her mother.

>> a legal battle brewing between madonna, a former friend, and the company auctioning off some of the star's personal items. >> they will square off in court this september to decide who has the rights to those items. candice gibson breaks down the legal battle in today's "gma" first look. >> in this morning's "gma" first look, madonna singing a happy tune. a new york judge blocking an auction house from selling some of the material girl's very personal items. granting the pop star a temporary restraining order that forced the auction house to remove 22 of 128 madonna memorabilia items for sale. among them, a revealing break-up letter from the late rap star tupac shakur. according to court documents, madonna was shocked to learn through media that the letter was being auctioned, saying i had no idea that the shakur letter was no longer in my possession. she also notes that most of the memorabilia put up for sale were provided by former friend darlene lutz, the material girl now claiming lutz betrayed

north bay, nearly total sunshine and 87 in santa rosa. san rafael, 79 degrees. vallejo at about 80. let's take a look at the south bay. 79, a refreshing breeze coming off the bay keeping you below average. milpitas, 74. the deeper you get to the valley, the less influence. 86, the cool breeze not quite getting you as much. san mateo, 72 today. it will be breezy on both sides of the peninsula. 60 at half moon bay to millbrae at about 68 degrees. palo alto, 74. along the east bay shore, faster breezes as you head south from oakland at 72, down to union city at 74. in san francisco, 67. almost average. same thing in the marinmarina. mission warmer at 68. enjoy temperatures in the 50s again tonight with cloud cover about the same as this morning. now, don't expect to see much cloud cover saturday and sunday morning except for at the coast where you're in the 66. low to mid 80s around the bay and we'll flirt with 100, then it will start to taper a little bit but still warmer than average next week. i know we all want to see the

roads improve, but is this the byproduct? >> yeah, this is what we have left over here in walnut creek, unfortunately, pretty big backup here on the southbound side of 680. this is all left over from some road work that scheduled to wrap at 5:00 this morning and here we are 21 minutes after. if you look towards the top of your screen, it looks like we still have flashing lights, but according to caltrans, we have all lanes back open, but boy, this really has not improved. it really wasn't too much of a problem until just aal before 5:00 when things starting filling in. keeping a close eye on this. we can check it out on the traffic maps too. if you're stating off on 680, especially from the concord area, you have about 2 1/2 miles of backup. it does improve significantly once you make it on 24, and again, we're hearing that road work has wrapped. we're working to confirm that woorb we don't have chp on the scene. here's a live look at the bay bridge toll plaza. no problems here. once you finally make it there. the metering lights should be flipping on any moment. next traffic just before 5:30.

backup between pleasant hill and walnut creek. slowly starting to improve. if you're just grabbing the keys and heading out the door, you can expect some delays. a quick check of the bay bridge toll plaza, metering lights at 5:27. things filling in there as well. heard about a new problem in the tracy area. we'll check on that next. >> developing news in the east bay as police try to figure out who shot and killed a father pushing a baby in a stroller. >> amy hollyfield is live. good morning. >> reporter: natasha, i just checked in with the sheriff's office here in san leandro. they say no arrests still. nothing happened overnight. they still haven't released any information about a possible suspect. they are asking for anyone with any information to please come forward. here's a look at the crime scene that just shocked the neighborhood yesterday afternoon. a 30-year-old man was shot and killed while pushing a baby stroller. his 3-month-old son was in that stroller. the baby is okay. it happened yesterday afternoon

outside of hayward in the cherryland neighborhood. residents say gunshots are common in the area, but they just cant believe someone pushing a baby stroller would be the target of violence. >> sad. whoever wants to try to do that in front of a child or even hurt somebody with their child, that's the wrong type of behavior. >> sheriff's deputies say they think that 30-year-old father was targeted. they haven't said why. child protective services is now involved. reporting live in san leandro. >> thank you. o.j. simpson is just a few hours away from the parole hearing that could set him free. he'll make his case via video conference. the 70-year-old was found guilty of armed robbery and kidnapping in 2008. stemming from a confrontation with two sports memorabilia dealers at a las vegas hotel. in 1995, simpson was famously found innocent in the brutal slayings of his ex-wife nicole

brown and her friend, ron goldman. later, he was personally found libel for their deaths in a civil case. the goldman family says they hope the former football star is not paroled. >> i understand our two cases are not linked, the murder case and what he did in las vegas, i think it's interesting to point out he stormed a hotel room with goons and guns to steal property. not a lot of people would do that, but that was where he went. his propensity is to be violent. his propensity is to go above and beyond what the law dictates he's soez supposed to do. >> if simpson is paroled, he's not expected to walk free until october 1st. and abc7 will carry o.j. simpson's parole hearing at 10:00 a.m. we'll also stream it on our abc7 app and abc7news.com. >> developing news in mariposa county. the huge and unpredictable wildfire burning near yosemite . check out these flames.

calfire says the detwiler fire has spreaded to 48,000 acres. it's still only 7% contained. 3,000 firefighters on the front lines battling these flames, with more crews on the bay. the town of mariposa and its 2200 residents have been ordered to stay away. in addition, to residents of colterville will given an emergency evacuation order. flames closing in on two sides. >> got the animals packed up. just waiting on the neighbors to follow us down now. >> i'm not going to worry about it. i'm alive. i'm not going to stay there for it to get to me. we'll come back. we'll rebuild if it happens. >> so far, 29 structures have been destroyed. another 1500 are threatened. calfire is going to give another update later this morning. >> fbi investigating a possible disturbance aboard a spearal airlines flight that took off from oakland. 576 took off just after 4:30 p.m. yesterday, bound for baltimore. the plane was diverted to denver international airport.

no one was hurt and no word on what exactly the disturbance was. the flight has been canceled and spirit airlines is working to get passengers on other flights to baltimore. well, this morning, san francisco police are investigating this deadly crash in geary and laguna. a motorcycle and a truck collided around 8:30 last night. the biker was declared dead at the scene. police say the truck driver is cooperating with investigators. the next generation of caltrain is about to begin, and it promises better service and less road congestion. governor brown will be in millbrae tomorrow to mark the start of caltrain's electrification project. it's going to convert from diesel to high performance electrical trains. it will allow for faster and more frequent service and reduce greenhouse emissions. 5:35 now. the sonoma marin area rail transit or smart plain plans to begin regular service soon. they may get federal approval as

early as next week. they found no red trags. the smart train will travel 43 miles from sonoma county airport to santa rosa to downtown san rafael. there are ten stops along the railway. the schedule includes 34 trips every week day. >> san francisco's planning commission expected to give preliminary approval for a new hotel. this wld be built on the site of the old tower records on columbus street and jones street. marriott international is targeting millennial tourists with a moxie hotel that will look like this, featuring up scale dining and bars that turn into coffee houses during the day. they propose constructed the four-story 75-unit motel, and the proposal does not include any off street vehicle parking. >> let's take a look at the golden gate bridge this morning. you can see, not too cloudy here. it will get cloudier over the next hour or so. on the roads today, yeah, go from clouds and a little fog to sunshine.

inland. we'll look at the microclimates next and the 100s for the weekend. >> we're slowly starting to look better through walnut creek, we have been checking this out all morn. southbound 680 was gridlocked for three miles due to overnight road work around the 24 interchange for some paving work. they have that wrapped up. we have totally confirmed that. not seeing any more flashing lights and caltrans says all lanes are open. i want to flip to our traffic maps and show you what's left if you're coming from concord or pleasant hill, you still have about a three-mile backup to get through as you head to 24. so down to around eight miles an hour through the worst part. i think when we check that again in ten minutes, it's going to look a lot better. westbound 205 before grant line road, a crash just pushed off to the shoulder. you want to head south through the tracy area and then of course once you make it onto 580, we're slow towards altamont pass. 14 and 12 miles per hour for your average. no blocking incidents there. we'll look at drive times at 5:50. >> this morning, john mccain

5:41. politicians sending prayers to longtime senator john mccain. mccain announced yesterday he's been diagnosed with brain cancer. senator mccain returned to arizona last week for surgery to remove a blood clot. during that procedure, doctors found the tumor. this is not the first time senator mccain has battled cancer. he's had several melanomas removed in the past. the 80-year-old will stay in arizona to recover and then begin treatment. well, president trump says he never would have appointed jeff sessions attorney general if he thought that sessions would recuse himself from the investigation into russian meddling in the 2016 election. the president called the recusal, quote, extremely unfair, during a wide-ranging 50-minute interview with "the new york times." sessions has not commented on mr. trump's remarks. he was the first sitting senator to back mr. trump's presidential bid. >> next week, we'll see the most high-profile lineup yet to testify in congress about the russian probe. donald jr., his son-in-law jared kushner and his former campaign chair paul manafort are all set

if you're walking around and the trees in san francisco look more neatly kept, it's thanks to a new program. crews from the department of public works were out trimming trees. this is part of a voter approved plan to have the city begin caring for the 125,000 trees that line city streets instead of you. carla short supervised the work.
