transportation projects. state lawmakers would also need to approve the measure and the governor would have to sign off. there's a lot before it would go before voters next year. >> quick action by san jose firefighters is being credited with stopping a destructive grass fire from getting out of control. it burned at least one building off query road near almaden lake park last night. videos show the flames which charred three acres. no word yet on a cause. >> it's now 4:30. if you're just joining us, let's get a quick update on weather and traffic. >> we'll start with the 12-hour day planner. what you're going to see are temperatures add 7:00 that are around the mid to upper 50. through 8:00, notice the gray. those are the morning marine layer clouds. they're back to the coast and going to be stubborn. 65 at san francisco. you can see upper 60s to low 70s around the bay. and 80s starting to show up in the inland east bay neighborhoods.

by 4:00, the clouds stubborn at the coast. 65 in downtown san francisco, but probably 61 along the coast. temperatures in the mid 70s around the bay, and look at these, low 80s in the south bay. mid 80s in the north bay, and upper 80s to near 90s. today, a little warmer than yesterday. but i still got at least a day or two of 100-degree heat in the seven-day forecast. here's alexis. >> at this point, all we're dealing with is overnight road work. it's really not too bad. zooming in on our traffic maps, we have lanes on northbound 880, scheduled to wrap up at 5:00 this morning. i'm not seeing any delays and this is for that continuing work of the removal of the 23rd avenue overpass there. so just a long-term project and we have seen a lot of overnight lane closures with that, too. also, 680 through walnut creek looking great. we do have some construction on eastbound 24. i'm not seeing any for westbound 24 this morning. that should not cause major delays either. we'll look at drive times in

less than 10. >> from castro valley where 61 people are without power after a red volkswagen crashed into a power pole. this is new video into our newsroom. this happened after 2:30 this morning. the vokelkswagen was involved i another collection with a black bmw before crashing into the pole. the driver of the volkswagen is now under arrest for suspicion of dui. >> protesters angry over planned parenthood took out their anger using chalk. >> they scribbled anti-abortion messages all over the front sidewalk of a home. >> the work here followed them home. we've got some video of those messages. take a look at these anti-abortion messages that showed up outside the home of dennis richards. this is after the san francisco planning commission approved a new planned parenthood. some of the messages include

save the babies and baby killer. neighbors of dennis richards told the san francisco examiner that about 40 young kids and 3 adults were responsible for doing this graffiti. this did happen outside the home of two commissioners. one, though, asked to remain anonymous. dennis richards is the other one. ironically, he wasn't even there for that vote. the commission did vote 5-0 on that planned parenthood, new planned parenthood, but he wasn't even there. reporting live in san francisco, amy hollyfield, abc 7 news. >> thank you, amy. happening today, the central california woman who live streamed a deadly car crash on instagram is scheduled to make her first court appearance. the 18-year-old was arrested on suspicion of dui and vehicular homicide for the death of her 14-year-old sister. another teen survived.

the chp said she was impaired when she crashed last week. the stockton teen has refused to submit to a chemical test and did not cooperate with officers. >> we were doing this incident normally, as we would author a search warrant to draw the suspect's blood. in this case, the hospital we were at would not do that. >> investigators plan to subpoena her medical records to prove she was under the influence. prosecutors say the instagram video is going to be a key piece of evidence in the case. in it, sanchez is heard saying she expects to spend the rest of her life in prison. u.s. and australian drug agents made a huge bust in santa rosa, finding 560 pounds of methamphetamine in a storage facility. these are the pictures of the drugs. it's a stunning amount. authorities say a 72-year-old australian man planned to buy a plane and fly the drugs from sonoma county airport to australia. which would be an extraordinary trip even for experienced

pilots, which the man was not, according to officials. the stockpile of drugs is worth more than $200 million american if sold on the australian black market. >> some merchants in chinatown are fighting back against unruly custom customers. we're told one store owner took matters into his own hands. >> no, no, no. >> charles lue recalls what little was said before he was punched in the face. he said this man, thomas baker, walked into the store sunday and started throwing hats on the ground. when the 86-year-old confronted baker, he was punched. through a tranlsilator, he sudd kung fu stick from a sales display. >> because he was mad, really mad. he said after he hit him, he got really mad so he started hitting him. he hit him like that. >> how many times? >> just a couple of times. >> baker also had a knife, which he dropped before running out of

the store. police caught him a few blocks away. >> he's lucky. he's really lucky. that guy could have overpowered him. and i certainly don't -- would not have handled it that way. >> those are the chinatown merchants association say crimes against store owners happen daily and are on the rise. it's leading to a lot of frustration. >> some of them, they're feisty. they'll fight back for their things. and they're sick and tired of being victimized. >> but, police warn against that. in san francisco, lisa amine guleashen. >> the san francisco board of supervisors has given approval to the new office of cannabis, and is considering now a moratorium on permits for new medical marijuana dispensaries in the city. the board is moving cautiously to address new issues arising prior to recreational pot becoming legal in january one is whether medical weed

dispensaries will convert to adult use and if so the permits they might need. supervisors also approved a cap on pot dispensaries in district 11. >> in the south bay, the santa clara valley water district is partnering with the u.s. army corps of engineers on a flood study. they hope to reduce flood risks along coyote creek in san jose. they accepted the request for assistance on the study. thousands of residents were evacuated and had property damage in january's flood. they say the feasibility study is an important step to securing funding at the federal level. >> let's open up the first weather window to the morning on the san mateo bridge. the sky is becoming cloudy, and eventually, it will become sunny. grab the sunglasses. mass transit a bit warmer today and still have a small craft advisory. guess where it's going to be, same area as yesterday, 1:00 this afternoon to 11:00 this

evening, that area you see shaded in yellow. heading out in san francisco, temperatures about 1 to 3 degrees warmer than they were yesterday. we have 57 to 59 degrees. so very uniform atmosphere there. hey, if you live in livermore, today is one of the first of many days you're going to reach 90. very nice this morning. 62 at 9:00. 90 by 2:00. quick look at san mateo, 70 by 10:00. mid 70s through 6:00. 67 by 8:00 this evening. 60s at the coast with 90s creeping inland. a small jump. hot spots develop in the inland neighborhoods tomorrow, and there might be a slight drop friday, but the weekend forecast is still full of heat. here's alexis. >> so far so good on the roads today. here's a live look at the bay bridge toll plaza. no metering lights yet. we're wide open, even in the cash lanes. we have almost an hour to go before it will start filling in and slowing down. drive times looking great.

where charlie gard, a baby with a rare genetic disease from the uk, will spend the rest of his life. his parents want him to come home and die at home. charlie's mom and dad spent nearly a year trying to get permission for their baby to travel to the u.s. to access experimental treatments, and they actually had to withdraw their efforts on monday. the case has drawn attention of both president trump and pope francis. and attracted widespread grassroots support. the judge also this morning considering placing charlie in hospice care for his final days. happening today, the murder trial for the man charged in the death of an off-duty richmond police officer is scheduled to start. officer gus vegas waus killed last february as he intervened in a domestic dispute involving his daughter and her boyfriend. robert vega pleaded not guilty by reason of insanity. jury selection is set to be held today and tomorrow with opening statements in the trial friday.

he could get life in prison if he's convicted of murder. >> to a story you'll only see on abc7 news. we hear from the former santa clara county correction officer on trial accused of assaulting an inmate. the judge declared a mistrial after the jury deadlocked. we have the story from san jose. >> i would like to thank the jurors. >> 11 of 12 jurors found that former santa clara county correctional officer tem tree was not guilty of assaulting an inmate in 2013. a hung jury means a mistrial. >> the 11 jurors were very adamant with us that they saw the case for what it was, that truly mr. tree was doing his job, what he was expected to do, and saving his partner. >> because the district attorney could decide to retry the case, tree won't comment about what happened during the confrontation with the inmate, but he told us this about being a correctional officer. >> the job is already tough. you're not dealing with regular people. this is bad people outside that

are coming in and we had to take care of what we had to do. >> the president of the correctional peace officers association says tree should never have been arrested. >> with this particular case, to me, it seem like a witch hunt. >> amy says the district attorney filed the charges against tree three years later, only after three officers were accused of beating to death mentally ill inmate michael tyree. those officers were found guilty of second degree murder. >> if there's a problem at the jail, it's focus on reform and we're doing that right now. >> the sheriff's office fired tree after the incident. a spokesperson said they supported the d. aft's decision to prosecute. >> we honor those deputies who perform the job the right way, by bringing this case to the district attorney's office. >> the district attorney's office said they're reviewing their options. it's 4:45. an electrical problem is blamed for leaving nine people stuck on a ride at gilroy gardens. sky 7 was overhead as

firefighters worked to free the riders inside the greenhouse yesterday afternoon. they were stuck for at least an hour. the gilroy fire department says there was a dead rail preventing the cars from moving. firefighters used ropes and ladders to pull the cars to an area where the passengers could get off safely and no one got hurt. >> a new landlord has problems for richmond's hilltop mall and the area around the shopping center. the new owner intends to develop office space, hotels, and more than 9600 housing units on the property near interstate 80. it went into foreclosure about four years ago. our meadier partner the east bay times reports the new owners want to rebrand the mall itself. hilltop has struggled keeping tenants, about one quarter of its retail space is vacant. >> take a look at your wednesday forecast with mike nicco. >> a good thing the people in gilroy weren't in the heat we're going to have the next couple days when they were stuck on the rail. a little breeze on the ferry building. going to be sunny away from the

coast. the warming trend begins and the heat holds inland. cloudy and pretty comfortable the next several nights. in the south bay and gilroy, 91 today, along with morgan hill. 89, los gatos. 78, milpitas. sunny 71 in santa cruz. quite a spread on the peninsula. millbrae at 72. everybody else in mid 70s to 80s. mid 60s along the coast to 70 downtown, south san francisco. sausalito. 62 in san rafael and vallejo to 87 in santa rosa. low to mid 90s around cloverdale and lakeport. 78 in fremont. as we head inland, just about everybody in the low to mid 90s. here we go. check out the temperatures. tonight we'll be in the low 50s to mid 60s. here's my accuweather seven-day forecast. what you're going to see are temperatures that are going to be really hot inland. not as bad around the bay. we'll have mid 70s to mid 80s,

and you can see low to upper 60s along the coast. now, i come back in a new minutes, we'll take a look. baseball and soccer today. and we've got traffic. >> yeah, and guess what. it's going to impact all of that. traffic is going to be involved. so we have more on those events coming up shortly. right now, looking a wednesday morning commute, and so far so good. we're really looking at light volumes. one new issue on the benicia bridge. southbound 680 near the midspan, a rart of some debris there. somebody lost some 2 x 4s so chp is running a traffic break. they will pick those up shortly. not seeing delay now and it could be closer to the 780 interchange. just keeping an eye on that. not something you want to hit with your vehicle this morning. the rest of the bridges look great. just watched zipper trucks go through. no delays from the north bay. we'll look at drive times in less than ten. >> thank you. on a related note. fewer people riding buses and ferries in the golden gate

transit district, and the san francisco giants may be partly to blame. ridership on the ferry to at&t park is down because of the team's bad season. ferry ridership fell by a little less than 1% between july of last year and the end of this past june. also golden gate's buses carried more than 10% fewer riders. the district says the drop is due to the winter's wet weather and more people telecommuting instead of riding to work. >> new york governor andrew cuomo has given the okay for cuomo has given the okay for state legislators to t textalyze rrk. it analyzed driver's cell phones to see if they were used just before a crash. as you might imagine, there are numerous privacy and constitutional questions here regarding the texalizer. we also need a new name for that. >> a very aggressive name. >> a man accused of smuggling
