risk. the water district says it's the first step at securing state and federal funds. the water district has asked for the court's help all the way back to 1997 when the creek flooded. it was turned down because no federal interest at that time. a former contra costa deputy ordered to stand trial on criminal charges for his alleged sexual involvement with an underage teenager. jasmine testified against perez yesterday. she said she reached out to perez on facebook in july of 2015 and within one month they had sex at least six times in his car in the oakland hills. perez and his attorney declined comment. in court they argued perez did not know she was 17 until months after the sexual interactions. the city of oakland is moving forward with gender neutral bathrooms on city property. our media partner at the east bay times says the city is moving forward with the resolution to install the first gender neutral bathroom at oakland city hall.

from the live desk new developments of a major train accident we're following in barcelo barcelona, spain. the trap did not brake properly when it crashed into some buffers. the accident happened just a little after midnight our time. during the morning rush hour in barcelona. cell phone video you see here shows the damage to the front of the train. government officials say 54 people were injured. dozens of passengers had to be taken to the hospital. the regional health chief says one person is seriously hurt.

now in custody. the fire department responded to reports of a building on fire. they found a man accused of setting the fire on the roof, smoke rising from the building. police spent nearly an hour trying to get that man to come down. the suspect demanded to speak with his kids before turning himself in. fortunately, no one was hurt in that standoff. we're learning this morning of a dramatic drop in one particular type of crime in san francisco. >> yeah, cell phone in your hand is safer than it's been in years. amy hollyfield is live downtown this morning. hi, amy. >> officials think a new california law is doing its job. they say the kill switch that is in your phone is now making it less desirable to thieves. california law says that manufacturers of smartphones now have to put a kill switch in them. once you activate that, it makes the phone useless. we found some people haven't even heard of this law. but they like it. and are glad to hear about these

the scene. no far no word on what led up to the stabbing. new this morning, san jose police are investigating what caused a driver to smash into a tree. look at this new video we got overnight. the crash happened just before 2:00 this morning on highway 101. took rescue crews about 30 minutes to pull the driver out. he was taken to the hospital. no word yet on his condition this morning. happening today, a judge expected to set a trial date in the kate steinle murder case. accused of shooting her in 2015. she was hit while walking with her dad on pier 14. lopez sanchez told abc 7 news he found a gun and it went off when he picked it up. lopez sanchez had been deported to mexico five times before the shooting. because of san francisco's sanctuary city law, authorities ignored a request by federal agents that he be detained. the steinle shooting touched off a national debate about sanctuary laws. this morning investigators in ohio say they are confident

they will find out what caused a thrill ride to fail at the state fir killing an 18-year-old high school student. tyler had just signed up with the marines a week ago and was set to begin basic training after graduation next year. his girlfriend was among seven people who were badly hurt when the fireball broke apart friday night. the dramatic video captured by a fair goer could become an important piece of the puzzle. forensic video analysts can take it down frame by frame for a better understanding of when and where the ride came apart. the fireball ride is shut down indefinitely at the santa cruz beach boardwalk and five other locations in california on orders from cal osha. sonoma county fair owners decided to ban the ride when it opens next week. a similar ride called delarium is also closed as a precaution. the dutch manufacturer has ordered a worldwide shut down of all the fireball rides until it

can come up with a plan for safety inspections. four people now face charges in connection with dozens of car break-ins in the east bay. brentwood police have identified two of the suspects as 20-year-old brian randolph and 20-year-old john robertson as you see here. we won't name the other two because they're teenagers. investigators say the group admits to breaking into 17 cars in the parking lot of a brentwood hotel last friday morning. one of those cars was stolen. it was later spotted near a livermore apartment complex where another 36 cars were broken into. the suspects say they committed the break-ins o s hoping is to l valuable items. this morning state officials say owners of 93 dams set to double check their spill control spillways. the peters dam in marine county and the coyote dam in santa clara. the department of water resources released that full list yesterday. the sacramento bee reports dams

the behavior seen in the video is unacceptable. some folks seeing red after a ton of pink. cal fire trying to figure out why one of its air tankers accidentally dumped 100 gallons of fire retardant all over a sonoma county neighborhood. look at this. everything was pink. plants, roofs, cars and most of the street and sidewalk on decanter circle in windsor were all covered in pink. the homes right in the flight path of the charles m. shultz sonoma county airport and local firefighters did work with cal fire yesterday afternoon to try to wash everything down. >> i came on up to the front and opened the door and it was like everything was pink. >> nine homes, 13 cars were coated with the retardant. it is considered nontoxic. here's the thing, it can damage paint. >> i can imagine that it could. what a mess. flash flooding is a big problem in alabama and here's proof.
