the case for pab.a.r.t. to relee more images of its new met cork of working video cameras. ho after police released these photos, they had their suspects in custody. a man they believe violently attacked two b.a.r.t. passengers in three days. >> once we saw it was the same possible suspect, we believed it was a public safety issue and we wanted to get that information out as soon as possible. >> reporter: 42-year-old mario christopher washington was spotted by an oakland fire department investigator in downtown oakland just after 8:30 this morning. police say he's the man who approached a b.a.r.t. passener thursday night. and then struck him in the head with bolt cutters. saturday, the same suspect punched a passenger twice in the face. washington has previous arrests, including for a strong arm robbie in january.

he believes b.a.r.t. should release images in his case. >> my question is why is b.a.r.t. not releasing other videos of crimes? there was a pepper spray incident at the embarcadero station over the weekend. and there's the mob attack that we were part of. >> it's believed those people were juveniles, and there are guidelines of the release of those images. this case, clearly it was an adult. clearly it was someone who could strike again. >> reporter: b.a.r.t.'s board of directors is developing a new policy on the release of surveillance images. laura anthony, "abc7 news." san francisco police have just released a picture of one of two people charged in last month's fatal shooting and robbery on twin peaks. he was linked to the crime after being arrested in another armed bbery at s mary's cathedral square. th second suspect was 20-year-old from san francisco.

investigators say the pair shot 71-year-old edward french and took his camry on july 16th at the overlook. now to a story you'll see only on "abc7 news" about the continued effects and aftermath of this massive fire in oakland. exactly one month ago, this seven-story apartment building, under construction, burned down. heat from the fire was so intense that windows from a nearby office building cracked and fell. >> reporter: pamela carol was forced to leave her apartment complex when this one, under construction on valdez street, caught fire july 7. the blaze at the building is considered suspicious, possibly the work of an arsonist. and this portion of 23rd street between harrison stil closed off. >> i don't know why they have

the street blocked off, because they're not falling anymore, i'm pretty sure. they're all boarded up. >> reporter: heat from the fire caused the windows to fall from this office building. one month later, some still can't park near their apartments and the nearest spaces have two-hour limits. >> there's very little pki here. no one can park in the parking lot. at lady with the yellow car, her car is stuck in there. >> reporter: carol and others want to know how long the situation will continue. they realize it may be a safety issue, but gaining access creates a safety challenge, too. >> i could walk in and out. what if an ambulance had to come? >> reporter: a spokesperson for oakland said the city issued permits to this owner to close the road to ensure minimum risk for public safety. the owner of the building, with boarded windows, is still working on repairs. lonnie rivera, "abc7 news."

a cross country murder case went to court today. the suspects are a professor and oxford university employee. melanie woodrow walks us through start of the legal process. >> reporter: one of two men accused of a fatal chig ste aala stabbing is headed back >> i don't know the facts. >> reporter: police described a horrific crime scene after receiving an anonymous call. they found 26-year-old trenton cornell stabbed to death. latham is also facing murder charges, fled to the bay area where they turned themselves in friday night. according to chicago police, before his surrender, latham sent a video to family and friends apologizing for the

sexual texts on a flight, she took a picture and alerted flight attendants. 56-year-old michael keller was arrested when the plane landed. the woman told our media partner "i'm being labeled as a hero. i don't need a bunch of attention. i'm just thankful the kids are safe." she added "it means the world to me and i hope by my example somebody who sees something wrong and might not want to say anything will speak up." it's now official, santa cruz has a new police chief. andrew mills was sworn in. he most recently served as chief of police for the city of eureka. oakland's deputy police chief is headed to the northwest. 41-year-old daniel outlaw was

named today as portland's police chief. she'll be the first african-american woman to hold that post. she's only the second woman ever named deputy chief. he will be introduced on thursday. new at 6:00, economists at stanford say obamacare is not having a negative effect on jobs. that was one concern raised by critics based on early projections by the congressional budget office. three economists studied the law's impact and found there was no major effect on the u.s. labor market as a result. the predicted positive and negative effects seemed to mostly balance each other out. another reason is that the predictions were made based on changes to medicaid and didn't look at the impact of insurance exchanges. they suspect the trends will continue in the future if no changes are made to obamacare. if it is changed, it's hard to predict how that would affect the labor market because it

would likely change medicaid and the availability of subsidized health insurance. two bay area counties have cases of west nile virus. last month, it was found in two dead birds in contra costa county. this is considered a late start to the west nile season. now to the developing story of the legal trouble involving the sinking and tilting millennium to youer in san francisco. that high rise is filled with luxury condos and sits next door to the new transbay terminal. kate larson is live with the latest developments in a case that's become a real ms. kate? >> reporter: that's right. this case management study is one of many filed by law firms across the city on behalf of lawsuits for the millennium tower. there's information in this document that the tower is tilting at more than twice the

previous rate and they would like to accelerate the trial schedule to expedite a foundation fix before the problem gets worse. >> it's discouraging. this is over a year now sense we learned about the sinking and tilting of the building. >> reporter: a hearing about the building in superior court today left more questions than answers when it comes to the future of san francisco's leaning tower. jerry dotson said consensus is that a fix is necessary but feels that's not the priority of the developers or the city. >> most disappointing is the fact that the mayor has not said something about fix thing building and the 1200 people in it and the safety of the people in it. >> we are looking for the earliest possible date to get this to trial. >> reporter: he believes the case will go to trial next year.

the dow jones closed at a new record high. today, it gained 5 points, ending the day at 22,118. the nasdaq saw a 32 point boost and was the only index that didn't set a record tonight. the s&p closed at 2480, a new high. $1.5 billion leads tonight's bay area business watch. that's how much tesla is raising so that it can produce more of its new model three cars. the first ones were unveiled at the end of july. we showed that to you as it happened. the ceo elon musk says tesla will make 10,000 model threes each week next year. it costs about half as much as other models. netflix has bought miller world. the publisher owns the rights to several graphic novels, which have been turn swod ed into mov.

women and minorities in california are leading the nation when it comes to owning a business. according to the u.s. census bureau, nearly 13% of american businesses owned by women are here in the golden state. 23% of minority owned businesses in america are also in california. it could be part of a growing trend in culture and women of mi minorities. >> it's easy to pass regulation when you don't fully understand how that regulation is going to play out and affect the bottom line of a business owner. >> advocates say california lawmakers need to get rid of the excessive regulations and taxes. >> talk about taxing. the heat has been brutal lately. >> not as muggy as it was. >> now we have a week of i think fairly comfortable weather

go back to school all over the bay area. but in south san francisco, they're still waiting for the school to be ready for them. this school has been under construction for years. >> it's way past deadline and way over budget, too. leeann melendez has been following the process for years, and now has an update on when it may be finished. this is a story y'll only see on "abc7 news" tonight. >> reporter: the construction project here has been a long ordeal for neighbors who live nearby. >> very dusty, and very noisy. >> reporter: the last phase of the project was supposed to be completed by 2016, but it's still looking like this, unfinished buildings and heavy equipment moving quickly to meet yet another deadline. >> it still isn't finished and we're still dealing with it. >> reporter: two years ago, we came to talk to parents on the first day of school. back then in 2015, not all of

the classrooms were finished. today, the district says it's been the largest and most expensive construction project to date. in addition, the general contractor in charge was replaced, finding a new company took time. >> it was just a big pile of metal sitting up here. it just sat there until they finally figured out how to get the second team in here, which is why they're at now. >> reporter: the district blames increasing construction costs in the bay area for going over budget. it says they've also added to the project. what was estimated to cost $21 million in 2013 is now approximately $30 million. tomorrow night, the district will meet with parents and neighbors again to discuss where they stand. the school district promises to have the project completed by december of this year. we'll be back. in south san francisco, leeann melendez, "abc7 news." tomorrow, the judge in the kate steinle murder case is expected to set a date to begin

the trial. "abc7 news" was there as he went before the judge with his lawyers. he's accused of killing ty inin in 2015 on pier 14. over sanctuary cities and te immigration policy. the judge discussed scheduling conflicts with another case today. no rulings were made. b.a.r.t. is reaching out to the public to get input on its proposals to reduce congestion in livermore. the main recommendation is to add a new station, but one lawmaker is predicting high costs and lowridership. >> reporter: when sky 7 flew above 580, traffic was sprawling. for years, there's been talk about b.a.r.t. bringing relief by expanding service to livermore. the talk is now taking a step closer to reality, with the transit agency evaluating a

proposal to extend the rail line by 5 1/2 miles down the middle of i-580 to a new station near the isabelle avenue interchange. it would cost approximately $1.3 billion. state senator cscott anthony weinerer is opposed, saying ridership would be load and the cost too high. >> pab.a.r.t. is struggling. to put a new b.a.r.t. line on top of it is just going to undermine the rest of the system. >> reporter: but the mayor tellitell i s the need is critical. with tens of thousands stuck in traffic, impacting air quality and employment in the region. >> we did a poll. over 70% of our residents want b.a.r.t., because they've been paying for b.a.r.t. for the last

15 yea 50 years. we have nothing to show for it. >> reporter: b.a.r.t. says the agency is exploring other options, including not going forward at all, or using express buses. two public meetings have b scheduled for this month. carolyn tyler, "abc7 news." officials are looking for ways to utilize the fair grounds. the county fair operates four days out of the year, and the county is hoping to attract someone with deep pockets to develop the space. since spring, they've had a number of proposals. but it needed the county to chip in. at this point, it doesn't want to subsidize private businesses. >> maybe we didn't reach the right people. we tried. we reerped o ereached out in th. but it does require a sizable investment. >> next week, the director will be advising the board of

supervisors to deny all the proposals submitted. if they agree, it's back to the drawing board. a south bay restaurant is taking the city of santa clara to court over plans to replace it with a new development project. the long-time owner of david's restaurant says he's been treated unfairly here. david louie also got the city's side of the story. >> reporter: while some restaurants come and go, david's has been operating in santa chaira for over 30 years, but the future is uncertain because of plans to turn the land into a mixed use project. the owner is on notice to vacate and he's asking for fairness. >> that's all i'm asking. treat me fairly. at one time they were looking at relocating me, finding me a new location and compensating me. >> reporter: what appears to bother him the most is the golf pro shop next door has had their lease extended.

unfortunately, some sad news today as former 1979 american league mvp don bayr dd of cancer. bayl played 19 years in the bigs, the first manager for the rockies in 1993. won mvp as a player and manager of the year. spent two years with the a's, 12 years alert ending his career with oakland in 1988. some wardrobe news for you. for the first time, the pga has allowed players to wear shorts during practice rounds for the pga championship. ricky fowler and jordan spieth among those taking advantage of it. rory mcilroy did not. he wore the nor nor nor nor norr spieth completing the career grand slam this week. an update on the little league, san ramone lost to southern california 3-2. so they're back in action tomorrow morning. we'll see if they can fight their way through the little league and get to the little league world series.
