still not clear if the victim was a customer, worker, someone else. the homicide happened late last night around 11:00. let me show you some of the video that we have from overnight as things got ramped up there and that investigation began. they had to block off the entire area around 1:00. you can see that obviously as we take another quick look at that live image here there are still people out there and we have a crew out there as well. reporter matt keller is gathering more details for us and we'll check in with him in the next hour. thank you. on to developing news now, a google employee behind that controversial memo is officially out of a job. >> a louft probably saw this on your feeds yesterday. that memo made public over the weekend. it argued that women don't have the biological makeup to succeed in silicon valley put see the employee there identified as software engineer james de more pets tells "the new york times" he will likely take legal action. >> in his 10-page manifesto he

golden gate golden gate brid we're back at 5:14. an alert firefighter is credited with spotteding the man suspected of two unprovoked attacks on bart. we broke this news of the arrest of 42-year-old mario washington on abc 7 news at midday yesterday. washington say transient who has been arrested before. he's accused of beat a man with bolt kutders on thursday then punching another man in the face on saturday. police released photos in a rare 6:00 a.m. news conference to e frens. two hours layer a firefighter saw him in oakland and called police. police in richmond arrested a 13-year-old for possession a rifle. these photos were poeftded on the website page. they say three teens were in the

237. we have a five-vehicle collision just before that connecter. sounds like we may still have one lane blocked with debris but there's no injuries and pretty much everyone off to the shoulder. no delay through that stretch yet. and then we will filling in and slowing down at the bay bridge toll plaza those metering lights on just a couple minutes ago. we do have a decent back up northbound 101 in san jose due to a crash. we'll head back there next. we're following breaking news in the south bay. police investigate a shooting that killed a man in east san jose. >> and this happened overnight at a shopping center at sim by and south white roads. abc 7 news reporter mackatt kel is there. >> reporter: the cornrow nor arrived on the scene and took the body away that's usually a sign police are wrapping up the investigation at the scene but we still have homicide investigators here. so far police have made no arrests. this was a big investigation here. the person was shot and killed inside jim's liquor mart just before 11:00 last night.

surveillance video could be a key part of this investigation, especially since this happened in a strip mall where many businesses likely will have some sort of cameras. we have confirmed the victim is an adult male. i asked them if they knew who th roads are open, but the rip mall will remain closed unti they complete their investigation. reporting live in san jose, matt keller, abc 7 news. thank you. 5:32 now. oakland firefighters trying to determine what cause dollars a two-alarm fire at a home. fire start aid round 10:40 last night on 57th avenue in the seminary neighborhood. crews closed off the street to keep the flames from spreading to nearby homes. a power line also fell which made it dangerous for firefighters. no word on any injuries or how much damage is left behind. happening today, the san jose city council is going to discuss several issues related to those devastating floods that damaged hundreds of homes in february. city council meets at 1:30 today to update the current recovery efforts.

tornadoes are rare on maryland's eastern shore. if confirmed this would be the second in two weeks. happening today, two suspects in the murder of a film scout at sansc twin peaks will make their first court appearance. they say 19-year-old lamont mims and 24-year-old fan tas sit decuir shot and killed edward french for his camera. we have learned that mims was released six days before that murder. >> he was arrest ford a firerms possession charge and he was confikted of that charge and was released on his own recognizance. >> french was a film location scout and may have been atop twin peaks work at the time. they got a break after a man and woman were robbed at gunpoint for a camera at st. mary's cathedral. they arrested mims and decuir for that robbery thursday conspiracy. a deadly stabbing in chicago is head back to illinois.

lathem waived his right to fight extradition in a court appearance yesterday. andrew warren and lathem are a cuesed of murdering a man in lathem's high rise condo last month. the victim lived with lathem. police found his body after getting an anonymous 911 call. lathem and warren surrendered to police friday night. his lawyer says he will plead not guilty when he returns to chicago. measure to repeal a ban on flavored tobacco products in san francisco has qualified for the ballot. it goes by the name let's be real san francisco and it's furchd almost entirely lit r.j. reynolds tobacco company. they will reconsider the ban if the board declines to repeal the measure will be set for a special election or the next sted scheduled city election. happening today, morocco town is trying to discuss how to raise money. the resev fund is nearly dry. money woes began over a year ago when a sinkhole opened up after

northbound 101 just before you get to story road, this is where we've got a two-car crash. involving an empty gas tanker truck and it sounds like a smaller vehicle, something like a four runner. we haven't gotten word on how serious the injuries are but we had an ambulance called to the scene and we've got the three left lanes blocked. no estimate on when those lanes will be open. it does sound like the tavger truck is going to need to get towed off the scene so that's likely one of the reasons why. well over three miles at point, looks like we're closer to four and you're crawling 2 miles per hour, 6 miles per hour approach that scene. talking about a few of the alternates, capital expressway up to 680 that's one way you can loop around, 82 wide open, 87 looking good at this early hour and i just checked the surface street flows for a couple of these side streets, they're still looking good as well. do you have a lot of options at that point, but if you get on northbound 101 you're going to be sitting there. i highly recommend anything except that at this point. quick check of the bay bridge toll plazaer those metering lights on for about 20 mands
