though. parts of texas supposed to be getting rain the rest of this week. all right. thank you. on to developing news outs of missouri where police are continuing around the clock manhunt for a cop killer. meantime the brother of the slain officer is calling him his hero. 37-year-old gary michael was shot and killed on sunday night by a man he stopped for a registration violation. michael's brother hopes that his death makes the world a better place. >> our community's going to be a little stronger and maybe our country's going to be a little stronger and if my brother did that, then that's a hell of a deal because he's not here before and if he could do that that would be a pretty good diehl. ease probably take that. 39-year-old ian mccarthy has been identified as the killer and he's been charged with first-degree murder. they set up check points where the shooting happened and he is considered to be armed and dangerous. this morning police in cleveland ohio, warning people after a 4-year-old boy was shot in the head after a road rage

this is pretty interesting. for the first time in harvard's 381-year history mat jort of students offered admission are nonwhite. the incoming freshman class is made up of mostly minorities, so that's nearly 51%. 22% of that group is asian money american, 402% after fan can american and the rest of latino american and hawaiian. that's making history.

story road about two minutes ago we got the all clear for our sig alert that we've had for about an hour and a half here. so we had a crash with injuries that involved a gas truck, ffortunately there was n gas in that truck. the bad news we've got a major backup so you're jammed for over five miles on northbound 101 that's one of our busiest routes this time of day. monterey road still looking good. we've got green on our traffic flows. a lot of folks heading on over to 85 to take 87. maybe want to stick to monterey road that's looking like your best bet. quick check of emeryville, heavy traffic i'm just getting word of a new crash near powell. right now let's check in with mike nicco and that's look a little misty, little drippy there in the east bay this morning. >> yeah, knots that too and both of us had to use our windshield wipe thers morning. i who to use my in oakley, berkeley and going through san francisco.

of the victim. police say this happened just before 11:00 last night. a man wads shot and killed inside jim's liquor mart on south white and sim by runs. man's brother and son confirmed with me was the ober of the liquor store, charlie lee, he's 57 years old. he was lying on the floor under the counter to wleft a man in a mask came in and demand money from the register from his wife who was at the cash register. lee stood up and said no and was shot. man threatened to shoot lee's wife but didn't. she wassic taken to the police station for more questioning. the would-be robber then left without month and the police have made no arrests in this case. surveillance will abi big key to this investigation. there are cameras around here, no word on how long police expect to be out here on the scene but they're rapping up their fingerprints investigation right now as they get that. they're also searching at a neighboring business as well. reporting live in san jose, matt kellerer, nbc 7 news. at the live desk want to get

an update on this story bause oare iand fiestigators are right now trying to figurout what startd two-alarm fire that tore through a two-story home. you look at those flames they're huge. happened around 11:00 last night on 57th avenue in the seminary neighborhood. firefighters actually had h to close down part of the street there as they try to keep those flames from spreading to some of those nearby homes. a power line also fell which made it pretty dangerous for the fire crews out there. we're still working on getting information on whether or not there were any injuries or how much damage was left behind. that's the latest here. reggie. thanks. happening today the san jose city council is going to discuss several issues relating to the devastating floods that damaged hundreds of homes in february. the city council meets at 1:30 this afternoon. they're going to update the current recovery efforts. they also plan tacoma prove its emergency planning and to strengthen its management staffing. there are still about 200 residents who are flifg temporary housing. happening today, two

suspects in the murder of a film scout at san francisco's twin peaks will make their first court appearance. sf police say 19-year-old lamont mims and 24-year-old fans tasty decuir shot and killed him on twin peaks for his camera. mims was released from jail just six days before the murder. >> he was arrested for a firearms possession charge and he was convicted of that charge and was released on his own recognizance. >> well, french was a film location scout and may have been atop twin peaks working at the time. police got a break when less than two weeks after french's murder a man and woman was robbed at gunpoint for camera equipment on st. mayor rhode island's cathedral. officers arrested mims and decuir for that robbery last thursday. a college professor arrested in the bay area for a deay stabbi in chicago is going back to illinois. northwestern professor wyndham lathem waived his right to fight extradition in a court appearance yesterday. he and oxford employee andrew

warren are accuse of murdering a man in the high rise condo last month. the victim lived with lathem. police found his body after getting an anonymous fein 11 call. they surrendered to police frooit friday night had the his lawyer says lathem is going to plead not guilty when he's returned to chicago which will happen in bay week or two. the judge in the kate styly murder case is expected to set a date to begin the trial. abc 7 news was in a san francisco courtroom as juan lopez sanchez went before the judge with his lawyers yesterday. he's accused of firing the ghaun killed styly in 2015 on pier 14 in san francisco. lopez sanchez said he he found the weapon under a bench and it be went off accidentally when he picked it up. he had been deportsed several times but kept returning to the u.s. illegally. the killing sparked a national debate over sanctuary cities and immigration. now to a story you'll only see here, residents are asking new questions after last month's massive fire in oakland. it happened at this apartment building under construction at valdez ant 24th streetsz.
