this is what drivers in the east bay were dealing with all morning long, a huge backup on i-820 in san leandro after a shooting closed the interstate for hours. thanks for joining us. i'm kristein sze. >> and i'm jessica castro. the backup has cleared, but police are still looking for a gunman. let's get right to abc 7 news reporter amy hollyfield. amy? >> reporter: hi, jessica. the situation has improved significantly. the backup has cleared. they reopened all lanes at 8:45 this morning so this looks great compared to what drivers early this morning had to face.

monday morning commuters who use southbound 880 made a slow crawl to work today a freeway at luellen boulevard and san leandro was shut down because of a shooting that happened at 2:30 this morning. >> an hour late to work. >> reporter: how long have you been in this? >> like 45 minutes. i'll stiff got an hour to drive to south san francisco. my job is driving me crazy right now. >> reporter: investigators say the gunman pulled up in a white car next to another car full of people and started shooting. >> we had a call of some shots fired. all units arrived on scene. at the time we got here there was a vehicle located in the fast lane, the number one lane, with four occupants. one of them was critically injured. the other three were not. >> reporter: this is the 91st freeway shooting in the bay area in the last year and a half. the chp spokesperson says this morning's investigation led to a five-hour long highway closure because they are very motivated

to make arrests and bring an end to these shootings. >> it is frustrating. there is quite a few freeway shootings, and that's why we're taking such precaution at this point and we're trying to handle it this as thorough as we can. >> reporter: investigators are at the hospital right now waiting to see if the victim is going to be able to speak with them. he was shot in the head and is in critical condition. at this point they haven't made any arrests. live in san leandro, amy hollifield, abc 7 news. >> amy, thank you. as amy mentioned, interstate 880 reopened two hours ago, and traffic is running much smoother now. >> abc 7 traffic reporter alexis smith has been tracking this all morning. >> reporter: things are looking a lot better, as would you imagine. it was a nightmare. we had five miles of the traffic that was not moving all morning. i heard from a lot of drivers that sounded like the guy who had been in that for 45 minutes, said it was just a nightmare. this is where we had the full closure at 880 at lewelling.

daylight brings a whole new look to this memorial on vista glen drive in san jose. neighbors say for about a week and a half a large group of people gathered here to remember the victims of a car crash. last night some of the people game victims of a drive-by shooting. >> we heard gunshots when we were watching tv and then we thought they were fireworks after us so we went to my mom's room and we looked outside and heard people screaming. >> officers arrived and actually found five people that were shot. they were transported to a local hospital, and they are listed as having non-life-threatening injuries. >> reporter: officers investigated at the scene near the reed hill view airport for several hours. neighbors say this group of people had overstayed their welcome. >> we don't really know them or who they are, but, yeah. they have been coming and smoking pot and drinking, and we've been trying to get rid of them, but i guess as of today hopefully things go away. >> reporter: police are not releasing a description of the

suspect vehicles saying witness accounts can vary in situations like this. neighbors say they heard car tires screeching away at the scene. concern that something like this could happen again. >> i don't want myself or family to have to fear to walk out, oh, like what if this happens again? >> reporter: san jose police say no suspects have been identified yet, and no arrests have been made. reporting live in san jose, matt keller, abc 7 news. >> matt, thank you. new developments in that deadly attack on a crowd of peaceful protesters in charlottesville, virginia saturday. the president has just strongly condemned the attack but almost 48 hours after it occurred. >> yeah. he had been criticized for his initial response to the deadly incident. abc 7 news reporter elizabeth hur has the story from charlottesville. >> james alex fields jr. arraigned this morning on charges of second-degree murder and related offenses. police said the 20-year-old is responsible for ramming his car into a crowd of peaceful

demonstrators in charlottesville and killing 32-year-old heather heyer, a paralegal from virginia. it happened just before 2:00 saturday afternoon. just hours earlier he was seen earlier marching and chanting with a group of white supremacists. his former high schoolteacher not surprised. >> he would often say how, you know, hitler's views were right. what if hitler had won? >> reporter: abc news learning fields tried to join the army in 2015 but that attempt lasted only four months after failing to meet training standards. now, all eyes on president donald trump criticized after his initial response saturday for not naming white nationalists directly while condemning hatred. today this statement from the president who also confirmed a federal civil rights investigation is underway. >> those who cause violence in its names are criminal and thugs including the kkk, neo-nazis, white supremacists and other

hate groups that are repugnant to everything we hold dear as americans. >> reporter: and earlier the president wasted no time barbing merck ceo kenneth frazier who resigned this morning from a business council advising the president citing a responsibility to take a stand against intolerance and extremism. president trump tweeting in response frazier will have more time to lower rip-off drug prices. as for the suspect charged with murder in this case so far, he's due back in court august 25 elizabeth hur, berkeley, california. >> top dog posted a sign with its views after a social media post suggests a man at the rally worked at the restaurant. a sign on the door says cole white no longer works at top dog. the actions of those in charlottesville are not supported by top dog.

several uc berkeley students stopped by the restaurant yesterday, many of them horrified by the violence. >> i feel like it's good that top dog is taking a stand. it's crazy. it's 2017 and we still have people are just so backwards, you know, like who just can't seem to wrap their head around inclusivity. >> top dog employees have no comment on their former co-worker. the fast food restaurant has been in berkeley for over 50 years. new this morning the state of california and the city of san francisco are suing the department of justice over president trump's sanctuary city restrictions. abc 7 news reporter leanne melendez is at the news conference and she tweeted out this picture showing city attorney dennis herrera making the announcement within just the last hour. the suit makes california the first state to challenge the administration on its sanctuary city policy of denying funds to cities that limit cooperation with enforcement of u.s. immigration laws. san francisco could lose $1.5 million because of the policy.

new developments involving ousted uber show travis kalanick and a pending lawsuit by him by a key investor. recode says kalanick's lawyers plan to file a motion to dismiss the case and formally move it to arbitration. benchmark capital owns 13% of the stock. they say kalanick is trying to pack the board with his allies and return as ceo. the lawsuit says that would harm shareholders and employees. kalanick resigned from the san francisco-based ride-hailing company back in june after a series of very public missteps. hey, good morning. check out this cool picture from live drone 7 or drone view 7, and you can see outside it tells the tale of what happens today. the coolest day this week. drone view 7 showing cloudiness and look at the flags on the explortorium moving to the east, along with the trees on the embarcadero. temperatures anywhere from 45 to 13 degrees below average.

drunk driving death livestreamed. the attorney of the 18-year-old driver is going public with a new theory of what called the crash. sanchez's lawyer says worn-out tires led to the blowout causing her to lose control. the crash killed sanchez's 14-year-old sister. prosecutors say sanchez was intoxicated and she was livestreaming during the crash. she is charged with six felonies. >> next this midday, longer maternity leave for new parents. the way, and you might want to call it, unusual way moms and dads are extending at home to bond with their newborns. >> and let's take a live look from drone view 7 flying over the

top of the temperatures or underneath them so you get an idea of what it's doing. i mean, we're in the 50s and 60s. only san jose and brentwood have seen a little sliver of sunshine that made it to 70 and 72 it. the breezes are going to get even faster today. fast at the coast right now and they will continue to be that way until 3:00 tomorrow morning and then they will push through the golden gate and make the left turn at the bay bridge and head through san pablo bay into the delta from 2:00 to 9:00 this afternoon and evening so brisk there and a little choppy. we don't have much more warming to go in the south bay. 74 in san jose. santa cruz 69. look at milipitas and sunnyvale, 71 and 72. 70 to 74, really stretching it for the peninsula today. 69 in millbrae. we'll be around 60 to 67 along the peninsula coast to 63 in downtown san francisco. up in the north bay, a little more sunshine. temperature around 75 to 79. up around cloverdale and maybe like some mid-80s. mid to upper 60s.
