unwanted violence. >> i think we saw what happened last weekend in charlottesville. >> there's the potential for things to get out of hand. i think the alt-right will use whatever they want to use to get their point across. >> reporter: the organizers posted they condemn violence, hatred and bigotry. city officials have been receiving calls from the community wondering if a security plan is in place. they are gearing up for the event and may ask outside agencies for help. >> we are taking every precaution necessary and we are in constant contact with google and event organizers to make sure we have the latest information and not everybody is assured we will make sure everybody is safe. >> reporter: organizers did not file a permit. city officials aren't sure how large the crowd will be. >> if we don't have as much advance notice then we do the best we can. >> reporter: this man was handing out flyers in front of city hall denouncing demore. they are expecting counter protesters to protest as well.

now to a gopping story out of san francisco. police are on the scene of a shooting at 5th and howard street near the burlington coat factory. the security guard confronted man accused of stealing. it happened around 2:30 this afternoon. there's no indication to suggest the theft suggest was armed. some sort of fight broke out to cause the security guard to draw his weapon. >> during the struggle then ensued outside. it appears that the armed security guard had drew his firearm and fired approximately three rounds. >> the man accused of theft is in critical but stable condition tonight. the security guard is cooperating with investigators. pre-trial ing add missi inninni program. a man was release ed and later

mims had just been arrested for ssesng firearms. the form that abc 7 news obtained shows there was an have a price r prior sfns for which he served time. response. no. the correct answer should have been yes. background, he was arrested last year for a felony car burglary in san o. he was arrested in november for car break ins. for that he served three months of a six month jail term for violating probation. the rap sheet showed he was sentence and served time. the judge decided to release him with certain conditions suggested by the prosecutor. july 16th, five days later the murder on twin peaks. district attorney was an earlier supporter of risk base system as a form of bail reform. there's been disagreements with the scores. >> we had a point of contention with the entity that does the risk assessments on many cases.

>> reporter: in this case the prosecutor did not catch the error. he says in the meeting i've reviewed the public safety assess pt ament and takes into consideration all the materials in my file. rap sheet. must have included we also spoke to the sister of the murder victim and she tells us by phone and i'd like to quote in part. i realize i made a mistake. the judge is not at fault. he did not have thect they are working with partners to ensure the assessment scores are done properly. they go onto say that pretrial risk assessment is much better than financial bail, than money bail because it's based on risk and not financial status.

vic lee, abc 7 news. stan ta canta clara prosecuu filed charges today. authorities say 21-year-old hendrix shot and killed charlie lee last week. prosecutors say lee was shot while tryi ining to protect his wife. his wife held him and called 911 while the robber threatened to shoot her as well. >> there was an unbearable tragedy for charlie lee's family and community. he was a store owner who was assassinated trying to defend his wife and his business. >> prosecutors also charged hendrix with attempted robbery. if convicted on both charges he could receive 60 years to life in prison. two t san jose police office were justified when they fatally shot 18-year-old anthony nunez last year. family called 911 on july 4th.

uber has reached a deal that it mislead consumers on privacy practices. specifically the federal trade commission says uber did not monitor its employees and the access they had to customer and driverer data. as a result uber has agreed to implement a privacy program and submit to audits of that program to regulators. google, facebook, apple and snapchat are making a push to force the government do get a warrant before it gets your data. they are among more than a dozen tech companies asking the supreme court to rule that users data be protected from warrantless searchers by the government. the companies filed a brief in the case of a convicted armed robber. they argue cell phone data was obtained without a warrant amounting to unreasonable search and ease your under the fourth amendment. uc berkeley a is new delive
