4:00. just a touch cooler than yesterday. i'll have more on the big warming trend next. want to get you over to alexis. >> we're really off to a quiet start this morning. i don't have any major problems to talk about, just one new teeny tiny issue, southbound 880 in the milpitas area, disabled vehicle on the shoulder and the call says it's a really narrow shoulder there. so just be on the lookout for that, on the right-hand side, and use some caution through that area. here's a quick check outside golden gate bridge. we did have a dense fog advisory and a high wind advisory, both issued for golden gate around midnight. not too breezy at this point. not seeing a lot of fog, but we could have stretches of low visibility. we'll check on drive times coming up next. >> thank you. it appears college students protesting the return of a p professor no longer have to worry. a student accused the professor of sexual harassment, that

professor was supposed to come back this semester, and now it appears he won't. matt keller is live for us at san jose state. >> reporter: good morning, reggie. today is the second day of classes here at san jose state. however, one class has been canceled and another class is looking for a professor because of this lingering sexual harassment controversy. this all happened in the department of education. last year, university investigators found professor lewis abtakhar sexually harassed a student. he stepped down as the department chair. however, he was still set to return to teach this fall. now we confirmed from a san jose state spokesperson, he will not be teaching at the university this semester. he was set to teach two classes. one was canceled. aptakhar's attorney said two third party investigations cleared his client of wrongdoing. no decision has been made on his future beyond this semester.

reporting live at san jose state, matt keller. >> thank you. forced to close up shop. businesses around san francisco's chrissy field will keep their doors closed this weekend during a controversial rally. the shutdown of the presidio will stretch from the main post to crissy field where a patriot prayer rally is scheduled to take place. businesses were told they have to close for safety reasons in case saturday's rally gets violent. the national park service issued the permit yesterday, citing the group's right to free speech. it comes with 26 conditions. you see some of them there, including no firearms, aerosols, or ammunition. >> abc 7 news spoke with the man behind the rally, joey gibson of vancouver, washington. he shared his reaction after securing his permit. here's reporter vic lee with the interview. >> joey gibson, leader of patriot prayer, is expecting hundreds of people to attend his rally saturday at crissy field. >> there's going to be bernie supporters coming in. we're going to have atheists, christians, muslims.

>> he never doubted the park service would grant him the permit to hold the gathering. >> i'm not surprised. it's in the constitution, the first amendment. >> he told us his rally is beyond politics. >> i do think people are drawn to the positive message of love and kindness, free speech, freedom. >> he said the last thing he wants is for violence to erupt like it did in charlottesville and in seattle the day after. >> i don't want any >> the pot rite prayer rallies have been denounced by city leaders and other politicians as a form for white supremacists. house minority leader nancy pelosi opposed holding the rally at crissy field. >> it's not a place where nazi sympathizers should come to spew forth their negative message. >> congresswoman jackie speier also opposed granting the permit, but she said it was ultimately an issue of free speech and assembly. she's just glad police are

just moments ago, u.s. defense secretary jim mattis accused russia of trying to redraw international borders. he made the comment in ukraine where he is right now meeting with the ukrainian president. he went on to say that washington will not accept a russian takeover of ukraine's crimea region. rebels took over the region in 2014. secretary mattis is the first pentagon chief to visit ukraine in a decade. should be interesting to see how mattis' comments play out throughout the days coming up because president trump has been trying to improve u.s./russian relations. back to you. >> thank you. today marks the third anniversary since the 6.0 magnitude napa quake. some of the damaged buildings have yet to be fixed. the earthquake in 2014 destroyed 25 structures and damaged dozens more. the napa valley register reports the total cost of repairs is still being calculated. >> to developing news in the

east bay. police need your help identifying a suspect in an attempted sexual assault. the victim said she was in the area of stockton avenue when someone grabbed her and tried to sexually assault her. police released these surveillance videos of the suspect. they say the victim screamed during the assault and neighbors heard her and the man ran off. if you recognize him, please call police. >> happening today, santa clara stadium authorities facing off against the 49ers over the final audit of levi's stadium. the two sides are at odds over what the audit means and who needs to pay up. that concluded the niners owe santa clara almost $2 million for public safety and other stadium costs the city has shelled out over the past three years. 49ers officials say the audit is riddled with errors. >> 5:07 now. a dean at san francisco state university is suing the school. sf gate reports the college of ethnic studies dean accused the university president of

retaliation. the college has struggled with ongoing budget deficits. last year, stunls protested because they felt the school was holding back funds. they wrongly blamed the dean for protests and overspending and then threatened to fire him. the dean claims he lost out on job opportunities because of it. >> developing news out of newark as students head back to school today. the newark unified school district may have to lay off teachers and staff next year. according to the east bay times, $5 million has to becut from the budget over the next two years. declining student enrollment is to blame. >> a water fountain and some locker room showers are off limits at an east bay high school because of water quality issues. abc7 news was at mcclieman's high school where it was found unsafe levels of lead were coming out of the faucets. a district spokesperson said the fixtures are the source of the lead, not the water itself. >> whether it was a faucet or the fountain head or whatever,

it's 5:14. developing news in charlottesville, virginia, where the organizer behind that violent white supremacist rally has turned himself in. university of virginia police issued the warrant for chris cantwell. they gathered on campus to protest the removal of a confederate statue. he's accused of illegally using tear gas and causing bodily injury. >> for the first time in florida history, the state is going to execute a white man for killing a black person. it is going to do it with a drug that has never been used before in any execution.

he's scheduled to die at 3:00 p.m. in 1987, he murdered a black man while making racial comments. he also murdered a mixed racial hispanic man dressed as a woman. >> a texas mom is warning about a dangerous challenge that sent her children to the hospital. a neighbor pouring boiling water on her 11-year-old son's back with his permission. he suffered second and third degree burns. >> no matter how stupid things look online, you know, your kids aren't above trying them just because they're kids and they're curious. >> her son is going to heal, but for others who have tried the challenge, it has proven life threatening before. some people doing the hot water challenge swallow the boiling water through a straw. doctors say the water can damage your esophagus and wind pipe. that's what happened to an 8-year-old florida girl. she died. >> the father of a 7-year-old girl is warning other parents after he says his daughter was

cycles and presidio bowling. some birthday parties there will have to be rescheduled. >> bad timing, i guess. anytime you lose a day's revenue for something like this, it's not good at all. >> all protesters will be screened for banned items. that's including firearms, aerosols, ammunition, big backpacks, drones, explosives, helmets, mace or pepper spray, selfie sticks, glass, thermal, or metal containers. protesters will have to walk in, no vehicles or bicycles are being allowed from the bridge all the way to the palace of fine arts. the one entry point will be right there at that marina boulevard main gate at mason street. reporting live in san francisco, amy hollyfield, abc7 news. >> thank you. meanwhile, lyft is telling drivers to report any incidents of intimidation or harassment. the company they should call 911

and list critical response line if they feel unsafe. two thirds of lyft members identify as members of a minority group. one lyft driver told our media partners he plans to stay on the south bay and on the peninsula come saturday. >> the patriot prayer rally is planned from 2:00 to 5:00 p.m. at crissy field. several counter protests are scheduled at the same time and location. there's also one at noon at harvey milk plaza at the castro and at the civic center at 1:00 p.m. we have information at our news app and abc7news.com. >> this park in berkeley will be the site of a rally against hate and violence saturday. it's aimed at countering a right wing valley. the counter protest and organized by racial protest leaders. others include a volunteer event saturday. >> a widening debate over historic statues linked to violence and racism.

abc7 news was at san jose city hall where some people are upset over this group of christopher columbus. a group called the brown buryes has started a petition to get that statue relocated. they say a man responsible for the genocide of native americans should not be glorified at city hall. >> proceeds will be donated to the oakland firefighters charity fund. last week, two off-duty firefighters were shot. one victim, jake walter, died. two businesses are pledging to donate all revenue they'll make tonight and next thursday. oakland detectives are asking for the public's help in solving a double murder. this was the scene captured by security cameras as shots rang out at a block party over a year ago. two men died on 15th street that night. fletcher cooks was defending his girlfriend when he was attacked and shot. mccrary was shot by a stray

bullet. there were about 350 people at the party and police believe there were four gunmen. >> a lot of times people have information, they're scared to come forward for one reason or another. >> somebody saw anything. somebody knows something. all we ask is that you just come forward. >> there is a $25,000 reward for any information leading to the killers. >> happening today, california could take a big step toward resuming executions. the state supreme court will issue a ruling this morning on a lawsuit challenging the constitutionality of proposition 66. it sets a five-year limit on death penalty appeals. right now, they can take decades. opponents say speeding up the process could send innocent people to their deaths. california's last execution was 2006, and there are about 250 people on san quentin's death row right now. >> running over the golden gate bridge is one of the reasons

people do the san francisco marathon. now that's in question. the bridge's board of directors will consider a proposal to stop closing one side of the bridge to traffic. organizers of the san francisco marathon and half marathon may have to reroute their course or limit runners to the sidewalk. another option would be for the marathon to create a protective barrier to separate the runners from traffic. >> developing news this morning, the search is on for two girls from lake tahoe who were reported missing in oregon. they released these photos of 18-year-old melissa lee and her younger sister kalyla, they were last seen at the eclipse festival in central oregon. the girls' parents have not heard from them since sunday. a san francisco lawyer is now representing the google engineer who was fired over his controversial memo. you'll likely remember it, arguing women are biologically less suiting for tech jobs. army dylan represented two groups fighting uc berkeley to

get conservative pundit ann coulter to speak last year. dylan said she's reaching out to other workers who believe google discriminated again them because of their political beliefs. and that breaking news, a major mix-up with the powerball drawing. it turns out we just got a correction from the massachusetts state lottery saying it was sold in the city of chickapea, not watertown, which puts into question the winning store. the store that sells a winning powe powerball ticket is also considered a winner since it receives $1 million, chickapea in an entirely different part of the state, in a sub, of springfield instead of boston. last night's largest grand prize won by a single lot raticket in u.s. history. the winner has so far not come forward. >> who are the winners in the mount pleasant school district

someone out of the military. he will have six months to implement the ban. >> we're getting a new look at the construction on the lake oroville spillways. this new video shows crews installing steel beams on the walls of the upper spillway. demo of the main spillway is now complete and placement of re-enforced structural concrete is a quarter way to being finished. last winter's storms ripped a huge hole in the structure and caused the evacuation of nearly 200,000 people. crews are working to have enough of the spillway rebuilt in time for wint storms. >> amazon is opening its first brick and mortar book store. today is the official first day of business. the store will be similar to the first one amazon opened in seattle last year, which has drawn big crowds. the san jose store will feature 3500 titles. amazon plans to open another book store at walnut creek's broadway plaza. >> this is nice, hundreds of kids in oakland sporting brand-new sneakers thanks to klay thompson.

from 75 in milpitas to 79, san jose, to gilroy at 87 degrees. smaller spread on the peninsula, but some areas only in the upper 60s around millbrae. redwood city at 76. 62 to 64 along the peninsula coast. 65 in downtown. 67 in san francisco. sausalito at 6. look at the north bay coast. 62 at bodega bay and stinson beach. 79 to 83 in the valley with novato one of the warm spots at 83. 69 in richmond. 70 at berkeley. also in oakland. to 75 in castro valley and also in fremont. 84 in san ramon and pleasanton today. only brentwood will make it above 90. tonight's temperatures, 53 in santa rosa to about 58 in antioch and san jose. cloudy once again. my seven-day forecast, how about we do it again tomorrow, and then as you head outside this week, you'll notice it will be warmer, especially sunday into monday, and then we'll back off

welcome back. some new details are just starting to surface on a thwarted terrorist plot in the netherlands. authorities there canceled a concert by a california band. it was supposed today have concert in rotter dame yesterday, but it got canceled when spanish police told dutch authorities about a specific threat to that concert. early this morning, they arrested a 22-year-old man in connection to the threat. no other details of his identity have been released. i'll continue following the story and let you know as soon as we get updates during the newscast. >> naacp wants to meet with the football league about colin kaepernick. ♪ sing a song >> organizers call this protest outside the league's headquarters in new york yesterday a united we stand rally. kaepernick ignited a national debate when he refused to stand
