traffic starting to build as you can see there's a little bit of red there. folks are waking up and getting out of the house and here's a live look at 680 in walnut creek where traffic is moving but going a little slow this morning. jess. from the live desk, we are tracking a horrific crash in the south bay. i want to show you video just coming in to the abc7 newsroom from san jose. shows the scene of the accident on mcdaniel avenue. a car plowed into a couple trees and from this angle, you can't even tell it used to be a car. incredibly, the driver walked away with only minor injuries. officers say they actually found him sitting on the curb talking to people. he was taken to the hospital as a precaution. police right now are talking to the driver to find out the cause of the crash and determine if alcohol was a factor. the bay area bracing for what's expected to be a weekend of protests. a right-wing rally is planned for tomorrow at san francisco's crissy field from 2:00 to 5:00

p.m. mayor ed lee's office handed out signs to businesses in the marina that read "unite against hate." now some of these business owners tell abc7 news they may not open tomorrow because of possible violence that could ensue at the rally. several counterprotests are chelged for tomorrow throughout the city. san francisco city leaders are preparing for the rally. certain muni bus lines will not make stops in the area around crissy field. all three cable car lines will be shut down and replaced by buses. san francisco general hospital says it's prepared in case of the event of serious injuries. and the public defender's office is reminding people to know their rights. do not touch officers. and truthfully identify yourselves if detained. >> the counter protests against tomorrow's rally will begin today on the steps of san francisco's city hall. mayor ed lee and members of the board of supervisors and other city officials will gather for the unite against hate rally at noon. and tonight, there are two vigils in san francisco that organizers call a stand against

hate. the first starts at 5:30 at congregation emanuel on lake street. another vigil starts at 6:30 at the chinese culture center on kerney street. now, to the other big rally this weekend scheduled to take place sunday in berkeley. the permit for the anti-marxist event at civic center plaza was denied. >> thas not expected to stop people from showing up. cornell bernard has the story. >> berkeley police chief andrew greenwood gave simple advice at this forum about sunday's planned anti-marxist rally. but greenwood knows that won't stop many people from coming out. even after the city sent this letter to rally organizer amber cummings that the city is unable to issue a permit. citing lack of security arrangements. the chief says extra officers will be on duty around the event. some from allied agencies. they're hoping to avoid ugly clashes like this, last spring, which resulted in injuries and dozens of arrests. this time, police will try to

separate protesters and counterprotesters. >> we just recognize separation is very important when two groups come to fight. >> charlottesville is coming to the bay. >> many activist groups are rejecting pleas from the city to stay away from the rally. >> we have to stand against white nationalism, white power, white supremacy, and fascism. >> whatever sunday may bring, the community is responding with love and tolerance. this simple sign, berkeley stands united against hate, is being posted all around town. >> we have to take a stand against this, show that berkeley is not about hate. >> the city of berkeley printed 20,000 signs, hoping they may spark peace. not violence. in berkeley, cornell bernard, abc7 news. counter protests in berkeley are scheduled to begin at 10:30 a.m. on sunday at cal's cres nlt lawn and 11:00 a.m. at alony park. the rally against markism is scheduled from 1:00 to 5:00 p.m. at civic center park.

police will be out in force. >> hurricane harvey is picking up speed in the gulf of mexico with winds at 110 miles per hour. forecasters say the category-2 storm will be upgraded to a category three storm by the time it hits texas tonight or early tomorrow. parts of the state expected to get up to 35 inches of rain. floodwaters could reach 12 feet above ground level along the coast. traffic on nearby interstates is bumper to bumper as people evacuate. mike will have an update on the storm's path coming up at 5:30. meanwhile, airlines stepping up to help travelers who will be affected by harvey. most airlines allowing rebooking and changes without fees or additional costs. seven on your side's michael finney says read the fine print. you should check with your airline for details because policies between carriers vary. >> this morning, more than 30 people are displaced after a fire ripped through an apartment building in santa rosa. the fire department posted this video of the two-alarm fire on social media.

you can see flames rising from the backyard. fire began on apple creek lane near west third street yesterday afternoon. fire officials say four units were damaged, all 15 occupied units were evacuated. investigators still looking into the cause. >> an old ship building facility in san francisco is one step transforms into be bustled entoa new neighborhood. here's a glimpse at what pier 70 will look like if it goes as planned. the developer provided these renderings. they like what it sees. they unanimously approved a proposal to revise the site. it's located in potrero hill and the dog patch neighborhoods. it calls for shops, work studios, and space. >> for some of you, the commute changes forever starting today. it's been nearly six decades since the north bay has seen regular passenger train service. >> that all changes now. the long awaited smart train finally gets rolling on its

regular schedule. amy hollyfield live in santa rosa this morning. seems like we've been talking about this forever and here we are. >> it does. they're excited. narver having a ribbon cutting ceremony this morning at 9:00. they're in a celebratory mood for sure. it's going to be free today to rine the train and all next week, you get a 50 cent discount. they're excited. there have been delays getting this up and running. it was supposed to start last fall, but they had diesel engine issues. that kept them from getting started when it was supposed to bow. this is a 43-mile line from san rafael to the santa rosa airport. what's unique about the smart trains is the positive train control. the safety feature that they have on them that's designed to stop the train in the event that it goes too fast or for whatever reason the engineer can't stop it, the positive train control can stop the train. today's first train is going to start running from the airport. that's going to be at 12:49.

welcome back. an oakland man getting 40 years to life for his role in a gun battle that killed a 30-year-old innocent bystander. it comes two months after a jury convicted 27-year-old alex davis of second degree murder in the death of shamiel pierce. she was a mother of three. prosecutors say davis fired the shot that killed pierce. she was a bystander in a wild gun battle that played out in the streets of oakland in 2015. >> an autopsy will determine how a student died at the university of southern california. 24-year-old jacob kelly was found in his dorm room at usc's health sciences campus wends. detectives say he may have died a week earlier. a maintenance worker at the resident hall contacted police after noticing a smell. investigators do not believe foul play was involved.

u.s. customs and border protection officers found the bengal tire during an inspection wednesday morning. it was lying on the floor of the teen's car. tigers are protected under the endangered species act. officials say the san diego zoo is now caring for the cub. three, two, one. liftoff. >> elon musk's spacex has reached a new milestone with its 12th mission of the year. yesterday, a falcon 9 rocket carry under to space the first satellite designed and built in taiwan. it will help evaluate natural disasters and monitor the environment. after carrying the satellite into space, the rocket landed successfully back on a drone ship. spacex has now launched the most missions in a single year. one more than russia. >> if a judge signs off, the world's surf league will be taking over maverick's. marvric's was last held in 2016. it got canceled this year.

national monuments under review by the trump administration be eliminated. however, he will recommend changes to three of them, possibly opening them up to oil and gas drilling, mining, and logging. "the washington post" says the three monuments are utah's bear's ear. grand staircase escalante, and cascade sisque national monument. no changes recommended for the national monuments in california. the final decision will be up to president trump. the white house won't say when the president would act on the recommendations. you'll be able to enjoy the magic year round at six flags magic mountain starting in january. the theme park in northern los angeles county will operate 365 days a year. magic mountain officials say the change will allow the park to better target tourists visiting from outside the region in the country. right now, the park is open only 250 days a year, primarily in

enforcement bracing for a very busy weekend. matt keller is live at crissy field. matt. >> reporter: good morning, jessica and reggie. we've got barricades all around crissy field that are here and ready to be put up in preparation for the rallies and protests that are going to be held tomorrow. getting here is going to be really, really tough. that's because public transportation is going to be impacted big time tomorrow. unite against hate signs are being put up at businesses, but the owner of monkey on chestnut will be closed for a different reason, because the 30 stockton and 22 fillmore won't come through the marini saturday afternoon. sfmta is stopping service because of the crissy field rally. sf mta will switch out all historic street cars like the cable cars with regular buses to cover those routes. >> this is really based on the recommendation of, you know,

a hospital in ft. worth overnight. at least ten babies are evacuated. the cook children's hospital says it's handled situations like this before during hurricanes katrina and ike. >> it might be one nurse per baby. it might be one nurse per two babies. we stand ready to accept newborns that require any type of critical care. >> the hospital can treat more than 100 nicu patients. it's possible more babies will be taken there over the weekend. and certainly, roads are clogged. everyone is watching texas, including meteorologist mike nicco who is tracking harvey. what's the latest? >> not good, jessica. the storm continues to intensify over the nearly 90 degree ocean water there in the gulf. i mean, look at how textbook that whirling dervish looks as it bears down on corpus christi down to brownsville and the rio grande river valley. 110-mile-per-hour winds. we're expecting that to boost up

to about 115, possibly 120 over the next couple hours. before it makes landfall late this evening as a major category-3 storm, then it's going to stall in parts of texas, leaving us with two to three inches, burying us, if you will. a life-threatening storm surge up to 12 feet. and at least our new models say 300,000 people without power. reggie. >> and it's going to sit there for days. that's going to be a huge flooding problem. thank you. only on abc7 news, a new development in the east bay police sex scandal. the i-team has learned attorneys for the woman at the center of it have filed a new federal lawsuit against contra costa county sheriff david livingston and ricardo perez. the complaints says perez began having sex with abuslin when she was only 17 years and livingston failed to supervise his officers and failed to train them to report the abuse of teenage sex

workers. the lawsuit says perez was one of 20 law enforcement officers from six agencies who had sexual encounters with abuslin. she's also suing the city of richmo richmond. oakland has settle a claim with her for almost a million dollars. >> a meetling that could change whether or not the iconic golden gate bridge is used for special events like the san francisco marathon. the golden gate bridge board of directors will consider a new policy that would ban bridge closures during those types of events and keep it open to traffic. bridge officials making the recommendation say it's a public safety issue. they want to avoid a possible terror attack. >> happening today, alameda county decides if it will continue participating in training for disaster and mass shootings. it's controversial because of what some see as the militarization of police. in the past, groups have been against the urban shield task force program, saying that it's highly militarized war games.

overturned big rig finally back upright after causing major traffic delays. a truck carrying 41,000 pounds of empty wine bottles rolled over around 4:30 yesterday afternoon on 580. that's just east of livermore. crews worked overnight to remove all that broken glass. the driver wasn't hurt. he says he lost his brakes.

>> a driver has apologized after being spotted driving around san leandro with a noose hanging from his pickup. this photo went viral after being posted on facebook. police found the driver and gave him some, quote, social education. the man told officers he meant no harm by displayed the symbol associated with the lynching of african-americans. authorities say he does not live or work in san leandro. >> uber is backing off its plans for a huge expansion in oakland. the ride hailing business is looking to sell the former sears department store it's been renovating for the past two years. the property at 20th and broadway. the green lining institute pushed to keep uber out to prevent what it is calling city gentrification. initially, uber planned to have at least 2,000 employees work at the new office. earlier this year, it scales it back to only a few hundred. >> the san jose police department is launching a bold new campaign to recruit officers from the lgbt community.

jose spartan football team opens their season. they're able to buy beer and wine for the first time in five years. in june, cal state officials dropped a ban on alcohol sales at home event. they host south florida tomorrow night. >> speaking of beer, petaluma based lagunitas is out with a new one and it's brewed with cannabis extracts. right now, super critical ipa is only available in select locations including more than 40 bars and stores around the bay area. it does not contain thc, so everyone can calm down. it's the compound that causes the marijuana related high. >> the tracy unified school district says it's alarmed by the rising trend in marijuana edibles showing up on campuses. the edibles are in the form of candy bars, cereal, and other treats. so far, the district has come across ten cases of edibles since spring. the administrators say they started appearing after the passage of prop 64 to
