take mass transit. we also want to show you a live look at the golden gate bridge. only a few cars there. looking pretty nice and clear. okay, for some of you, the commute, though, is changing forever starting today. it has been nearly six decades since the north bay has seen regular passenger train service. but that all ends now. the long awaited smart train finally gets rolling on its regular schedule. amy hollyfield is live in santa rosa this morning. hi, amy. >> hi, good morning, jessica. we're finding there's a little confusion. we have seen a couple commuters show up thinking the trains were going to start running this morning. that is not the case. today is the ribbon cutting ceremony. today is all about celebrating. you can count on those trains for the monday morning commute. they'll start the celebration this morning at 9:00, and they have waited a while for this. the smart trains were supposed to start running last fall. but a problem with the diesel engine caused a delay. this 43-mile-long stretch will go from san rafael to santa

a right-wing rally is planned for tomorrow at san francisco's crissy fiel from 2:00 to 5:00 p.m. mayor ed lee's office handed out signs to businesses in the marina that read "unite against hate." some owners tell abc7 news they may not open tomorrow because of possible violence that may ensue at the rally. several counterprotests are scheduled for tomorrow throughout the city. >> san francisco city leaders are preparing for the rally. several muni bus lines will not make stops in the area around crissy field. all three cable car lines will be shut down and replaced by buses. san francisco general hospital says it's prepared in case the event results in serious injuries. and the public defender's office is reminding people to know their rights. to not touch officers, and to truthfully identify themselves if they are detained. >> the counter protest against today's rally will begin today on the steps of san francisco city hall.

mayor ed lee, members of the board of supervisors and others will gather for the unite against hate rally at noon. >> tonight, two vigils in san francisco that organizers call a stand against hate. the first starts at 5:30 at congregation emanu-el on lake street. another at 6:30 at the chinese culture center on kearney street. >> now to the reason so many are concerned, of course, what happened in charlottesville. new details about the suspect accused of ramming his car into a crowd of people in virginia. 20-year-old james fields jr. was scheduled to appear in court today, but a judge has agreed to a request from prosecutors to continue that case until december 14th. fields will have a prelim hearing then. he's charged with second degree murder in the death of heather heyer, 19 other people got hurt. now, to the other big rally this weekend that was scheduled to take place sunday in berkeley. >> the permit for the anti-marxist event at civic center plaza got denied, but that isn't expected to stop

people from going there. the city cited lack of security arrangements. the chief of police is asking the public to stay away from the area on sunday. extra officers will be on duty around the event and will try to separate protesters and counter protesters if the rally turns violent. >> separation is very important when two groups come to fight. it's something we have worked on in the previous demonstrations and we'll continue to work on. >> we have to take a stand against it. we have to show that berkeley is not about hate, but is about tolerance but not allowing hate speech. >> the city printed 20,000 signs that read berkeley stands united against hate, hoping their spark peace and not violence. >> counter protests in berkeley are scheduled to begin at 10:30 a.m. on sunday at cal's crescent lawn, and at 11:00 at the ahlone park. the rally against markest -- i should say ohlone park. it's scheduled from 1:00 to 5:00 p.m. at civic center park.

from the live desk, we are tracking a horrific crash in the south bay. a car plowing into a couple official trees in san jose. this is on mcdaniel avenue. incredibly, the driver walked away with only minor injuries. officers say when they got there, they found the driver sitting on curb talking to people. >> he was transported to the hospital for some minor injuries just to be checked. but it's miraculous. i don't use that word lightly. i think it's miraculous he walked away from this accident. >> calling it a miracle. we just got that interview for you from the live desk. police talking to the driver now

to find out the cause of the crash. they're also trying to determine if alcohol may have been a factor. >> this morning, more than 30 people are displaced after a fire ripped through an apartment building in santa rosa. the fire department posted this video of the two-alarm fire on social media. you can see the flames rising from the back yard. the fire began on apple creek lane near west third street yesterday afternoon. fire officials say four units were damaged. all 15 occupied units were evacuated. fire investigators are now looking into the cause. an oakland man is getting 40 years to life for his role in a gun battle that killed a 30-year-old innocent bystander. it comes two months after a jury convicted 27-year-old alex davis of second degree murder in the death of shamiel pierce. she was a mother of three. prosecutors say davis fired the shot that killed pierce. she was a bystander during a wild gun battle that played out in the streets of west oakland in march of 2015. two other men convicted along with davis will be sentenced

next month. the aclu is suing the state of california for throwing out 45,000 ballots in last year's presidential election. local election officials rejected those vote by mail ballots due to doubts about the signatures. the aclu claims election officials have no expertise when it comes to analyzing handwriting. meanwhile, california's secretary of state says fewer ballots have been rejected in every election since 2008 and california leads the nation in empowering voters. three, two, one. liftoff. >> elon musk's spacex has reached a new milestone with its 12th mission of the year. yesterday, a falcon 9 rocket carried into space the first satellite designed and built in taiwan. it will help evaluate natural disasters and monitor the environment. after carrying the satellite into space, the rocket landed successfully back on a drone ship. spacex has now launched the most

missions in a single year. one more than russia. >> if a judge signs off, the world surf league will be taking over maverick. it was last held in january 2016. it was cancelled when cartel management declared bankruptcy. they look forward to working with the san maeo county harbor district and the local community. they just need court approval to assume the permit for the big wave event. that would be great to have it resurrect here in the bay area because it's been missed. >> yes, and such an important event for the bay area. so many people travel up here to see it, to be a part of it. >> absolutely. felt a little empty without it last year. let's get that back. let's talk about what's going on. we'll include the beaches with sunshine. not waves like that. not this time of the year. we do have some patchy fog through the north bay. and our sensors, the lowest visibility is in santa rosa, three miles. it's got to be floating around somewhere. you can see how compressed the marine layer is.

as we head to diablo in the distance, brighter and the warming begins for all of us today. tonight, comfy. partly cloudy. the extended, above average warmth all seven days. today, let's go warm to cool. 88 in gilroy, morgan hill, san jose, 82. to milpitas at 77. we have 80 on the peninsula down to about 70 in millbrae. 66 at half moon bay. everybody else around 63 to 65 degrees along the peninsula coast. 70 today, downtown south san francisco. near that in sausalito. mid 60s at the north bay coast. you'll have low to mid 80s through the north bay valleys to 90s around cloverdale and lakeport. along the east bay shore, 78 in fremont, the warm spot. look at castro valley. oakland at 73 degrees. inland, 87 in san ramon to everybody else around 90 to 95 degrees. good news, we'll fall back to the 50s and low 60s tonight. a few 70s up in our hills where it will be warmest. and that will springboard us to

100s tomorrow all the way through monday. look at that, mid to upper 80s around the bay. even some 70s reaching the coast. going to be a warm one this weekend. >> thanks for the warning. and i don't have too many warnings to give you if you're about to hit the roads because it looks like on this friday so far, and i'm probably about to jinx it, we're looking good. as you can see, mass transit, totally in the clear. no delays at all. we're not seeing major issues on the roads. here's a live look at the golden gate bridge. everyone is going by smoothly. no stress, so blessed. >> that's nice. >> there are new details in the search for those missing navy sailors whose ship crashed into an oil tanker near singapore. today, the court confirmed divers identified the remains of one man found late last night. the 26-year-old is from connecticut. these guys are so young. earlier in the day, divers recovered the remains of 22-year-old kenneth aaron smith from new jersey. eight sailors are still missing. five others were injured in monday's crash.

and that ship is now in the port in singapore. >> now to a stunning new development in what's being called the trial of the century in south korea. today, the man sentenced to five years in prison. he's accused of paying $36 million in bribes for political favors. a court found him guilty on multiple counts of corruption. he's expected to appeal the ruling. lee became the acting head of samsung back in the year 2014. >> this is a major mistake. this morning, the health care companiate gnaw is reviewing its calls to customers revealing their hiv status. a large clear window showed confidential information. the letters were sent to patients currently taking medication for hiv in several states including california. attorneys say they received at least 23 complaints.

they say they are weighing their legal options right now. happening today, the sentencing for a former volkswagen engineer linked to the company's cheating scandal. james robert liang is scheduled to appear in a detroit courthouse. he pled guilty for his role to defraud regulators and customers by implementing software cheated tests. all the money will go to the air resources board. >> alameda county is set to decide the fate of the exercise. it may get the urban boot today. >> and spacex sends another satellite into orbit. the record this launch has set. >> as you get up, get your day into gear, well, here's a live look at walnut creek as you head out the door. we have weather and traffic on your screen throughout the commercial break with abc7 news now. we'll be right back.

really, really tough. that's because there's going to be a lot of changes to public transportation. unite against hate signs are put up at businesses, but the owner of monkey on chestnut will be closed for a different reason. because the 30 stockston and 22 fillmore won't come through the marina saturday afternoon. sf mta is stopping service through parts of town because of the crissy field rally. sf mta will switch out all historic street cars with regular buses to cover the routes. >> this is really based on the recommendation of safety experts at events like this and what we have seen around the country, that these events can turn into a violent situation. we want to make sure we're keeping everyone safe. >> fisherman's wharf, pier 39, all of it is right here, and that's how you get around the city. it does put a damper on everyone's experience for the day. >> be prepared for the possibility of road closures anywhere.

coastline areas. >> a meeting that could change whether or not the iconic golden gate bridge is used for special events like the san francisco marathon. the golden gate bridge board of directors is going to consider a new policy that would ban bridge closures for these events and keep it open to traffic. bridge officials making their recommendations say this is a public safety issue. they want to avoid a possible terror attack. only on abc7 news, a new development in the east bay sex scandal. the i-team learned attorneys for the woman at the center of it have filed a new federal lawsuit against contra conta s an officer. the complaint says perez started having sex with abuslin when she was just 17 years old and the sheriff failed to train the workers. the lawsuit says perez was one of 20 law enforcement officers from six agencies who had sexual encounters with abuslin. she's also suing the city of

richmond. oakland settled a claim with her for almost $1 million. new video shows an overturned big rig finally going back upright after causing major traffic delays. a truck carrying 41,000 pounds of empty wine bottles rolled over around 4:30 yesterday afternoon on 580 just east of livermore. crews worked overnight to remove all the broken glass. the driver wasn't hurt. he says he lost his brakes. it appears uber is backing off plans for a big expansion in oakland. the san francisco business times reports the ride hailing business is looking to sell the former sears department store it had been renovate trg the past two years. the property is at 20th and broadway. the green lining institute pushed to keep uber out to prevent what it calls more city gentrification. initially, uber planned to have at least 2,000 employees work at the new office, and earlier this year, it scaled back to a few hundred. >> a driver has apologized after

being spotted driving around san leandro with a noose hanging from his pickup. take a look here at this photo that went viral after being posted on facebook. police found the driver and gave him some, quote, social education. the man told officers he meant no harm by displaying the symbol associated with the lynching of african-americans. authorities say he does not live or work in san leandro. >> happening today, alameda county decides if they'll continue participating in training for disaster and mass shootings. the controversy is over what some see as a militarization of police. now, in the past, groups have been against the urban shield task force program, saying that it's really highly militarized war games. the stop urban shield coalition plans to attend and speak against the plan to keep the training. the task force meets at 9:00 this morning in oakland. i've got live doppler 7 dialed down on what continues to be a very grave concern for us down in texas. let's take a look at harvey.

you can some of the outer bands, tropical storm force winds, even rotation within some of these thunderstorms, which means tornadoes are going to become more likely as this gets closer to the shore, to 95 miles, the eyewall is, from making land in corpus christi. that's going to put it some time in the evening to early overnight hours as a category 3 storm with a storm surge of 12 feet. plus, there's a possibility that it gets into land and it just stalls and rains all weekend. we could get up to three feet of rain with nowhere for it to go. and that's going to mean catastrophic life-threatening flooding in nearly 300,000 people could lose power. back here at home, things a little quieter. temperatures in the upper 50s to low 60s down in the south bay. we're pretty much in the mid to upper 60s everywhere. novato, 59 degrees. mt. tam, that puts a smile on
