over the weekend it was the heat. yesterday it was the haze, today happiness because it's finally over. you're looking live outside where the weather should return to normal today and get even cooler as we head through the week. there's a slight chance of another shower or two. >> thank goodness, especially for all those folks who don't have air-conditioning like me. >> sorry. >> it's been hard to sleep lately. >> i imagine so. >> i can't imagine -- well, it's been hard to sleep even for those -- it's been hard to sleep for everybody. >> yeah. >> harder for some than others, no doubt about it, absolutely. let's look at what's going on with live dopplar 7, overlay the wind so you can see there's a little bit of a sea breeze, 17 miles per hour that's helping clear out that nasty haze we had yesterday. a look from sutro tower we can see all the way over toward the east bay hills this morning. temperatures still warmer during the overnight hours because of the humidity and the cloud cover, 66 to 69. we'll manage around 70 for the better part of the afternoon at the coast.

78 to ate 1 around the bay and 83 to 86 from noon to 4:00. breathe easier and grab those sunglasses. good morning, mike. want to take a quick chesk our roads this morning, they're starting to fill in as everyone is coming back from the labor day holiday. westbound ate eight, little sfop and go traffic it's not terrible. leave a few extra minutes early for your commute this morning. on caltrain we had that deadly crash overnight in redwood city, car went through a fence, landed on the tracks and that was hit by train. however, the speed restrictions have been removed, there's no bus bridge this morning and we currently have only about a ten-minute delay for trains heading through the redwood city area. amy holly field's at the scene we'll check back no with her later this morning. a huge improvement there. thank you. developing news in the south bay, a brush fire in the gilroy area now affecting a local middle school. >> parents are being told to make alternate dropoff plans at solar sano middle school and

part of a popular park is close the. tiffany wilson is live in gilroy with more. >> reporter: good morning. just a couple minutes ago we saw a few cal fire crews come down out of the neighborhood behind me that has direct access to the fire. the fire stands at 100 acres burned and it is 10% contained. neighbors told abc 7 news that kids playing with fireworks sparked the fire sunday night. cal fire says the cause is still the fire will impact some kids going to school. pd families with kids at sa low so he know middle school will have to make alternate drop justify and pick up since the christmas ranch spart close. that's where they've set a base camp. the south side of crist magazine hill park is spill open. no homes are at risk. >> we do have some engines on the road up near eagle ridge for structure protection just in case the fire has been moving uphill in a west ward direction and so luckily it has not backed down towards the homes.

lane on point san peddro road as we trying to get around a fallen tree limb. her family sued the city, driver, and the county claiming negligence because the tree limb was not removed. according to our news partner, the marin independent journal, the lawsuit has been settled for over $750,000. happening today, a far right activist facing charges stemming from a bloody protest in berkeley may enter a plea. kyle chapman faces felony weapons charges. he's aused of using an illegal baton to beat koernt protesters during a rally to support president trump back in march. he has a long criminal hissly it and so face up to eight years in prison if convicted. bay area renters and landlords are watching a case set to go before the court of appeals this fall. a judge will decide the strength of eviction protections for single family homes an condos. couple in the sunset district is suing their new lld. they say the landlord more than tripled their previous went e present $1,900 a man to $6,700 a

month. couple argues the dramatic increase say loophole landlords use to evict tenants without paying tenant relocation fees. in may the superior court of san francisco sided with the landlord. now a live desk update. >> at the live desk hurricane irma has been upgraded to a category 5 storm bringing a maximum of 175-mile-per-hour winds. florida residents are preparing for irma to possibly hit this week. officials warn that it could cause land slides and flash flooding and generate waves of up to 23 feet. states of emergency have been declared in purity rico, the u.s. virgin islands, and all of florida. and given everything that we've seen lately with harvey. >> right. >> from certainly very nervous and trying to get prepared for all of this. >> the good thing is they have several days to get ready for it. it's the lee ward islands and u.s. and british virgin islands that are going to have the biggest problem.

abc 7 mornings. >> all news. >> all morning. there's a new response to the rising tensions in north korea. this morning russian president vladimir putin is calling for talks with north korea. he says u.n. sanctions against the regime will not stop the nuclear threats. meanwhile, china has agreed to stop importing goods to north korea and south korea flexing its military muscles conducting navy drills off the eastern coast. just yesterday u.s. ambassador nikki haley issued a warning to the north korean dictator. >> his abusive use of missiles and his nuclear threats show that he is begging for war.

>> president trump says he is considering a military strike. north korea has carried out 13 missile launches since february. happening today, the united nations is honoring the 20th anniversary of the death of mother teresa by designating september 5th of the international day of charity. she founded the order of the missionaries of charity and devoted her life to people living in the slums of calcutta. she was cannonized last year. in making today's designation, the u.n. general assembly recognizes the role of charity in easing human suffering. millions of honda and acc cure rar rahon owners could receive $500 that's if a judge approved the lawsuit over defective air bags. honda and the takata corporation have agreed to $600 million settlement covering more than 16.5 million vehicle owners. they cause the air bags to explode upon deployment and has been linked to 16 deaths and more than 180 injuries. for a list of the vehicles

i'm joking you know but in all seriousness it was a rough weekend and yesterday was probably the roughest day because of the poor air quality during a holiday, no doubt. all that has changed. hi, everybody. here's a look at the visibility, 10, 9, that's unlimited. sure we have mid-and upper level clouds out there and a little bit of humidity but look how much cleaner the air is. mid to upper sichlgts, near 70 at the coast today, 80 around the bay and mid to upper 80s inland. nicer evening coming our way with a lot of sunshine, mid-60s to mid-70. alexis. >> good morning and we started off this morning thinking we're going to have a major problem with caltrain. there's a deadly crash overnight on the train tracks, a vehicle went through the fence in redwood city and that was hit by an oncoming train. over an hour ago the tracks were cleared, four directions in both directions and the speed restrictions have been removed and we've got good a 10-minute delay in that area. amy hol by field has been opt scene for us all morning. we know the trains are moving

through the area but what's the latest with that investigation? >> reporter: good morning. i want to show you where the crash happened. the car went through this fence right here and then landed up there on the tracks. and that's when the train came along and hit it, pushed it about a half a mile down the tracks before coming to a stop. this was just at 1:20 this morning. the train wasn't carrying any passengers it was a mechanics train, so it was northbound but no one on board. the driver, though, of the car was killed. >> the person's 29-year-old male out of redwood city. we don't know the ethnicity at this time and we don't know whether he died from the initial collision or died as a result of the collision with the train. we're doing a joint investigation with the sheriffs. >> reporter: he crashed at buckingham avenue in westmoreland avenue here in redwood city. they don't know why, they don't

know if he was under the influence. won't know that until a toxicology report comes back. but it was a maintenance train, i want to correct what i said, that was head towards san francisco that fatally struck this car and that driver. they did get the tracks checked out and cleaned up. they were shut down for about four hours but now all commuter trains are running without any problems. reporting live in redwood city, amy holly feed, abc 7 news. thank you. happening today we're expecting to find out if president trump will make a decision on daca. the president trump already tweeting about it this morning. he wrote, congress get ready do your job. daca with an exclamation point. attorney general jeff session who's was in favor of ending the program will make the announcement at 8:00 a.m. our time. polls showed the majority of americans support daca. >> the average people who see daca students, see our students here, who see daca people who contribute to the military, contribute to jobs, contribute to some of those dangerous and difficult jobs in the country,

and is at risk. she was lalt seen at valley fair around 4:00 in the afternoon. authorities say she has brown eyes and gray hair, is about 5'10". if you've seen her, contact santa clara police. new developments in a santa barbara kidnapping case. virginia paris has been found in henderson, nevada have this morning. her daughter told the abc station there that she is safe. she wref she was taken against her will by a former boyfriend last friday. paris and joseph hetzel were caught on camera checking out of a motel in arizona yesterday morning. they were also spotted in a starbucks where paris told the customer there that needed some help. no word if police have hetzel in custody. developing news, house leaders plan to vote tomorrow on a bill to deliver disaster relief to texass that recovers from hurricane. the package would replenish a

rapidly dee leeting aid fund. these homes in huft torn still several feet under water. storm has killed at least 60 people and damaged 185,000 homes. skoorlz also dealing with major damage forcing thousands of students to relocate. this morning, a bay area search and rescue team is back home after spending more than a week helping in houston. abc 7 news was at oakland international airport last night for the heartwarming homecoming. >> definitely knowing he's there helping people that are really in a huge time of need is amazing to know that he was able to make a difference in so many people's lives. >> it's kind of sad to see that much stuff under water and for so long. even on our way to the airport we could still see parts of houston under water. >> there's still two dozen firefighters driving back from houston with all their equipment. they should be home thursday and friday. they're part of the task four team. they say harvey a reminder to stock your home with emergency supplies. and the san mateo county sheriff's office giving a shout out to a retired sheriff who now

lives in texas. these are photos posted on facebook showing tim freezing rain helping harvey victims. former sheriff towed his boat over 100 miles to rescue others from their flooded homes and a big thank you from all of us at abc 7 news too. a riled police chase ended in frightening moment for another drive. the second driver says it came to an end when the suspect collided with her black bmw at the mill valley off ramp off 101. witnesses say the crash could have been much worse. both cars have significant damage but no one was injured. police identified the suspect as 45-year-old aaron lee of san rafael. he he was charged with evading arrest, reckless driving and possession after methamphetamine. happening today, the board of supervisors will reconsider the ban on flavored tobacco products. it's a ban they just passed this summer back in june. groups in support of the ban will rally on the steps of city hall today alt nine. the board can either repeople or

put it up for the next scheduled city election which will be next june. supervisor ma lea cohen is a sponsor of the law and says she hopes if it lands on the ballot health conscious voters will choose to keep the ban. also happening today the city of alameda discussing a proposed bill to end a ban on medical marijuana dispense orreries. if approved it would allow permits for three dispensaries, one to serve medical users and two for recreational user. a group plans to submit more than 600 signatures in support of the ordnance. a consulting group says the dispensaries would generate $800,000 a year in business taxes. these are all the wildfires burning in california right now. it looks overwhelming because it spt the ones in red are active. there's 29 of them. more than 12,000 firefighters are battling these blazes. one of the largest is threatening 2,700-year-old giant sequoias in madero county. so-called railroad fires burned

moderate, moderate good, good, we'll take it. it's a little humid by our standards and that's why temperatures are up just like we talked about. we're in the upper 60s to mid-70s in saratoga and loss altoes, up in the hills 64 in los gatos, 70s in redwood city, brentwood, fairfield, napa, 69 in lafayette, livermore, alameda, san francisco, half moon bay at 68. san rafael looks clean as we look south on 101. not as hazy on the roads, mild to warm, and becoming breezy if you're on the bay north the bay bridge. 60s, 70s, and 80s today. more 60s, 70s, and slightly cooler 80s and then look at thursday. just barely 60s and 70s. we may get to'd in concord and antioch. we've also got summer slipping away for a day and a chance of showers. first, since it could be one of the busiest days of the year on the roads, let's bring in alexis pd find out what's going on. summer volumes are slipping away along with the summertime temperatures.

a brush fire will impact kids heading to school this morning. >> parents are being told to make alternate dropoff plans. tiffany wilson is live in gilroy with more on the situation there. hi, tiffany. >> reporter: good morning. if you look behindmy you can see some of the smoke from the fire. right now the fire is about 100 acres and 10% contained. no homes are at risk. neighbors told abc 7 news that kids playing with fireworks sparked the fire sunday night. cal fire, however, says that the cause is still under investigation. the fire will impact some kids going to school today. families with students at sa lar sinnott middle school will have to make alternate dropoff and pickup arrangements since the ramp side of christmas hill park
