live where you live, this is abc 7 news. >> san jose police now say a fatal shooting outside last night outside a apartment complex may have been totally rand random. they're asking the public to help. thanks for joining us. we have new information on the victim. who was killed, apparently just walking down the street. the shooting happened on busy story road near apartments families live in and small businesses where people shop. abc 7 news reporter tiffany wilson is live at san jose police headquarters with the latest, tiffany. >> reporter: kristen, police are talking to witnesses, but so far, they do not have much information on the suspect or how that suspect got away. it was an uneasy morning from

many families living in this apartment building off story road. >> for me, i was surprised. >> reporter: as parents ushered their children to school, many couldn't help but discuss the violence at their doorstep. >> somebody kill people. >> reporter: the shooting happened shortly after 9:00. >> it appears that this victim was attacked randomly. >> reporter: this sergeant said the victim was in his 30s. he was rushed to the hospital where he died. he heard the gunfire. >> those were not fireworks. we assumed they were shots. >> reporter: the suspect took off. does it make you nervous that this happened so close? >> yeah, actually. >> reporter: officers taped off the wide perimeter and blocked off part of story road. around 5:30 this morning, a crime scene cleaning crew scrubbed the sidewalk where it appears the victim was shot. >> the victim was not armed. and we have not recovered a weapon at this time. >> reporter: that means the suspect likely still has a gun. >> we have very little information to go on at this

point. so we're really asking for the public to contact us with, with any bit of detail they could offer that could help us solve the crime. >> reporter: neighbors have seen violence before. one mother says she keeps her family safe by making sure that everyone is inside by 8:00 at night. live in san jose, tiffany wilson, abc 7 news. >> tiffany, thank you. the chp is asking witnesses to come forward to help solve a deadly hit-and-run crash in san rafael. a man was found near the bus stop at the lucas valley off-ramp on highway 101 just after 8:30 last night. he was pronounced dead a short time later. investigators say no cars stopped in the area. the victim's name has not been released. new details on a wild fire burning in santa clara county. cal fire says firefighters made significant progress on the fire overnight, it's now 65% contained. the fire in gilroy has burned 100 acres since it began sunday

evening northeasterly the eagle ridge housing development. now neighbors say kids playing with fireworks started the fire. the cal fire is still trying to confirm the cause. developing news as irma continues to barrel through the caribbean toward the u.s. mainland. here's a live picture now from the u.s. virgin islands. the national hurricane center is calling irma potentially catastrophic. puerto rico and florida are now scrambling to get ready. abc news reporter maggie ruly has the latest. >> reporter: hurricane irma is tearing through the caribbean as the powerful category 5, and showing no signs of slowing down. st. barts, others caught up in the devastating path. the storms now bearing down on st. martin, battering the tourists hot spot with sustained winds of 185 miles per hour, and gusts even higher. >> we are literally within inside, like three doorways in and this is what you can hear.

>> reporter: the u.s. now bracing for impact. puerto rico's preparing for a catastrophic event with 700 people already in shelters. >> no one is ever ready for a category five hurricane. >> reporter: and florida is sitting directly in it's path. >> this is serious. and we cannot take chances. >> reporter: the florida keys under mandatory evacuation. >> if you're told to evacuate, get out quickly. remember, we can rebuild your home, but we cannot rebuild your life. >> reporter: station after station out of gas. >> they put up caution tape. >> reporter: critical supplies running short. >> absolutely crazy. the line's wrapped around the entire inside of the store. >> reporter: hundreds waiting in line for water in miami. >> costco sold out of water. >> reporter: residents boarding up their windows to protect against expected wind speeds of more than 145 miles per hour. the president has declared a state of emergency in florida, puerto rico, and virgin islands. the storm is approaching florida saturday afternoon hitting miami

as a category four hurricane. then skirting up the eastern side of the state is the category three with wind speeds still at 125 miles per hour. maggie ruly, abc news, new york. okay. perspective on just how massive hurricane irma is, we want to show you some incredible video released this morning. this is from noaa, the crew actually flew over the eye of the storm, giving us this incredible view, but hopefully not too dangerous for them. meteorologist might be tracking irma as it moves closer. mike, i'm worried for them. >> something you don't want to do unless you're a professional and trained to do it like they are or when they used to let the rest of us meteorologists go on a ride once in a while. yeah, that'd be exciting, but let's look at what's going on. in all seriousness, look at the eye out of san juan, puerto rico. you can see the british virgin islands starting to get the backside of the storm while the u.s. virgin islands are getting raked by the hardest part of the

storm. last two hours, idea where have it's going. a lot asking about puerto rico, and it looks like the southern part of the eye may just graze the northern part of puerto rico, and if you want to get hit by the eye wall, you want to get hit by the southern side. hurricane-forced winds up to 50 miles per hour. tropical storm forced winds out to 185 miles per hour. it is powerful and it is large. and as maggie ruly just showed you, it is making more of a right turn. now, the winds are the big story now, but once it gets to the turks and caicos by friday morning and then the bahamas, it's going to be storm surge, then when it hits florida this weekend, it's going to be a rain and wind maker with up to 18 inches of rain. >> oh. all right. thank you, mike. new this morning, president trump has agreed to raise the debt ceiling and fund the government for three months as part of hurricane harvey aid deal. the house approved the $7.9 billion bill earlier today. it's expected to be on the desk before accounts run out.

and this morning, the top republican and democrat in the house of representatives are each speaking out on president trump's decision to phase out daca. the program that protects undocumented immigrants brought to the u.s. as children. and the president himself is giving conflicting indications on twitter. jessica castro from abc 7 mornings is here with the latest developments, jessica. >> lawmakers on both sides voicing their opinions loudly. overnight the president seemed to hint he would revisit the issue, but then early this morning, gave another signal that he's standing by the his original decision. he'll phase out daca, unless congress steps up. >> despicable affect political cowardice. >> reorter: nancy pelosi not holding back, scolding president trump fiercely. >> coward is squared because he gave the announcement to his attorney general instead of just making the statement himself. >> reporter: the backlash has been growing and started long before an official announcement this tuesday by the trump

administration. protests all across the nation, including the bay area. today pelosi and other top lawmakers speaking out. >> the president's decision to end daca was heartless and it was brainless. >> reporter: nearly 800,000 daca recipients are now at risk of deportation to countries some of them have never known. >> this is the only country we know, and then of course, it will be a dream to just be citizens, contribute to the country and then keep making us strong. >> reporter: overnight president trump tweeting, congress now has six months to legalize daca, something the obama administration was unable to do. if they can't, i will revisit this issue. and today, the president holding firm. >> no second thoughts. >> reporter: the speaker of the house, paul ryan, backing the president's choice to punt the issue to congress. >> i think the president made the right call. >> reporter: but also trying to reassure the dreamers. >> i think people should rest

easy. >> reporter: now it's up to congress to get something done, but already lawmakers have a full plate. daca goes on the list alongside funding the government to prevent a default and a hurricane relief package. jessica castro, abc 7 news. >> thank you. new this morning, white house press secretary sarah huckabee sanders was on the view today defending president trump. sanders sat next to her father, mike huckabee, things got heated when asked how they could support a president whose made demeaning remarks about women. sanders said she's always felt respected. she blames the media for cherry picking statements and spinning them into false narratives. she says it impacts his ability to succeed. >> i think america should want him to succeed. he is the president whether they voted for him or not. and i think that we have to get behind him. we should be championing for his success because his success is america's success. >> and you can watch the view weekdays here on abc 7. airs at 10:00 a.m. right before

b.a.r.t. is starting a news conference right now to unveil a new transit village planned at the walnut creek station. more residences, shopping, and parking, but it could be a headache for riders until the project is complete. abc 7 news reporter amy hollyfield is live with the details for us, amy. >> reporter: this parking garage is full by 7:00 a.m. every weekday. that creates quite a scramble for commuters. well b.a.r.t. officials say they are on it. and that is why they are having a press conference right now to announce details of how they're going to solve this problem. ask anyone at the walnut creek b.a.r.t. station about parking and you'll hear about the need for more. >> we need more. i have to pay, i think $85 a month for one of the garages next, neighboring the station. my husband does the same.

because we can't get b.a.r.t. parking. >> i would like parking if they had an extra parking garage for sure. yeah, that would be great for peop people. >> reporter: b.a.r.t. says relief is on the way. at a press conference, b.a.r.t. board members describe plans for a new garage and new transit village. the garage will add 100 new parking spots, plus new restaurants and shops and 600 apartment units. but some commuters wonder how all of those people will fit on the trains. >> i mean, i think trains are already crowded. so unless they add more trains, more frequently, i think, i mean, it will be tough for commuters on b.a.r.t. >> reporter: it's hard to estimate what this will do to ridership. they're still a few years out. the parking garage will be the first priority. and with construction starting this weekend, b.a.r.t. officials today want to emphasize what key point to commuters. >> when that construction work begins, we're going to do everything we can to mitigate

the impacts. no matter what happens, we're going to have the same number of spaces available at the walnut creek station throughout this process. the number that's available today will be available next month will be available next year. >> reporter: so the work will be done in phases. the garage is set to be completed by the end of next year and they'll start working on transit village. amy hollyfield, abc 7 news. >> thank you. happening now, b.a.r.t. is starting the test runs on it's extension. it'll lead to two new stations, one in milpitas, the other in the area north of san jose. the trains are not carrying passengers yet, testing starts at 7:00 p.m. tonight and continues into next year. from friends to your tv screen. up next, a closer look at live with kelly and ryan as they kick off their new season. how the two are teaming up to make small screen success. and how about a live look right now from our exporatorium

now your forecast with mike nico. >> in case you slept in this morning, it was colorful and it showed signs of being label the cooler today. the fog you see or the low clouds here has reached our inland east bay neighborhood. humid areas no doubt, partly cloudy and mild by this afternoon. chance of light showers by tonight and tomorrow, maybe a clap of thunder. and the extent hot spots are going to develop this weekend.

let's look at today's tmperatures, coolest along the coast, mid-70s, half-moon bay, san francisco, about 77 to 82 around the bay. and then about 80 to 85 inland until places like ants yok and 88 and 86 up in lake port. today it'll be about 81 in san jose. so pretty comfortable for the most part. going through the game, a's game, intermittent sunshine, 12:45 first pitch, warming up to 74, that sounds comfortable. let's look from the exporatorium and break down the next 12 hours. 63 at the coast. 8:00, 64, not much of a drop by midnight. notice we hang in the mid-70s around the bay at noon and 4:00. the clouds are coming in with that extra moisture in that chance of a thunderstorm or two. which will be kind of on the warm side to about 68 in antioch. here's the area of low pressure. here's lydia.

even though it's not a tropical system anymore. it's still bringing some moisture our way. and look at all the lightning bolts with those thunderstorms that are going to head our way tonight through tomorrow. and already seeing some storms develop in the high country. look at that from tahoe northward, that red flag warning, high fire danger through about 11:00 tomorrow evening. so they're going to get it worse than us. here we are at 9:00 this evening, you can see some green starting to develop. and even some of it pushing from the coast on to shore tomorrow as we start the morning commute at 4:30. and they're still around by 9:00. the amount of rain is going to be very light, but the potential for lightning is out there and fire starts i think for the most part, we'll miss out on most of that and get a few sprinkles that'll taper by noon. clouds open up a little bit late tomorrow during the afternoon and evening hours. tomorrow's going to be our coolest day. now when that low passes us tomorrow it's going to drag the mugginess with it. friday you'll start to feel some of that refreshing, drier air

that we're used to. saturday we're back to average. look at temperatures sunday and monday. you arer 60s, low 70s at the coast. and even some mid to upper 90s monday and tuesday. nothing compared to what we dealt with last weekend. >> that's pretty much cool now that we're used to the heat. >> exactly. >> all right, sounds comfortable. >> we're used to it now. >> thank you. glowing reviews are coming in as kelly and ryan begin their first full season together as hostings of live with kelly and ryan. the first week is characterized by the usual celebrity appearances and vurer gaveaways but an unusual instant chemistry. sandy kennon has the scoop. >> reporter: they've been hosting live for just a few months, but kelly ripa and ryan seacrest are so comfortable together, it seems like the pair's been together for years. so it may surprise you to learn that ryan was nervous when he stepped out for that first show. >> i'm a fan of the show. friend of kelly ripa's, i like to do well, and have people want

me back. and that was what was most concerning to me. was like okay, i want her to feel like she made the right choice and i want the team and audience to want me to come back. >> reporter: ryan has signed to host the new abc version of american idol on the west coast. when it comes to the details of the commute, well, just listening to it is exhausting. >> i do this show in the morning live, the moment this show is over, we built a radio studio here, i walk into that and do it live to the west coast. and then come spring, we'll add american idol live in los angeles one day a week. so i'll be working in two cities at the same time. >> reporter: his co-host isn't worried about ryan being tired. >> there's a goofy quality that overtakes you when you're running on fumes and you're exhausted. >> reporter: and that makes for better tv. >> i'm not traveling coast to coast like he is doing, but i am traveling from fields hockey game to wrestling tournament. and that is like exhausting. >> reporter: the hosts have tens of millions of followers on

breaking news. several states and the district of columbia are filing a lawsuit over the president's plan to end daca. that protects undocumented immigrants. washington state attorney general bob ferguson made the announcement this morning. the lawsuit will be filed in the eastern direct of new york and ferguson said more could join in the future. california's attorney general yesterday announced plans to sue as well. a new class of celebrities will put their dance skills to the test on "dancing with the stars." >> who's ever really take an dance lesson? anybody taken an actual dance -- okay. okay. >> okay. the entire cast of the upcoming season was announced on "good morning america" this morning. today, it includes hgtv star
