tonight. >> reporter: really troubling story. we're not far from the home where it happened. a lot of neighbors understandably very upset tonight. police say the man who shot the animals is out of jail now facing possible animal cruelty charges. >> i think it's absolutely outrageous. >> reporter: linda have been taking pictures of a doe and two fawns for weeks. they believe it's one of these fawns and its mother that were shot and killed by their neighborhood on saturday. >> i think it's outrageous that a person would do that to innocent, non-harming creatures. >> we got a call from a resident about somebody described sneaking around the street with a flashlight. >> reporter: officers showed up and found a homeowner who said deer had been eating his new landscaping. a gruesome sight. >> discovered two deer. one that was dead and one that was dying. >> reporter: each shot with a

pellet gun. are is the pellet gun. 54-year-old mark dickenson used to kill the deer. >> you don't kill a doe with her fawn. it's really troubling. >> reporter: she's performing a necropsy on the deer to determine how many times they were shot. >> it's not worth killing a beautiful, gentle, innocent animal. >> reporter: abc 7 news tried contacting mark many times with no luck. his attorney said police had no right to arrest them. >> my client had no intention of harming, hurting or acting in any malicious way towards the animals. >> what was his intent? >> scare them away. >> reporter: the sheriff office is reviewing the case. father and his 3-year-old son suffer serious injuries today when a parked suv backed over them. responding chp officers say they don't believe anyone was inside

the suv as it rolled backwards pinto the man who was holding hs son. the two had just gotten out of car when it happened just before 11:00 this morning. >> it's sill to know if it was human error or mechanical error. we'll look at all that stuff. >> both father and son were rushed to the hospital. the boy was flown to ucsf hospital in oakland. alameda police are calling it a hate crime. a piece of rope made into a noose found on city street right next to alameda high school. that's where laura anthony is live with the story. >> reporter: this was found yesterday afternoon here by a pschool employee. this noose was fashioned out of the small rope that holds up the screen on the fence behind me. it was small but the message loud and clear.

courtney smith and other parents believe school officials should do more about a noose shown in this police photo found outside the tennis courts. >> it was a noose. that's a message. it's clear. i think we should send another message to say this is not how we do it in the bay area. >> reporter: it was fashioned out of thin, nylon rope. >> the whole length was about four feet. >> reporter: the district did notify parents with robocalls. >> i'm very sorry the parents don't feel the school reacted enough. >> reporter: smith and' others want more done to reassure african-american students that make up 6% of the population.

>> if they don't feel backed and protected by the school it will create a hostile environment for them. >> reporter: the school district plans to hold a series of meetings. police want anyone with information about the noose to contact them. charles manson follower leslie van houghton was granted parole. at 19 she helded kill two people in 1969. it's the 21st time she's appeared before a parole board. last year panel granted her parole but it was overruled by governor brown. the governor has 120 days to review the decision again. federal and state authorities are looking for two inmates who walked away from the federal prison camp this dublin. anna armstrong and michelle left the minimum facility at 7:15 monday evening. both women were serving time on

federal drug charges. armstrong received a five year sentence last march and irene michelle was sentenced to nine years back in 2014. brentwood police found stolen mail in pillow cases at a hotel and that the thieves used a digital key app to get around checking in at the front desk. abc 7 news reporter is live with the story tonight. >> reporter: brentwood police say the thieves stole mail from concord residents. u.s. postal inspectors are trying to get it back to the owners. >> we have seen an increase in theft. it's an issue that we are addressing. >> reporter: in this case police say thieves stole the mail and used a fake name to check into this hotel using a hilton digital key app on their phone. >> when you rent on the app,

they'll provoid you a blue tooth access code to allow you to check spinto your room meaning u don't have to check in at the lobby. you can go straight to your room. >> open your door with digital key. >> reporter: hilton advertises the convenience at hthousands o hotels. hotel staff found hundreds of pieces of the stolen mail stuffed into three pillow cases after they checked out of room using the app. there's no surveillance cameras outside the hotel. police say the thieves were able to ae main anonymous by having to contact at the front desk. >> i feel like it's not a really good idea. i feel like it's better if you go up there and talk to people personally. >> reporter: this is the same hotel where 17 cars had their passenger windows smashed and the cars were ransacked in a single night. brentwood police turned this mail theft case over the u.s.

maximum sustained winds of 185 miles an hour noufing to the west northwest. the biggest threat will be storm surge. 6 to 12 inches of rain. possibly up to 20 inches causing flash flooding and mudslide. it's a threat to the florida area by sunday afternoon as category 4. 145 miles an hour winds. by monday it's 120 miles an hour winds but this storm is going to impact the east coast for days. hurricane irma is not the only hurricane. we have jose gaining strength. we also have hurricane katia. this one is expected to hit vera cruz. dan. the airlines are being pro-active allowing people to reschedule their flights in anticipation of hurricane irma

that's perishable i got rid of. >> reporter: she left ft. lauderdale this morning and described the chaos already building. >> all the water is sold out. supermarkets don't really have any food for the families. schools are closed. the tolls were lifted by the governor. >> reporter: after what happened in houston, fl tl's governor rick scott wasted no time suspending tolls across the state to help move traffic. even the airline vs been proactive already cancelling flights and offering passengers a chance to rebook free of charge. some have even added cheap flights to help with the evacuation. >> look at what your airlines are doing right now. look at what they are offering. we're seeing a lot of airlines on their websites giving passengers the opportunity to change their flights would you tell us having to pay any penalties. >> reporter: irma may be as bad or worse than hurricane andrew that devastated the area 25 years ago. facebook's mark zuckerberg

he's been outspoken on immigration issues but he hasn't said what, if anything, facebook plans to do to assist its affected employees. with the announcement of ending, many dreamers are desperate for help. we have more on what's next. >> reporter: the city of san jose and santa clara county are planning litigation to prevent federal action. we spoke with dreamers today and a law professional to talk about options. >> we can do what's called an i 6 o 1a. >> reporter: he's nervous about what lies ahead. his 1-year-old son is a u.s. citizen. his wife is a resident but he is a daca recipient. >> i feel the need of looking for solutions because if i ever do leave, what's going to be of my baby and my wife. >> reporter: he was one of many

dreamers who reached out to an immigration attorney who find out what his options are. >> they give you a month to extend it up to two years. these are just temporary measures that somebody can take to try to keep their status legal for a little by longer. >> reporter: some dreamers say they have been advised there's not much they can do. >> as of now my attorney told me i would have to marry someone, a u.s. citizen if i wanted to get a green card because that's my only option. >> reporter: today 15 states in the district of columbia filed a lawsuit to block the president's plan to end daca. california's attorney general announced he will sue separately. santa clara university law professor says the states will likely argue rescinding daca is unconstitutional. >> there needs to be better reasons given when the administration does something like that. perhaps public hearings, notice, comment, those sorts of things.

>> reporter: attorneys are telling dreamers deportations are fot going to happen overnight. with 800 thousands recipients in the u.s., it's an enormous undertaking. a 60-year-old san francisco man has been sentenced to more than 0 committing a number of violent home invasion robberies that targeted 300 citizens. he was found guilty of 16 counts of robbery against seniors. he attacked elderly san francisco residents who lived alone and spoke little to no english. the crimes date back to may 2014. congress took a big step towards getting self-driving cars out on the road. the measure would block states from trying to control their design. michael finney is here. >> that's ticking some people off. the house passed a bill to speed up the twomt of self-driving cars. it would allow automakers to put up to 25,000 cars on the road in

that's the biggest one day gain in almost a year. the wireless wars continue. t-mobile is trying to attract customers with free netflix subscriptions. it's based in los gatos. the company will pay the annual $120 fee for people who already have a netflix account. the weather is getting interesting. you may have noticed that it feels cooler today. we're seeing some leftover moisture for what was once tropical storm lydia. it's spinning just off the coast. that's why we're seeing thunderstorms around the state. so far more than 1100 strikes have been reported around california. very unstable situation. earlier today saw some thunderstorms develop southwest of the bay area and because of

68 in half-moon bay. seeing those tropical clouds from our emeriville camera it's going to make for a great sunset. most of you in the 70s and 80s. i'm stepping aside because it's spectacular from our east bay hills camera. you can see how beautiful that view is. a chance of shower and thunder. a warmer pattern is setting out for the weekend. temperatures first thing in the morning in the 60s. watch out for those shower. it's still going to be hue mid. hour by notice you'hour you'll clouds increasing. you'll see a few showers developing during the morning commute. it's a just a chance could even see an isolated thunderstorm right on through the lunch hour before things change. it's about a 30% chance.

investigators are trying to determine what caused a pipeline leak near the phillips 66 refinery in rodeo. the state department of fish and wildlife says an estimated 55 to 60 gallons spilled on monday. the leak comes as the refinery seeks to double the number of oil tankers that make deliveries there. no one from phillips 66 could be reached for comment. a suspected shoplifter in eastern texas did everything she could to avoid going to jail. take a look at this video. you see her in the backseat of the squad car and while police

were rummaging through her shopping bags, she removed her seat belt, slipped through her cuffs and climbed through the window partition. she took off in the squad car. police chased her for 23 minutes at speeds over 100 miles an hour. police eventually caught her by using a pit maneuver forcing fog to lose control and slide to a stop. she's now in jail. the people became trapped after a gondola broke down from mechanical failure. one man said the ordeal was terrible. the tower gives 360 degree views of the coastline. americans arenreally aren'ta trusting mood. the wall street journal asked 1200 people which well known person do you respect and trust.
