it does sound like one lane gets by. three lanes down. i'll talk more about alternates in a few. surface streets are a better bet at this point. another crash that has cleared but some pretty long delays into tracy. let's check in with meteorologist nik nicco. mother nature did set the alarm for 5:00 this morning for places like discovery bay, byron, brentwood and i hope you were planning on getting up that early. this is going right across highway 4. it should be in brentwood any minute. antioch in about ten

pittsbur pittsburg in about 25 minutes. highway 4 corridor is getting interesting. and low to mid-60s the chance of showers continuing through noon. temperatures in the 70s. developing news now hundreds of people are being warned not to use their tap water for the next 48 hours. the east bay mud issued the warning last night to residents in 267 homes in and near almeida point. they emphasized the water shouldn't be used for anything including drinking, washing dishes, cooking or for your pets. residents said that they did notice an odd taste over the weekend. >> two days ago i tried it. >> if affected you can pick up water on west ranger avenue.

san mateo is asking the state to did might surprise you. officials want a ban on distracted walking. matt? >> reporter: hi, reggie, hi, natasha. we've seen it people looking at their cell phones and they start to cross the street. leaders want to ban this. people walking while crossing the street. they unanimously passed a resolution at their board meeting yesterday. he wants to make sure people are looking up and not down. it accounted for more than injuries from 2000 to 2011. the resolution basically asks the state to consider it or

consider giving the right to regulate the issue. the city of honolulu passed their own ordinance for pedestrians when looking at a mobile electronic device crossing a street or highway. matt keller, abc 7 news. it's 5:04 now. on to developing news, fema estimates the 25% of homes in the florida keys are gone following hurricane irma. officials say 90% of homes were damaged. search and rescue teams have made their way into the more distant reaches of the keys. they allow residents to return. destruction is so great in the u.s. virgin islands that people are being evacuated to puerto rico. >> i'm not sure what's going to happen next. that is something very

discomfort i discomforting. >> more than 4 million people are still without power. officials say it may take ten days to restore power in areas hardest hit by the hurricane. i want to show you video coming in from st. thomas, the devastation left behind. residents just starting to return home there. also a fear this morning that food supplies could run out before a new supply comes in. i want to show you new video, extensive damage there, also. this morning the french president is staying there and i will be keeping my eye on his visit. >> it's hard to see that. i was just there a few months ago. it's beautiful. happening today a truck full of supplies with donations will be heading to texas from san francisco to help hurricane

harvey victims. abc 7 news was there when volunteers loaded hundreds of boxes on to the semi. it's an effort by usf student who wanted to help after seeing the devastation. >> about $2,000 but that's nothing to me because money comes and goes. it's more about making a difference. >> and there is still time for you to help because of our story adding one more day for donations. you can find information about how to donate by going to our website, abc 7 news. the truck is leaving san francisco today at 5:00 p.m. and developing news where a middle schoolteacher accused of a sex crime is off the job this morning. our media partner "the mercury news" reports they are cooperating with investigators. the principal sent a message to parents. police say the teacher is accused of annoying or molesting a child.

he hasn't been publicly identified yet. a controversial decision in berkeley. police will now be allowed to use pepper spray during violent use pepper spray during violent confrontations. you can hear people booing. the plan amends the policy to use pepper spray on specific individuals committing violent acts. police are pleased with the vote but says it comes with responsibility. >> we are being granted the trust by our community to use for those very difficult, violent confrontations that a concern may occur in the future. >> police will be armed with pepper spray tomorrow when ben shapiro speaks at cal. forrer white house strategist steve bannon may be a target late they aremonth. officer joshua nia is out of jail on $100,000 bail. his arraignment was postponed

last month. investigators say they found child pornography on his computer. enea is a ten-year veteran. he has been suspended without pay. news after man wanted for attempted murder. this morning contra costa county deputies are looking for antonio morales. we will get you his photo later on. investigators say he rammed his car in a group of people at a parking lot in byron. two victims were taken to the hospital. they have since been released. if you know where he may be contact the contra costa sherr 's office. a group of residents working to stop crime in the city will take on car break-ins. police say there are more than 200 car burglaries in the city every month. today members of stock crime sf to legislate for legislation to prevent rental car burglaries. supporters want car companies to hide or remove advertising, bar codes and other visible markings

that let criminals know it is a rental car. a hearing will get under way on the sale after popular big wave surf contest off half moon bay. the hearing for the mavericks happening in southern california. the world surf league has scooped up the invitational contest and a $525,000 deal. this still needs to be approved in u.s. district bankruptcy court in los angeles. we have a pretty big issue in the north bay. southbound 101 before you get to spencer avenue down to just one lane due to a roll over collision about 30 minutes ago.% they're working on getting everything pushed off to the side. for now just one lane is getting by. they're trying to clean up a lot of debris. they have called a tow truck to the scene. we're looking at about a 27-minute drive. if you're trying to get through the area and then head down to golden gate bridge you'll save yourself about 15 minutes if you head over and use bridgeway through sausalito.

also another slow spot this morning due to an earlier crash westbound 580 tracy to castro valley should be in red. that is exactly at an hour. everything pushed off to the side. we're still trying to get some vehicles hooked up to a tow truck. you're slow there. no delays on northbound 101 and northbound 280 highway 1 to san francisco at just about ten minutes. let's check in with meteorologist mike nicco and a little bit of rain out there. live doppler 7 on the north bay right next to the west and moving west over the northern napa valley are some showers. those will eventually move over to windsor and possibly santa rosa. the strongest of the storms are down to our south around monterey where i think the strongest storms will be. we still have a chance of thunderstorms today. if you see lightning count to 30. if you hear the thunder before that seek shelter inside and then wait 30 minutes until the last bolt to head back outside.

daca program. president trump put an expiration on the program that protects 800,000 people from deportation. nancy pelosi is working with paul ryan and leader kevin mccarthy to come up with a solution. >> so while the president thinks that giving six months' time for congress to act, we want to do that sooner, within six weeks. >> two-counties in california are voicing their support for daca recipients. they passed resolution to become d.r.e.a.m.ers counties. president trump and south carolina governor will discuss the white supremacist rally that turned violent in charlottesville. the only african-american republican in the senate criticized mr. trump's response last month at the events in charlottesville. the president initially condemned the violence from many sides before calling out white supremacist, neo-nazis and the

kkk by name following two days of harsh criticism. also happening today senator bernie sanders will introduce a bill to create a single payer government run health care system. it's an issue gaining ground among democrats seen as possible presidential candidates. just yesterday new york senator gillibrand became the ninth to publicly support the medicare for all act. senators elizabeth warren, harris, cory booker and others have lent their support. sanders made single payer a focal point of his failed presidential primary bid against hillary clinton. and speaking of -- well, let's talk about this. whole foods foot traffic rose 27% after amazon acquired the grocery store change. it's unclear whether lower prices and curiosity will continue to lure customers in to their stores. some expect it to level out a bit. whole food wants to right the whole paycheck. i'm not so sure the next story is cost conscious. >> not at all. >> apple fans still buzzing this

with your "gma first look" i'm rebecca jarvis, abc news, cupertino, california. >> who is going to buy that for me? >> yeah, we need to start a fund for you. >> your birthday is over. >> thank you, mike. what if you saw this on muni this morning, look at the driver. he's reading a newspaper while driving. yikes. fortunately this did not happen in the bay area. i want to emphasize that. this happened in maryland. a rider took this video and showed it to transit authorities. the driver was placed on paid leave pending an investigation. authorities called the driver's actions disturbing and unacceptable. she said she just wanted milk and all she got was a shoulder injury allegedly. the woman in white you see in this jail waiting room in dayton, ohio, asked the correction officer to exchange her juice for some milk, that's when things really went haywire quickly. the officer grabbed her, took

her down. she claims she suffered permanent and debilitating injuries. she refused medical attention, however. now this actually happened in 2015. the woman is just now filing a lawsuit for excessive force. there has been no comment from the corrections department so we don't really know why this escalated the way it did. >> it's 5:19. dumb criminals, right? this is not one of them. this guy is clever. you see the guy about to apply for a job nonchalantly in boston, massachusetts. the applicant had also been the suspect in this police pursuit that was taking place in a nearby neighborhood. thanks to observant witness who saw the suspect ditch his car, officers in the pursuit were able to track him inside of that store. >> he grabbed him and he starts to tussle with him and the other two come in guns in hand and they said to him, you didn't think that we weren't going to

find you, did you? >> this all happened yesterday after the arrest the officer and manager high-fived one another. that was a real high-five right there. the suspect set to be arraigned this morning. >> it is 5:20 and i know some of you are going to wake up and see some drizzle. >> windshield wipers going. >> it's a little strange. hi, mike. even some thunderstorms possible. this had a history of dropping hail as it moved through discovery bay and now is moving heading to brett wood. another bolt of lightning. lightning is dropping out of this thunderstorm. and you can see it's starting to touch antioch as it continues to go up highway 4 so that highway 4 corridor is where the most diverse weather is now. a little bit of drizzle on the bay bridge this morning. south beach back across the western span. more new drizzle and thunderstorm. cooler and drier air arrives tonight and seasonal pattern for

our weekend. here is a look at what's going on at 7:00. you can see still a few possibilities of thunderstorms in the form of green. down to the south a better chance. and then as we head into the afternoon hours it'll move even further south and up into the mountains. there's still a possibility of a little bit of drizzle for the better part of today as you'll be pretty cloudy. temperatures right around 80 degrees in the south bay. a lot of us to right near 80. low to upper 70s, 70 to 78 on the peninsula. temperatures around 67 to 70 along the peninsula coast into downtown san francisco. up in the north bay about 76 at vallejo, san rafael, 77. everybody else right around 80 degrees. along the east bay shore, 71 in berkeley. fremont at 78. as you move inland about 79 to 83 degrees. so nothing extreme there. temperatures cooler. antioch at 64. that will be the trend, cooler

nights and a cooler afternoon tomorrow and then a little bit warmer in the afternoons but the nights will still stay cool. >> i want to take you back to our traffic alert this morning in the north bay. the roll over crash does not sound like it will be cleared anytime soon. a sig alert. we have the three right lanes blocked north of spencer and there was a lot of debris. the vehicle that flipped, they're having a harder time really getting that cleared from the roadway. approaching that crash on southbound 101 down to about 42 miles an hour, 9 miles an hour once you really get into the backup. plan on a longer commute if you are commuting from the north bay today. a quick check of the toll plaza. no official word yet of the metering lights being flipped on. if they haven't already they will be any minute. the south bay looking good so far this morning. looking at decent volume. next traffic update just before

resolution asking the state to ban cell phone use in crosswalks. the supervisor made the proposal. he says he believes it will save lives. a proposal to allow women to go topless in public is a no go for now. one city leader said they should pass an ordinance saying men must wear shirts. >> number five from the live desk, folks returning home in florida after irma but power restoration is a challenge. at least four have died from carbon monoxide poisoning. firefighters think power issues may have sparked this fire at a tampa school. tampa school. number six, car-pool drivers with riders. some parking space have is been set aside. the a's revealed where they want to build a new stadium. it's a piece of property near lake merritt and lake lany college. the a's are covering to build

housing and commercial space nearby as an incentive to cut a deal. this next story could be a storyline out of the next "hangover" movie. >> a man from the uk in vegas for a bachelor party thought it would be a good idea to take a swim in the hoover dam. you'll see a speck in the middle of your screen. he said he got hot and needed to cool off so he scaled down some rocks and jumped into the hoover dam. he was arrested and fined $330 american dollars. people who work at the dam said they have never seen this before and there would be no quick way to save him if he got into trouble. so don't do that. mate. >> funny. another full 90 minutes of news including the images b.a.r.t. police want you to see. some homeowners wanted $1.6 million for this home.

good morning, south bay. let's get up and get going. >> this is abc 7 mornings. coming up on 5:30, good morning to you. it is september 13th. we are halfway through the week and the whole team here ready to go. >> we are ready to go and the weather is a little unusual. >> it is. and first we have to get to you, there's something going on in the north bay. >> a roll over crash this morning and that is blocking a lot of lanes here on southbound 101. let's take you up on our traffic maps just before you get to spencer avenue. only the far left lane is getting by. this is a sig alert. that means that it will be at least 30 minutes before it clears. it could be much longer than that. we don't have an estimate on when things will be back open here this morning. a lot of debris involved in this and injuries as well. not a great situation there if

you are starting off in the north bay this morning. starting to ramp up some other areas, too, a live look at the metering lights officially flipped on this morning at 5:21. so start get heavy through the maze. i know i had to use my wipers this morning. you had to, too, right? absolutely. that was because of drizzle. i'm tracking thunderstorms right now. more intensity in the eastern sections by deer valley road, st. andrew's drive right there next to highway 4 just to the west of it. let's see where it's going. right up to clayton, concord, pleasant hill, martinez at 5:55 and vallejo at 6:06. history of small hail and you can see all those lightning bolt. be careful there. a look at some of the drizzle out ahead of it and that's in walnut creek as we looked south on 680. drizzle and storms. low to mid-60s.

the chance lingers through noon. then the skies will open up a little bit for sunshine. 72 to 77 at 4:00. and then by sunset about 63 to 70. most of the activity before lunch. >> thank you, mike. and developing news this morning antioch police are investigating a shooting that involved an off-duty officer from another agency. it happened around 10:00 last night on lone tree way. investigators found the officer standing near a car with a woman and they say he shot a man who left the scene. the victim was found a couple miles away with a gunshot wound in his arm. so far police have not said what led up to the shooting. they're expected to release more information later today. and also a new development in the push to allow women to go topless in one east bay city. >> one woman took this discussion literally during a berkeley city council woman. amy hollyfield live for us in berkeley. amy? >> reporter: good morning, reggie. the city council got quite a show last night here in berkeley. take a look. a woman who was at the meeting

decided to take off all of her clothes and then she paraded around in front of the councilmembers. she climbed up on a table and then on the dais after the councilmembers left the chambers. this all came after a discussion over whether they should lift the law that says women must keep their chests covered. activists say the law is sexist. >> you cannot show but men if men can expose their nipples everywhere on the street, in public places, women should have the same rights. >> reporter: the council did not take action on the item. one member said maybe they should pass an ordinance that says men must wear shirts. another said they should consult the commission for the status of women before they decide. right now it is a misdemeanor for women to bare their breasts in berkeley. one councilmember noted it is not strictly enforced here.

reporting live in berkeley, amy hollyfield, abc 7 news. the florida keys took the biggest hit from hurricane irma with nearly every home there damaged or destroyed. some areas are still cut off. all 42 bridges across the keys have been deemed safe. the death toll has grown to at least 12 now in the entire state of florida. president trump and vice president pence will travel to the state tomorrow to tour the disaster zone. many floridians are returning now. those who stayed and survived are considering themselves pretty lucky. >> i stayed in the bathroom, in the hallways. for two days it was hell. you didn't know if you were going to make it or not. >> it does sound awful. more than 4 million homes and businesses in florida are still without power this morning. officials say it could take months to restore electricity completely to the whole state. ♪ darling, darling

stand by me ♪ ♪ oh, stand by me >> there's usher and blake shelton and tons of star power. more than $44 million is the latest total raised last night in hand-in-hand. dozens of stars turned out to sing, answer phones, all pleading for support during the one-hour telethon to help people in texas devastated by hurricane harvey as well as florida and the caribbean hit hard by hurricane irma. the two men charged in oakland's deadly ghost ship fire expected to plead not guilty in court. they each faced 36 counts of involuntary manslaughter. one for each person killed in december's fire. almena rented the warehouse and illegally converted it into living spaces. harris lived there, too, and helped book musical acts to perform in the building. the oakland a's are revealing where they want to build their new stadium near lake merritt and lany college.

the a's are offering to build housing and commercial space as an incentive to cut a deal. they want to open the ballpark in 2023. there is significant opposition. activists from nearby chinatown neighborhood fear they will be displaced. there will be no new medical marijuana dispensaries opening for at least the next 45 days. a moratorium while it works on regulations for the coming sale of recreational marijuana which starts january 1st. the supervisors want new rules to cover both medical and recreational pot. the city has 35 dispensaries right now. the board is expected to consider marijuana regulations this fall. now a live desk update from abc 7 mornings. okay, listen if you are looking for a job this holiday season. target just announcing this morning it will hire 100,000 workers for the holidays, which is a major increase from last

year. get this, that's more than 30,000 jobs than created last year. they only had 70,000. a big jump there. sales have been pretty good lately. they had profits this year. target has 1,800 stores nationwide, dozens of those right here in the bay area. santa clara county committing at least $200,000 to help people caught up in the uncertainty over daca. the money will help renew their status before the october 1st deadline when president trump says he will end it. >> this is really a short window, so getting some assistance from the county is really something that will be really helpful. >> immigrants have to pay a $495 fee every two years to qualify for the program. about 1,700 of the county's 24,000 daca recipients are eligible to renew their status. families of shooting victims are suing u.p.s. driver jimmy lamb gunned down three co-workers in june before

killing himself. the families of the victims benson louie filed a lawsuit claiming that he set off a metal detector but that the security guards did nothing to stop him. the suit alleges u.p.s. workers complained about security problems at the building. a third u.p.s. driver wayne chan was also killed. two others were wounded. onboard surveillance cameras captured these images around 9:30 monday morning. the victim told police he showed her what appeared to be a handgun. he then took her purse and got off the train in south hayward. the victim was not hurt. if you recognize the man please call b.a.r.t. police. you may notice it's a little quieter near some cal train stations. cal train engineers will now only sound one short blast instead of continuously sounding

their horns when passing through certain stations. it only affects stations where tracks and platforms are separated from street level. however, engineers will still blow their horns at station that is have pedestrian crossings. there aren't enough homes available in silicon valley. sunnyvale, a house just went for way over asking price. our media partner "mercury news" reports a sunnyvale home recently sold for nearly $800,000 above asking. the four-bedroom, two-bathhouse listed at $1.7 million but sold just under $2.5 million. the agent who represented the seller says that may have just set a record for the most a home has gone over asking in the city. the buyer's agent says her clients were just tired of getting outbid. >> okay. i guess it's over to me now. a look at the roads this morning. we do have a traffic alert, unfortunately in the north bay. we still have not seen any improvement on southbound 101 before you go et to spencer

avenue. the three right lanes blocked. all due to a roll over crash that happened early this morning. boy, we're getting close to an hour now for this crash. so you're down to about 9 miles an hour approaching. i did check alternates. i had been recommending bridgeway drive through the sausalito drive. saving you about five minutes. so some folks using that for an alternate. heavy on 101. that's one of our latest commutes to really ramp up from the north bay so it's not a terrible backup yet. in the meantime a new issue here westbound 24 near wilder road. a new crash involving a motorcycle. that is blocking the two left lanes just before you get inside the tunnel. some backups. a quick check outside, we do have some mist and drizzle as well. so far southbound 680 through walnut creek looking good. if that crash is there for long on 24 that will start to impact that commute as well. let's check in with mike nicco with a look at the rest of the

forecast. mike? hey, everybody, good morning. look what's behind me. those are lightning bolts. that's a thunderstorm heading towards clayton right now. let's take a look at what it's been doing the last 35 to 40 minutes. discovery bay, the possibility of hail. purple signifies small hail if not really large rain drops. some brief, heavy downpours as it moved along to brentwood. the intensity is down but still dropping plenty of bolts. you need to be careful. and it's the definition of an isolated thunderstorm. it's about the only one in town except for the one just to the west that's now developing west of mt. st. helena. around windsor between clover dale and santa rosa. we have a chance of drizzle and isolated thundertorms with lightning and hail and gusty winds and heavy downpours. most of us will miss out on that, though, and have to deal with the drizzle.

welcome back, everyone. i have a very sad story making international headlines. an italian family killed after falling into a volcanic crater in italy. an 11-year-old boy died when he fell in and his parents died trying to save him right near naples, a pretty popular spot for tourists. the volcano is not active but the area acts like quicksand. the family's second child, only 7 years old, did survive.

speaking out about the incident with las vegas police officers that he says was a result of racial profiling. las vegas police say that bennett had been running and acting suspiciously. they say race did not play a role in the incident. two police officers singled him out, pointed their guns at him, and threatened to shoot him because he was a black man at the wrong place and time. >> all of a sudden i hear somebody say, get on the ground, the guns were already drawn. at that point i'm just thinking, like, is this real right now? >> you can see more of the interview coming up at 7:00 a.m. take a look at our traffic alert that still has not cleared in the north bay. we have three lanes down, southbound 101 just before spencer avenue, our sig alert, all due to a roll over crash. the backup not extremely long but down to five to ten miles an hour for about a mile approaching that.

you can see there's quite a few. another thunderstorm developing just to the east of discovery bay and that is going to move to the west almost over the same area. so you're getting hit twice. now look at this, that is live doppler 7, that circle 7 you see. and it is showing some pretty intense thunderstorms up here also with some locally gusty winds. heavy rain and a small possibly of hail especially out of that one just to the west near doppler 7 and the one over geyserville. so that's something to think about over the next half hour or so as they march just about due west. a look at the south bay. quiet other than a little bit of drizzle. the rest is a damp morning and a the rest is a damp morning and a dry afternoon. you can see the activity shifts down to our south. an isolated chance and the

it is 5:52. contra costa county has a new district attorney. retired superior court judge diana becton, the first woman and the first african-american to hold that position. she takes over a troubled office that has been plagued by controversy including a campaign cash scandal that led to her predecess predecessor's resignation. she is a graduate of sf state and golden gate university law school. she'll likely be sworn in as d.a. next week. a bill to change the law about crosswalks in california now sits on governor brown's desk this morning. technically in california you can't cross when a signal looks like that. a bill has been co-authorize that had would make it legal for you to cross the street while that walk sign is flashing as long as you can make it across before the signal turns to a wait sign. you can now guarantee
