a major league stage for this east bay marching band. tonight they took advantage of an a's game appearance to call out what they see as social injish. good evening. i'm dan ashley. ama daetz is on maternity leave. a's rookie bruce maxwell took a knee. tonight the oakland unified honor band did the same. live at the ballpark with more on the message those students delivered tonight. katie? >> reporter: dan, some fans were not happy about tonight's protest, but students tell me this was their opportunity to be heard because they're simply not old enough to vote. ♪ playing the national anthem in front of a major league crowd can be nerve-racking, but tonight students say it was empowering. >> people get to see what we're thinking because everybody has their own opinion. >> reporter: the oakland yeun

fied school district honor band took a knee while playing the anthem at the oakland athletics game. >> they're at the age where they don't have a lot of power because they can't vote and they're just watching what's happening. but they're also old enough to know what's going on. >> reporter: president donald trump said nfl players should stand for the national anthem or be fired, referenced colin kaepernick. students are upset about the president's rhetoric, the violence in charlotte, and other issues some may consider too mature for children. >> we want fod say what he's saying is not okay. >> my kids come home and talk a lot about what's going on in the world and with our current administration, and even my 9-year-old son, he has a lot to say. it's just amagz. >> reporter: the band first took a knee last year when kaepernick first started the protests. >> last year about two-thirds of the kids took a knee during the national anthem. that was the first time any of the musicians had ever taken a knee that we're aware of across the nation. >> reporter: a few band members remained standing tonight.

participation is voluntary. >> meantime, the nfl continued its protest over racial injustice tonight. the dallas cowboys and arizona cardinals either knelt or linked arms during the national anthem in response to president trump's criticism. meanwhile, pittsburgh steeler alejandro villanueva says he was embarrassed standing alone yesterday. villanueva, an army veteran, says he unintentionally separated himself in the moments leading up to the anthem. ve e>>dybory image of me standing by myself. everybody thinks that the team and the steelers are not behind me, and that's absolutely wrong. it's quite the opposite. they all would have -- actually the entire team would have been out there with me. >> villanueva says he will continue standing for the anthem and respects others' right not to do.so abc7 news was at berkeley today where a group called united against right wing violence held a rally. this was supposed to be day two of a planned free speech week

event. cal officials told us the university was played by organizers of free speech week that scheduled speakers that had never planned to actually come. now two more right wing speakers say they do intend to speak tomorrow. patriot prayer founder joey gibson and child chapman. an officer in town to assist with the event, had two guns stolen outside the black bear diner. his department does not have set rules for how officers store their handguns. today drivers on the bay bridge noticed a billboard with a simple message, impeach president trump. abc7 news report lilian kim explains who's behind the ad and what they're trying to accomplish. >> reporter: the new bill board targeted people heading into san francisco. it displays the word impeach alongside a picture of the president and it certainly piqued the interest of bay bridge commuters.

>> if i have to pay for it, i'm going to be a hot person. >> reporter: rest assured there was no tax money involved. it cost courage campaign $1,500 for the billboard to display its ad for a week. the organization will see how the next few days go before deciding whether to keep it up longer. and that decision will be based on traffic on its we abslsitoe,. it takes people directly to a petition calling for president trump's impeachment. >> we hope people see it and go, oh, my gosh. i agree. i didn't know there was an organization pushing for this and they might plug into the work we're doing. >> reporter: it also paid for an ad on the bay bridge applauding colin kaepernick for his national anthem protest. as for this latest ad, reaction is mixed. >> i think emblazingen that is a little too much. >> i'll go and look into it. if it's worth while, i might go ahead and sign it. >> reporter: courage campaign plans to put up similar

billboards in seven districts where hillary clinton won the majority of votes. in oakland, lilian kim, abc7 news. breaking news in southern california. a fire has forced evacuations on the border of orange and riverside counties affects more than 1,000 people. it's burned 2,000 acres so far. firefighters say the heat and wind have been just a dangerous combination. this fire is also burning dangerously close to state route 91 near riverside. check out this tractor-trailer that caught fire because of the flying embers now smoldering on the side of the road. new at 11:00, a mother is facing felony manslaughter charges in the deaths of her two daughters. alejandra ruiz who was the only survivor of a tragic car crash last year could be sentenced to 11 years in prison. she drove off the road into the petaluma river, where her car flipped over and submerged. the sisters were found strapped to their car seats and did not

survive. tonight law enforcement in the south bay is searching for robbers who targeted unsuspecting atm customers. they hit four locations on september 8th, and now police have released their photos. they got a good look at them. abc7 news reporter katie marzullo has details. >> reporter: the robbery happened at this chase branch at 8:30 in the morning. the victim was a woman using the atm. >> two suspects approached her. one grabbed her and said they had a firearm. she actually saw a firearm. >> reporter: these are the suspects, a man and woman in their mid to late 20s. a chase customer we talked to was shocked, especially given the busy intersection. >> it could have gone really bad. the fact that it could have happened with people literally right next to this event. >> reporter: after comparing notes and photos with police in other cities, camel investigators linked the couple to three other daytime robberies on september 8th, one in santa clara, one in sunnyvale and another at this bank of america in san jose. >> incredibly surprising.

the fact that they've been aware of this for several years and it's only now coming to light through investigative journalism is a problem for them, i think. >> some buyers of new homes in fremont didn't know the builder had unearthed indian skeletons there until the abc7 news i-team told them. now the developers of that $20 million project are offering to take some drastic action. >> reporter: we are putting the pieces together about what the builder knew, what they knew it, and what they told the

>> they're finishing off 17 homes in just two acres in fremont with elegant floor plans, close proximity to silicon valley, priced at $1.2 million. the i team has confirmed with the heritage commission that construction crews first found indian remains at that site more than two years ago. >> all throughout this site, they found a good number of bodies. >> reporter: and eventually unearthed 32 skeletons, some carbon dated to 650 years ago. >> it looked like a very old skeleton. >> reporter: they followed state rules and hired a team of monitors to ensure the remains are handled properly. sean harris did the job for two months. these women were in charge. >> i'd really like to know what's going on. >> we'd like to know how you found out. >> ramona didn't want to talk even though the builder referred me to her. >> i'm happy to address your questions and thanks very much. >> so have they found -- was it 32 skeletons?

>> i'm happy to allow ramona to address my questions. >> you just said you're happy to answer my questions. >> why would the developer be so concerned about keeping this quiet? >> well, okay. sales. >> andy galvin is director of the mission dolores museum in san francisco. he also works as a monitor for indian remains at construction sites. >> you don't want vandalism during construction, and you don't want protesters there. >> protesters? >> protesters saying what a horrible thing this developer is destroying our ancestors by digging them up. >> reporter: van dale kept it quiet from the public but also from people buying the homes. >> it was very hush hush on finding the body at all, and i had asked, you know, are the owners of these houses being told about it? they said it will probably be a small line on the bottom of a contract. >> reporter: several buyers told me the disclosure form simply listed artifacts found at the site. most buyers thought that meant

pottery or arrowheads, not skeletons. >> that's news to you, huh? >> i never heard. >> you didn't know? >> no. >> just days after my i-team report last month, breaking news of the indian skeletons, van dale sent this letter to home buyers finally acknowledging artifacts and human and animal bones were found in the soils underneath the community. the company also confirmed what i reported, that the remains will be stored in this vault, a big white box under a foot of asphalt at the end of the street, just outside the living rooms of two homes. the builder offered, should you wish to terminate the purchase of your home, van daele will return your deposits. >> they had an obligation to make this disclosure. >> golden gate professor marc greenberg tells me the disclosure now is better late than never, that buyers had a right to know about the indian remains from the start, not just because of the possible impact on property value. >> for example, let's say you bought the property and wanted to put a swimming pool in the

back, and doing so might disrupt a grave. you need to know that in advance. >> reporter: the company refused to be interviewed as did many of the buyers. they tell me they are consulting with attorneys and weighing their options, dan. >> i know you'll stay on this. >> sure will. moving on, u.s. capitol police arrested 181 protesters who disrupted today's hearing on the republican-led graham/cassidy health care bill. many showed up in wheelchairs urging lawmakers to oppose the bill intended to replace the affordable care act. republicans hope to push the bill through the senate before the september 30th deadline, but maine republican susan collins doo dashed that hope today when she announced she will not vote for the bill after seeing reports that it would cause millions to lose their health insurance. let's go talk about the weather forecast. meteorologist sandhya patel is here as we start the first week of fall. sandhya? >> yeah, dan. it's going to include one word -- warm. basically it's just going to be

warm all week long except by friday. things will change. i do have a sunset from earlier tonight. this is from our sutro tower, you could not have picked a more beautiful sunset. it's stunning. now, the warmth to build as you take a look at this live picture from our east bay hills camera. you will notice that it is definitely clear outside, and i do want to show you a live picture one more time again with the highlights. so we're looking at warmer fall weather over the next couple of days. the fire danger will be elevated as it is right now, and it will get cooler by the end of the workweek. so if you do not like this warm weather, it changes by the end of the workweek. i do want to show you right now a look at the concerns coming up. high fire danger for tuesday and wednesday. it is going to be dry and windy in the hills and there's a low

risk of heat illnesses possible, especially with the upcoming warm weather. so these things are to keep in mind. we a here's a look at live doppler 7. >> the skies are clear across the entire bay area. the winds are gusting out of the north-northeast. mount tam, 23 miles an hour. that is a wind that dries out the air. relative humidities have come up from earlier in the day. we head into tomorrow. notice what happens as that gusty wind develops. downsloping wind will reduce our humidity level. so it's going to be really dry in places like livermore down to 14%. you will notice petaluma, 17%. fire danger will be rising as the humidity drops. red flag warning for the north and east bay continues until 5:00 p.m. wednesday. watch out if you're out and about everyone joying the warmth. the fire danger is running high. temperatures anywhere from the 50s to the 70s. here's a look at tuesday.

boy, just incredible pictures to show you tonight of a lava flow in hawaii. the molten magma is pouring out of the kilauea volcano on the big island of hawaii. this is an extraordinarily large surface lava flow, and it's just beautiful. kind of almost hypnotic, isn't it? it does look golden really. fascinating. cool shots. on to sports. >> warriors play their first preseason game saturday already against denver. that was quick. then leave for china to play two games against minnesota in the global games

major league record for home runs by a rookie. hit two today against kansas city raising his total to 50. the fresno state alum has hit 13 rome runs in september and six in the last five games. maguire hit 49 back in 1987 for the a's and still has five games left this season. the warriors leave for china this sunday after their first exhibition game saturday against denver. the majority of the talk is how the players will handle it. also a big test for head coach steve kerr's health. he's gotten some help, took plenty of time off during the summer, and does appear to be much better. still his outlook, while cautious, is optimistic. >> i'm not 100%, but i'm on a good path, and i'm confident that i will be 100% at some point. hopefully sooner rather than later. i think it's going to go smoothly. i think i'll be fine, but who knows, you know?
