80s and 90s once again will be the name of the game by 4:00 today. let's get a check of the roads with alexis. >> we're off to a fairly quiet start. here's a live look at the bay bridge toll plaza. we've got just under an hour before the metering lights come on and we'll see delays back through the toll plaza. our drive time so far, one spot as usual, westbound 580 tracy to bub ly dublin, you're in the yellow at 33 minutes. northbound 85101 to cupertino, you look great at 15 minutes. police are questioning 40 drivers who saw a deadly officer-involved shooting in the east bay. >> it caused a traffic nightmare yesterday. amy hollyfield is live for us this morning. >> reporter: good morning, reggie. several police agencies were involved in this but emeryville police is the lead agency and is asking for any more witnesses to

come forward and tell them exactly what they saw and what happened. they already have dozens of witnesses, at least one posted this video of the actual shooting on social media. officials say the homicide suspect got out of his car and fired at officers and police fired back, killing the man. >> we're still trying to determine how many officers and which officers were involved in the shooting, so that's under investigation right now. our detectives are learning about who was present and what actions occurred. >> reporter: interstate 80 was closed in both directions. it was shut down around 9:00. they opened eastbound lanes around 11:00, but westbound lanes headed into the city closed until 5:00. the backup was horrendous. officials said they had to keep it all closed so they could gather evidence in this shooting. they haven't released any information about the suspect, just that he was wanted for a 2015 homicide in fairfield.

they say they will release his name after his next of kin has been notified. reporting live, amy hollyfield, abc 7 news. happening today, a judge scheduled to hear a motion for a new trial for the man convicted of killing sierra lamar. a sentencing hearing is also scheduled for today after being postponed earlier this month. according to our media partner, the mercury news, defense attorneys say the judge failed to disclose a conflict of interest. the judge once represented the prosecution's lead investigator back when she was a lawyer more than 25 years ago. according to multiple sources, the judge said that she did not recall representing that investigator. the landlord of the ghost ship warehouse where 36 people died in a fire in december will reportedly get at least $3 million in insurance payments. our media partner, the bay area news group, says he has already received more than $670,000 from a policy covering property loss and liability. she is being sued by dozens of the families of the victims.

returning, just an indication of a cooler weather pattern that is under way at this hour. at 63, still mild in the south bay and san jose, 60 in fremont but the north bay waking up to cooler temperatures in the lower 50s at this hour. reretufu and cloud cover later on today midday. the warming will not be as fast as it was yesterday. even along the coast it's still cool in the 60s. by the afternoon, it will not be as warm of a day today as it was yesterday, but still above average for this time of year. so highs today, we're going to see a wider range from the coast to the bay and inland. 77 the high in san francisco, 82 in oakland, still warm in the south bay, 90 in san jose, low 90s inland from concord and livermore, and 86 the high in santa rosa. the three-day forecast shows you coastal cooling begins today and look at friday. friday it feels like autumn again. widespread cooling will hit us to finish off the workweek. saturday, a breeze kicks up that keeps temperatures where they

news yesterday. the bus had been heading for the transbay terminal. a witness tells us the driver seemed to lose consciousness. he was one of five people hurt. police did not move the bus until engineers made sure nearby scaffolding wouldn't collapse. this morning republicans face the job of hammering out the details of president trump's ambitious plan to slash taxes. some democrats and republicans are already saying they're concerned how congress is going to make up the revenue lost by cutting corporate and personal taxes. here's abc's lana zack. >> reporter: president trump is promising an overhaul of the u.s. tax code, the biggest in decades, and he insists that the middle class will benefit. >> our framework includes our explicit commitment that tax reform will protect low income and middle income households, not the wealthy and well connected. and it's not good for me, believe me. epea r>>yr: ateort t b least on the wealthiest americans will benefit from the president's plan through the elimination of the estate tax, something that's only paid on estates valued at

more than $5.5 million for individuals, $11 million for couples. the president's plan would also slash the tax on corporations from 35% to 20%, reduce the number of tax brackets for individuals and families from seven to just three, and double the standard deduction, meaning no taxes on the first $24,000 of family income. democrats are already beginning to question who will really benefit from the president's tax plan. senator elizabeth warren tweeting out not one penny in tax cuts for the wealthy and giant corporations, especially not on the backs of everyone else. the stockton teenager who live streamed a crash that killed her younger sister will stand trial. prosecutors say the 18-year-old was driving with her 14-year-old sister and another girl in july when she lost control of the car. sanchez' sister, jacqueline, was killed. the other passenger was hurt. a forensic alcohol analyst said

sanchez' blood alcohol limit was over the legal limit. it did have to be retested because the officer incorrectly wrote down the name of the person that drew the sample. california voters may have more sway about who will be our next presidential nominee. governor brown has moved the presidential primary to march. they have traditionally held it in june. the state moved it to february in 2008. back then it didn't happen and lawmakers moved it bac in 2012. that early primary could potentially give candidates who have more money the edge in california. after of california voters surveyed in a new poll don't want dianne feinstein to run for re-election next year. just 43% of people in the public policy institute poll thinks that she should run for a sixth term. the 84-year-old feinstein has angered liberals with her call for patience with president trump. still, 54% of voters approve of

the job she's doing. feinstein hasn't said whether she is going run again. in a recent heat spell you may have noticed something new on your phone. did you see it? the health department sending out an alert yesterday warning about the heat and giving out information on cooling stations and other city services. the message also asked cell phone users to check on their neighbors, especially the elderly. >> it could be 95 in an apartment or house that does not have air conditioning. folks who live in those conditions are going to be vulnerable to heat-related illness. we want to make sure that those people know what to do, that the people who look after them know what to do, that they can get to a cooling center. >> this was the first time the city has used the cell phone alert system for a heat-related advisory. i think a lot of us are puzzled by that because it only got up to 85 in san francisco. >> i think it was a direct reaction to that labor day weekend heat where it was just so intense. yesterday was 85. labor day weekend it was 106 in
