her client. she never disclosed she once represented the prosecution's lead investigator working 25 years ago in the county counsel's office in a wrongful death case. if she loses the motion hearing sentencing could be delayed months while another judge looks at the transcripts of the case. mercury news reports zecher said in court documents i expressly deny defendant's claims that a person aware or the facts might reasonably entertain a doubt that i could be fair and impartial in this case. i am not biased or prejudiced against or in favor of the defendant in this action. sierra lamar's body has never been found. reporting live in san jose, matt keller, abc 7 news. on to another story this morning. playboy founder and pop culture icon hugh hefner has died. we are seeing an outpouring from fans. last night fans gathered at his walk of fame star in he died of natural causes

yesterday surrounded by loved ones at his home. he published the first "playboy" magazine in 1953 featuring a nude pin-up of marilyn monroe. he bought the crypt next to hers in southern california. we're tracking developing news out of the peninsula. police are increasing patrols around san mateo schools after reports of two ademtd kidnappings. the latest was near san mateo high school yesterday morning. a 14-year-old girl said she was on her way to school when a man driving a white van grabbed her. it happened near peninsula avenue and the caltrain tracks. she kicked him and ran home. a similar incident was reported last week. police are trying to determine if the two cases are related. the suspect described as a man in his late 50s or early 60s, unshaven, average build, and slicked-back black and gray hair. police are now working on a sketch. these surveillance photos could be key in capturing a driver who ran down a 3-year-old child in richmond and then kept

driving. the child now in critical condition. you see the pictures here showing a small red car. it happened on mcdonald avenue and7 211:30 yesterday morning. police say the boy was hit after he slipped away from his mom who was trying to put him into their car. major breaking news on the effort to bring help to puerto rico after hurricane maria. the jones act has been lifted and it's effective immediately. the white house press secretary tweeted out the news only a short moment ago say president trump has authorized the jones act be waived at the request of puerto rico's governor, ricardo rossello. and what is the jones act? it is a century-old law that requires all goods ferried to and from u.s. ports to be taken on american built and owned ships. lifting this act now means that puerto ricans can get supplies faster and cheaper. they can use international carriers while they need that extra help. back to you, natasha.

we're hol on to mild airdi ng from yesterday, upper 50s to lower 60s thin most spots. for most it's a warm autumn day. 82 in oakland, about 90 in san jose. 86 in santa rosa, 90 in antioch and a warm 90 degrees in concord. let's get a check of the roads with alexis. good morning, drew. i want to take you back down to southbound 880. the nimitz has had a couple of issues this morning. the first was right around the fremont on-ramp to southbound 880. we had two flipped vehicles. those are all gone so things thinning out there. just north of there before state route 92 we're hearing of a new multi-vehicle crash possibly involving a semi. we may have as many as four lanes blocked right now. we're working on more details, but definitely heavy through that stretch. a quick check of the bay bridge toll plaza. no issues here. however, within the maze there, 580 to westbound 80 we do still have a crash. it sounds like that's taking up more lanes. we'll check on that next.

it is 6:14. new at 6:00, a post office employee in missouri under investigation after he was recorded pepper spraying two dogs. the incident was captured on surveillance video. you're going to see the mailman spray the dogs at least 12 times in the six minutes he was on the property delivering a package. the dog's owner said she was also impacted because her eyes and hands became irritated after touching the dogs when she came home. the post office says it's investigating if the dogs posed a threat to the mailman. the trump administration announced it will allow no more than 45,000 refugees into the united states next year. that is the lowest cap ever for resettlement. officials said the lower cap would allow the department of homeland security to address a backlog of asylum claims which are filed by people already in the u.s. before leaving the office in january, president obama had set a goal of 110,000 refugees this year. if you are having trouble finding a parking spot on san francisco streets, you are not

alone. according to "the examiner" transportation officials may reduce the number of residential parking permits in the city. next tuesday they will consider a pilot program that cut thel w residential permits per household. the proposal would reduce the number of permits from up to four to just two. california could be making a move towards banning the sale of polluting cars. the state's chief air pollution regulator says the state is considering a ban on cars fueled by internal combustion engines. mary nichols made the comment to bloomberg news. nichols says putting motorists in an all-electric fleet would help the state meet its ambitious targets for reducing greenhouse gas emissions. sonoma county roads are getting a multimillion dollar facelift. over the next two fiscal years crews will repair 82 miles of pavement, 25 of which were badly damaged last winter. the price tag, $28 million, which the board of supervisors

alex alexis. >> westbound 580 on that connector to 80, it does sound like we have two left lanes blocked due to a crash. originally it was off on the shoulder. emergency crews are working to hook that vehicle up and tow that off to that toll plaza parking lot. as you can see, that is backing things up on 580. if you want to head south and use 880 instead, i'm really not seeing any delays there, so that's a possible alternate for you. a few more details on this crash just north of state route 92, one lane getting by so emergency crews on the scene, several vehicles involved. that backup continues to grow from just north of 238. if you want to use mission boulevard or hisperian those are some options as well. did you spot something a little unusual in the sky last night? take a close look. see that bright spot captured by our emeryville camera is the international space station.

heads-up today, especially if you're traveling internationally. california voters may have more sway as to who the next presidential nominees are. governor brown has signed legislation moving the 2020 presidential primary to march. california has traditionally held that primary in june. the state moved it to february in 2008 in hopes of having more influence, but that didn't happen and lawmakers moved it back to june in 2012. the early primary could potentially give candidates with more money the edge in california. well, half of california voters surveyed in a new poll do not want dianne feinstein to run for re-election next year. just 43% of people in the public policy institute poll think that she should run for a sixth term. the 84-year-old has angered liberals with her calls for patience with president trump. still, 54% of voters approve of the job that she is doing. feinstein hasn't said when she'll announce whether she's running again or not. now onto your morning money report. president trump is promising an overhaul of the u.s. tax code. >> it's the biggest in decades, and he insists the middle class

will benefit. the presidet's top economic advisor, gary cohn, is on "good morning america" talking about the plan. >> everybody at home wants to know what this is going to mean for them. so can you tell middle class families watches right now, say a family of four earning $55,000, how much they will save under the president's plan? >> that family can expect something in the neighborhood of $650 to $1,000 tax decr we are really solving for the middle class. >> it is clear there is one way the wealthiest americans will benefit. the president's plan calls for the elimination of the estate tax. that's something that's only paid on estates valued at more than $5.5 million for individuals and $11 million for couples. san francisco-based uber has decidedutown its carl leasing program. exchange leasing was launched two years ago by uber to lease vehicles directly to drivers who weren't able to obtain a car because of poor credit
