the morning and overnight hours that they really didn't have any delays here this morning. that certainly is good news here today and that crash is no longer blocking the roadway either. >> a quick check outside. in the south bay a little bit of the road spray kicking up. probably going to have to put those wipers on at some point those wipers on at some point this morning. you're in the green. i'm so used to saying yellow at this point. southbound 101 looks great at 17 minutes. okay, alexis, thank you. now to some of our top news here. residents allowed back by the bear fire near boulder creek. they are finally waking up in their homes, evacuated overnight tuesday after the fire broke out. residents were allowed to return home. the fire has burned 320 acres

and is 35% contained. we have all seen these images by now. there are some homes still standing but much of the neighborhood is flattened by fire. access to that neighborhood opens up for the first time since the fire. amy hollyfield is there. >> reporter: good morning, reggie. residents are finally going to get to get past this checkpoint making sure people aren't allowed in but they're going to get past this point at 10:00 this morning and some expect it to be an emotional day. they got the news last night. there were a lot of details given about not handling ash because of health concerns and services that the government will provide. how they are going to rebuild. >> as a father, just worried about to try to provide a roof

for them, just the simple necessities home again. >> reporter: for the next two days only homeowners will be allowed in. privacy as they process and grieve what has happened here. these restrictions are for the coffey park neighborhood. they will have to show i.d.s at the checkpoint to be allowed in and will only be allowed in between 10:00 a.m. and 5:00 p.m. reporting live, amy hollyfield, abc 7 news. now that the fires are nearly contained, some wineries are open for business. much of the valley remains intact. one tour company owner tells us that hasn't stopped people from canceling. he's already lost about $30,000

from cancellations after the fires and a half dozen of his employees have no work. >> for a small three-car limousine operation that's huge. so the perception that everything is gone, employees with hoses and shovels stopped the flames and more than half of the grapes had already been harvested. happening today an arraignment scheduled for the driver charged with hitting a san francisco police officer with a stolen car. elia lewin-tankel remains in intensive care after undergoing emergency surgery for his injuries. here's abc 7 news reporter. he's a good man. he didn't deserve what happened to him. i'll be forever in his debt for what he's done for me. >> reporter: the news of officer elia lewin-tankel hits home especially hard for those who trained with him at the bay

>> reporter: well, it's dry. roads here are still wet and you can see behind me here that there is a leftover after crash that happened, a tow truck here crashed and it took out a traffic light pole and crews here are now trying to fix that because right now the southbound lanes are closed on almaden expressway. some video we took earlier this morning you can see the tow truck all smashed up for some unknown reasons it crashed into that light pole there. rain may have been a factor. and in dublin there was another tow truck driver near the dublin pleasanton b.a.r.t. station and a fence along the freeway, debris flew everywhere including onto the b.a.r.t. tracks. crews ended up clearing the tracks in time for the morning commute. chp is reminding drivers to slow down.

the roads here are still wet so a good reminder that the roads here are still slick. give yourself a little bit of extra time on the morning commute because of that. reporting live from san jose, janine de la vega, abc news. a tough morning for tow truck drivers. firefighters in the santa cruz mountains are getting much-needed help. because of the 320-acre bear fire. cal fire says they have indirect fire lines in place. they're just waiting for the flames which are in inaccessible areas to get closer to the lines. some residents forced out by the bear fire are now being allowed back home. those are the residents of a neighborhood evacuated tuesday. one evacuee says he saw flames from his deck but now only some wisps of smoke.

>> i wasn't too concerned about the house because we did take most of the memorabilia and the things that mattered to us and i knew we were safe. all neighbors left. >> he says the experience has motivated him to be better prepared. fire crews are making steady progress on the north bay fires. the redwood valley fire is 90% contained while the sulfur fire is 96% contained. the atlas fires, the nuns fire 84% contained. pocket, 80%. three of the hardest hit neighborhoods will reopen at 10:00 this morning to residents of coffey park. orchard mobile home park and journey's end mobile home park. i should note there are virtually no homes standing there. it is devastation.

this will be the first chance those residents get to go back, see their properties and try to recover any personal property. >> school administrators working to try to give their students and families a sense of normalcy. >> schaefer charter school in coffey park and rieble elementary are still standing. both are located right in the middle of all that rubble. the plan is to clean up the schools and reopen them on october 30th. >> i imagine we're going to be excited and happy and then we'll have those moments where the feelings come up. they're still in shock. >> that is going to be difficult for those kids. kits and backpacks for students who lost everything. a public battle between the sonoma county sheriff and the acting director of the customs

enforcement agency. an unverified report that an undocumented immigrant had set the devastating wildfire in sonoma valley. the man is in custody facing unrelated arson charges. it's highly unlikely he's to blame for the disastrous fires. i.c.e. release this had statement reading, quote, once again a noncooperative jurisdiction has left their community vulnerable to dangerous individuals and preventible crimes. but the sheriff issued his own strongly worded response saying in part i.c.e. attacked the sheriff's office in the midst of the largest natural disaster this county has ever experienced. i.c.e.'s misleading statement stirs fear in some of our community members who are already exhausted and scared. disturbing allegations coming out of the north bay fire zone involving fema aid and i.d. theft. 7 on your side's michael finney spoke to a santa rosa resident.

she tried to get aid for her veterinary practice destroyed by wildfire. dr. lamar said she was speechless when fema told her someone had already used her social security number to apply. >> really on top of everything else i'm sure that nobody nee that ever. in this situation it's even more devastating. i am now a victim of identity theft as well as the wildfires. >> that is so crazy. she's not the only one facing this issue. >> over 4 million people registered for help. so we're aware of this latest scandal going on right now and we're trying to fix it as we speak. >> fema says no money will be going to scammers, any aid given is deposited directly into a registered survivor's bank account. you can bring your issues directly to 7 on your side's michael finney. he has been in the north bay all

weeklong. today at the community center from 11:00 to 7:00. >> sunnyvale police need your help in finding an at-risk man. he's 59-year-old robert perez. he walked away from an assisted living center. he is thin, wears glasses and has a gray beard. if you've seen him call sunnyvale police. developing news where police are looking for a carjacker who ran over and killed the vehicle's owner. authorities say he left his pickup running and unattended at 5:30. you can see from sky map 7 on sky 7 where this happened. they tell us when he got back to his car the suspect was in the driver's seat. they say the suspect threw him to the ground and then ran over him.

he leaves behind a wife and two kids. a man is in custody after officers say he choked a police k-9 during his arrest. they spotted thomas williams in front of his redwood city home wednesday. he then ran inside and officers followed and they said williams fought back. williams started choking the dog. police were able to handcuff williams. crash will be okay. he is taking a few days off, though. the national parks service is dropping its fight to restrict dogs. the decision comes after a lawsuit uncovered irregularities in the decision making progress. it would have required them to be on a leash. park officials wanted to protect native plants and wildlife. they lobbied for their dogs to run off leash.

>> parks commissioners thought they had voted 4-3 to rename justin herman plaza. then they found out they have to do it again. even though he was recorded as saying yes so the city attorney's office says legally the vote is 3-3. they will take another vote at its november meeting. repair costs at the damaged oroville dam have skyrocketed to more than $500 million which is nearly double the original estimate of $275 million. the contractor says the project has required significantly more excavation and concrete than expected. tens of thousands were evacuated in february after the main and emergency spillways were heavily damaged during the storms. >> our storm over.

as you look southbound towards 24, the good news it did clean the air. you may see a little smoke but it looks like your air quality it looks like your air quality will stay in the healthy levels. we're at about 46 in rohnert park and napa. we're 50 right now in san ramone. we have 55 in alameda and newark and redwood city. 55 in san jose. winds aren't quite as fast at 11 miles an hour. roads, they're slick this morning. mass transit cool to mild

we're back at 5:45. controversy over president trump's comments to a widow. the chief of staff opened up about the loss of his own son and how he advised the president to handle those emotional calls to a fallen service member's loved ones. john kelly lost his own son when he stepped on a land mine in afghanistan in 2010. this is something he doesn't talk about often. >> my son's case in afghanistan, when he died he was surrounded by the best men on this earth. his friends. that's what the president tried to say to four families.
