bay, westbound 580 near 24. traffic is slowing on westbound 24 on the connector map to 580 and of course i've been mentioning that as you head to 680 so check out the drive time, tracy to dublin is 1:07. that's approaching 680 and several lanes are blocked. southbound 680 slow right now, dublin to mission boulevard. >> frances, thank you. we are tracking developing news out of san bruno as well. an uber driver taken to the hospital after a shooting on the freeway happened after 11:00 last night on 380 just east of el camino real exit. according to chp the driver had just picked up two passengers at the airport. he was coming from sfo. they were not hurt in the shooting. chp found the second car further down the road and it was shot multiple times. the people inside the car ran away before police arrived. the you burr driver was taken to

the hospital with nonlife threatening injuries. so far no arrests. firefighters are in the final stages of reaching containment on four different fires. the pocket fire is now 86% contained. a group of fires including the nuns fire is now 90% contained. and the most destructive fire, the tubbs fire, is 94% contai d contained. it destroyed thousands of buildings. students in napa county will be heading back to school. >> one of those schools that's reopening today is donaldson way elementary in american canyon. that's where we find reporter elissa harg son joining us live. hi, elissa. >> reporter: jessica and matt, students can expect clean classrooms that have been wiped down multiple times and mental health counselors will be on site. thousands of students in the napa unified school district will return to school for the first time in two weeks since

the atlas fire and others broke out in the north bay. schools closed because of bad air quality. smoke-filled classrooms and ash. teachers and maintenance crews have been airing out buildings and clearing away the ash. they had to turn off air conditioning units to change out filters. adjustments will be made when air quality is bad. the superintendent posted a video last night thanking first responders and thanking parents and students for their patience and understanding. >> there's amazing stories of our students volunteering at the evacuation centers, the vintage farm, and many other ways they showed real leadership. they're showing the leadership we expect from our students and we are so grateful and so honored to be serving them. >> reporter: i just checked the bay area air quality management website to see how things are today.

in napa county it shows this area is in the yellow. there is only a small risk for people who already have respiratory problems. reporting live in american canyon, elissa harrington, abc 7 news. another fund-raiser in the works for the fire victims. the chronicle reports working with giants president to hold a benefit concert at at&t park. the goal would be to raise between $30 million and $50 million with all of it going directly to those hit by the fire. no exact date yet but organizers are aiming for early november. and you can find more ways to help fire victims on our website, abc7news.com. we have complete coverage of the north bay wildfires all on one page including resources for evacuees, maps of the fires, analyst of updated evacuations. and from the live desk this is certainly a case of he said/she said. the widow of an army sergeant killed in niger says the

president forgot her husband's name when he called her. but this morning president trump tweeted that he said the soldier's name right from the very beginning. the circumstances surrounding the death of sergeant last david johnson remain unclear. president trump has denied saying, quote, he knew what he signed up for to myeshia johnson, the widow. congresswoman frederica wilson, meanwhile, of florida was in the car with johnson when the president made the phone call and she said the president did say those words. >> whatever miss wilson said was not fabricated. what she said was 100% >> critics say the president has now turned a soldier's death into a game of who do you believe? you can see the entire interview with myeshia johnson on "gma" beginning at 7:00 this morning. happening today preliminary hearing continues for a former oakland police officer charged

with soliciting sex from a prostitute and tipping her off about undercover stings. officer ryan walterhouse has pleaded not guilty. he was arrested last year. the fbi was reportedly conducting a sting operation on one of the dates prosecutors say he warned the woman. oakland police say walterhouse's case is not related to the larger scandal involving a woman named jasmine abusman. oakland police are expected to release more details about a hit-and-run. our media partner the bay area news group reports police arrested 35-year-old annette koslowski for driving under the influence. they say she hit the child and is accused of leaving the scene. police say she was arrest add short time later after she hit a parked car. some good news for napa residents this morning and it's not fire related. the city plans to take the nearly half million dollars the state will give them for the new road maintenance fund and use it

to fix 15 miles of streets in six neighborhoods. according to napa valley register the streets targeted for state funding serve neighborhoods north and south in the napa valley commons. the new road maintenance fund was created by higher fuel taxes and vehicle registration fees. california is joining 18 other states to protect health care subsidies. the move lawyers will take today. plus, some of the youngest victims of the wildfires. how the community is coming together to help them be kids again. looking live outside this morning with abc 7 now.

a former wrestling coach at san francisco state is accusing

the university of age and racial discrimination. according to "the examiner" the athletic department told the coach jensen he did not recruit enough black wrestlers and was told his contract would not be renewed and he, quote, couldn't have the job forever. jensen was the wrestling coach for 34 years. the school release aased a writ statement saying they denied it and would do an evaluation. students and parents got together for a special dinner. abc 7 news was at hidden valley elementary school. school board members lost everything in the firestorm. so did teachers and students. >> i'm not that stressed anymore that the fire will get to me because they took a lot of it out. but it got close to my house. >> it's nice to be back at school and i think it will be good for when school starts up

again because it's normalcy. >> teachers come back on wednesday to formulate a re-entry plan. students return on friday including welcoming more than 80 new students from the school down the street that burned down. hidden valley is a total loss. officials say 146 students lost their homes between the two campuses. in the santa cruz mountains the bear fire is now 7 % contained. cal fire says nearly 400 acres burned. the fire destroyed four structures and nine firefighters have been injured since it began. and now we want to take you halfway around the world. quite a sight for swimmers. look closely here at your screens. a pod of orcas came right up to the beach, and you can see them splashing in the waves and people, frankly, running out of there. swimmers say they didn't notice the killer whales there next to. some were scared. others say it was a once-in-a-lifetime experience. >> they called them orcas at

it feels more like summer than it does october. >> it's that one time of the year it will get really hot. probably the last stand. i'm not sure we'll get to the 90s like we're going to get to this week. look at the offshore breeze and look how far the marine layer is out, about 100 miles right now, and you can see, yeah, the sunshine about to break out. technically around 7:26 it will crest the hills there. 54 to about 61. that 61 is in livermore where we have a down sloping wind this morning. 71 to 75 from the coast to inland at noon. 77 at the coast. 86 to 87, well above average. almost near record warmth today. enjoy a wonderful evening. 66 to 74. so we've got alexis out right now. guess who's back, it's frances. >> just like old times and, unfortunately, traffic just as bad. right now the drive on westbound 580 from tracy to dublin is 1:06. there were earlier problems approaching the 680 interchange. they have been cleared but the delay remains.

southbound 680 slow from highway 4. it's a 12-minute ride. and i also wanted to mention the san mateo bridge, just turned yellow yellow. a crash at the toll plaza. 21 minutes. what started as a typical uber ride turned into a terrifying situation. >> a gunman opened fire on their car along interstate 380 and it's something we typically all do. we get an uber from the airport. it's a bizarre story. tiffany wilson with what happened with this trip. hi, tiffany. >> reporter: hi, good morning, jessica and matt. yes, the police are searching for the gunman who fired on the uber right now. it all started when the driver picked up two passengers here at sfo around 11:00 last night and got on westbound 380.

at that point another car started opening fire and the uber was hit multiple times. a chp officer says the driver was hit by a bullet and crashed just east of the el camino real exit. the two passengers inside were not hurt. another black car that looked similar to the uber driver's black toyota corolla was shot multiple times further west on 380. the people inside of that car ran away before police arrived at the scene. >> we were on scene, locate add vehicle that was stopped behind me there in the center divide, a black toyota corolla with several, what looked like bullet holes. three parties in the vehicle. unfortunately, the driver was struck. >> reporter: the driver was taken to the hospital, but he is expected to survive. chp says the crime scenes stretched nearly a mile long and westbound 380 was closed nearly five hours while they investigated. it reopened shortly before 4:00.

chp has not released any information on the suspect or suspects involved in this shooting. live at sfo, tiffany wilson, abc 7 news. thanks, tiffany. san francisco police responded to a call an uber driver was shot during an attempted robbery at laguna and clay street across from lafayette park saturday night. there is an uber sticker on the back of his car. we're waiting for an update on the man's condition. developing news out of vallejo. police are looking for the driver in a hit-and-run crash that left two children in critical condition. it happened around 5:45 yesterday afternoon at turner parkway and foothill drive near the gateway plaza shopping center. both children were airlifted to a pediatric trauma center. police say a woman was pushing her 2-year-old son and 3-year-old daughter in a stroller when a car hit that stroller. that person drove off and the mother was not hurt. >> happening today opening statements in san francisco in a

trial expected to get national attention. kate steinle was shot and killed on pier 14 in july of 2015. an undocumented immigrant, jose ines garcia zarate, fired the weapon but his immigration status is off limits a woman in the jury pool of 1,000 told abc 7 news that they were told to ignore the politics surrounding the case. >> they did talk about that not wanting to color peep's thoughts during the case, that that was not what this case was deciding and that wasn't the place to make decisions about immigration policy. >> a trial is expected to conclude in early lee ayanne melendez will be covg

the trial. people impacted by the north bay wildfires. >> it is on aero drive, open every day from 9:00 to 7:00 through this sunday. they will assess needs and offer recovery information. can get water, snacks, gloves, trash bags and dust masks. >> some people living in glen ellyn and kenwood were lifted. there's still a mandatory curfew in those areas. dozens of roads remain closed. fire crews expect to have full containment of the fires on wednesday. a story really heating up. president trump is defending himself against a soldier's widow who said he forgot her husband's name.

the battle over who remembers what over a condolence phone call the president made to myeshia johnson as she was on her way to meet her husband's body. in an exclusive interview on "gma" johnson says president trump first told her, quote, he knew what he signed up for. then couldn't remember sergeant la david johnson's fame. >> he couldn't remember my husband's name. the only way he remembered my husband's name he told me he had my husband's report in front of him and that's when he actually said la david. >> well, the president tweeted this morning, he had a respectful phone call with johnson and actually spoke her husband's name from the beginning. so he's refuting that and you can see the entire interview with the soldier's widow, myeshia johnson, in an interview right after our newscast. and you can also watch it right now on the abc 7 news app.

so stay tuned for "gma" at the top of the hour. the hunger strike scheduled to begin in the santa clara county jail suspended but some inmates refusing food because they're angry with sheriff smith. smith allegedly commented a hunger strike would help the inmates lose weight according to "the mercury news." prisoners feel that undermines agreements reached last week between inmate advocacy groups and jail officials over improving conditions. refusing food inmates want their meals donated to the needy and improving inhumane jail conditions like overcrowding. workers at uc campuses are continuing their battle over what they say are unfair wages. our media partner the bay area news group reviewed audits from all ten uc schools. they found contract workers are being paid below the system's promised $15 an hour minimum wage. uc president janet napolitano set the bar at $15 back in 2015. the school's largest employee

union has said the wage bump is nothing more than good publicity and isn't being executed. a uc spokesperson says by the end of the year the system will provide more training to employees who oversee the contracts to make wages more fair. >> construction crews expect to meet a deadline set by the state to fix the oroville dam. this shows crews rushing to finish repairing the emergency spillway by november 1st. that's just nine days away. record rain caused the spillway to erode and nearly fail in february forcing nearly 200,000 people to evacuate for several days. the goal is to get it repaired before the rainy season begins. cost estimates for the project has gone from an estimated $275 million to $500 million. absolutely no rain in the forecast now through the end of the month. in fact, above average temperatures with our warmest set coming at us now and a secondary warming trend next week that won't be quite as warm

as this one. in the hills at 67. los gatos, 63. we have 52 right now in campbell. san jose, 56. milpitas, 64. santa clara, 67. cupertino, 49. we have temperatures all over the place in the south bay. 59 in alameda and san francisco. novato, 48 degrees right now. let's take a look from the east bay hills camera and you can see just how cloud free and fog free we are this morning. so clear and dry for the roads today. no fog and maybe a little bit around novato. visibility was as low as one mile at one point. your school day forecast, make sure they're wearing the autumn gear with temperatures in the mt. 50s but summer wear for the afternoon hours. average high in san francisco is about 69 degrees. noon we're at 72. we'll top out at about 80 at 4:00. we'll take a quick look at oakland, the average high about 72 degrees.

that will melt and we'll have to start over again. a look from mt. tam, how clear it is this morning. even the bay looks like glass in some areas. total sunshine, warm to hot highs. clear tonight, comfy back in the 50s and 60s and the heat gradually tapers by the weekend. look at these two areas of high pressure. they strengthened pushing the storm track in this atmosphere all the way up into canada and it's going to cause some flooding rains there. it dislodges this cool and chilly air and dumps it into the midwest and eventually the east coast where their temperature will be in the 40s and 50s for highs later on into the week. make sure you get the forecast before you pack. 86 in san jose. near 90 in santa cruz. 81 to 86 on the peninsula. we'll be around 76 to 79 degrees
