to 66 with sunshine around the bay, 61 to 69 inland and then we're all back in the mid to upper 50s by 7:00. a lot more sunshine, a lot less breezy today. enjoy it. here is sue. we are going to the bay bridge. take a look at the backup there, just slight backup for those paying cash on those left hand cash lanes. if you can carpool that's always a great way to go even when the met rieng lights are turned on, those carpool lanes are usually moving by at the limit. here is your approach to the bay bridge on the east shore freeway, a little bit more crowded but still moving nicely, no stalls or accidents on that stretch to get you on through. road work coming over the waldo road, southbound 101 through the robin williams tunnel and that should be picked up momentarily. here at the live desk i have an update on that breaking news i mentioned at the start of our show. a stabbing at a safeway store in san francisco and i just was

able to get some more information. we have learned that it was an employee at the grocery store who tried to stop a man from stealing something and then those two men got into a fight, the suspect's dog bit the employee numerous times and the suspect also stabbed the employee in the back. police tell us other employees then rushed to help out the victim and called 911. he was rushed to the hospital and that employee right now is in critical condition, unclear fell make it. meanwhile, the suspect is under arrest. that is horrifying. jessica, thanks for the update. the man accused of starting a fire in the santa cruz mountains is headed to court this morning. >> investigators say he is responsible for the bear fire and they say they have witnesses who saw the arson happen. abc 7 news reporter matt keller live in santa cruz this morning. matt. >> reporter: reggie, the bear fire was destructive and dangerous. not only did it destroy homes, structures and vehicles. several firefighters were also injured while battling it.

that's why the arson suspect is facing such serious charges here in santa cruz county court. the sheriffs investigators believe 54-year-old marlon coy set the fire below boulder creek based on interviews with three people who saw it happened. detectives say coy was in a relationship with a woman where the fire originated but there had been some sort of dispute. he was arrested on october 17th, date after the fire started, not for arson, but because he allegedly stole jewelry from an evacuated home. coy faces five felony counts in connection to the fire and nine felonies for the alleged burglary. his hearing is scheduled for 8:15 this morning here in santa cruz. reporting live in santa cruz, matt keller, abc 7 news. the tubbs and pocket fires in napa and sonoma counties are expected to be fully contained today. the nuns fire is 100% contained now. most road blocks in sonoma county have now been lifted. mandatory evacuation zones are clear as well. the sonoma county sheriff says

residents are transitioning to a new normal. >> we've sent all the agencies that came to help us home. we've release the national guard troops that were here to help us and we've gone back to normal staffing. >> the sheriff estimates approximately 75 to 100 agencies provided aid. santa rosa police are still looking for 14 homeless people reported missing after the fires. develop news this morning, president trump trying to distance himself from the former campaign leaders after yesterday's double indictment. >> the biggest break in the investigation was the revelation of george papadopoulos pleaded guilty to lying to the fbi about his russian contacts. he is the former trump campaign foreign policy advisory. former campaign chairman paul manafort and one time deputy campaign manager rick gates were charged with 12 counts in all. those charges include conspiracy against the united states and money laundering. both employed not guilty to those charges. new developments in a san jose murder investigation, police say border patrol officers caught the suspect near the u.s./mexico border. police say this man, devin

vargas is in the san diego county jail in morning, he is accused of stabbing lucas gutierrez to death almost two weeks ago, it happened on brandon lane east. police have not said how the menu each other. day six in the trial of sews a garcia zarate. a ballistics expert testified. he says zarate fired directly at steinle even though the bullet ricocheted off the ground. prosecutors are trying to persuade jurors that this was no accident. the defense plans to bring in its own crime scene expert to testify. happening today new legal action to protect a homeless encampment in berkeley. complaints from a nearby school caused bart to evict people living on the east side of the tracks. this is video of them getting booted out last week. the people on the west side filed an injunction. attorneys representing that group plan to ask a judge today to extend that injunction. bart owns the land in question but it's maintained by the city.

there was a rally today to raise the income of low wage workers in san francisco, taking place at city hall at noon. supporters are asking for at least 1686 an hour in 2018. the groups includes in the low wage category are airport, nursing home, laundry, home care and nonprofit workers. >> new numbers show how serious lead levels are at three san francisco public schools, tests conducted at west mortal and malcolm x as well as san francisco international high schools and according to sfgate.com at least 30 water taps contained water with high levels of lead. a fountain in a high school at san francisco international had a lead level nearly 60 times the maximum under federal health guidelines. go to website for a full list of schools that have and have not been tested. >> now your accuweather forecast with mike nicco. let's take a look at the difference between yesterday and today. just a little bit warmer down in

san jose, about four degrees, but you can see with the clouds they're having a harder time filling in, temperatures 2 to 9 degrees cooler in our inland east bay neighborhoods and the north bay valleys. let's start up there where we have 43 in ukiah. bodega bay 46, novato and american canyon at 43, 44 napa, one of our usual warm spots, tiburon right now at about 48 degrees. across the bay, though, you can see san francisco 53, mid 50s to upper 50s down the bay shore, both sides into the south bay. 48 lafayette and brentwood. a look from mt. tam you can see how much cleaner the air is and drier for the commute. mass transit skoo cool this morning, mild this afternoon and a calm out on the water. san jose hour by hour halloween forecast, 5:00, 67, down to 64, 61 at 7:00 and then into the

upper 50s by 8:00 and 9:00. how about oakland, starting off at 60 at 5:00, 58 at 6:00, down into the mid 50s, 55 degrees as we head through the evening hours. all right. let's jump ahead to what's coming our way. we have two storms coming in, we had to elongate the time frame that's going to influence our weather to monday morning. we're going to have rain, occasional downpours, a half inch to an inch of rain and double that up in the hills. it will be breezy at times all four days. we will take an hour by hour look at that and the rest of the accuweather seven-day forecast coming up next. how about the morning commute? who hi, suh is. we're going to san jose to check out your ride. 101 at the 880 overcrossing, traffic is looking good, head lights headed in the northbound directions, no delays here. we go across town and take a look at 280, head lights headed north from san jose towards cupertino and that's the 17/880 overcrossing there, looking at an eight minute drive for that

distance a. we will take a look at our traffic maps, slowing out of the central valley. let's take a look at mass transit options this morning, right now bart 41 trains on time, ace train number 1 has left stockton and is on time making its way towards lathrop. no problems with muni. thousands of people who have overpaid or even double paid for parking tickets in san francisco will see a refund. >> abc 7 news reporter jonathan bloom explains how to find out if cash is coming your way. to many the simple sound of the street sweeper causes panic. >> i would have moved that car like 5:55 but i just miss it had. >> now he is stuck paying this $73 ticket. >> it's absolutely outrageous. that's insane. there is not enough parking, too many cars. >> patrick mcguire learned that when he first moved to town with his pickup truck. >> i got hit with $2,000 worth of parking tickets in front of my house. >> but for all the people here paying hundreds or even thousands of dollars in parking fines it turns out a fortunate

few are due to get money back from the city if the city could find them. >> they have a refund due to them. >> in all the city is holding on to more than half a million dollars belonging to drivers who accidentally paid too much or paid for the same ticket twice. mistakes that mostly happen when people pay by mail. >> these individuals were on this list, we haven't been able to get ahold of them so we're trying other forms of communication. >> they've published the list online, about 7,000 drives, each with tens or hundred dollars of dollars in unclaimed cash. in most cases. mta has no problem finding drivers, this he know where you live. >> these people collect about 50, 60, maybe $100 million worth of parking tickets and fees a year. >> actually, $90 million so the unclaimed refunds are the tiny percentage, still the city will take that pun if nobody claims it. >> if we don't get ahold of them that money will go into the general fund. >> if it's yours you have until december 14th to get it. >> how about not charging so much in the first place. >> city officials point out parking fines go right back into

found him yet. with hoards of families and children hitting the streets for halloween both the mayor and chief will be in seminole heights. >> we want those kids to be able to go trick-or-treating safely. >> reporter: we will have more on this community on edge coming up at 7:00 a.m. with your gma first look, i'm kendis gibson, abc news, new york. it's 5:15. a federal court is blocking president trump's ban on transgender members of the military. >> you remember in august the president announced he intended to reverse a 2016 policy that allows troops to serve openly as transgender individuals. the judge wrote that transgender members of the military who had sued over the change were likely to win their lawsuit because the administration provided no actual evidence for why a ban should be implemented. house of cards is collapsing in the wake of the kevin spacey scandal. netflix says the upcoming season will be the last for the drama and it does stret that the decision to end td show was made before the spacey candle but says it is deeply troubled by the claims. spacey is accused fd making

sexual advances on a minor just 14 years old decades ago. he is the star and executive producer on house of cards. carvey weinstein is banned for life from the pro drufr guild of america. the group says he gave up his membership and board members unanimously voted to impose a lifetime ban against him. dozens of women have come forward accusing him of sexual harassment. apple about to get greener thanks to a solar deal. the gallop project the largest solar power plant in oregon began commercial operation late last week giving apple a giant new source of green energy. avan green renewables tweeted this picture, it will sell the power to the tech giant through a long-term power purchase agreement. let's get over to meteorologist mike nicco. a lot of people wondering will we have good weather for trick or treat. >> it's going to be a little chilly for some kids but they will be running so much they will be fine. might just have to put a long

sleeve shirt or something underneath the costume. here is a look from sutro tower, more sunshine and it looks like calmer and also milder conditions. fewer clouds and cool tonight and an active pattern rs friday, saturday, sunday and monday. today we will have 59 at half-moon bay, clouds will be a little more stubborn here than everywhere else, 62 san francisco, 63 to 67 around the bay and 67 to 71 inland. so, yeah, that extra sunshine will jump our temperatures about 3 or 4 degrees over yesterday. also it will feel warmer because it won't be breezy as it was yesterday, winds knifing through our clothes. 42 santa rosa and clover detail. mid and upper 40s until you get to antioch and san francisco. low 50s there. still expecting the first part of the storm to come in friday morning in the form of drizzle, scattered light rain. it will become steadier at 7:00 up in the north bay and then that will push through all the

way until about say 8:00 in the morning through the heart of the bay and then by about 2:00 in the afternoon to 3:00 it will move out of the south bay. we will get a break saturday night through sunday morning and at noon sunday you can see a batch of steadier rain light to moderate moving through all the way until monday morning during the commute. that entire time its snowing in the sierra, that's why they will have one to two feet at this higher elevations. first push of rain through saturday, a quarter to a half inch and when all is said and done monday two-thirds to an inch and a half from the south bay to north bay mountains. my accuweather seven-day forecast we will be in the 60s and 70s through thursday and friday through monday 50s and 60s. sue. >> back to the bay bridge we go. no metering lights yet at 5:18 this morning, expect those to be turned on at any time. just minor delays for cash paying folks in those left hand cash lanes, we will check back in a few minutes because i have a feeling it's going to be

heading out the door here are the sent things to know before you go. number one is breaking news, i've been watching from our live desk, a safeway employee was stabbed overnight trying to stop someone from stealing. happened at the store in san francisco on 7th and cabrillo ongoing park. the employee is hospitalized in critical condition. number two, it is day six in the trial of jose garcia zarate. the defense plans to bring in its own crime scene expect to testify. president trump responding to the indictment of former campaign chairman paul manafort. in a new tweet minutes ago he said there was no collusion. number four, starting tomorrow you will be paying more at the pump thanks to a new gas tax. it's going up to 12 cents a gallon for gasoline, 20 cents for diesel. the money will be used to improve roads and public transportation. number five, check this out, we have got several chances of wet weather starting friday with the heaviest of the weather hitting saturday and sunday and

>> we are splendid in our orange and black. >> not quite as blustery as yesterday. you can see it right here, most of us are calm to a 3 mile per hour wind at concord and napa. look at the flags on the ferry building, they are not moving as we look from our roof camera, south along the embarcadero. temperatures a little cooler this morning, dress warmer, 47 to 51 degrees, the coast will stay in the 50s where the clouds will linger a little longer but you will still see sunshine. 60s already with those slower breezes and that extra sunshine will push us to 66 to 69 around the bay, temperatures by 7:00, 53 to 59. we will take a look at your hour by hour trick-or-treating forecast coming up next and a big chance of rain, over a four-day span in the accuweather seven-day forecast. coming up on 5:30 we've got pretty lysle conditions out there this early tuesday, halloween morning. traffic throwing flew san rafael, taillights headed in the

southbound direction past the north gate mall and civic center at the limit from novato into san francisco, about a 22 minute drive right now. earlier accident over the altamonte, the reason for very slow traffic, it's about -- in fact, let's take a look at some of the drive times. i think it's about an hour, just about an hour from tracy to dublin west on 580. 24 looking great from walnut creek to highway sp 13 in the oakland area, 680 from 4 to walnut creek a 6 minute drive. developing news out of san francisco a man has been arrested after police say he stabbed a safeway employee. this happened around 12:30 this morning at the store on 7th and cabrillo. police say the employee tried to stop the suspect from stealing. the suspect's dog bit the employee several times, that's when the suspect stabbed the employee in the back. he is in the hospital right now in critical condition. developing news out of antioch, police are investigating a deadly shooting there, this happened around 8:00

last night on pepper tree way a few blocks south of antioch high school. one person is dead, police have not released any information about a possible suspect. happening today the suspect accused of starting the bear fire in the cruz mountains expected to be in court. >> 54-year-old marlon coy was arrested on october 17th one day after the fire started not for arson, though. officers said that he stole jewelry from an evacuated home. the bear fire burned 400 acres, destroyed two homes and hurt 13 firefighters. three witnesses say they sawoy c he faces five felony counts in connection with the fire and nine felony counts in connection with the lurg larry. in sonoma county the board of supervisor will get an update on the wildfire recovery efforts and debris cleanup program. emergency housing needs will also be on the table when the board meets in morning. the nuns fire that burned parts of sonoma is fully contained, the tubbs and pocket fires are 99% contained. cal fire expects full containment on all north bay fires by today. 5:31. you may want to fill up your

tank today. >> california's new gas tax starts tomorrow and prices at the pump are supposed to jump by double digits. aim hollyfield live in concord. good morning, amy. >> reporter: good morning. the people behind me look smart for filling up today and we're finding they are just here because they need gas. this err not even aware of what is happening today but they do have good timing because starting tomorrow gas is going to cost a bit more. 12 more cents a gallon for gas, 20 more cents a gallon for diesel. this is the new california gas tax going into effect. drivers we talked to seems a bit surprised and a bit defeated. >> didn't even know and you've got to pay it anyway. >> i actually do it every day monday through thursday because i travel all the way from here from antioch all the way to santa cruz so i drive every day. >> what is this going to do to you? 12 more cents a gallon.

>> it is what it is. it's not like i can change anything about it. >> reporter: this tax is to pay for road improvements. it's expected to bring in $52 million in the next ten years. if you have an electric car you don't completely escape the tax. you will be charged $100 a year to go forward road maintenance. there are some attempts under way to get a measure on next year's ballot to repeal this tax, but for now you're going to have to pay it and it starts tomorrow. reporting live in concord, amy hollyfield, abc 7 news. barts new fair inspection program to crack down on fare cheaters will cost the agency $740,000 a year. however, its police chief doesn't think it will be effective at least at first. that's according to sfgate.com. the plan to smack cheats with a $75 fine starts january 1st. six inspectors were fired to go person to person asking for proof of payment but keep in mind there are 46 stations and

420,000 passengers that ride every single day. chief carlos rojas says it doesn't add up, but changes are still likely. the goal is to recover the $25 million that bart says it loses every single year to evaders. this morning president trump's legal team is responding to the double indictment of paul manafort and rick gates and a former campaign adviser's guilty plea. >> if you look at the manafort pleas no mention of anything to do with the campaign there in their indictment. with regard to papadopoulos as sara sanders said yesterday he was a volunteer with the campaign, sefbd on one of the committees. he was evidently according to the documents that the government has filed he was in contact with individuals that purported to be somehow involved with russia or russian government, it's not clear from the governments what they actually were. >> the president's attorney appearing on "good morning america." he says there is no crime of collusion after george papadopoulos pleaded guilty to lying to the fbi about his communications with the russian nationals.

he also says he has not talked to the president about pardons but does say pardons are not on the table. 5:34. happening today execs from facebook, google and twitter will testify before congress on russia's use of social media in the 2016 election. facebook will tell the senate judiciary committee that 126 million of its users may have seen content produced and circulated by russian operatives and that is a lot more than previously disclosed. these are some images of the ads. google will say that russian troll farms bought $4,700 worth of ads and uploaded over 1,100 videos to youtube. san francisco supervisors will consider a resolution calling for congress to begin impeachment proceedings against president trump. it points to his firing of former fbi director james comey, the trump campaigns ties to russian interests and the president's financial interests. richmo richmond, oakland, alameda and santa cruz have passed similar resolutions. officers would have to file

reports in any confrontation where they use physical force. right now they only have to do this if it's someone who is injured or a weapon is used. supporters say it will hold police more accountable in any encounter with citizens. happening today the family of a ten-year-old boy injured on a water slide in dublin plans to file a lawsuit. this video was quite something when it first came out. our media partner at the bay area news group shows the boy getting thrown off of a slide in may at the wave water park. it looks really bad but he was not seriously hurt. his parents attorney says the lawsuit will include the water park, city of dublin and the slide's manufacturer and contractors. san jose police say a suspect is in custody for a string of strong line robberies that target senior citizens of asian and east indian descent. investigators released the surveillance video of a robber caught in the act, that is 21-year-old lawrence carter yanking a necklace from a victim's neck. you can see it right there. carter faces multiple felony

counts including robbery, elderly abuse and assault with a deadly weapon. he may be responsible for other robberies. voters may have the final say over california's sanctuary state law. supporters of a ballot initiative to overturn it can now begin collecting signatures. the law limits the ability of state and local police to work with immigration authorities. the backers say it undermines the federal government and protects criminals. they have until january 3rd to collect 366,000 ballot signatures for the initiative to appear on the ballot next november. let's start off with some temperatures because they are cooler this morning so dress warmer. upper 40s everywhere in our inland east bay neighborhoods. concord 51, same thing at san ramone, 52 pleasanton and livermore and dublin at 53, pittsburg at 52 degrees. temperatures around the bay, 52 oakland, up to san jose at 59, up in the hills los gatos 48,

a nice nine minute drive. guys? just coming into our live desk a really biz zr story making national headlines right now. a 16-year-old boy in texas was hospitalized after he made a liquid toxen and then ingested it. happened in corpus christi. he made and drank ricen which is a deadly toxin. hazmat crews had to be called in and even the ambulance that took the boy to the hospital had to be decontaminated afterwards. no word yet on his exact condition, but that toxin is so deadly that in powder form it can kill you with just a few grains, but as a liquid form he does have an okay chance of recovery, so we'll stay on top of the story. two sailors say they were stranded at sea for five months before being rescued, now questions are being raised about whether their story is true. % >> black face or halloween costume gone wrong? you will hear from a local store

either he or the victim are students. questions being raised about the story of two women stranded at sea for nearly five months ex. >> experts are saying some parts of their story don't add up. the coast guard said the women had an emergency radio beacon aboard their sailboat the whole time but it was never activated. one of them says they didn't activate it because they never felt like they were truly in distress. they are there are also questions about a tropical storm the women say that they encountered. there was no record of any severe weather along their course. abc 7 news has obtained exclusive video of an employee at staples explaining why she's wearing this dark makeup that many people say looks like black face. a customer took this photo friday at the staples in pleasant hill. a video you will only see here on abc 7 news. she's going to explain her motive behind the potentially offensive costume. >> what is your costume supposed to be? >> i'm a beauty shop customer.

coming together to make this halloween special for young fire victims. students at jack london elementary got to dress up and enjoy a carnival yesterday, the event sponsored by the boys and girls club of central sonoma, it's not just businesses lending a helping hand. >> i heard a six-year-old that told her grandfather halloween will have to be canceled this year and it broke my heart. >> that's tina, she is stocking up on candy and putting an invite on social media to welcome all trick-or-treaters to the austin creek community. the installation of security cameras at dolores park in san francisco is under way. the cameras started to go up in the last week or so. it's part of an effort by the city to reduce crime following a shooting in august that hurt three people. officials also hope the camera will help reduce graft tee, but did you see what was there just around that camera? graffi graffiti. the city spent $250,000 on this installation. it's 5:46. rainy season on our doorstep

already and happening today the city of san francisco is trying to make sure people are ready for the wet weather. city leaders will be at the flood prone areas of 17@and full some streets at 10:30 this morning. the barricades go up to try to prevent flooding. they will be talking about their strategy called rain ready sf. it encourages people in the city to plan and prepare and includes creating an emergency plan, picking up sandbags and buying flood insurance. >> going to take a look at that weather. tonight no rain but there is rain in the draft eventually. >> there definitely is, two storms i'm cracking right now, that will be coming our way. so a couple of things you want to do, i apologize for that video. clear the leaves in your drains and your gutters. watch the wipers and the tires and how about slow down just a little bit as you encounter some of that wetness, especially early on when it starts to interact with the oil that's on the ground. all right. so let's talk about what's going on right now in bull nut creek.

another storm moves into the north pay and then exits the south bay about 8:00. you notice all that snow the entire up in the north bay. our first push of wet weather we're looking at about a quarter to a half inch of rain. calistoga and ukiah a lot more. as we get that second storm to come in we will nearly double that to two-thirds of an inch of rain in the south bay to an inch and a half to two inches up in the north bay. here is a look at what's going on as far as your accuweather seven-day forecast. 60s and 70s today, tomorrow an thursday, 50s and 60s friday, saturday, sunday and monday. the rain gets to rain on us for an extra hour saturday night into sunday. set those clocks back an hour and check the batteries in your smoke detectors. let's see a peek outside at what's going on with our traffic. bay bridge toll plaza metering lights were on at 5:21 this morning and you are all sold out back to the mcarthur maze you go. we have first reports of an accident westbound highway 24
