the new jersey home depot where he rented a truck on the day of the attack, use it had to mow down pedestrians nearly 20 blocks on a bike lane. eight people were killed. according to the criminal complaint against him he wanted to kill as many people as he could. he allegedly was inspired by isis videos he watched on his cell phone. natasha, i want to follow up on that story. president trump this morning once again responding to the new york city terror attack. i want to show you some tweets he sent out within the last ten minutes or so. statistically that process takes much longer than going through the federal system, and he also sent out this tweet within just the last eight minutes saying there's also something appropriate about keeping him in the home of the horrible crime he committed. should move fast. death penalty.

stopped the rampage all coming up at 7:00 a.m. abc news, new york. more lawsuits targeting pg&e in the north bay fires are expected to be filed today just as the california judicial counsel has been asked is to combine them into one. it was used in the san bruno explosion. if granted one judge will hear the entire case in san francisco superior court. today mary alexander, the lead attorney for victims in the ghost ship fire, will hold a news conference to announce new filings representing 12 victims in the north bay fires. alexander will also provide an update on the ghost ship fire cases. happening today the prosecution is expected to wrap up its case in the kate steinle murder trial. the 32-year-old was walking along san francisco's pier 14 with her father when she was shot more than two years ago. shot more than two years ago. the jury watched the

police then took a different approach. they lied to get garcia zarate to confess. they told him the firearm had been recovered and had a dna match. he finally admitted he shot the gun. he said he found it at the pier. new developments in the case of a bay point man who died in police custody last year. newly released body cam video shows the moments leading up to the death of humberto martinez. a warning here, some of you may find this disturbing. lilian kim has the story. >> reporter: body cam video obtained by the east bay times shows a pittsburg police officer putting 32-year-old humberto martinez in a chokehold. at one point you can hear martinez struggling to breathe. >> he's still resisting. >> reporter: this encounter was a result of a pursuit that began after police tried to pull over martinez for expired tags. martinez drove to a friend's house instead and ran into the garage. officers chased him into the kitchen and after a struggle an officer ended up applying the

chokehold. >> it's just a life and death struggle. humberto was struggling to breathe and they're insisting that he not move while they choke him out. and they killed him. >> reporter: officers tried to revive him to no avail. his death was found to be an accident. friends at the house when it happened believe otherwise. >> that little bit of him showing him dying and struggling to breathe, i mean, how could you not hear a man trying to breathe and still keep on choking him and beating him. >> reporter: a spokeman declined to comment on camera, but in a statement said the department believes the officers acted, quote, lawfully, appropriately, and consistent with training and experience. this case may very well end up with a jury having to decide. the family has filed a wrongful death lawsuit. in pittsburg, lilian kim, abc 7 news. 5:06 now. new details this morning about daca. california's attorney general is asking a federal judge to reinstate the program until a lawsuit against the trump

administration has been decided. the request was made for a preliminary injunction blocking the administration's push to end the deferred action for childhood arrivals program. daca protected undocumented immigrants, many of them now college students, from deportation. new developments this morning about the sale of recreational pot in san francisco. a hearing before the city supervisor's land use and transportation committee will discuss another set of marijuana regulations as they pertain to planning code amendments, one of those regulations is an equity program. now that is designed to help certain people find employment and business opportunities in the cannabis industry. they are low-income residents, people of color, and those who are arrested or convicted. the tesla model three will be late, really late. that's just the beginning of the bad news for the bay area based company. >> tesla is reporting a massive loss. matt keller is live in san jose. matt? >> reporter: good morning, reggie and natasha.

a lot of people are shocked by tesla's earnings report. not only is the company losing a lot more money than expected, it's making a lot less cars. the model three was supposed to be the car of the masses. production is making it the car of the few. $19 million loss in the third quarter due to heavy spending on model three production. elon musk promised 1,500 in the third quarter but only 220 were produced. blame it on the battery because the delays at its facility in nevada, tesla expects to make 20,000 model threes per month by the end of march. elon musk originally promise that had by december. it's been in high demand, is about half the price of the model s at $35,000 and that's not including federal tax credits. more than 500,000 potential buyers on the waiting list having put down a $1,000 deposit. the only people who might be more upset than them might be tesla stockholders, down more than 5% in after hours trading.

we're back at 5:14. happening today president trump's former campaign manager paul manafort and his business associate rick gates will appear at a status hearing in washington, d.c., courtroom. the two surrendered monday as part of the investigation into possible russian collusion in the 2016 election. both are accused of conspiracy against the u.s. and other felonies. a status hearing is where the judge, prosecutor, and defense attorney discuss evidence and motions. manafort and gates have both pleaded not guilty.

happening today house republicans are expected to release the text of its sweeping tax overhaul bill. the rollout was set for yesterday but lawmakers needed more time to decide what exactly should be in it. gop lawmakers objected to plans to eliminate deductions as well as proposals to limit pretax contributions to 401(k) retirement plans. president trump has said that the bill will primarily benefit the middle class. also happening today president trump will announce his pick for the next head of the federal reserve. his leading choice is federal reserve governor jerome powell, a former treasury official who appears inclined to continue gradual interest rate hikes. he may be open to easing some regulations on banks. if nominated powell would replace janet yellen, the first fed chief to serve a full term without being nominated for a second. kevin spacey is seeking evaluation and treatment amidsexual misconduct accusations according to

"people" magazine. several allegations have recently come to light. his response to the accusation caused widespread criticism. actor and director dustin hoffman is accused of harassing a teenager. hunter claims it happened when she was 17. hoffman is apologizing. the head of facebook says the company will invest more heavily in security. the ceo mark zuckerberg says profits will take a hit because of the move. the social networking site has come under fire for russian-bought ads. nearly 126 million facebook useers in america may have been exposed to content generated by the russian government. by next year facebook plans to have more than 20,000 people working on safety and security doubling the current number. amazon getting ready to hire hundreds of seasonal workers for its fulfillment centers. it's holding a hiring event at 9:00 in richmond at the court yard marriott. according to the silicon valley business journal amazon has more than 800 open positions at its

fulfillment centers in san jose, richmond, and newark. the jobs pay around $13 an hour. houston astros fans are celebrating the team's first world series championship. friends, this is not houston. this is right here. abc 7 news was at the sports bar in san francisco and look at this. last night astros fans nervously watched the game. they saw the victory over the dodgers and, you know what, probably celebrated all night long. >> here is my question, are they astros fans or just dodgers haters? right? how many astros fans are really in san francisco? >> isn't that one and the same? right? to texas, thousands of real fans wait for hours to be the first to get the world series championship swag and they're still there. this was the scene south of houston where the line wrapped

temperatures about the same this morning as yesterday. we'll start dry during the day but the clouds will return. nice southerly breeze will keep us mild today and a little more humid and that will translate into drizzle, even light rain and milder conditions tonight and tracking several light storms through the extended. temperatures today, 60 along the coast. 62 in san francisco. 63 to 66 around the bay. a narrow margin with the increasing clouds. 63 to 68 inland neighborhoods. tonight you see the green out there, some of the light rain scattered with our temperatures in the low to mid-50s tomorrow morning. so here we are at 5:00 this evening. evening commute looks pretty quiet. then you can see once the sun sets during the overnight hours that southerly wind bringing up the moisture and creating the drizzle to light rain that will continue throughout the day tomorrow. scattered waves of light rain and sprinkles and then the steadier rain moves in during the evening and overnight hours, but it leaves us quickly by saturday morning and saturday afternoon looks to be pretty quiet.

sunday, though, looks like the storms will come in later and weaker. 4:00 in the north bay and then exit the south bay by the end of the morning commute. here's a look at my accuweather seven-day forecast. we'll get about a quarter of an inch to three-quarters of an inch in the north bay. about 1 to 1 1/2 in our hills. so the threat of flooding on the burn scars is there but is not a great threat right now. don't forget to turn your clocks back an hour, get that extra hour of sleep saturday night into sunday and those temperatures stay below average with another chance of rain light tuesday and wednesday. how about the morning commute, sue? so far, so good most places. we do have a couple of problem spots, a solid stream of traffic coming down the east shore freeway on through berkeley and the mcarthur maze into the bay bridge. toll plaza, a problem in the vallejo side of things eastbound 37 near skaggs island with a car trying to pass a big rig and got stuck. got out of control and stuck under the big rig. i am seeing some slow traffic in

francisco. >> the southbound lanes are shifting to the center of the road. amy hollyfield has what this means for your morning commute. hi, amy. >> reporter: good morning, reggie. here is what it looks like. these lanes right here next to the sidewalk are now closed, construction zone. the cars will be moved to the middle of van ness so expect a different ride through here starting today. this is southbound. so this is coming into the city from the golden gate bridge. this is one phase of a huge project, a major overhaul of van ness. in this phase they'll be replacing the water and sewer systems underneath. officials call this part of the project intense and disruptive. they say it will take about two years. van ness will lose some parking spots to this phase and at times van ness will be reduced to one lane in each direction. the van ness makeover is expected to be complete in 2020. reporting live in san francisco,

amy hollyfield, abc 7 news. >> amy, thank you. san francisco police are trying to figure out whether the carjacking after taxi is related to that police shoot-out we told you about in the castro yesterday that left an officer in critical condition. now the shoot-out happened near 18th and diamond just after midnight yesterday. it started when officers were notified about a suspicious vehicle, detectives say it turned out to be stolen. when officers approached there was an exchange of gunfire between the suspect and at least one officer and both of those people remain in the hop. the suspect's condition is life threatening. about a mile away in the mission district san francisco police say a carjacked taxi was ditched on oakwood street. it's believed it was taken in the castro right after the shoot-out. the exact connection to the crime remains unclear this morning. neighbors say police searched all around that area yesterday. at the live desk this morning tracking breaking news. a third person has died after a shooting inside a colorado

walmart. it appears to be at random. and right now there is a manhunt under way for the shooter. the shooting itself happened late last night in thornton which is just north of denver. witnesses say a man walked in and opened fire. two men died at the store. a woman died at a nearby hospital. and i've noticed this morning that a lot of reports say that walmart has confirmed those victims are not employees so they were guests of the store. the gunman was able to escape. right now police, as i mentioned, are looking for that person trying to identify him with surveillance video. there's no indication, though, this is an act i have terror. natasha, back to you. >> jessica, thank you for the update. happening today nearly 2,000 oakland city work remembers planning a one-day strike. that strike and protest of an unsuccessful six-month negotiation with the city over fare wages and work site safety. city officials say they're continuing to negotiate and they want a fiscally prudent agreement. the strike will cause the following to close today at 2:00. all head start and early head start centers, all parks and rec

facilities and after school programs, all senior centers and all public libraries. police, fire, and emergency personnel will not be affected by the strike. the fbi's investigating a death threat against the owner of oakland's ghost ship warehouse. 36 people died in a fire there last december. the bay area news group says the threat was received after news reports she could collect $3 million in insurance payments. master lieutenant and his second in command face 36 counts of involuntary plan slaughter. prosecutors haven't charged inge. there are reports of e-mails inge knew about electric problems. a tally of the destruction left behind from the north bay fires. >> the tubbs fire destroyed 4,658 homes in sonoma county including the coffey park, fountaingrove neighborhoods. it also burned 94 commercial buildings and damaged 23 others. >> it also burned -- the nuns

fire, 639 homes in the glenallen, kenwood and bennett ridge neighborhoods as well as parts of northeast sonoma, and 73 others were damaged. as for the pocket fire, it burned three homes and damaged three more. the damage from the three fires is now the costliest in u.s. history. a business recovery center opens in santa rosa this morning. now that will provide information about government disaster loans and other help for business owners affected by the north bay wildfires. the center is located on stony point road near west 9th street right near to the pg&e offices. tickets go on sale for a fire benefit concert in rohnert park that will feature the counting crows. the november 18th show being presented by the family copola with bottle rock presents. the ticket prices range from $50 to $150. and now to that deadly attack in new york city, president trump making a bold statement on twitter about the suspect accused of carrying out

the incident and abc news reporter janai norman with what he said in response to his first isis-related terror attack as president. janai? >> reporter: well, jessica, president trump says woe love to send the suspect to guantanamo bay but admits that would take a long time. this morning he's up on twitter urging to move quickly toward the death penalty. overnight the president calling for the death penalty tweeting nyc terrorist was happy as he asked to hang isis flag in his hospital room adding should get death penalty. >> we have multiple casualties. this is a mass casualty situation here. >> reporter: president trump has continued to voice strong opinions in the wake of the deadly truck attack in new york city. police say sayfullo saipov drove a large home depot truck, swerving into a bike lane, mowing down pedestrians for nearly 20 blocks, almost a full mile, leaving eight dead. >> we have to come up with punishment that's far quicker and far greater than the

punishment these animals are getting right now because what we have right now is a joke and it's a laughing stock. >> reporter: president trump taking a tough stance on the man being labelled a terrorist, a stark contrast to the shooting in las vegas 30 days earlier when for days the white house said it was inappropriate to talk about politics or policy. the president hasn't stopped the political tweets since they started within hours of the new york attack taking aim at the diversity lottery program that allowed the suspect into the u.s. seven years ago. >> diversity lottery sounds nice. it's not nice. it's not good. so we want to immediately work with congress on the diversity lottery program on terminating it, getting rid of it. >> reporter: and despite calling it the democrat lottery system, the diversity visa program had bipartisan support and was signed into law by republican president george h.w. bush. that program provides about 50,000 visas every year out of

millions of applications and everyone who is accepted gets a background check. reporting live from washington, janai norman, abc 7 mornings. okay, janai, thank you. this morning we are learning more about the eight people who died in the attack. they include a mother of two young boys who was visiting from belgium. five others were tourists from argentina celebrating their 30th anniversary from graduating high school. and also two americans, a man from new york and another from new jersey. the first phase of repairs to the lake oroville spillway are done just in time for the approaching storm this is new video of the spillway provided by water resources. the repair work just completed is the first phase of a larger plan to restore the dam and its spillway to its original condition. record rain caused the spillway to erode and nearly fail in february. nearly 200,000 people had to evacuate for several days. that project will cost at least half a billion dollars.
