for today we see a little bit of extra humidity in the north bay. it is roaming around, as low as a quarter mile in some areas. that's the big story. winds are blowing north to south in santa rosa. light breezes here in san francisco on the ferry building. temperatures running from the mid-40s to mid-50s at 7:00. we'll say low 60s to mid-60s no, 4:00, and mid to upper 50s by 7:00. hi, sue. good morning. we have both of these problems happening on highway 37. one involving a big rig car stuck under a big rig. the car is off the roadway in the bushes. we are seeing delays across the whole area there except past the scene of the accident looks good.

partially blocking san jose north 280. >> thank you, sue. attorney general jeff sessions scheduled to visit the big apple today. >> defending national security in the wake of tuesday's attack. this photo is of the suspect, sayfullo saipov, at a new jersey home depot. he rent add truck there on the day of the attack. he use it had to mow down pedestrians nearly 20 blocks. eight people were killed. according to the criminal complaint against him he wanted to kill as many people as he could. he allegedly was inspired by isis videos he watched on his cell phone. president trump is responding again to the new york city terror attack. he sent out these tweets just within the last hour saying would love to send the new york city terrorist to guantanamo but statistically that process takes

much longer than going through the federal system. there is also something appropriate about keeping him in the home of the horrible crime he committed, should move fast. death penalty. he's been quiet since sending out these tweets. i'll keep tracking it for you. >> and abc news will have much more on the terror attack tomorrow night. a special diane sawyer "20/20" special airs at 10:00 p.m. here on abc 7. >> more lawsuits targeting pg&e today. the california judicial counsel was asked to combine all these lawsuits into just one and that request is a common one. if that's granted one judge will hear the entire case in san francisco superior court. mary alexander, the lead attorney for victims in the ghost ship fire, will hold a news conference to announce new filings representing 12 victims in the north bay fires. alexander will also provide an update on the ghost ship fire

cases. huge environmental restoration is under way in the aftermath of the north bay wildfires. more than 1,000 volunteers are gathering acorns to grow new trees. the east bay times says the response has been amazing. they say so many people signed up to collect, box, and mail in acorns that it briefly crashed the server of the california native plant society over the weekend. it focuses on collecting acorns from sonoma, napa and mendocino counties. happening today the prosecution is expected to wrap up its case in the kate steinle murder trial. the 32-year-old was walking along san francisco's pier 14 with her father when she was shot more than two years ago. yesterday the jury watched the videotaped police interrogation of the defendant. jose ines garcia zarate lied about his name, age, nationality and said he was nowhere near the crime scene. police took a different approach. they lied to get him to confess. they told him the firearm had been recovered and they had a dna match.

it seemed to work in their favor. garcia zarate admitted he shot the gun. he said he found it at the pier. body cam videos raising questions about the death of a bay point man in police custody. i want to warn you some may find this video disturbing. body cam video obtained by the east bay times shows a pittsburg police officer putting 32-year-old humberto martinez in a chokehold. at one point you can hear martinez struggling to breathe. martinez collapsed. police could not revive him. this was ruled an accident but friends who were there when it happened believe otherwise. >> that little bit of him dying, struggling to breathe, i mean, how could you not hear a man trying to breathe and you still keep on choking him and beating him? >> this encounter was the result of a pursuit that began after police tried to pull over martinez. the family has filed a wrongful death lawsuit. new details about daca. the attorney general is asking a federal judge to reinstate the

program until a lawsuit against the trump administration as been decided. the request was made for preliminary injunction blocking the administration's ending of the deferred action for childhood arrivals program. daca protected undocumented immigrants, many of them now college students from deportation. the lawsuit is fighting the president's decision to end that program. the much-anticipated tesla 3 will be late and we mean really late. that's just the beginning of the bad news for the bay area based company. >> tesla report add massive loss. abc 7 news reporter matt keller live for us in san jose. matt? >> reporter: good morning, reggie and natasha. i just checked the after hour trading for tesla's stock and it shows that it's down almost 6%, a disappointment for shareholders. also disappointing people wa waiting for the model three cars to come out and be delivered. buyers are on the waiting list for the $35,000 car. the ceo elon musk promised 1,500 in the third quarter but only

let's take a look at temperatures. we'll start in san francisco where it's 48 in sunny side. the rest of us 50 to 52 degrees. coming through the ferry building, warmer, 55. 49 right now in richmond, san leandro, union city, belmont, 46 in walnut creek and santa clara. dress warmly this morning. let's take a look at some of our temperatures. we'll start off about 51 in livermore. 64 at noon. and then upper 60s in the afternoon hours. shy of our average high of 71. over in observing we have an average high of 68. 61 by 8:00. for our north bay, 45 at 8:00. noon 60. we're almost there. storm impact scale one for the storms coming our way. we'll talk more about that. >> metering lights turned on at

5:23 this morning stacked up in the maze. moved to the right-hand shoulder fortunately but traffic is still stacked up in the area there. one eastbound with a big rig involving a car that got stuck under it, waiting for a tow truck. the other at skaggs island has traffic slow and go from the two lanes to one lane. even more so this morning due to that accident westbound. we'll check on that and another accident in san jose on highway 280 north in just a few. >> amazon is getting ready to hire hundreds of workers at its fulfillment center holding an event at the court yard marriott. according to the silicon valley business journal amazon has more than 800 open positions at its fulfillment centers in san jose, richmond and newark. the jobs pay around $13 an hour.

welcome back, everyone, and this breaking news is something you want to pay attention to. there's a huge recall out this morning that could mean life or death. recalling more than 37 million fire extinguishers with plastic handles. i'm going to zoom in to that recall and show you exactly what i'm talking about. they say they can become clogged or need excessive discharge. this recall includes a long list. it includes extinguishers as far back as 1973. look at this list. it knows of at least one death in 2014 where emergency responders could not use the extinguisher, they couldn't get

it to work. there's 134 different models that are affected. we do have a link on our website, abc7news.com. happening today the text of the sweeping tax overhaul bill. the rollout was set for yesterday but lawmakers needed more time to decide what exactly should be in it. some gop lawmakers have objected to plans to eliminate deductions for local property and income taxes as well as proposals to limit pretax contributions to 401(k)s. president trump has said the bill will primarily benefit the middle class. >> the head of facebook says they will invest more in security. profits will take a hit because of that move. they have come under fire for russian-bought ads. nearly 126 million facebook users in america may have been exposed to content generated by the russian government. by next year facebook plans to have 20,000 people working on safety and security doubling the

current number. good news for marin county residents eager to see election night results as soon as possible. vote by mail ballots returned before november 7th will be available on election night. all you have to do is go to marinvoters.org and look for election results. first reports from precincts are expected around 9:30 p.m. the site will be updated every 30 minutes after that. houston astros fans are celebrating the team's first world series championship. what is so funny about this, this is not houston. this is right here in san francisco. last night astros fans or dodger haters, take your pick, nervously watched the game seven victory. and they celebrated all night long. >> to texas where thousands of astros fans are still celebrating or in this case waiting in line for hours.

out by the morning commute on monday. 4:00 we begin the commute dry but then it gets wet as we go through the morning commute and then the evening commute about a tenth to a quarter of an inch. by the time we get to saturday morning a quarter of an inch in the south bay to three-quarters of an inch in the north bay. my accuweather seven-day forecast, a chance of rain tuesday into wednesday. it's rain season, sue. we have a busy friday in our future with slick roads for the first time this season. to san jose, 280 at the over crossing. no problems here. a problem 280 near highway 85 blocking the left lane and i am seeing some slow traffic there. a heads-up there waiting for a tow truck. problems on highway 37 not so slow eastbound. a car stuck under it with the tow on the way. westbound another accident off

and good morning on this thursday, november 2, or as i like to say, friday almost. almost. hope you're doing well this morning. we're talking about weather because although today is going to be dry, it's definitely changing. >> yeah. this time tomorrow some of us will be getting wet and that's going to make sue's job a little busier tomorrow morning unless you slow down. we hope everybody does. right now making the commute a little bit slower, the fog. there's a lot of it up in the north bay. it's increasing the visibility in santa rosa. the reason it's increasing some of the fog is moving. look at that north to south wind. some of that fog crossing the san pablo bay and working into the san francisco bay. your 12-hour day planner

temperatures in the mid-40s to mid-50s. we'll be near 60 to 64 at noon. 60 to 66 at 4:00. and then 55 to 60 at 7:00. increasing clouds but dry through 7:00. sue? taking a look at your san mateo bridge commute 17 minutes to get from hayward across the span and up over the high rise foster city. slow and go here. no stalls or accidents but busy. you may want to check on the dumbarton bridge as an alternate. a couple of problems, to san jose. this is northbound 280. we are seeing some significant slowing now before highway 85 up to cupertino. the left lane is partially blocked with an accident there and back to highway 37, two separate accidents, eastbound and westbound. the westbound seems to be slower. that is the commute direction and fog may be a part of the culprit in that area. mike is telling us it's quite thick. take a look at your north bay commute in a few minutes. happening right now a major change along van ness avenue in

san francisco. >> crews just shifted the southbound lanes to the center of the road. reporter amy hollyfield live with what this can mean for you as you drive around. amy? >> reporter: hi, reggie. it's going to mean a different commute. it looks really different out here. take a peek. see these lanes on southbound van ness, actually the sidewalk, they are empty. they have pushed the car to the middle of the road and they are navigating around it quite nicely so far. this is southbound so coming into the city from the golden gate bridge. these lanes next to the sidewalk are now going to hold construction equipment. at some spots two lanes traveling in the same direction will separate to pass on either side of the median so they are really moving things around. this will cost some parking spaces on van ness and there will at times be work that will reduce van ness to one lane in each direction that will be sporadic. the work crews will be replacing the water and sewer systems

under van ness so much-needed work. this phase will take two years but this entire overhaul will be complete in 2020 and officials are promising we will have a greener, safer, and more efficient van ness. reporting live in san francisco, amy hollyfield, abc 7 news. >> thanks for the warning, amy. san francisco police are still trying to figure out whether the carjacking of a taxi is related to the police shoot-out that happened in the castro. that left an officer in critical condition. the shoot-out happened near 18th and diamond just after midnight yesterday. it started when officers were notified about a suspicious vehicle. detectives say it turned out to be stolen. when officers got to the car there was an exchange of gunfire between the suspect and at least one officer. both of them remain at the hospital and the suspect's condition is life threatening. about a mile away in the mission district san francisco police say a carjacked taxi was ditched on oakwood street. they believe the cab was taken in the castro right after the

shoot-out. the connection between the two events still remains unclear this morning. neighbors say police searched all around that area yesterday. and right now in major breaking news, update out of colorado after a shooting at a walmart left three people dead. and look at this. i want to show you this. police outside denver releasing more information on the suspect. they do have a name. he is said to be scott ostrem, 47 years old. thornton, which is where the shooting happened, is a suburb just north of denver. police think ostrem opened fire on shoppers inside the walmart at random. they don't think it was terror related. police have expanded their manhunt for ostrem. this is now a nationwide search. i will let you know if we get any more updates. back to you, natasha. >> jessica, thank you. nearly 2,000 oakland city work remembers planning a one-day strike. the strike is in protest of an unsuccessful six-month

negotiation with the city over fair wages and work site safety. officials say they are continuing to negotiate and want a fiscally prudent agreement. the strike, bottom line, will cause the following to close today at 2:00. all head start and early head start centers, all parks and rec facilities and after school programs, all senior centers, and all public libraries. police, fire, and emergency personnel will not be affected by this strike. the fbi's investigating a death threat against the owner of oakland's ghost ship warehouse. 36 people died in a fire there last december. the bay area news group says the threat was received after news reports that she could collect $3 million in insurance payments. master tenant and his second in command max harris face 36 counts of involuntary manslaughter. however, prosecutors have not charged inge. there are emails showing he knew about electrical problems at the warehouse. cal fire release add preliminary tally of the destruction left behind from last month's north bay fires.

>> the tubbs fire destroyed 4,658 homes including coffey park and lark field neighborhoods. it burned 94 commercial buildings and damaged 23 others. >> the nuns fire gutted 639 homes in the glen ellyn neighborhoods as well as parts of northeast sonoma and 73 others were damaged. the pocket fire burned three homes, damaged three others and the damage from the three fires is now the costliest in u.s. history. there's a recovery center opening in santa rosa for businesses affected by the fire this will provide information about government disaster loans and help applying for them on the spot. there will be other resources available for business owners. and tickets go on sale this morning for a fire benefit concert in rohnert park that will have the counting crows in partnership with bottle rock presents and sonoma state university. tickets will be available starting at 10:00 a.m. at the student center and online.

deadly truck attack in new york city. police say sayfullo saipov drove a large home depot truck serving into a bike lane mowing down pedestrians for nearly 20 blocks, almost a full mile, leaving eight dead. >> we have to come up with punishment that's far quicker and far greater than the punishment these animals are getting right now because what we have right now is a joke. it's a laughing stock. >> reporter: president trump taking a tough stance on the man being labelled a terrorist, a stark contrast to the shooting in las vegas 30 days earlier when for days the white house said it was inappropriate to talk about politis or policy. the president hasn't stopped the political tweets since they started within hours of the new york attack taking aim at the diversity program that allowed the suspect into the u.s. seven years ago. >> diversity lottery sounds nice. it's not nice. it's not good, so we want to immediately work with congress

on the diversity lottery program on terminating it, getting rid of it. >> reporter: and despite the president calling it the democrat lottery system, that diversity visa program had bipartisan support and was signed into law by republican president george h.w. bush. it provides about 50,000 visas out of millions of applications and everyone who gets accepted gets a background check. reporting live from washington, janai norman, abc 7 news. janai, thank you. this morning we are learning more about the eight people who died in the attack. they include a mother of two young boys who was visiting from belgium. five others were tourists from argentina celebrating their 30th anniversary from graduating high school and also two americans, a man from new york and another from new jersey. >> all right, jessica, thank you. the first phase of repairs to the lake oroville spillway are done just in time for our approaching storm. take a look at new video provided by the state's department of water resources.

the repair work just completed as the first phase of a larger plan it restore it to its original condition. you probably remember record rain cause it had to nearly fail in february. 200,000 people had to be evacuated. project will cost at least half a billion dollars. since we're playing christmas commercials, why not have some christmas songs like let it snow, let it snow, let it snow. winter storm watch will probably turn over to a warning some time today as it starts tomorrow evening through 4:00 a.m. sunday. check the tires, wipers, and lights. pack your chains and expect delays and possibly closures from that heavy, wet snow. most of it's going to fall friday night into saturday as the snow level drops from 6,500 feet to 5,500 feet. sunday snow showers but sunday night into monday another chance of some steady snow. in fact, here we go. at noon tomorrow, 1 to 3 inches.

by saturday afternoon, look at that, a foot in kirkwood to 2 feet at donner and then about another 6 to 8 inches sunday night into monday. back here at home, temperatures running from 44 in menlo park to 52 in san bruno on the peninsula. most of us in the 40s and 50s. it's going to be a little wet. more on that storm impact scale and the rain coming up. sue? >> i wonder we'll be skiing before thanksgiving. wouldn't that be nice? to san jose, 280 in the northbound direction is busy. this is the 17 /280 over crossing. an accident blocking lane number two. and then farther to the north we have another accident blocking the left lane of traffic. you can see here the red sensors. this is up to cupertino northbound just before highway 85. slow and go as you make your way from san jose up to cupertino and then we have better news here. an earlier accident both directions eastbound and westbound.

if you put an order for the new tesla model 3 in, you're going to have to wait even longer than you thought. the company just announced a big delay in deliveries. and that is not the only bad news for the palo alto-based company. >> matt keller live for us at santana row in san jose. good morning, matt. >> reporter: good morning, natasha and reggie. a lot of people were shocked by tesla's earnings report. not only did they make a lot less money than expected, they're also making a lot less cars. and a lot of people are waiting on those cars. you remember those big, long lines in 2016 of people waiting to plunk down just $1,000 just to be put on the waiting list for the model 3. about 500,000 people are now on that waiting list.
