live where you live, this is abc 7 news. get ready for some rain. a live look from our sutro tower camera shows clouds over san francisco and soon the cloudy skies will be turning to rain. i'm reggie aqui. kristen will be in later today. the storm that's moving in is going to be the first of our rainy season. that system is expected to bring snow to the sierra. here's a live look at our camera at heavenly mountain resort in h south lake tahoe. some resorts are already open for the weekend. meteorologist mike nicco tracking what impact the storm will have right here in the bay area. mike? >> hey, reggie, hi, everybody. let's start where the storm is. it's still up to our north. still developing over the

pacific northwest. see the live radars, doppler radars in seattle and portland picking up the shower activity and mountain snow. see the curl right there off the vancouver coast. and that's the low that's going to dip down. and move toward us. any time we have a storm move at us from the north, it doesn't usually have much of a tropical connection, and it's the first storm of the season. so the rainfall amounts are not all that impressive, but it is the first storm of the rain season. so we need to be careful. that quarter of an inch in the south bay to three quarters of an inch in the north bay, from light to moderate rain. it will be off and on from now, or i should say from tonight all the way through monday. so i'll take an hour-by-hour look coming up, reggie. >> see you in a few, thank you, mike. new developments in the deadly colorado walmart shooting. the suspect is now under arrest. scott ostrem was taken into custody after a brief chase this morning. see him behind the police

officer, wearing a red shirt. he was accused of killing two men and a woman in walmart in denver. the 47-year-old nonchalantly entered the store and started shooting, then calmly walked outside and drove off. police say the shooting appears random. for now the motive is unclear. president trump once again responding to the deadly terror attack in new york city. this morning he tweeted this. "with love to send the nyc terrorist to guantanamo but statistically that process takes longer than going through a federal system." he continued "there's also something appropriate about keeping him in the home really, really intelligent, really curious person. >> reporter: nearly a dozen others injured including two students and two staff members from nearby stuyvesant high school. bill de blasio visiting students there this morning. >> the solidarity you saw in the 3wi building is absolutely amazing, the way they backed each other up. something new yorkers should be proud of. >> reporter: the city remains in mourning and high alert after the chilling confession from the suspect in his hospital bed.

sayfullo saipov admits to planning the attack for weeks. we've seen people jogging on this bike path all morning long. everywhere there are reminders. behind me chunk are missing out of the tree from when the suspect hit it during the attack. a scar from what happened on halloween night. abc news, new york. abc news will have much more on the new york city terror attack tomorrow night, a special diane sawyer "2020: isis and america" airs at 10:00 p.m. on abc 7. this morning pg&e is facing a new lawsuit claiming the utility company is responsible for the couple's burn injuries in the north bay fires. the two plaintiffs suffered severe burns while escaping their home in santa rosa. they lost that home and all of their belongings. the lawsuit claims pg&e knew of the high fire danger and failed to properly maintain its power lines. there are dozens of pending lawsuits against pg&e.

the attorney for this case asked san francisco superior court to consolidate all the cases under one judge. and a warning from the napa police this morning about fema impersonators. they want you to know about fema officials have badges and i.d. with them. fema is not asking for personal banking or social security information. they are only there to do a visual inspection and leave. if you see someone suspicious, ask them to leave your property, and file a suspicious activity report at ftc.gov. the recovery effort in the north bay fire zone does continue today. and the focus is on the full animal shelters up there. some oakland shelter cats are now boarding a flight for seattle to make room for wine country animals. abc 7 news reporter amy hollyfield live at oakland animal services with the rest of that story. >> reporter: hi, good morning, reggie. look at this empty cage. this was pluto's home this morning. he has been moved out, evicted, if you want to say that, but it's a good thing. he is making room to help those who need help up north.

>> they know they're being rescued. there's no doubt in their little minds. they know somebody's saving them. yeah. you're getting saved, baby. >> reporter: douglas pennington doesn't wear a cape but he is swooping in to save some cats today and you can tell, he loves taking care of these little souls. >> i try and go slow, pet them and, you know, give calm that way, give them long body strokes and little chin rubs. >> reporter: he works for the aspca and drove to oakland from long beach to transport 11 cats from oakland's animal shelter to shelters in the seattle area. the move is to make space for animals up in the fire disaster zone where the shelters are full. >> we do not think this crisis is over. there are still a lot of people displaced by the fires still trying to figure out where they're going to be living. so we want to continue to have space to aid those shelters up there to make space for them to

help their community. >> is be brave. going to get you a home. >> reporter: these little guys with ill be c will be cargo on alaska airlines today. douglas has no doubt they will soon be family members. >> it's great. knowing that they'll get adopted and they do get adopted really quickly up there. it's amazing. >> reporter: now four-legged fire victims will not be coming here. they learned the hard way during hurricane katrina, it's not good to rescue an animal for the floodwaters and ship them out of town, it makes it tougher for the families to find them. so they will be moving animals from the adoption floor in those shelters in they can stay here. >> seems to make a lot of sense, amy, thank you. tesla's first attempt at a mass vehicle assembly hit a speed bump. the palo alto-based company delivered disappointing news to wall street and customers. abc 7 news reporter matt keller

joins us live at their showroom in san jose. matt? >> reporter: reggie, we'll start with the good news for tesla, they sold more model ss and model xs, you can see those here, in the showroom, however, it's the trouble with the model 3 that concerns shareholders and customers. do you remember the lines? hundreds, if not thousands of people outside tesla showrooms across the bay area in 2016 ready to pay $1,000 to be put on the waiting list for the model 3. tesla's newest and least expe e expensive vehicle for the masses. flash forward to now, tesla is still facing some obstacles getting the $35,000 car in first gear. >> i was one the first that signed up. >> reporter: los gatos resident, mike salts, one of more than 500,000 people on the waiting list. tesla released its earnings report. not only did the company lose more money than expected, $619 million, but it's also making less model 3 ss. ceo elon musk promised 1,500 in the third quarter, but only 220

were produced. because of delays at its battery facility in nevada, tesla said it now expects to make 20,000 model 3 ss per month by the end of march. putting them about three months behind. >> i understand it's not the easiest thing to do so there's bound to be road blocks in the way that you have to get past. good that it's being done. >> reporter: tesla is falling behind its own schedule, it may find people are looking at all their options. neil mcgwire drives the electric hybrid chevy volt. he's not willing to put down $1,000 for an electric car that's not quite ready. >> a nice style to the vehicle. i've seen all the car companies coming out with electric vehicles. so i'm anxious to have choices across the board. >> reporter: the news has hit tesla's stock pretty hard. it's down about 7.5%. reporting live in san jose, matt keller, abc 7 news. >> matt, thank you. new this morning, a massive recall. you're going to want to check your fire extinguishers.

agreements were violated and we've been following that story ever since. those customers said salespeople verbally promised annual membership dues would never change since they paid upfront fees. but the district attorney's office accused the san ramon company of threatening to terminate people's memberships if they didn't pay more according to terms in the fine print of their contracts. now this morning the 7 on your side team learned 24 hour fitness will pay $1.2 million in a settlement. 24 hour fitness has admitted no wrongdoing. new this morning, a huge safety recall affected millions of fire extinguishers, likely one of the models is right in your home. jessica castro from abc 7 mornings has more. >> reggie, this is a massive recall affecting more than 37 million fire extinguishers specifically with plastic ha handles. right here, this is one example of those affected kidde extinguishers being recalled. it's on the consumer product

safety commission website. and i want to show you this, look at this list. it is very long. 134 different models on it. some ex-titinguishers were made far back as 1973. kidde says the extinguishers can become clog or require excessive force to discharge and also say the nozzle can detach with enough force, say, if something hits it. kidde issued today's recall voluntarily and they say they will replace all 37 million affected extinguishers with metal features instead of those plastic ones. all you have to do is call the company. >> there's a long list of fire extinguishers but most of them have this plastic device. the new one they'll get will have that metal handle. >> cpsc knows of at least one death in 2014, this man a 22-year-old, who died in a car fire after a crash on a pennsylvania road. emergency responders could not get the recalled extinguishers to work. because there are just so many different models affected, we'll

i know there have been so many changes along van ness after knew in san francisco. here's another one. southbound lanes shifted to the center of the road to make room for new construction areas that with the mill mean there will be fewer places to pass and most of the left-hand turns off of van ness are still blocked off. crews are working to replace major utility lines including water and sewer. construction is projected to last a long time. until 2020. now your accuweather forecast with mike nicco. >> talk about waiting for something, been waiting for this fog to clear all morning in petaluma, still a quarter mile visibility. that will start lifting here shortly. let me show you the exploratorium camera this morning, put it into motion, took a time lapse to snow you t the clouds, couldn't get traction. sitting there spinning their weals a wheels and eventually dissipate. kind of a neat optical phenomenon. look from sutro tower, see the

clouds and haze as the atmosphere gets a little more moist, more moist, moisture? gets humid. how about that? during the day today. as the clouds return. it will be dry. the clouds won't start letting go of the moisture until tonight with drizzle and light rain. it will be milder tomorrow morning because of that. tracking several light storms through the accuweather seven-day forecast. temperatures today, 60 at half moon bay to 62 in san francisco. the spread around the bay, about 63 to 66. spread to north bay, about 63 to 65. everywhere else inland about 66 to 68 degrees. here's a look at the south bay where we'll see the most sunshine and some of the warmest weather today. at 12:00, 61 at the coast. 66 for our inland and bay neighborhoods. 59 in the coast at 4:00. increasing clouds keep us in the mid 60s elsewhere. 55 to 60 at 9:00. then light rain starts to develop as we head toward midnight, temperatures in the mid 50s. in fact, see more green areas here representing rain during the overnight hours and temperatures around 50 to 55 degrees.

significantly warmer for some of us by 10 to 15 degrees tomorrow morning. here we are, this evening at 5:00, not much going on. look at that southerly push of moisture that will turn into drizzle and scattered rain during the overnight hours. and that will continue during the day tomorrow. becomes a little steadier during the evening hours and overnight hours as a cold front slowly sweeps through. but notice it does clear us out for the better part of the day tomorrow. except for up in the sierra, will it keep snowing and snowing and snowing. sunday at 4:00, that's when the second cold front comes through and by the end of the commute monday morning, the rain is gone. so here's a look. 4:00 tomorrow morning, not much out there other than near the coast and up in the north bay, but it will get progressively wetter during the morning commute and just takes a little bit, a couple hundredths to make it slippery and accidents to happen. by 5:00, we're looking at everybody seeing a little bit of scattered rain out there. and then you can see by noon, saturday, we've got about tenth of an inch in the south bay, quarter to half inch for the

rest of us. the storm is drying out a little bit from what we thought yesterday. same thing with the snow in the sierra, possibly 1 to 2 feet above 6,500 feet. that winter storm watch at 11:00 tomorrow evening through sunday at 4:00, that will probably turn over to a winter storm warning later on today as we get closer to the event. we got a host of 1s there for friday and saturday. we'll have a little bit of rain again sunday to monday. that would be a 1. tuesday and wednesday looks like a 1 once again. the common denominator throughout this, go iing to be cooler than average are temperatures in 50s and 60s for highs. >> i saw people in their full winter coat last night. it was, like, 57 degrees. >> in san francisco. right? okay. >> i made a really big deal out of it. >> did you really? >> can you imagine? >> were you jealous? >> no. >> okay. thanks, mike. now to today's morning money report. house republicans released their long anticipated tax bill and could have a major impact here in california. the bill would only allow taxpayers to deduct state and property taxes up to $10,000. now that could have a major

consequence for higher tax states like here in california. a mortgage interest deduction cap could also deliver a significant blow, especially to homeowners in the bay area that bay outrageous prices. the administration is putting pressure on congress to pass the tax bill right away, but not all republicans are onboard yet. >> might be before thanksgiving, how you can vote on, debate, study and learn about something in two weeks and vote on it which is going to impact maybe the next 20, 30 years. to me, we should spend a lot more time on it. >> house minority leader nancy pelosi calling the tax act a plunder on the middle class. countdown is on for apple fans. tomorrow is the day iphone x hits stores. but don't expect to actually buy one, no, silly. you're supposed to preorder that. that sold out so fast. buyers who were lucky enough to nab one in the first round will be able to pick up their phones tomorrow. as for the rest of us, it's not just apple, but even other carriers like verizon and t-mobile, they say be prepared
