>> gunshots for a good 25 minutes. >> people died here today, folks. this is a very tragic event for all of us. >> the assistant sheriff understandably getting a little emotional about today's shooting. >> the sheriff said the gunman appeared to select as targets randomly. you can see on the ma'am where horror erupted. a gunman killed four and wounded ten others. minutes ago the same official you just heard from the staff. he said what they did helped avert an even bigger tragedy. >> because there was a series of gunshots. about a quarter mile away that alerted that staff and they went on an immediate lockdown without having to be told to do so by law enforcement. >> investigators have identified today's shooter but they are not

releasing his name at this time. wayne freeman is live from tehama county. >> reporter: good evening. we do have a good sense of who the shooter is but we cannot identify him yet. the time line as to who he shot and when and where remains a little bit muddy. this is still an active investigation. we dock there are five people dead including the suspect. five people dead. at least ten people injured. from what just emerged, there may be more. as it turns out, the sheriff told us that there are relatives of this suspect that they have not heard from, who they should have heard from. these are relatives who are missing or unheard of and they worry about their safety. it is the small community you never heard of until today. one filled with police, police tape, shell casings and early this morning, fatal gunfire. >> all i'm told is it is a semi-automatic rifle. >> reporter: what we heard was

ten rounds. >> i said it was like bruce willis movie. >> reporter: this woman identified herself only as sharon, the 45-minute ordeal was almost over. it began in a neighborhood where the suspect shot two neighbors. then progressed to a school where more shots were fired. brian rogers heard the first of them and called the sheriff. >> we heard the kids screaming. we heard the teachers telling them on get down. >> the suspect already had a reputation. >> we were here at the shop and we heard 60 something high powered rifle rounds about a month ago, coming from the bobcat area. apparently, the neighbors called in and the sheriff told them there was nothing they could do something something happened. just like this. >> reporter: after the suspect drove through town shooting randomly at people and hitting some of them, it ended >> it is de stavastating. >> reporter: it does appear from

what the sheriff told us today, that the first killing was not random. the first victim was a neighbor who lived either next door or in the neighborhood of the suspect. he had earlier, we are told, approached her with a weapon. there was a restraining order. she, we're told, at least as of last hour, was the only intentional victim. everything else, we're told, seems to have been random. he went to the school, he shot at the school for roughly six minutes and then he continued. he shot and killed another woman in a car. her daughter was injured by another bullet or shrapnel. then another case of another victim who he hit intentionally and caused a traffic accident. that is the latest from rancho tehama. we'll have more in an hour. >> thank you. governor brown issued a statement about the shooting. he says anne and i are saddened

to hear about today's violence in tehama county whichly involved school children. if you have the abc7 news app, you received this push alert about the shooting moments after we learned about it. you can get these by downloading the it's abc7 news app. >> now to the weather. there is a lot of rain on the way and with it some warnings. let's go to meteorologist sandy. >> this is the first level three strong storm of the season. let me show you live doppler 7 and we'll talk about what's happening. the clouds are increasing in the north bay. we're still waiting for the storm. a level three storm. we have the sub tropical moisture associated with the cold storm coming out of the gulf of mexico. this storm is tapping into an atmospheric river. what you probably know as the pineapple express. what does this mean? we'll get soaked. here's the storm impact scale.

the fire by jumping into their pool filed a lawsuit against pg&e. they claim pg&e's fleg to maintain vegetation around fire lines caused the fire. >> four law firms which have taken on the coil before dropped a 50-paint complaint which points the finger at the tree management practices as inadequate that caused or contributed to 43 deaths and widespread property damage. >> the reason you file a 50-page complaint is to say we're % serious. we're not going to accept this. this isn't going to happen again. >> gregory wilson and his wife managed to survive the tons fire by diving into their pool and staying submerged except to grab area. he is listed as theville in this lawsuit. his speech has been affected by the ordeal. >> just think about all the people that died in this fire that didn't have to die.

it came so fast. you know, there has to be a way so that this will never happen again. >> pg&e issued a statement that said we are aware that lawsuits have been filed. there has been no determination on the causes of the fires. we're focused on doing everything we can to help these communities rebuild and recover. frank wants an independent review of pg&e practices. >> the nation welcomed an independent panel of experts, chosen by anybody other than them or the cpuc. to go in and inspect their practices are and evaluate whether the processes they say they have he on paper are actually working in the >> in burlingame. a man escaped from a psychiatric hospital in hawaii

and flew to california. he may now be in san jose. 59-year-old randall saito left the hospital on sunday. the officials say they are aware of the situation and are on the lookout. the fbi and u.s. marshals are also searching for him. he was found not guilty of a 1979 murder by reason of insanity. the hawaiian prosecutor describes him as fill all the criteria of a classic serial killer. santa clara county is facing an unfair labor practices, representing guards at the county jails. the peace officer's association claims the sheriff's department made 12 changes to working conditions without providing notice or opportunity to discuss the new policies. >> when you make changes, you should communicate with all stake holders. because we are the expert. we work there every single day. >> reports say one change allows

the latest twist in the kate steinle murder trial. testimony asking to throw out testimony after it was reported that a witness lied. in another case where the defendant was wrongfully convicted. live in the newsroom with the details. >> reporter: the prosecution knew about this witness and failed to tell the defense. the defense filed a motion saying, hold on a minute hfl we known, we would have asked the witness about this previous case in front of the jury. but apparently, that's something the prosecution wanted to avoid. the prosecution in the kate steinle murder trial requested that we not see the motion. it asked he judge samuel feng to strike the testimony of prosecutor john not evans.

evans testified that based on his knowledge of crime scene investigations, in his opinion, garcia zarate intended to shoot steinle and that this was no accidental shooting. what the defense did not know at the time was that evans is being sued by a one-time reality tv show contestant whose conviction was overturned and then acquitted in a second trial. evans testified and was found to have lied under oath about reading an important ballistics study done by the san francisco police department. with what others found. >> if you're on trial, shouldn't that witness who is giving testimony against you be confront with this misconduct? >> but the defense was never given the chance to question evans a second time. they said he may have violated the brady versus maryland decision, establishing the prosecutors must turn over all

evidence that might exonerate the defendant. professor of law rory little says he tells all his future prosecutors to share what they have. >> fits bad information for your case, you have to turn it over. if it is not bad information, fits meaningless, then there's no harm in turk it over. >> the judge ruled late today. that, too, was sealed. in san francisco, abc7 news. >> a billion-dollar lead paint lawsuit. ten cities and counties in california are part of it. 2013, a judge ordered paint doims pay more than $1 billion for the clean-up lead paint according homes built before 1950 and as recently as 1980. today's ruling limits to it pre 1951 housing. which the san francisco city attorney's office says is still

tomorrow morning, light bay. pretty light. and then the storm begins to push in. noontime, you will see some pockets of rain by 2:00 p.m. starting to shift into santa rosa. you see the pops of red. i would not rule out an isolated thunderstorm. it will be pretty much coming down hard in the north bay. starting to slide southward as we head into 7:00 p.m. the drenching rain continues. 11:00 p.m., it doesn't end there. by 4:00. that's one area the national weather service will evaluate later. on it could be included in the flash flood watch. we go to scattered light
