and good morning. it's 5:00 a.m. it's monday when a lot of you go back to work, isn't it? welcome back. we're here to get you off to a good start. there is going to be a lot of rain on the roads, though. >> it could be a tough commute. >> had to slow down today. it took about five or ten minutes longer to get to work at least, and that's because there was hardly anyone on the roads. once you get deeper into this and you can still see the showers, some encroaching the golden gate bridge now and highway 37 across the north bay. put this into motion and you can see the heaviest is over. we still have plenty of chances of showers. you can see the puddles on the embarcadero here and san francisco has had more than a half inch of rain. 7:00 in the morning, 50 to 55.

the holiday shopping spree isn't over. today is cyber monday. >> and one of the biggest retailers offering deals online is amazon. amy hollyfield is joining us live from tracy. hi, amy. >> reporter: hi, good morning, jessica. here is a behind-the-scenes look at what happens when you place those orders. they are being processed right here at this distribution center in tracy. we are expecting a busy day at this place today. they tell us on this day about 740 items are ordered per second. amazon alone is offering thousands of deals today, so are many other retailers and customers are expected to respond. adobe is predicting sales will be up 16.5% compared to last year's cyber monday. a big jump. and if that happens that would set a record for cyber monday. they say online orders actually

peak tonight. between 8:00 and 11:00. shoppers have been thinking about their purchases. tonight they hit the buy button and it doesn't stop today. amazon is ready for a busy season. today the busiest day but more to come. across the country they're planning to hire 120,000 workers to get them through the busy holidays. here in tracy they have 2,500 associates working at this plant and they're looking to hire more. so if you leave for holiday work, amazon is hiring. we are going to interview an employee about what it is like to work here during this busy time of year. i just talked to him. he said one word to describe it is exciting. you will hear from him coming up later at 6:00. reporting live in tracy, amy hollyfield, abc 7 news. we have new video coming in this morning of a crash on highway 17 in los gatos and we're learning that rain may be to blame. it happened just before 10:00

last night. take a look here. a black volkswagen jetta went 150 feet down an embankment. firefighters formed a line. they were able to pull the driver back to the top. it took nearly half an hour. the rescue forced the closure of both northbound lanes and the driver appeared to only have suffered some minor injuries incredibly and was transported to a nearby trauma center for evaluation. >> we now know the name of the person accused in a hit-and-run crash that killed four people in san pablo. chp identified the driver as 47-year-old fred lowe from sacramento. that crash happened saturday night on interstate 80. lowe was arrested not long after and booked into the martinez jail charged with vehicular manslaughter, hit-and-run, dui and driving on a suspended license. bail has been set at more than a million dollars. happening today jury deliberations resume in the case of the man accused of killing kate steinle on a san francisco pier. that panel began discussing the

fate of jose ines garcia zarate last week. prosecutors believe he should be convicted of murder. defense attorneys say he fired the weapon accidentally after finding it in july of 2015. garcia zarate faces the lesser charge of manslaughter for steinle's death. the power of organized farm labor in california could take a hit today. the state supreme court expected to decide whether a law allowing the state to order unions and farming companies to reach binding contracts is unconstitutional. labor activists say the law helps farmworkers improve labor conditions. opponents say it gives them a say over wages. >> the postal service is releasing very little information about a package that was delivered to an alameda home and exploded. the friday incident started the neighborhood. law enforcement sources say a woman living in the house was

hospitalized. she was hurt but will recover. the atf, alameda police and sheriff's department are investigating the incident and looking for evidence. >> the policemen came and asked us if we have a camera in the building. i said, no, i don't have a camera, but what happened? they didn't tell us anything. >> investigators won't say if they have any suspects or where the package came from and why. neighbors say a police officer owns the home where the package exploded. a drone pilot is in custody after flying the device over games yesterday. >> the drone dropped what police describe as propaganda leaflets. lilian kim has the story. >> reporter: fans at the 49ers game had never seen a drone over levi stadium before, which is why they were quite amused when they saw one fly over the southern end zone in the first half. >> we figured it must have been something put on by the team, by

the stadium, to drop off freebies to the crowd. >> we wanted the free stuff. we didn't know who it was from. >> reporter: this is what fans got instead. a flyer marked with a big red "x" talking about the first amendment. >> it was some type of first amendment propaganda, something about tv stations. >> reporter: it turned out levi stadium was just the first stop. police say the same drone was used to drop the same leaflets during the raiders game at the coliseum in oakland. by that point santa clara police issued a be on the look youd to law enforcement agencies. oakland police officers arrested the drone pilot shortly after. they haven't yet released his name but his twitter page has links of videos of him practicing with the drone. for many fans the fact it was an unauthorized drone flying over them was disconcerting. >> if they dropped leaflets they could drop down anything really. think about it. it's a scary thing to think someone can just fly something over during the game and nobody

can really stop it. >> reporter: police say the drone pilot faces several charges, violating faa regulations to local ordinance that is prohibit drones near stadiums. lilian kim, abc 7 news. we are now hearing from the father of the man who was attacked by a great white shark off pebble beach. he says the shark took two or three bites of his son before they were able to get him out of the water and to safety. his son is expected to make a full recovery. authorities say the attack happened at still water cove friday afternoon as they were spear fishing when the shark bit his right leg. >> at that moment just a shock for me. just horrifying. i just tried to help him to stop the bleeding. >> his son described the shark as about 15 feet long. once onshore two off-duty

sheriff's deputies were on the scene to help out with the wounds. perfect surfing conditions in the sierra. the sheriff's office posted this video on its facebook page saying, wow, surf's up. check out the waves yesterday. the power and beauty of lake tahoe never ceases to amaze. >> that's incredible. >> yeah, they had a lot of wind yesterday but that is starting to pullback a little bit. in fact, the winter storm warnings are going to expire at about 10:00 this morning so if you're traveling up that way, if you can wait a couple more hours things will improve rapidly. you can see the ring around san jose in the south bay, at least 280 from stevens creek to alum rock. light showers there. heaviest shower right now moving right across the dumbarton bridge over to newark, union city this will head across 84 and into sunol. look for more puddles there. temperatures up to 16 degrees cooler than this time yesterday

rivera. they say they saw him pour gasoline around the perimeter of the home and set it on fire. police had to evacuate the entire neighborhood until the flames were out. officers say the boy got into a fight with his parents and decided to torch the house. investigators say he was seen running at way from the home but was later found and is now cooperating. a 15-year-old boy from florida is in jail as a person of interest in his own grandmother's murder. >> reporter: in this morning's "gma first look" 15-year-old sits in a detention center awaiting extradition back to jacksonville, florida, where he is a person of interest in his grandmother's murder. >> we need to talk to him about what may have taken place in the house. >> reporter: florida detectives are poring over his grandmother's house he was driving attempting to cross the canadian border. mott and the stolen car the center of a nationwide search

for three days after his father reported the teen and the grandmother missing. along with several weapons stolen from the home. one day after he went missing police finding a shallow grave in the yard of the neptune beach home. >> the processing of the home revealed evidence of foul play. potential criminal violence inside. >> reporter: we'll have the latest on the ongoing investigation coming up at 7:00 investigation coming up at 7:00 a.m. new details this morning, the associated press saying fbi didn't tell officials russia tried to hack their g mail accounts. the ap investigation found that the fbi knew for at least a year. the officials were being targeted by the hacking group known as fancy bear. the group has ties to the russian government. fbi officials declined to answer most questions from the ap about how it's responded to the spying

operation. and a battle over who will lead the consumer financial watchdog is heading to court. english was appointed and is suing president trump. the president has named his budget director nick mulvaney to the post. it argues under the draw the deputy director becomes acting director when the agency's top spot is vacant. massage envy, the popular spa chain with locations across the country including here in the bay area, has been accused of sexual assault. buzz feed reports 180 women filed lawsuits, police reports and other complaints against massage envy. one woman who used to work as a receptionist at an l.a. location describes what happened to her five years ago. >> he pulled the blanket back down to my ankles, pulled my underwear down to my knees and then massaged my butt with his hands. when this happened to me i thought it was an isolated

thing, one sick man. >> the company said, quote, each of these incidents is heartbreaking for us and for the franchisees that operate massage envy locations. with over 15 years and 125 millin massages, even one incident is too many. the next story is bittersweet. a teenager from tennessee has received the final gift from her dad who died five years ago and every year since then bailey has received a huge bouquet of flowers and a card from her dad, mike. before he died he made arrangements to have bailey receive those flowers every year until her 21st birthday which was this year. bailey says it all came as a complete surprise. >> i did not know that i was going to get this, and the day of my 17th birthday i got the biggest flowers. i had no idea who they were from. it had a card, it said from here

the world is talking. get ready for another royal wedding. prince harry and american actress meghan markle are engaged. kensington palace said the wedding will be in the spring. the couple got engaged earlier this month in london and they started dating in 2016. the queen and the duke of edinburgh are delighted for the couple and wish them every happiness. the duke and duchess of cambridge said, quote, we are very excited for harry and meghan. it has been wonderful getting to know meghan and to see how happy she and harry are together. the happy couple will make their first appearance since the announcement later on today when they give an interview to british television. it's a little formal.

they took the long thanksgiving weekend off. they last deliberated on wednesday. matt gonzalez says jose ines garcia zarate had no intention of hurting kate steinle in the summer of 2015 on pier 14 in san summer of 2015 on pier 14 in san francisco. the prosecution said jose ines garcia zarate had the gun with him and called the case presented by the defense as fiction. they say the defendant wanted to fire the gun at the people and aimed at the closest target, the steinles. garcia zarate has been charged with second-degree murder but the jury can consider first-degree murder or involuntary manslaughter. the judge says he will give a 30-minute notice to all people to let them know the verdict is about to be read. matt keller, abc 7 news. download our free abc 7 news app enabling push alerts. easy to find.

search abc 7 news in the app store. new this morning a dramatic sight for drivers on interstate 80 in vallejo last night. a car caught fire and abc 7 news viewer shared video of the car. it was destroyed. luckily no one got hurt. chp closed traffic for two hours while they cleared the scene. president trump and lawmakers back to work after the thanksgiving holiday. >> and the focus now is tax reform. but sexual harassment allegations are still also a main focus. the president did not answer questions whether he plans to campaign for roy moore. the alabama gop senate candidate accused of sexual misconduct with minors. >> it is pretty clear to me the best thing that roy moore could do for the country is to move on. the reality of it is the allegations are still very strong, incredible, and the denial has been weak.

>> president trump needs that crucial seat to pass the gop tax reform plan. he will meet with republican senators tomorrow about their version of the bill. a state assembly committee will hold its first meeting ever on the issue of sexual harassment in the california legislature. the committee will not address the specific incident recent accusations brought against other politicians are encouraging the assembly to get ahead of the issue. the committee is led by laura freedman, a first-time democrat from glendale. happening today students will return to tehema county school after a shooting there. yesterday community members and religious leaders blessed the campus. they prayed and asked for protection for students and staff. many haven't seen each other since the attack. >> we're praying for safety

peace. god would just continue to work and it's not going to be easy for some. >> staff have been credited with saving the lives when the shooter opened fire on the campus. police say neal killed five people before he went to the school. divers have identified the body of the truck driver who plunged into the oakland estuary. they say 68-year-old paul scherer was the only person in the vehicle. witnesses say the truck careened off the fruitvale bridge around 8:00 and sank quickly. the oakland fire department led the search with a dive team from san francisco. >> the vehicle was located under water, zero visibility in the estuary. everything is by touch down there. >> paramedics tried to revive

a man who knew the suspect explained what happened. >> he was telling me he was a little scared of what's going on. the baby was in no danger whatsoever. we all know that. i told the cops what he told me, if one of us, myself, my dad, or my brother go to the car he would give us the kid and he would come out. >> we are told the baby was taken to safety and appeared unhurt. it took nearly three weeks but this morning two fugitives who escaped from a palo alto jailhouse are in jail. bivins was taken into custody yesterday morning. his accomplice tramel mcclough was arrested at a walmart in stockton. bivins ended up at the fairmont inn in san leandro. marshals waited for him to come out of his room. >> i was parking my car and the police come in.

scared but, you know. bad guys, no good. >> bivins had been on the run since november 6. that's when he and mcclough escaped in palo alto. california is just weeks away from the legal use of recreational marijuana, and now san francisco officials are issuing a report on the problems new users could face. according to "the chronicle" the report says the biggest challenge will be warning users about the hazards of consumption, things like the possibility of overdosing or driving under the influence. most of what we know about pot comes from medicinal use not recreational. recreational pot becomes legal january 1st. uber and lyft drivers protested on one of the busiest travel days of the year. yesterday they picketed outside of l.a.x. drivers say they often wait in traffic to pick up passengers from the airport and then end up only going a few miles. they say it's just not worth it. uber tells our sister station in

let's focus on the seven-day forecast. tuesday, wednesday, thursday, and friday high clouds and sunshine. light storm on our impact scale for the weekend. hi, frances. hi, mike. we've been talking about the sig alert. sky 7 is live at the scene right now. this is the hot spot in hayward. eastbound 92 just before hesperion off the san mateo bridge there was an earlier big rig accident and the fuel leak so they had to pick up some absorbent and look at the traffic right now. only the right lane is open. so eastbound 92 as you come off the san mateo bridge traffic is heavy approaching the scene. this accident happened just a little bit before 3:00 this morning so it's been out there for three hours. and this is the hot spot. notice westbound traffic on the right-hand side for most commuters. that is moving well as you make your way to the san mateo bridge. so just keep this in mind for this morning's commute, eastbound 92 approaching hesperion the hot spot this morning. that's the spot to avoid.
