out of flax. or simply adjust your thermostat. do your thing, with energy upgrade california. live where you live, this is abc 7 news. >> gun in the courtroom. in just the last hour, the key piece of evidence in the kate steinle murder trial was walked back into the courtroom as the jury questioned the judge about the murder weapon. thanks for joining us today, i'm reggie aqi. kristen sze is going to. be in later today. this is day six of deliberations in the steinle trial. as we await a verdict, every new development is under scrutiny. abc 7 news reporter amy hollyfield live for us at san francisco's hall of justice. a amy? >> reporter: hi, reggie, the jury wanted to see thereat gun. they had questions about it. the gun was brought back in so the jury could take a look at it and ask questions.

at issue, is whether that gun went off accidentally, which is what the defense has said. we told our legal analysts about this new development, and he said it is slykely th ly likelyo get a look at the trigger, how much pressure it took to make that gun go off, to pull that trigger. prosecutors believe it was intentionally fired. that the prosecution did fire it on purpose. jose ines garcia zarate says he picked up the gun, he found it on the ground and it just fired. prosecutors do believe he aimed and deliberately fired it. the bullet hit kate steinle in the back and killed her. this happened on pier 14 two years ago. she was there with her father. we saw the defense team walk into the courtroom, it was about 10:00. i asked them if they had any comment, if they could tell us anything about their client during these deliberations process. they just said no comment. the jury is not scheduled to deliberate tomorrow. so if there's no verdict t

groped her in 2013 and cupped her breasting during a photo op. the second woman to allege the behavior happened while franken was a comedian on a uso tour. franken has apologized for some of these claims but said he will not step down. hip-hop mogul russell simmons has resigned from his companies following a second allegation of sexual misconduct. simmons' decide comes after screenwriter jenny lumet accused him of having sex with her in 1991 despite repeated demands he stop. in a statement, simmons says his memory of the night is very different but apologizes for being thoughtless and insensiti insensitive. matt lauer is issuing a statement apologizing for the sexual misconduct allegations against him. that statement comes the day after nbc fired the longtime host following complaints of inappropriate behavior by a co-worker. abc 7 news reporter has that story. >> reporter: former nbc

powerhouse matt lauer glaringly absent from nbc's iconic tree lighting last night. >> welcome, everybody, to christmas in rockefeller center. >> reporter: just over 24 hours ago the longtime "today" show host was fired after a female colleague accused him of sexual misconduct. this morning his former co-anchor savannah guthrie reads his statement live on air. >> "some after what is being said about me is untrue or mischaract mischaracterized, there's enough truth in the stories to make me feel embarrassed and ashamed. repairing the damage will take a lot of time, and soul searching, and i'm committed to beginning that effort. it is now my full-time job. ". >> reporter: late wednesday two more nbc employees came forward one telling "the new york times" lauer summoned her to his office in 2001 during a work day, locked the door and sexually assaulted her. >> these women were scared because matt lauer had so much power, what we're hearing about

dldidld i downloading the abc 7 news app. a possible shakeup to president trump's national security team. the white house is discussing a plan to replace secretary of state rex tillerson with mike pompeo according to two administration officials. the timing of a change is unclear. we also don't know if pompeo has been approached about the cabinet reshuffle. pompeo is reportedly open to taking the job. the former exxonmobil ceo felt secure in his position. a south bay school district is so strapped for cash it's now considering closing multiple schools. as you can imagine, that has left parents fighting for their children's campuses. abc news reporter matt keller live for us in san jose. matt? >> reporter: reggie, this is a very tough decision for the oak grove school district here in san jose, as many parents, students and teachers are wondering if their school will close next year. you can't close schools without shedding some tears.

>> i'm devastated. this is our home. our teachers are like family. >> for all the years i've been in this school -- >> reporter: you don't want to leave it. >> no. >> reporter: frost elementary and the school choice program, indigo, share campus in the oak grove school district in san jose. they're one of eight elementary school campuses considered for closure along with baldwin, glider, oak ridge and santa teresa, and anderson, del roble and miner in h the west region. the district says a big drop in enrollment in the past several years in santa clara county is expected to continue forcing them to make the most difficult decision. a consolidation committee made up of staff, parents and community members recommend three to five campuses for closure or the next school year. >> all these schools are wonderful. it's a really tough process. we know it's kind of something we're at this point and have to do it so we're all just kind of trying to look at it with an open mind and as fairly and positively as we can.

privileges. today's morning money report, americanairlines now looking for a new director of crew scheduling after a big mixup that left millions of passengers in limbo over the holiday season. so here's a job posting that scheduling crew director has to have six years of experience, the carrier is dealing with what's being called the glitch that stole christmas. americanairlines says an error in its scheduling system gave too many pilots time off. the airline released a statement this morning saying, "out of the 200,000 flights american will operate in december, only a few hundred are currently unassign ed to pilots. we have not canceled any scheduled flights and will work to ensure both our pilots and customers are cared for." parking in san francisco is no easy task. soon it can cost you even more. parking meter prices may go up to as much as $18 an our. it's part of a proposed change to a san francisco municipal transportation agency program that adjusts meter rates based
